An investigation is underway after a tragedy in san jose. A double drowning at a daycare here thats landed a third child in the hospital. Good evening. Im ahmad daetz. That incident took place shortly after nine this morning at the happy happy daycare located on fleetwood drive in san joses almaden valley. Abc seven News Reporter leslie brinkly has more from investigators, as well as some stunned neighbors. Two year old boy unconscious is breathing as uncertain when he was found drowning, attempting cpr instructions. Now the emergency call came in around 9 a. M. Fire and Police Personnel rushed to this home in the san jose suburb. Happy, happy daycare operates out of a home on fleetwood drive at clover hill drive. Three children were rushed to the hospital where two died. One survived and is said to be in a condition that is not life threatening. The pool is seen from sky seven, has a fence and a gate and a pool cover. The San Jose PoliceDepartment Homicide unit and the Santa Clara County das office are conducting a joint investigation into the circumstances around the drownings. Neighbors said the daycare operates from 8 a. M. To 5 p. M. And charges 2000 a month per child. This is a daycare with five children present. All five are accounted for just makes my heart and i feel bad for the families because we do. When i take her to school, we watch. We watch the families bring their kids and so we see their faces. Its a heartbreaking. An abc7 news is learning much more about the prior history of this Daycare Center and its past run ins with state inspectors. Today the Us Coast Guard suspended its search for a swimmer reportedly attacked by a shark and pulled under in the waters off Point Reyes National seashore. The National Park service is still searching. The swimmer disappeared off Wildcat Beach along Point Reyes National seashore. Abc seven News Reporter luz pena went to the area and has the latest. The search continues for a swimmer who went missing sunday morning after witnesses say he was attacked by a shark at Point Reyes National seashore. We have personnel at Wildcat Beach looking for any sign of the missing individual. We do actually have jet skis from Golden Gate NationalRecreation Area coming over, as well as jet skis from Stinson BeachFire Department. According to witnesses, the missing swimmer was with a group that was celebrating a wedding at the wildcat campsite at around 10 40 a. M. Sunday. The Us Coast Guard received an emergency report that Samantha Edell used her Satellite Phone to help the group call for help. They said it was a shark attack and said that i said, how how bad is it . He said that his friend was attacked and that didnt come out back out of the water and that and so i hit the sos on my satellite communicator and took the communicator down to the beach, which was right below us because we were on the edge of the bluff so that theyd be able to locate. The communicator to get to the area where the swimmer was last seen. Workers here confirmed he had to hike 6 to 7 miles to make it to that spot, an area that is uncommon to swim at the National Park service is categorizing this incident as an unconfirmed shark attack. But stated a strong population of white sharks in the area. Were hoping for the best possible outcome. Um, according to the California Department of fish and wildlife, there have been 210 shark attacks or incidents off the california coast since 1950. In point reyes, beekman says there havent been any fatalities in the last 20 years. Sometimes we get in our head and were like, oh, the water looks nice. Why not just jump in and cool off . Things can change. You never know whats out there. This morning, the Us Coast Guard ended their search by members of the National Park service are set to continue until at least tomorrow in marine county. Luis pena, abc seven news. Governor newsoms choice to finish the term of senator Dianne Feinstein will be sworn in to the us senate tomorrow. Laphonza butler is the governors choice to fill the seat. She will be sworn in by Vice PresidentKamala Harris. Abcs evan News Reporter stephanie sierra has local reaction and more on butlers ties to california senator designate lafont. A butler making history across the us and in california this week, the 44 year old mississippi native is a well known consultant and trusted adviser to Vice PresidentKamala Harris, who is set to be sworn in as the first lesbian person of color to serve in the us senate. Well she checks all the boxes, at least from Gavin Newsoms perspective. She wanted an africanamerican woman. Thats what he got. Shes also a lesbian. Shes also very active in democratic politics, big with union politics. And she lives just outside washington, d. C. So she doesnt have to move. Despite butler having never served in Public Office on the local, state or federal level, governor gavin newsom told us today, its like shes the only choice. She was outstanding. Shes shes the best choice. She understands how systems work. She is deep understanding of the legislative process, deep understanding of executive process. Shes next level qualified. Butler was previously the president of emilys list, the nations largest resource for women in politics, where she campaigned to elect democratic prochoice women across the country before that, she was a regent for the university of california. The director of Public Policy and campaigns at airbnb and the president of the california seiu council, where she spent a decade of her career. And god, does she do a lot of things in that decade . Did she inspire a lot of us . Carmen roberts, the organization executive Vice President , says butler has been an advocate for low wage workers and women of color, adding one of her victories was leading the statewide minimum wage up to 15 per hour. You know, most of us were making 7 to 8 an