President said we were put in this position of power and importance to make decisions for the people who so proudly elected us the most important of which has been a long considered to be the selection of. A United StatesSupreme Court justice. Meanwhile early this month President Trump released a list of potential nominees before heading to a rally tonight in North Carolina reporters pressed President Trump on whether a woman could be a front runner in his nomination to replace ginsburgs seat. I could see most likely it would be a woman yeah i think i could say that it would be a woman i if somebody would ask me now. I would say that a woman would be. In first place at the joyce of a woman i would say would certainly be. Appropriate. The president reiterating that statement during that rally tonight in North Carolina. Meanwhile, despite that move despite has announced that the president still has some folks who says he should slow down one of those republican senator Susan Collins of maine says the decision should be made by whoever is elected on december 3rd. Heres what she had to say in fairness to the American People who will either reelect the president or select a new one. The decision on a lifetime appointment to the Supreme Court should be made by the president who is elected on november, 3rd. Senate Majority Leader Mitch Mcconnell has already vowed to call a vote for trumps upcoming nominee, democrats countered that republicans should follow the precedent the Gop Legislature set in 2016 by refusing to consider a Supreme Court choice in the runup to an election. It was also justices ginsburg dying wish for her replacement, not to be named until after the election and democratic president ial nominee, joe biden expressed his concerns last night. On how the vacancy should be handled. Let me be clear. The voters should take the president. The president should take to justice. For the senate to consider. This was the position Republican Senate took in 2016. When they were almost 10 months to go before the election. Thats the position United States senate must take today. 45 days we are way until the november election and it is worth noting that bidens pick for Vice President that senator Kamala Harris now sits on the house judicial on the Senate Judiciary committee i should say which handles those confirmations and will be part of those hearings for that next person selected for that seat, so were joined live right now by bradley june death whos a professor of law at santa clara university. Hes also the former Supreme Court clerk for Justice Sandra day oconnor. Bradley one of the things that we just talked about a second ago that will you know obviously plane will loom large in this is those confirmation hearings, whoever is decided. Senator Kamala Harris also a Vice President ial pick is also on the Senate Judiciary committee how would you see that playing out. Explosive i think this high stakes political it doesnt get bigger than this in terms whats at stake. The Supreme Court with the potential a republican majority to take a 6, 3 majority of the court and released wing constitutional on a number of important areas. In a conservative direction and so what happens is really really important on a substantive level and then you put on top of that is happening in the middle of of a president ial race where the Vice President ial nominee is a member of the committee and its going to be rather explosive. So Susan Collins said that her fellow republican should not hold a vote on a replacement. Before the election. Assuming though that President Trump gets reelected or excuse me does not get reelected. And in november. What happens then in those weeks up until inauguration can hes still in the senate. Still put forth a nominee to the Supreme Court. Yeah theres nothing legally that would preclude that i think the barrier to that would be political in that i think the Republican Party would probably face a pretty significant backlash if theyve been turned away at the polls such that the the American People believe that the democrats should be the ones who select the next nominee if they go forward and do so anyway. I think the repercussions will be felt for the party for the Republican Party for many years to come. Well who are some of the obviously the president saying that a woman would be at the top of his choice, he released the list of 20 names earlier this month. If that is a woman that is selected and once again he reiterated during his rally tonight are there any names that are sticking out at this point. That would be a of pick or good. Successor justice comes ginsburgs seat. Well i you know i dont feel comfortable evaluating the quality of the candidates, but i those people who watched the court and watched this process carefully. I think theyre think theres about a 90 chance that it will be judge amy coney she had made it to the very end of the process the last time. She checks a lot of boxes in terms of what i think that the president and. The majority of the conservative majority in the senate and then the people within the Republican Party the Republican Base really care about in terms of nominees. Shes on the record i think is being pretty clearly willing to vote to overturn roe versus wade and planned parenthood versus casey right. For women to terminate her pregnancy so i think there are a lot of reasons politically and in terms of of whats happened in the past in this process that she is very very likely to be the nominee. So theres obviously a lot of talk immediately about who will eventually replace Justice Ginsburg but can we talk a little bit about her and her legacy and what has been lost by her. Her death. Was sure she leaves an enormous