There arent any obvious candidates who can appeal across this enormous divide that the republicans in the house are experiencing right now, which means that they cant do business. The floor is basically now closed for business and you recall we only have a little over 40 days for the Appropriations Bills to get passed that need to be passed to avert another crisis in terms of shutting down the federal government. Professor wolpert said he expects congress will likely come to the brink of another shutdown soon unless the Republican Party can find a way to bring their opposing factions together. All of the House Democrats did join eight republicans to vote in favor of mccarthys removal. Southern California Democratic congressman adam schiff saying in a statement under Kevin Mccarthys speakership, the house of representatives has lurched from crisis to crisis. Simply put, Kevin Mccarthy lacks the integrity, honesty and skill necessary to govern. He voted to overturn the election. He broke his word to the president on the budget deal. He brought us to the brink of a shutdown. We need a leader who has the ability to govern. He announced the decision not to run for speaker again, first in a private meeting with house republicans. As you remember, his path to the gavel was a bumpy road to begin with. If you recall, it took a historic 5018 ballots in january for him to earn the speakership. He made several promises to hard line republicans to get their vote, including reinstating a rule that would allow any Single Member to call a vote to oust him. Thats exactly what Florida Republican matt gaetz did. Heres what mccarthy told reporters about his defeat today. You need 218. Unfortunately 4 of our conference can join all the democrats and dictate who can be the republican speaker in this house. I i dont think that rule is good for the institution, but apparently im the only one in i believe i can continue to fight maybe in a different manner. I will notrillionun for speaker again. Ill have the conference pick somebody else. We are not at the end of this process. Okay . At most were approaching half time. Weve got to be able to assemble a governing coalition. Both republicans and democrats are Holding Party meetings to choose nominees for a new speaker. We understand republicans will hold an election for speaker next wednesday. Say a nominee needs the majority of the caucus. Minority leader Hakeem Jeffries told democrats not to help mccarthy, and its likely he will be the partys choice for another speaker vote. Right wing republicans have to solve the problems that right wing republicans create. Okay and so the civil war within the Republican Party has nothing to do with us. I voted 15 times for her. Yeah, and mike, there was some speculation leading to this vote that democrats might help him, but a number of them expressed frustration with the former speaker, especially over the stopgap spending bill, even seeing reporting that a tv interview with mccarthy was played where he blamed democrats for the potential shutdown. So certainly no love lost there. A lot of moving pieces and, you know, a very busy day as we see there on capitol hill. But not the only story, right . In addition to mccarthys removal, california officially. Well, we have a new senator. Yeah, mike Laphonza Butler making history today. Shes not only the sole black woman currently serving in the us senate, shes only the third black female us senator for ever. And historic moment on the floor of the us senate. I will congratulate us Vice President kamala harris, the first black woman to represent california in the upper chamber, swearing in the second black woman in the role. Laphonza butler. Its a great day for california. Its a great day for democrats. Its a great day for black women. I know that our old colleague is looking down at this moment with pride now that her seat is in good hands. As governor, newsom appointed butler to finish the term of the late senator Dianne Feinstein. Following through on a promise to pick a black woman. There are so many barriers that have existed to prevent lgbt folks and black folks and others from entering the most exclusive halls of power in the senate was one of those. After the moment on the floor, she took the oath on her personal bible held by her wife, nikki lee butler is the first openly lgbtq person to represent california in the senate and the first black lesbian to serve in congress. Thats just going to give her more of a platform to be able to get things done. Butlers never held Elective Office and faced immediate criticism for currently living in maryland. Her staff says shes since reregistered to vote in california. The question remains will she run for a full term next year . Her office said this week. Laphonza is focused on respecting and honoring senator feinsteins legacy and getting ready to serve the people of california in the senate. Her entry would complicate an already crowded field. We plan to partner with senator butler and we plan to continue backing barbara lee for senate. We think i think we can do both. No, i dont believe she should. Each one putting together a Viable Campaign and to be