hour and so that gave us something. Now were on our way to 20 an hour, and none of that would have happened without the tenacity and the work of laphonza butler. Newsom says he first met butler years ago and has since been impressed by her commitment to fighting for everything from civil rights to lgbtq, plus rights. Plus, shes young in some ways. Cant even make all of this up. If i had to literally design from the mind of imagination, put pen to paper, someone i would like, including time of life. Shes just 44 years old and shes going to be such an example for little black girls like my granddaughter who sees someone that looks like her in that position and knows that, you know, stephanie, anything is possible. This choice allowed newsom to follow through on two prior commitments appointing a woman of color at and didnt want to appoint someone who was in the race. I was clear about that. And concern that were so close to the election, just a matter of months. More than 75,000 Health Care Workers are threatening to strike wednesday morning in what could be the Largest Health care strike in us history. A coalition of kaiser permanente, unions is in a labor dispute with the health care provider. The unions representing nursing assistants, pharmacists and lab technicians, but not doctors and nurses. Theyre doing a three day walkout and is planned starting wednesday. If a new contract deal isnt reached. Kaiser permanente says bargaining is ongoing and its optimistic it can avoid a strike. In a statement, kaiser says, quote, this past week we reached tentative agreements in four key areas travel for continuing education, the use of temporary workers such as traveling nurses , tracking staffing vacancies and dispute resolution. Its a great opportunity for us to show them what were all about, bringing in upwards of 1000 Uniformed Service members like Melanie Ricardo from the navy stationed in san diego after serving for 12 years. This is her first San Francisco fleet week. Im absolutely so excited for the food. I hear that you guys have amazing seafood and clam chowder, so im just so excited to get out there and put on my uniform and eat some amazing food. But before the parade of ships air show live music and more, its business. First at the San Francisco department of Emergency Management is holding their annual Emergency Preparedness drill. A lot of people think fleet week is just the air show and ships, but this is a week where its just an Incredible Opportunity for First Responder guys to meet each other and to Work Together and to really learn from how were going to help one another after a big emergency. Tsay captain doug langenberg, Commanding Officer of the uss john murtha, says this exercise involves support across local, state and federal partners. All to test different methods of communication in the event of a major disaster. Were going to use the marine corps, the navy, coast guard, as well as your local Police Department and Fire Department are going to all Work Together in this exercise in case of a disaster response. We would be there ready to engage in, provide our support. The different agencies are testing communication on radios , Satellite Phones and whats called voice over ip phones. We like to have redundancy in all of our communications. As we know, after a major catastrophic earthquake in San Francisco, some of our cell towers might go down. And we need to be able to communicate with other forms of communication. So thats why were testing our radios. So lets take a look as to what you can expect later on this week when the blue angels take to the skies friday. Warm and sunny, mid 80s in the morning. Its going to be in the 50 was great visibility on saturday. Plenty of sun, 79 degrees here in San Francisco. And for sundays air show, it will be cooler and there will be some fog, but hopefully they can maneuver around it. So heres whats going to bring us the warm weather. High pressure is starting to take control of our weather. That area of low pressure brought us the showers over the weekend. On saturday, as you know, mammoth reported snow. So pretty exciting stuff as we look at live doppler seven, though, you will notice some high clouds up above, some fog down below near the coast and around the bay. Now winds have been onshore so far, gusting to about 23 at sfo sustained 25 miles an hour in San Francisco. So lighter breeze inland at 18 miles an hour in fairfield, exploratorium cameras showing you a little bit of that fog over San Francisco as we look toward Salesforce Tower its comfortable mid 50s. Oakland, 58 degrees. Youre in the 60s from Mountain View to san jose, currently 59 in palo alto and 54 in half moon bay. As we look from our Oakland Airport camera visibility is okay from this Vantage Point mid 50s novato santa rosa, 61 right now in napa. Some of our milder spots in the upper 60s from fairfield to concord. Livermore, youre at 63 degrees. And from our Golden Gate Bridge camera, we are seeing a little bit of a murky view areas of fog overnight, sunny and warmer tomorrow. Warm to hot weather from wednesday through friday for the entire bay area and we are looking at heightened fire danger and the possibility of nearrecord temperatures. There are a couple of cities that will get close to records. Well see if they materialize tomorrow morning. Watch out. There will be fog not just near parts of the coastline, but around the bay shoreline as well as we head into the afternoon hours, we start to see some breaks in that fog layer and the sun starts to pop up. But we will still see some lingering fog near the coastline. And in the morning, you are going to be seeing the upper 40s to the low 60s in terms of temperatures, some of the cooler spots in the north bay santa rosa, 48 degrees, definitely one of those mornings where you will need that extra layer, just like this morning, tomorrow afternoon in the south bay, youre looking at temperatures in the low to upper 80s from san jose to gilroy, 83. In san jose, 80 degrees in sunnyvale on the peninsula. Its going to be a nice day. 78 in Mountain View. Warmer than today. 