Republican attorney generals from several states argued that the healthcare law should be struck down. Act has been as a fight since president obama became president. The legality was challenged eight years ago and narrowly survived. When the aca became law a decade ago, it required people to have Health Insurance or face a fine. Three years ago, congress got rid of the fines. Now, the republican attorneys general in 18 states argue that without the fines, the law is no longer viable and should be thrown out. This is the issue of sevenerable in the courts where, you can cut out parts of the law and still have the rest of it stand. Looking at our severallibility precedent, it seems the proper remedy would be to sever the mandate provision and leave the rest of the act in place, the provisions regarding pre existing conditions and the rest. So the question to you, obviously, is how do you get around those precedents on severallibility, which seem on point here . Under the text of the law, the mandate is inseverable. This keeps pushing up the line between faithfully following what Congress Actually does rather than what it may have intended to do. Every justice asked that those lawyers extremely skeptical questions. The uc professor said that skepticism might be a sign how the justices might decide the case. The justices asked hard questions of the other side. I think when you look at the balance of the questions and you certainly look at places where people like cavanaugh and roberts kind of tip their hand of which way theyre going, its just extremely unlikely to imagine that were going to see five votes for the proposition that the entire affordable c. A. R. E. Act is going to fail. There is a lot at stake. 23million americans have Health Insurance, thanks to the affordable c. A. R. E. Act. There are about 130 million americans with preexisting conditions who are protected from losing that coverage because of the law. What is before the court today is an enormously consequential statute. It provides Health Insurance and other lifesaving benefits and protects to hundreds of millions of americans. Ktvu learned it was a love triangle that led to a murder suicide involving workers at a san mateo Residential Care home. The officers found one worker was shot to teeth and three people developmentally disabled live at the home and they were not hurt. Investigators chased after the suspected shooter who was reportedly angry the victim was in a relationship with his wife. We received a call of shots fired on pierce street. Eventually, we were able to determine there was a deceased person there. Police say the suspected shooter ran to his home, which is a mile away from the care facility. A Police Negotiator urged him to surrender. The incident lasted several hours until the wife came out of the home. Police say they went this and found the man shot and killed him. Police in san jose are investigating a deadly shooting. Not a lot of information coming out of Police Headquarters about this one. We know that officers say this happened at 2 30 in the morning on mckee road near capital avenue. The traffic in the area was blocked for several hours. At last check, no one has been arrested for the crime. Anyone with information is asked to call san jose police. And officers in san jose are investigating a deadly crash. This one happened around 4 00 this morning at the intersection of brokaw and zanker roads. One vehicle was travelling west when it was height by another car travelling south on zanger road after one of the cars ran a red light light. One person was ejected from the vehicle and another transported to a hospital. The number of homicides in oakland surpassed 100s for the year. At 5 00 last night, Police Responded to a shooting on natchez way, near 105th avenue. A man was pronounced there at the scene. A short time later, the Police Responded to a shooting near east 19th street and 23rd avenue. That victim was taken to the hospital where they were later pronounced dead. And this brings oaklands total to 101 homicides so far this year. And last year, oakland had 78 homicide investigations. Firefighters in oakland are investigating the cause of a building fire near 19th avenue and marine way. This started around 6 15 this morning. Force responded to flames and heavy smoke. They raised a second alarm. In the end, nobody was hurt. Oakland police were called to the scene after reports of gunshots in the area. Police officers searched for signs of a shooting victim but didnt discover evidence of a shooting. A south bay couple is in custody accused of how trafficking. Jessie gary tells us the case came to light after an inspector noticed something at the store. Reporter Santa Clara County prosecutors said this couple committed a heinous crime. All in the name of saving a few dollars. Theyre very savvy Business People who exploited their workers. Reporter at the arraignment in superior court, they both 66 years old, were charged with Human Trafficking and wage theft against at least four employees. The case against the couple began in february. Control officers conducted compliance expenses on his two gilroy liquor stores. They happened to come across a situation that they didnt feel looked right. They noticed it looked like someone was sleeping in the back of the store in unhealthy conditions. Reporter over several months, agents noticed one employee never left the store. He was locked inside during the overnight hours and slept on a mattress in the back. He washed him in a mop sink. Three additional employees were targets for abuse with a Common Threat of deportation used as a control in go ahead. In all of the cases, the employees were not paid appropriate wages. Donations starting to come in for those who need help for this upcoming thanksgiving. Reporter here at the San Francisco food bank, a donation of 1,000 turkeys came in monday in time for thanksgiving. Ed the need has never been greater in our community. Reporter the turkeys will go to programs providing thanksgiving meals to those in need. The food bank plans to distribute holiday meals to 50,000 house high holds. It will be a whole households. It will be a whole chicken, produce and grapes and holiday items to allow a family to have a real holiday meal. Reporter at the food hub in San Franciscos mission district, thousands of people come to receive their groceries. Many have been laid off. For programs like this, getting food to them is tough enough, but thanksgiving is coming and so another challenge. Roberto hernandez helps start the Mission Food Hub since the pandemic struck. Hes trying to raise money to provide 7,000 thanksgiving meals. And i am concerned that this thanksgiving, people wont be able to celebrate and have food and cook a turkey. Thanksgiving this year is going to be different than the last few years. Reporter this year, there will be a tent seta up where some people consider while maintaining social distancing. But, much of the dinners will be to go. Even though they cant eat together in the dining room, they can come here for a sense of community and belong. Tropical storm eta is flooding tropical storms in cuba today as communities across florida and Central America are cleaning up after the storm hit. Eta first landed in nicaragua as a category 4 hurricane last week and hit the honduras, triggering a deadly land slide in guatemala. Tens of thousands had to flee their homes. Late sunday night, eta made landfall in the florida keys as a tropical storm. The forecasters said eta could swing up from the gulf and target Central Florida flash, possibly turning into a hurricane. Another storm, theta, is brewing in the atlantic, the 29th named storm of the year, breaking a record set back in 2005. And much closer to home, something beautiful to share with you. The National Figure skating championships wered to be held in san jose in january. Local Health Officials had concerns about an indoor event with so many athletes, coaches and officials.
