Jon, this obviously is high stakes because the democrats have told us some of the things they want to do like eliminate the filibuster, like add two states, you know, puerto rico and dc getting two more liberal senators, pack the Supreme Court adding 3 more liberal Supreme Court justices, not thats not even to mention the policy like higher taxes and the Green New Deal, et cetera. So theres a lot riding on the senate races obviously. Jon there absolutely is and i would point to that tax question which we talked about earlier. Joe biden has said he wants to raise the Corporate Tax rate to 28 , its now at 21 . Youve got to think if that tax rate is going up 7 Percentage Points that the market isnt going to take that very well. The market is booming right now, so it looks like the market is discounting that thats not going to happen either because republicans keep the senate or because or the market is counting on somehow, you know, the senate blocking the tax increase. I think thats the one piece of this that really matters to the market right now and so far it seems to be digesting it okay. I think theyll look for things to cooperate with china and change the harshness with the relationship. Georgia secretary of state announcing an investigation into more than 250 claims of voter irregularities while opening a probe into four Third Party Groups seeking to influence the vote. The Third Party Groups have a responsibility to not encourage illegal voting. If they do so, they will be held responsible. Joining me now is publisher dennis gartman, ryan payne and Constellation Research founder, ray wang. Great to see everybody. Dennis, what do you make of the rally, pointing to a triple digit move, dow industrials up 320 points right now after wall street wrapped up a very strong month for november, all the major indices up 11 in the month of november, snapping a two month losing streak. Weve got vaccine optimism contributeing to a lost of these gains. When you look at the charts, is there reason to believe this is sustainable . I have my serious doubts. Two things bother me. One, the cnn agreed index last week reached 96, the highest its ever been was 98. When it gets above 70 and turns lower theres a period of time following that where stock prices get weaker. It closed yesterday at 88. It was bullish of stocks in september, october and first two or three weeks of november but with the cnn index at those levels im somewhat suspect. Secondly, it is bothersome that Insider Selling which reached a historic high three weeks ago and is still extended right now tells me that the market is i think somewhat vulnerable. Its still a bull market. The market six months from now, a year from now will be higher than it is right now. Could it be lower a month from now and two months from now, i suspect it shall. When the index gets above 90 and turns lower, caution i think is the order of the day. I suspect this will not be sustained for much longer. Maria longer term youre bullish but maybe we can get into the market at better levels if we see a correction before a further gain. Ryan, what do you make of that . The s p 500 soaring nearly 11 in the month of november. The major index said that tesla will be added to the s p 500 in one shot on december 21st. Not over two days, as had been floated. Ryan, your reaction . What happens to tesla once its part of the s p 500 club . Well, i said in my podcast recently, the s p 500 is getting stuffed like a pinata. You already have mega cap names that drive the whole index, almost 25 of the index. Now you have the Largest Company ever to be entered into the index at 538 billion. To put that in perspective, thats the size of berkshire hathaway. It adds to the overvaluation that you get in the s p 500. I think investors have to realize when youre buying the s p 500, it is 500 stocks but its only driven by a handful of stocks and with the economy recovering ma magnificently her, its smart to start to diversify your money around the globe, you mentioned the pmi numbers, in new york theyve been fantastic. Have you to be careful, concentrate your money there, not usually a good sign. Maria so you would be putting money in europe, is that what you just said . Oh, yeah. Absolutely. Europe, emerging markets, youve got to have a Global Portfolio here. Maria yeah. Ray, i want to ask you about big tech and the legal woes that could be on the horizon, federal and state antitrust authorities are preparing new lawsuits against facebook and apple, probing whether Technology Giants are abusing their power. We know the companies are more dominant than they ever been and we continue to see instances of censorship. What do you think this means for investors and are you expecting section 230 to go away which right now protects these companies from getting sued. Its a great point. These are monopolies. Facebook is in social. Google is in search. Theyre competing on digital advertising. Thats going to be the challenge, theyre competing, 137 billion for google, 70 billion for facebook. That section 230 piece is important. Theyve been protected from lawsuits, from section 230 for quite some time. Heres the challenge. I think whats really going to happen is congress is going to drag them in, do the hearings and not much is going to happen