68 half moon bay. Downtown San Francisco, 73 degrees. A little bit of a breeze right near the coastline and in the north bay, youre looking at temperatures in the low to mid 80s from san rafael to santa rosa, 82 in vallejo, 80 in napa, heading into the east bay, 78 degrees in oakland, getting you up to 82 in castro valley, the sun shining. Its a warm day. I mean, you couldnt ask for better october weather, 86in concord, 88 degrees in fairfield, 87 in brentwood. Now on wednesday, were going to turn up the heat. Temperatures going up into the 90s as thursday, mid 90s. You will notice along the coastline, its pretty warm as well. On friday, we hold on to that hot weather. But one thing that we are concerned about is gusty offshore winds developing small window where we see that happen between late tuesday night and wednesday. You will notice the wind directions out of the northeast, calistoga, middletown, 25 to 27 miles an hour. Its a very drying wind. So that is whats bringing us the concern about fire danger. Abc seven News Reporter leanne melendez has more on that. It takes more than just police and its supporting cast to make a dent in San Franciscos drug trade. The role played by judges inside the superior court is now coming under scrutiny by city hall and the district attorney. Even though weve been advocating for repeat offenders to stay in, theyre still being released. Violent and repeat offenders. Da Brooke Jenkins took Office Nearly 15 months ago and only last week was her office for the first time, im able to convict a drug dealer who claimed that he was a victim of Human Trafficking and forced to sell drugs for fear of his safety as well as others. And the jury was not persuaded by his story. And did find him guilty. 20 year old Eduardo Rosales silva had been arrested in may 2022 for possession to sell cocaine, fentanyl and meth, but was released by a judge. Less than a month later. He was arrested a second time for selling drugs and again was released by the court. He was finally kept in jail after the fourth arrest. He will be sentenced on october 6th. According to jenkins, so far this year, there were 511 individuals with open bench warrants who failed to appear in court after they were released by the judge. We wanted to get some context and asked if this kind of leniency is followed in other bay area counties. I mean, if somebody has no record whatsoever and theyve got a stable address in the like most of the time, they may not be kept in custody, but if theres a second time, not 3 or 4. A second time, theyre going to occupy the San Mateo County jail. But before San Franciscos da was able to convict rosales, silva, three similar drug dealing cases resulted in a hung jury. It may not come as a surprise that San Francisco jurors tend to be more liberal and sympathy stick. In a recent newspaper, editors article, someone who served on a jury explained why they decided to vote to acquit a drug dealer from honduras. Quote, i believe the evidence showedhat the accused, who ill call esteban to protect his identity was coerced into selling drugs against his will. I hope that he will now have the opportunity to rebuild his life and separate himself from the coercion and violence that have gotten him here. A few months ago, i went to the tenderloin to ask those who werent using drugs in spanish if it was true that some drug dealers were being coerced and threatened and they chose not to answer. Last may, a survey of 500 potential San Francisco voters conducted by emc Research Found that 70 of them said sanctuary city policies should not be extend to those undocumented people selling drugs. Supervisor Hillary Ronen i think that this is a distraction. I dont think that low level drug dealers from central, its from from honduras are the real cause of this drug crisis. Instead, ronen blamed the makers of oxycontin for the current Opioid Crisis in San Francisco. But shouldnt we do something about it now, though . Shouldnt we do something about that now . 100 . And that combined with poverty is what led to the crisis in the streets today. Not immigrants. Still, even the former speaker of the house had to concede that one way out of this crisis was to bring in the Drug Enforcement administration. The dea. Nancy pelosi writing to attorney general merrick garland. Eople are dying from fentanyl and violence. We hope to hear soon about a designation of operation overdrive for San Francisco to combat the cartels. Weve got critics who are handwringers and navel gazers and defenders of the status quo without even having the courage to admit that theyre defending the status quo. We need to try new approaches. So we turn to sacramento to see if the state is taking harsher action and found that lawmakers there are still taking a lukewarm approach to the fentanyl crisis. For example, three bills introduced in the California Legislature did not advance. Ab 367 to add sentencing enhancement for those who serious injure or kill through fentanyl poisoning. Rejected ab 955 to increase penalties for dealers who sell fentanyl over social media rejected ab 1058 to increase penalties for those possessing a large amount of fentanyl. Also rejected. Prosecutors worry what will happen if courts arent given the tools to convict drug dealers. In the 1980s and 90s the crack cocaine epidemic led to harsh sentences mainly against african americans. But in 2014, when california voters passed proposition 47, making simple drug possession for first time users a misdemeanor rather than a felony, that eliminated jail sentences and made offenders eligible for