airdropped into this is simply not fair. And by the way, i dont think many people know her. When San Francisco firefighters first arrived at the crash scene at fifth and market last night, they found a woman pinned underneath the axle of a selfdriving crews car. There was no one else around. So initially it appeared as though the selfdriving car was the only vehicle involved in this unique situation. We had no driver passengers nor any witnesses on the sidewalk to tell us how long she had been beneath the vehicle. What i can say is that rescuers responded within 60s from the initial dispatch. But overnight, representatives from cruise, the company that operates the Autonomous Car, said they looked at that cars dash cam video, which gives a different view. The company says that video clearly shows another car involved in the collision. Cruise shared that video with ktvu. For our viewing purposes only, theyre not releasing it publicly. In it, we did see a dark colored sedan driving alongside the cruise car. Both cars appeared to have a green light as the woman tries to cross the street into oncoming traffic. In the video, we see the dark colored sedan hit the woman first. The impact throws her into the path of the selfdriving car and she becomes pinned underneath it. That dark colored sedan was gone by the time firefighters arrived. Were looking to identify the driver as well as locate the vehicle. In a statement this morning, San Francisco police acknowledged the second vehicle, but stopped short of calling this a hit and run, saying, quote, we believe another vehicle that was not an Autonomous Vehicle may have been initially involved in the collision, but the vehicle or driver were not present at the scene during our inveigstation, end quote. Authorities arent sharing any information this morning about the woman who was struck, but firefighters say she suffered multiple traumatic injuries in the collision. Crews says it will not make that video or any still pictures from it. Public the company says it will only share that dash cam video with investors gators and said, quote, our heartfelt concern and focus is the wellbeing of the person who was injured. And were actively working with police to help identify the responsible driver, end quote. San Francisco Police want the publics help with this investigation. Theyre asking anyone who may have Surveillance Video from their home or business in the area or anyone who witnessed the crash at market. And fifth, to come forward and help. And until they can, you know, come to the table at good faith and bargain with the rank and file members regarding this staffing crisis, we will not they it will not turn we will be striking tomorrow. Union negotiator Angela Glasper says the saber rattling weve seen in the past will become workers walking off their jobs wednesday. The lone issue separating Kaiser Permanente and its Union Workers staffing. Union members say patients usually wait 3 to 6 months for routine appointments , but the two sides had been at odds over pay Staffing Levels and retention of workers for several years. But covid 19 worsen the situation. Me myself had an appointment to get an exam that was i was being tested for something serious. S it took me six months to get that exam done. So you can imagine what the patients are going through. 75,000 Union Workers across the country are preparing to walk off their jobs for three days starting wednesday. Certainly the hospitals will attempt to hire replacement workers, as they often do during nurses strikes, but its unlikely theyll find enough people to cover such a large number of states and a large number of workers that are on strike. Kaiser officials declined to comment about the negotiations or possibility of a strike or settlement. In a statement from monday, they say a strike is not inevitable and it is certainly not justified. Our goal is to reach a fair and equitable agreement that strengthens Kaiser Permanente as the best place to work and ensures that the high quality care our members expect from us remains affordable and easy to access staff. Those words are cold comfort for workers such as Angela Glasper, whos been with kaiser for 35 years. But now shes conflicted by a paradox. In order to get her patients the quality care they need, she says, not showing up for work is the best option weve been complaining about staffing for years now. This is not something that just came about out. Its been years since we had proper staffing. New at five tonight, the family of an oakland banker shot and killed by his neighbor has been awarded 2. 4 million in a settlement following his death. Miles armstead was doing yard work when police say he was fatally shot by jamal thomas on may 1st, 2020. Thomas was a convicted felon on probation who suffered from Mental Illness and was squatting next door. Police reports show he had threatened the armstead family for months, his widow says. Oakland police and county probation officers should have done more to protect her family. I think the first time someone calls and its like, oh, its a neighbor argument, but if were calling for five months and windows are being broken and were scared, and now our house is boarded up in the middle of a pandemic as well, i think there should be some more urgency that comes to that situation to figure out whats going on. The city of oakland will pay the armstead family 450,000 and Alameda County will pay 1. 