again because these are digital giants that have to compete against china and thats what theyre protecting them against. Maria why do you think theyre not going to do anything . Youve heard negative comments about this dominance on both sides of the aisle, ray. You dont think the Incoming Freshman class will want to mess with big tech . Theyre definitely going to bring them in but when you look at antitrust legislation its typically do the benefits outweigh the costs, do people have free access to the markets, is it fair to the markets, not necessarily free and are we sty stifling innovation and competition. Were competing against the chinese digital giants, and they have monetization models across the board, not just in ads but in commerce, not just in search or social media but in banking and so they let their digital giants proliferate and our digital giants can compete in their markets and because of that its a war on a. I. And data and the companies that have the most data and better a. I. Systems will win and thats going to be part of that challenge. Maria its a good argument. Well be watching that. The Trump Campaign is filing a lawsuit to the wisconsin Supreme Court today, alleging abuse around the process of absentee voting in the state which they say affected approximately 220,000 ballots. This comes after arizona and wisconsin did in fact certify the Election Results for joe biden on monday. This after my interview with President Trump on sunday morning futures, his first interview since election day. The president sounded off on the election and his ongoing legal battle. We have stories that are unbelievable. But were not allowed to put in our proof. They say you dont have standing. I said id like to file, to the lawyers, i would like to file one nice, big, beautiful lawsuit. Talking about this and many other things with tremendous proof. We have tremendous we have affidavits. We have hundreds and hundreds of affidavits, like the people that you saw the other day in pennsylvania. Willing to sign under penalty of perjury and these are respected people. These are people that are putting their lives at risk and they dont want to take the affidavits. Then they say we dont have proof. Maria joining me right now, to talk more about all of that is ohio congressman on the appropriations committee, tim ryan, congressman, always a pleasure to see you. Thank you so much for being here whavment do you make of all of this, congressman . Here we are in this incredibly extraordinary moment in time where a sitting president is contesting the Election Results. What do you say about that . Well, i think that the trump phenomenon, the Trump Campaign, his ability to put out a product, market a product, runs into a brick wall when you hit the legal system and thats really whats happening here. Theyre filing all kinds of complaints. Theyre filing lawsuits. But when you read what the judges are saying about these lawsuits, republican judges appointed by trump, theyre saying theres absolutely no merit here and you also have lawyers who have a responsibility and an obligation to tell the truth in court or they they risk their law license. They wont say theres fraud while theyre in court. Theyll say it publicly to the media, but once they get in the court and their licenses are at risk, they dont say it because its not the truth. And we just got to continue to let the president play this thing out but we all know how its going to end. Maria so i agree, we just have to see this through. I was told yesterday by the way that the Trump Legal Team has not had an opportunity yet to present evidence to a judge. They say thats happening this thursday. So were waiting. Were watching. Were going to watch this play out to see how the courts view this. Well know within the next two weeks. Agreed . Well probably know, what well know by december 14th. Thats when we have to get the Electoral College to certify. Yeah. For sure. I mean, we know now. I mean, this is happening. I mean, think about the vast conspiracy that would have to be at hand here in multiple states with democrats and republicans, all participating and nobody knows about it other than donald trump. I mean, this is a pretty farfetched story line hes trying to tell. Like i said, maria, once you get the court the rub of the law, the rub of the judges, the rub of lawyers having to abide by their own obligations and the oath that they took in order to be lawyers, if in pennsylvania or arizona, thats where the truth comes out and the truth has come out and we need to move on. We know the president s going to take longer to come to grips with this. Maria lets watch the process take place and well keep covering it. I want to move on to find out how you think your life changes with this new house of representatives in the new class, congressman and tell me about the priorities of you believe that congress will be taking up in 2021. Ill get to the covid cases in november, in terms of what were seeing. We just passed 4 million covid cases in november alone. First, talk to us about what you think will be priorities for the congress. Well, obviously covids going to be the first and foremost, how do we get our arms around this. Looks like its going to be a tough december, january, february. The vaccines are