Drug Diversion programs. They have adopted an approach that no to do that will shove us back into the 1990s. That is their attitude, that attitude to me is a sorely mistaken attitude that is costing human lives. But theres a difference here. According to the cdc, more than 150 people die every day in this country from overdoses related to fentanyl with crack cocaine in the 80s and 90s. The causes of death among those who used or sold it were homicides and aids. In the newsroom, leanne melendez, abc seven news, the care act begins today in california. Its a program meant to get more people with Severe Mental Health disorders into treatment , even if the person doesnt want the assistance. Ace San Francisco will be one of the first seven counties in california to implement the new program. Its the only bay area county taking part at this time. The idea is to have the court step in for people with untreated Mental Illness to try to get them stable housing and other services. Thousands of people on the citys streets may qualify, but people dont have to be unhoused to qualify. Its been a Controversial Program because judges have the last say in ordering a treatment plan and bail was denied. Again today for the man accused of killing tech executive bob lee. A judge heard arguments from nima. Mommys new defense team, but ultimately denied bail. Momeni is accused of stabbing the cash app founder in april in San Francisco. Bail for momeni was previously denied when he had a different attorney. Today, prosecutors said nothing had changed since then other than them getting access to mommys cell phone, which showed Text Messages from his own family, calling him a, quote, lunatic and psychotic. Balwanis attorney reacted to the judges decision. Im disappointed in the courts ruling. I think that there are conditions that the court could have set. I dont think that this is a guaranteed no bond situation. And we believe that we made the right arguments. But we you know, we respect the judges decision because thats what we have to do. He says his client is ready for the trial to begin and get his day in court. Its not really going to go far because it is so shallow and its going to continue to get compressed as High Pressure builds. So it will become almost nonexistent as we head towards the middle of the workweek. Areas of fog overnight. Sunny and warmer tomorrow. Warm to hot weather wednesday through friday. And we are looking at heightened fire danger. And near record temperatures ahead. So lets look at the temperature trend for livermore. The average high is 82 degrees for your tuesday. Were going to be up into the 86 degree range. Those temperatures are just going to continue to climb into the mid 90s as we head towards the end of the workweek. And into the weekend. And then the temperatures will really drop off sunday and columbus day. Lets take a look at live doppler seven right now. We do have some higher clouds passing through and some patchy fog right along the coastline. That fog is around the bay as well. And as we look at the Bigger Picture here, do you remember those showers that came through . Thats the system that brought us the showers on saturday, brought snow to mammoth. High pressure is now taking control of the weather. And as it gets closer and closer to us, were going to see the offshore winds picking up. And were going to notice that the temperatures really rise and youre going to feel it by the time the end of the workweek arrives and as we head towards the fleet week forecast, you can see warm and sunny on friday in the mid 80s getting up to about 79 on saturday. So the heat backs off just a little bit in the city. Great visibility for the air show, though, by sunday. We are talking about some fog and cooler weather as we look at the fog from our mount tam cam. Look at how gorgeous that is right now and look at the temperatures mid to upper 50s from San Francisco to oakland, 63 in Mountain View, san jose, youre at a comfortable 65 degrees. Heres a live view from our emeryville camera and really visibility looks okay. This is 80 here and heres a look at your temperatures. Novato 54, santa rosa, 55. Youre in the 60s from napa to upper 60s. Fairfield concord, 63 and livermore and a live view from santa cruz camera right now all is calm air quality is going to be good to moderate tomorrow. Notice as the heat builds, more areas go into the moderate category on wednesday and thursday and friday, all areas will be in the moderate category as High Pressure puts a lid on the atmosphere and doesnt allow the atmosphere to mix out. So were going to see the air quality starting to decline, but still safe to be outside as of right now. So tomorrow morning, some fog around the coast in the bay tomorrow afternoon, an we start to see some of that fog pulling away. But there will be some that will linger along the coast. So its not going to be a hot day tomorrow, thats for sure. Temperatures in the 40s and 50s for most of you, 60 in antioch tomorrow morning. I would grab that extra layer tomorrow afternoon. I think its going to be nice enough that you can get away with short sleeve weather in the inland areas in the mid 80s to upper 80s. Fairfield, 88 degrees, 83 in san jose, 78. In oakland, 73. In the city 68. Half moon bay 83. San rafael up to 85 degrees in santa rosa. There will be plenty of sun for your tuesday, but we are watching is offshore winds developing late tuesday night going into wednesday. Notice the direction out of the northeast. Its a very drying wind down sloping wind, 25 to 27 miles an hour. That is what is concerning as it will be a couple of days past when you got some wet weather over the weekend. So fuels get dried out and the fire danger, as you will notice, starts to increase as we go into midnight wednesday. It goes into the high category for parts of the north bay.