9 million. Armstead leaves behind his wife and five children. Jamal thomas is set to go on trial in november. A new poll shows a little more than half of bay area residents support paying for Public Transit agencies. The survey by Embold Research found 56 of those questioned say they believe Bart Caltrain and light rail like vta and muni are important for the bay area and must be maintained even if it costs taxpayers more money. When asked about other ways to fund transit, 22 supported raising fares. 18 would raise bridge tolls, 16 would raise gas taxes. But the majority, 56, say they would do none of the above. He joins us now in the newsroom. And brooks, you sat down with the president of the school board who says hes actually receiving Death Threats over this. Yeah, a handful of hateful attacks, he says, that threaten him and his family so much so hes even filed a restraining order against someone this is the first interview Ryan Jurgensen has given since that flag policy was voted on. He says a small number of people are inciting anger, more controversy and potential violence. I did not expect this amount of vitriol from people for weeks. Ryan jurgensen, the sunol glen unified School District president , says he and his family have repeatedly been threatened. I can take people disagreeing, but its beyond the pale to start harassing children in in an elementary school. It is uncalled for to harass my wife that wont stand. It follows a controversial School Board Decision that he stands behind to only fly the United States and california. Flags on campus. The us flag is the most inclusive flag that there is in the world. It stands for freedom. It stands for liberty. It stands for one nation. Together for indivisible. And there is not one student in our school that is not represented by that flag. The change in policy brought about backlash and protests, even claims of a direct attack on lgbtq plus students and teachers. Jurgensen says thats not true. And wasnt the goal. And ultimately we need to get down to teaching our children, educating our children in math, reading, writing and focus on that and not focus on any other distractions, but online threats and harassing emails have ensued. One claiming oppression was jurgensens goal, saying you may need to hide your kids in anything you love. Another reading. Enjoy your weekend. The documents show jurgensen has already filed a restraining order against at least one community member. He says with lies being publicly spread, hes taking safety precautions. You never know in this this world that were in these days. People do crazy things. Four of his children attend synagogue, then a fifth starts next year. He says some of the hate has also been directed at them. This father says he has no agenda other than to do whats best for the school. All schools should be safe and inclusive for all people, for my kids, for everyones kids, without exception, jurgensen says he has no intention to resign. Tonight, the fbi in San Francisco is warning of a new scheme targeting bay area residents and others across the nation. It is called the phantom hacker scam. The fbi says the new twist here is theres now a group of scammers in the scheme working together in plain several cast of characters. A swindler pretending to be a tech support staff. Then handing off the victim to another swindler, pretending to be a bank employee. And then a government official. This group of criminals contacts older adults, either through text or email to deceive them into thinking that foreign hackers have infiltrated their financial accounts with some victims have reportedly lost their entire life savings to the scammers. We are seeing higher losses. Unfortunately these people are cold and calculate being truly heartless and they will take every single penny that a victim has. Special agent tripp says if you believe youve received a fraudulent email or text, if you can do not delete it and call the authorities so they can view the suspicious correspondence in hopes of tracking down the hackers. San jose spent 58 million on overtime time pay for Police Officers during the last fiscal year. That is nearly 20 more than it did in 2021. The average base salary for a Police Officer is 120,000 a year. The san jose spotlight reports the average officer earned 38,000 in overtime. One officer earned 158,000 and a sergeant earned more than 201,000 in overtime pay. City leaders say overtime is necessary because of officers shortages, and theyre working to hire more officers tonight. New details in the case of two children who died after being found in a backyard pool at a residential daycare. As ktvu henry lee reports, the two victims are both girls under the age of two. No comment tuesday from the family linked to the home daycare in san jose. A day after two little girls fell in a backyard pool and drowned. Dont take it much, boy. You are taking