coming. Thats a good sign. Theres light at the end of the tunnel. I think weve got to get back onto the economy. I mean, weve got to help these small businesses, especially restaurants, entertainment businesses. Weve got to make sure they stay afloat through this dark winter so they can come out stronger in the spring and in the summertime when hopefully this thing will pass along. And weve got to figure out how you we rebuild the middle class. We cant keep going down this road that led to a donald trump, actually, coming into power because so many people dont think that the Economic Future belongs to them. And weve got to resuscitate manufacturing around electric vehicles, charging stations, batteries, the new energy economys going to be critical to rebuilding that middle class. And weve got to focus on that, maria, because when you look at the problems we have in this country, the social problems, the culture riffs, i believe the vast majority of those come down to the economic stagnation, the erosion of the middle class and whether youre a wealthy republican or a wealthy democrat or a fiscal conservative or social conservative, whatever you are on your politics, that economic issue has got to be front and center over the next couple years. Maria yeah. But congressman, the cities and states imposing new shutdowns and restrictions are not going to help, right . Restaurant workers finding themselves out of work again. Are we going to see more shutdowns . I know youre cosponsoring the restaurants act. Real quick. Well, weve got to help them. Weve got public help and economics. We could do both. Were a big, wealthy country. We have to make sure we protect the public and make sure the businesses survive. The wall street Journal Editorial Board out with a new oped this morning, return of the obama economists. It explores joe bidens Economic Policy advisors and staff who are veterans of the Obama Administration. Some Obama Administration holdover include janet yellen the head of the fed, se see ya ralph. I want to talk about the team, nancy, get your take on its impact. How do you see it . Thanks, marie y listen, i ma. I think the most damning part of the oped was the phrase that this is a group of people who see government as an engine for growth. Nancy lazar talked about business as the engine for growth. These absolutely right. The least talked about economic benefit of the Trump Administration in my view was the reduction in regulation what we will likely see is a return to obama level regulations which will stifle growth and will probably hurt the very group that tim ryan advocated that we help, and thats the middle class. Energys going to be hit hard with executive orders on day one in terms of increases in regulation. So i think this is were going to see a recovery that benefits risk assets and the wealthy over the middle class, just like we saw during the Obama Administration. Maria i think thats a really good analysis. And Jon Hilsenrath, its really two different governing styles. Its an approach of give the power to the people, try to create as much opportunity as possible so that people can decide how they allocate their money, what they want to do. On the other side, versus Big Government programs where the government will be making decisions for you, whether it be healthcare or anything else. What kind of impact do you see this new team having and in particular, seems to me that janet yellen is the easiest to get confirmed as treasury secretary. Would you agree with that . It seems so, although we had senator holly yesterday signaling his discontent with yellens views about international trade, so i think yellen will get confirmed pretty easily. I dont think republicans are going to roll over on any of mr. You know, i do want to say a couple of other things. One is im talking about this wall street journal editorial piece, im on the news side. That came from the opinion side. We try to keep the two sides separate. I dont want to represent myself as someone on the opinion side of the paper. Having said that, i do want to i think this issue of the differences between the biden im sorry, between the obama and the trump economies is kind of complicated. So if you look at Economic Growth, the Economic Growth rate, the economy grew at a 2. 25 annual rate during the obama expansion, during the years when the economy was expanding under obama. If you look at the expansion under trump, in other words, take away what happened after coronavirus, and only look at the expansion, it grew at a 2 andahalf percent annual rate. So it did grow faster under trump. What was behind that . Well, this is where it gets a little complicated. The deficit was actually being reduced during those obama expansion years, spending was being reined in because of agreements between obama and Republican Congress and during the trump years the deficit was being expanded. It was growing. We had a trillion dollar deficit and more spending and busted budget caps after 2017 trump. So its just i just dont think its a clean narrative. I think its a complicated narrative and it needs to be taken that way. Maria its interesting. And you make a really important point in terms of the deficit. You think well see the deficit get busted again . Yes. Absolutely. Theres no question