They released their judgement , which is their view on andys legal challenge , trying to clear legal challenge, trying to clear his name for the past 20 years. And they have today decided that on two further grounds, his conviction was unsafe, which meant in fact, that back in 2004, he did not have a fair trial and of course you raised another issue which relates to the board and lodgings is that thats part of the compensation regime. And your viewers might be aware that if someone has been wrongfully convicted , they been wrongfully convicted, they do have a right to make an application to the state for compensation for that wrongful conviction. But that doesnt conviction. But that doesnt mean to say that the government are duty bound to pay out. And under the previous regime, until recent announcements by alex chalk yesterday , they the chalk yesterday, they the government deducted border lodgings from that compensation payout. Well, what would the board and lodgings be . Because i regularly report on things like oh it costs us about 35 to 40 grand a year to house somebody at now his majestys pleasure. So whatever compensation he was going to get for what . Hopefully his life not being ruined but not far off 17 years were they looking at deducting a 40 grand a year from that for the time he spentin a year from that for the time he spent in prison . Spent in prison . Well, lets start with the amount of compensation that one can claim. So its capped at ten years and thats £1 million. So thats the most that under the current Compensation Scheme that a person is entitled to receive. Person is entitled to receive. And of that , previously under and of that, previously under the under the Compensation Scheme, the government were entitled to deduct board and lodgings. Now im not an expert in this area of law. Im a a criminal barrister and we work on getting people who are wrongfully convicted free at the court of appeal. But i understand that a sum that the government thought deemed fit would be would be deducted from a compensation claim. But we welcome the news yesterday that the government have now decided, following the coverage that andys case has received, that they will no longer , in future they will no longer, in future claims, deduct that amount from someones compensation. Someones compensation. Okay. All right. And to just clarify that, the update from today, i suppose, is that there were elements of his inner initial conviction. So not just the fact that obviously it wasnt him, but what was the process that was used in to , process that was used in to, order quote unquote, snare him in the first place . Was wrong . Was it is that right . Well, on the 26th of july, the court of appeal found that the court of appeal found that the dna evidence had been obtained by myself and my colleagues in an appeal prove that Andy Malkinson could not have been the perpetrator of this crime. But we also this crime. But we also presented to the court of appeal at that hearing further evidence which showed that the Greater Manchester police had, in fact withheld vital evidence, which could have helped andys legal team at the time defend him at trial and in the court of appeals view , if that material appeals view, if that material had been disclosed, the jurys verdicts may have been different. So this ruling today upheld upholds our view, which is that andy didnt receive a fair trial at the time and should never have been convicted in the first place. But i think these sort of places have a role. Its more not so much the location it is whether or where it fits into the entire process. There are really three things that need to happen here. One, we need to reduce the flow , ideally stop it. Secondly we need to be able to sort of we need to be able to sort of we need to be able to sort of we need to resource and properly organise the process of assessment and returns. And then thirdly , we need to be able to thirdly, we need to be able to accommodate the people who are being processed in an appropriate manner. Now this is probably going to start a bit of a discussion now with with our colleague whos joined us. But the United Nations Refugee Convention does allow for the secure detention of people who have claimed asylum, having entered or crossed a border unlawfully. Border unlawfully. And that gives some authority here to put people in in in camps that are built for the purpose. Now, the problem weve got at the moment is all of our accommodation is being dealt with ad hoc hotels, barges , with ad hoc hotels, barges, islands around the place. There islands around the place. There is no strategic , coherent plan is no strategic, coherent plan here which puts these these things in part of the process. And thats a problem. And thats a problem. All right, shoaib, ill let you come back to that. Now, shoaib khan is a human rights lawyer. Yeah yeah. Yeah. So, i mean, obviously , i so, i mean, obviously, i mean, you know, the people who actually rejected Ascension Island were priti patel and bofis island were priti patel and Boris Johnson. And like i always say and like people say, main is these say, the main thing is these people are our responsibility. So, instance, like, know so, for instance, like, you know , obviously we just last , obviously we had just last year , you know, the past 18 year, you know, in the past 18 months, hundreds of thousands of ukrainians , you know, around the ukrainians, you know, around the world who were settled and integrated societies. So integrated into societies. So would we be happy to send ukrainians to the Ascension Island . Then why not . Island . If not, then why not . What is the difference . And obviously, i can i can obviously, can i can i can i just hit asylum a little bit . Im just going to come back a little bit on that show. So because i would say that the difference is, is that there is actually a war on in ukraine. These people are genuine refugees invited refugees and we invited them in. And a of them happen to and also a lot of them happen to be women and children. So, i mean, are there there mean, there are there are there are quite of differences. Are quite a lot of differences. I henry, what ive said i mean, henry, what ive said there is that are our there is that they are our responsibility, these people. I would that it yeah, but i would say that it is absolutely for not lawyers to decide opinion in decide or have an opinion in terms of their profession and decide or have an opinion in termzrole their profession and decide or have an opinion in termzrole in ir profession and decide or have an opinion in termzrole in thisofession and decide or have an opinion in termzrole in this asssion and decide or have an opinion in termzrole in this as to on and decide or have an opinion in termzrole in this as to whether their role in this as to whether or this is workable. The job of the government is to make things to develop things workable, to develop policy, to laws and to policy, to pass laws and to implement them. Now thats thats an interesting point, though, because showing to be to be fair. All right, shoaib, i mean, to be fair , its all very well and be fair, its all very well and good, henry saying you know, its its your job to its not its not your job to decide somethings workable.