shes one i mean shes one of the most significant americans of our lifetime let alone one of the most significant lawyers in the history of the country. And she her significance is its like it to some like Thurgood Marshall in that she had an amazing career of significance before she ever became a as a civil rights lawyer. She was really a pioneer in bringing impact to knock down barriers, discrimination and gender in the late 1960s and early 1970s and then after after being appointed to the bench first in the court of appeals and then at the Supreme Court in 1993 she had an amazing amazingly important impactful career as a as a judge and is the justice did a lot to mold and shape the direction of constitutional law when she became a Supreme Court yeah shes its an enormous loss to our she you know impact is going to last for many many years in in our nations history, particularly within the law but beyond the scope of of the law or the constitution. And final question that i bradley is the republicans do control the center right now, but there is some talk that a couple of. Republican justine kind of talk Susan Collins of maine, but do you see any other potential republican defectors saying hey you know why we may need to slow this down and wait. Do potentially see that happening to wear for other republicans. Side with the democrats basically put this on hold until after november. I think thats quite you know i i think one of the votes that was potentially in play was lindsey graham, but apparently he came out today and said that hes in full support of going had i think Lamar Alexander in tennessee i think Lisa Murkowski in i think all of them are probably waiting to see where how the ground shifts on this and theres a significant ground swell of of people really being in opposition in middle of the country that is in opposition to them Going Forward and trying to push this through before the election and you could see some votes start to change quickly. If he doesnt win hes youre saying that things could still move forward he could still pick some. Nominee between november and january. Absolutely as a legal matter absolutely just like between now and november 3rd is a legal matter they can run someone as with so many things in our constitutional process. The constitution sort of sets a framework for whats permissible. But its austin politics and Political Forces that that actually determine what people do with in not framework and so i think the real constraints here of of this happening after the election after the incumbent president loses would be longterm political cost to the Republican Party if they tried to do that and were out of time producers going to come out and i still going on. But one of the democrats have in their back pocket to block a nominee. Nothing really nothing other than you know mobilizing public support particularly in those important states where there are senators who are facing election. That thats all they have are politics and political pressure to stop this from happening. Thank you so much this is professor bradley june whos that santa clara university, thank you for joining us here on kron 4 news at 8 oclock tonight. And lets talk now about our 4 zone forecast as we take a live look outside here at the city of San Francisco on this saturday night was a nice day people are obviously out as we saw from that video from fort mason the air though the smoke returned. Yeah, but hopefully wont be sticking around. Much longer. Meteorologist Mabrisa Rodriguez is here to talk about the spear the air alert in effect right now and how long it will last recent yeah thats right jonathan and just seen so were not tracking any marine layer today, instead hazy skies. In fact we are noticing an increase in poor air particles. Unhealthy for most of the north bay and our inland valleys of the east bay, good to moderate amounts around the bay area shoreline. So we do have a spare the air alert in effect right now through this evening and one thing that we are going to notice though moderate amount of air particles so the spare the air alert not going to be extended for the 2nd half of your weekend. So that is great news right there expect to see some improvement for air quality specially because of the return of those westerly breezes so winds out of the west going to push all of that smoke and ash away from the bay area out of the east bay for most cities and wind speeds also noticeably. Calmer around 15 Miles Per Hour less but along the San Francisco peninsula coastline could see gusts. Upwards of 20 Miles Per Hour less because of that strong sea breeze there and also tracking warmer temperatures were by sunday. Were actually going to be 48 degrees above average and very fitting as well just cnn jonathan because it is going to be our last weekend of summer 2020 until you return to more falllike temperatures by around tuesday back to you. Thank you bree son now close to 5 million acres have been burned up and down the west coast. Those fires contributing to the poor air quality here and also around the state in california alone nearly 3 and a half million acres have been charred from flames so far this year. Fire crews though getting some much needed help in their fire fight. Thats because the United States marines have now been called in to help support firefighters even as wildfires here in the bay area are nearly contained. Fire crews are still battling a number of blazes across the golden state. A fema center to help folks impacted by wildfires in Sonoma County will be open next week. But theyll be operating with some new hours starting monday the Intake Center will be open from 00 09am in the morning until 6 in the evening. The Center Located