about it. You know, i do think republican attitude is going to change. Theyre now getting more focused on cutting back spending. But i think a lot of democrats kind of came out of the obama years and came to the conclusion that they kind of lost the fight on spending and it slowed the growth rate and then they got knocked for a slowing growth rate and i think yellen and others are going to come in and say weve got to push for spending as long as this economy has a 7 , 6 unemployment rate. Maria yeah. And a lot of those policies will have to get passed a republican senate, if they win on january 5th. But joe biden can use executive action on a lot of the regulatory things that nancy you were talking about so well probably see many more regulations as you correctly note. No surprise that we saw a big decline in foot traffic because of this pandemic over the holidays, right . No, no surprise at all. I think everybody was expecting that. I think the magnitude of it was a little surprising. You know, inventories in stores looked like they were prepared for more. I dont think it was a surprise. Maria all right. So what happens now, bill . I mean, weve got vaccines on the market soon. We are expecting that a majority of the public could get vaccinated by the middle of next year. Do you think brick and mortar is in trouble over the long term . Our habits are changing, bill. I mean, during the pandemic people started getting groceries delivered. They had not done that before. They may very well continue doing it, right . Well, we are in the midst of a retail transition. They happen periodically. We went from main street to malls to big box. Now were transitioning to digital or some form of digital. Its been interesting to watch and be a part of. Clearly, the pandemic has accelerated that change. But i do think that theres a place and there will be a mace for physical retail, even the largest, highest projections of Digital Sales are in the low 20 . That means 75, 80 will stay brick and mortar. Its going to be more difficult to be brick and mortar. Its going to have to be digitally engaged or omni channel in order to be successful, youll have to have a unique position or selling proposition, you have to be special. Department stores are going to be challenged. I think certain categories are going to be challenged. I dont think this is demise of physical retail. I do think its maria you think the one stop shopping outlets, like a walmart, like a target, like a costco are going to be performing well but challenges still remain, you said the Department Stores. Why wouldnt a Department Store be seen as a one stop shopping . You say walmarts a one stop shopping and it will be fine. Well, i think the food piece of the one stop shopping is critical. We shop food with weekly or biweekly frequency that drives traffic to a retailer. Your point earlier was correct. There have been a lot more people having groceries delivered. Its still not a double digit percentage of sales. So most people still are getting their food in a physical store. And if you have a one stop shop with food and other things, i think you have a chance of being successful. So target, costco, walmart. Even amazon now with their engagement with whole foods has recognized they have to have a physical platform for food. Maria thats a good point. People want to make they want that comfort that its fresh, that they know theyre looking at it and they know that its fresh. Bill, look, youre the president of wss ventures. I want to get your expertise on how youre investing, because youre in the Venture Business now and you have this incredible background from walmart, youre able to identify where the growth stories are. Share for us, please, where are the growth stories in retail . Well, i think you have to spread your risk like any good investment portfolio and i think that you have to look for as i said earlier, unique selling propositions and in this particular environment with covid in the digital strength, you have to look for people who have physical presence but strong online sales as well. And above all right now, cash and cash preservation is important. I think whats going to happen is that weak retailers or retailers who were weak going into this are going to have a difficult time coming out of it but retailers who were strong will survive through the end of this and as you said the vaccine is coming shortly. So those retailers who survive will be in an environment with less competition because many retailers wont of survive and so if you pick your investments carefully and look for retailers with a unique selling proposition and enough cash to get through the other side, i think theyre Good Investments right now. Maria do you have one example for us . Well, i probably wouldnt want to give that out right now in that i think some areas in fashion that are particularly good, look for cash preservation. I think sporting goods, camping, hunting, fishing, you know, we can look at the publicly available information for all this. Maria okay. Thats good. I love those answers. You have countries like iraq and nigeria that are scraping the bottom of the barrel, theyre out of money. Countries like russia and saudi can withstand this a bit longer, the lower production levels but its a tough go.