the happy, happy daycare on fleetwood drive in the almaden neighborhood was the scene of a tragic discovery at about nine monday morning about an hour after the daycare opened for business. Three children were found in the pool, two of them, 18 month old payton alexandria cobb of hollister and one year old lillian hannon of san jose died. The third suffered injuries that were not life threatening. Nearly 24 hours after this incident, all of us are in shock and feeling the trauma. This is the type of call thats the worst that a parent can receive as a department. Were going to investigate this, obviously. San jose Police Officer steve aponte says its unclear how the kids ended up in the pool, which is surrounded by a gate and is accessible via a door in the backyard playground. Somehow along the way there are ways that those doors opened up. Whether or not that was a juveniles themselves, whether it was some other method. Were still looking into that. Aponte says. A number of other questions have yet to be answered, including how many caregivers were on duty at the time where they were when the kids fell into the pool and whether they could face any criminal charges. Questions of how this happened and to really have the hard answers to why two children are dead. He said the tragedy is a grim reminder that parents need to evaluate their child care choices. The incident as a whole will be an eye opener to many families, not just here in san jose, but nationwide, to really do their Due Diligence and investigate anima lives across the street from the daycare where hed see kids being dropped off and picked up every day for the past couple of years. Its just sad. I mean, its two babies just being a being a parent myself, right . Its just your your your heart goes out to the parents. The double drowning investigation is being conducted by the san jose police, the Santa Clara County das office and the department of family and Childrens Services in san jose, henry lee, ktvu, fox two news. Hunter biden pleaded not guilty today to three federal gun charges. Biden appeared this morning in a delaware federal court. The three felony counts are related to a gun purchase from 2018. Hes charged with lying about his drug use on a form to buy the weapon like to an employee at the gun shop and then illegally possessing the gun. Some republicans have accused the special counsel, david weiss, of moving too slowly, an accusation attorney general Merrick Garland denies. David weiss is a long standing career prosecutor and he was appointed by mr. Trump as the United States attorney for the district of delaware. I promised at my nomination hearing that i would continue him on in that position. Todays plea comes just a few months after a deal with prosecutors fell apart. Biden faces up to 25 years in prison if convicted on all counts, but that is unlikely, given no prior felonies. Cal state student assistance announced that they will take a vote on unionizing the employees will vote on whether to join the California State University employees union. Most csu student assistants make minimum wage have no sick time and no Health Insurance as employees because the csu limits student assistance to working 20 hours a week. Ive also have to work other jobs off campus. Over my six years of working as a student assistant, ive held two, sometimes three jobs at once. There are 19,000 student assistants working across cal states 23 campuses. So far there is no date set for that vote. It has come up a little today. Itll come up tomorrow, wednesday, and the most dangerous fire day will be friday because fuels have had an opportunity to dry out on each of these subsequent days. And as they dry out a little more, a little more when you get to fuel moistures down below 10, which its possible for us in this in this kind of a regime pattern thats when fire becomes a real concern. The Catholic Church has been around for centuries, but this week could signal the start of new changes that may alter the churchs future, especially when it comes to giving women a voice in religious matters. There are 700 million catholic women around the world, and so its time that the Church Actually listened to them. Pope francis will open the synod of bishops on october 4th. Its a three week long meeting where religious leaders share experiences and counsel the pope on issues affecting the church. In the past, women were only allowed to watch. But for the first time in 50, for women attending will be allowed to vote on a variety of church topics, including whether to give Women Leadership roles. Lgbtq catholics and the celibacy of priests to change the church and this synod is focusing on that. You need both a change of culture of mindset. Its about attitude, education, action. And its not easy. Instead of putting women at the back of a hall, those attending the synod will all be sitting at neutral round tables to help with conversations. They want their voices to be heard, not just towards decision making, but also during decision making. Women want to be part of that. Some critics caution against the change, arguing it creates opportunities for division in the church.