at the Sonoma County office of education located there on skyline boulevard. To talk getting some new life tonight still to come the Bay Area Company know getting the green light from and trump said he is giving his blessing to a proposed to talk between bay area based oracle and retail giant walmart. The president said the proposed deal will likely result in a new Company Based in texas. The move comes just hours before the Commerce Department plan to remove the chinese owned app from Us App Stores tomorrow. Meanwhile, here in the Bay Area Group is hoping that a federal judge here in San Francisco would block President Trumps executive order limiting the messaging app we chat during hearings today, the judge in the case expressed concern that the order was a burden on protected speech. We chat users here in the United States. A ruling is expected some time by the judge tonight, well let you know when a decision is made. And coming up here on kron 4 news at 8 and well hear from Supreme Court justice this and President Donald Trump said today that we could see his nominee for the vacant Supreme Court seat as soon as next week the president making those comments during a rally in fayetteville North Carolina tonight, Kayla Strayer with our sister station has more. With just 45 days until election day President Donald Trump telling a large crowd in fayetteville tonight that he will quickly nominate a replacement for the late Supreme Court justice ruth ginsburg. Josie yet, but we have numbers women on the list. I feel this incredible list of brilliant people. The crowd chanting fill that seat. The president then taking a poll of the crowd in fayetteville asking if they want him to nominate a man or a woman the crowd shouting louder for a woman disapprove. Democrats want the nomination delayed until after the election, the republican senator thom tillis now locked in a selection battle telling the crowd. The president has the responsibility and the authority to act now. As a member of the Judiciary Committee ive seen the last of hes going to nominate one of those just this is now going to vote for their confirmation. Speaking about covid19 President Trump saying trends are improving and that schools and businesses need to reopen he also says hes launching a new role america less than plan for students, teaching them that america is quote the most exceptional country and we will teach our children to love our country. Always respect our Great American flag. That was Kayla Strayer reporting for us tonight, democrats have already come out saying that ginsburgs seat should be replaced after the election now to a developing story from washington dc tonight today, federal Officials Say they intercepted and all the low containing the poison ri son. The letter was addressed to the white house and President Trump. Federal investigators now trying to figure out exactly where it came from. You may remember back in 2014 a judge sentenced a mississippi man to 25 years in prison after sending letters dusted with that same poison to president barack obama along with other officials today flags around the country were flown at halfstaff in honor of the late Justice Ruth Bader ginsburg. She served more than 27 years as a justice on the court. The Supreme Court of the United States now tonight a former clerk for the u. S. Supreme court is remembering her as a womans rights advocates. Gilliam metzger is currently a professor of law at Columbia University metzger says working for ginsburg was a remarkable experience. He was already an idol of mine from her work as a womens rights advocate she. And left a lasting i dont think im the only former clerk. Who is sort of carries her voice in my head. Im when im writing i will often have the experience of all right a sentence and a look at it and i think now the justice would let me get away with that one right for the justice. Metzger says despite ginsburg short statue, she wound over everyone with her energy force and determination. That she went to been surprised if ginsburg stayed on the court for ever. Tonight were actually hearing from some of the remaining 8 Supreme Court justices on the loss of rbg chief Justice John Roberts wrote this he said that our nation has lost a jurist of historic stature. We have the Supreme Court have lost a cherished colleague today we mourn, but with confidence that future generations will remember Ruth Bader Ginsburg as we knew her tireless and resolute champion of justice. Meanwhile Justice Clarence thomas wrote this saying quote the most difficult part of a long tenure is watching colleagues decline in passed away and the passing of my Dear Colleague ruth is profoundly difficult and so very said he wrote. I will dearly miss my friend. Justice Sonia Sotomayor called ginsburg an American Hero adding quote she welcomed me to the court with a warmth i could not have expected. And i came to feel a special kinship with her. She was someone whose wisdom kindness and unwavering support i could always rely on. I will forever cherish the moments we shared with ginsburgs death the court now split between 5 conservative justices in 3 liberal justices that is until a replacement is confirmed. Our 4 zone forecast is up next as we take a live look outside at San Francisco international airport. Its a lovely evening out there across all the bay area. Yeah, definitely a gorgeous day outside spoke returned a little bit but the good news was we still saw some blue skies but hopefully. All the smoke will be gone soon. Heres meteorologist Mabrisa Rodriguez, yeah were definitely heading in the right direction, some unhealthy air particles over parts of the bay area but tomorrow. Were going to notice better air quality and warmer temperatures as well in fact taking a live look outside marine le or nonexistent very shallow if any along the San Francisco peninsula coastline and temperatures once again warming up to above downtown San Francisco at 72 degrees mid 60s for pacifica in Half Moon Bay warming up into the low 70s and this is our last weekend of summer 2020 and were feeling that summer sizzle for your 2nd half of the weekend with millbrae and burlingame flirting with 80s and those of you in san mateo going to hit that low 80 degree mark. Mountain view in the mid 80s with widespread mid to upper 80s for the south bay, san jose 86 degrees as dismal petas winds out of the west helping to push all that smoke and ash and were not really going to notice any cloud cover so starting and ending the day with plenty of sunshine livermore toasty temperatures there in the low 90s with widespread low 80s throughout the east bay shoreline and walnut creek and concord warming up to 92 degrees nap a few degrees cooler than that at 88 santa rosa and avato in the low to mid 90s but then starting to cool down by early this upcoming week back to you just in and jonathan thank you so much. Back now to our 4 zone forecast as we take a live look outside in San Francisco along the embarcadero little hazy skies out there tonight unclear last recession cleared up for us if that is fog or smoke or the combination of both yes certainly the smoke and ash out there this evening just steam. Thats why we have the spare the air alert in effect in addition to that warmer temperatures today in bed for about 5 to 10 degrees warmer from yesterdays daytime highs, widespread 70s along the coast and east bay shoreline with 80s as you major way inland and heres that orange glow. Because of moderate to unhealthy air particles throughout the east bay with the poorest for those of you in the inland valleys temperatures for the most part still on that mild side widespread 70s right now for most of our inland areas even throughout the east bay shoreline starting to cool down in the 60s though for downtown San Francisco and oakland the Half Moon Bay cooler than that at 59 degrees so current wind speeds out there right now in the Single Digits or teens and were going to notice that change in wind direction from the that westerly flow certainly going to help improve our air quality for the 2nd half of the weekend. But as you can see marine layer nonexistent very shallow if any right along the San Francisco peninsula coastline. So were going to notice mostly sunny skies temperatures for your overnight lows in the upper 50s so right about where we should be for this time of daytime highs tomorrow about 48 degrees above average 70s along the San Francisco peninsula coastline with 80s throughout the east bay shoreline and widespread 90s as you make your way inland cooling down those starting early this upcoming week and very little change 7 days from now back to you. Thank you nearly a year ago the Bay Area Health community was jolted by the sudden death. Bernard tyson at the age of 60. Now the been rj tyson impact fund under the umbrella of the American Heart Association is giving out 1 Million Dollars for community let solutions aimed at the social factors that affect peoples health. One beneficiary is nams northeast medical services in San Francisco which helps low income asian immigrant communities in particular need now because of covid19 we adopted the approach of doing drivethru in la cruz sites april or march about more than 50 of the deaths related to covid were not asians. And there wasnt really much with that data to explain. Why that was has conducted more than 3,000 covid test through its drivethru sites but realize that hundreds more people were falling through the cracks not getting the message nor the medical care they needed about the coronavirus they were hindered by the very barriers to health care that the tyson fund is designed to fight language barriers concerns about immigration status. No transportation to get to test sites cultural concerns about going to medical facilities plus the risks associated with families and multi generational households nams decided a mobile ban was the solution and now money from the tyson fund will make that happen we plan to use a stand to outreach to areas of the city that have a high burden of covid19. And you currently dont have a lot of testing options available to them that ending the season with the help of videos in 5 different languages and staff the ban will travel to the people who need the help the testing will be open to all with special attention to immigrant communities in the bayview Hunters Point in time visitation valley and what tell in neighborhoods of San Francisco josh, we feel youre really lucky to be one of the recipients of the 9 tyson. 80 grant you know and hope to continue really his legacy she being held equity in our community. That was pam moore reporting for us tonight. Now the dems mobile van for covid testing is being retrofitted right now and it will be ready to be used in october so far the tyson fund has collected to some 2 Million Dollars from all across the country. So is force Ceo Marc Benioff was a major contributor. Kron 4 news this weekend is rashaana and we talked with one store owner in the east well happy new year to everyone this weekend is rashaana which marks the beginning of the jewish new year and sauls restaurant and deli in berkeley became really popular spot for people to pick up their traditional rashaana foods so people are standing in line. So they could get their orders and the owner Karen Adelman tells us that this year orders were up because a lot more people she says are waiting in line more this year. The last year.
