An historic day at the u. S. Supreme court. The justices hearing arguments on the issue of president ial immunity and whether former President Trump can avoid prosecution for charges that he tried to undo his 2020 election loss. Ktvu jana katsuyama. Joining us now in the studio with details on the dramatic day in court, jenna, Christian Justice gorsuch said today that this decision will be writing a rule for the ages in this case could lay out the entire scope of how we define president ial power. Donald trumps attorney, d john sauer, began the hearing with his Opening Statements without president ial immunity from criminal prosecution, there can be no presidency as we know it. For 234 years of american history, no president was ever prosecuted for his official acts. Sauer claimed Donald Trumps actions were official when trump tried to switch the 2020 Election Results to his favor, trumps attorney argued that a former president should qualify for immunity from prosecution for official acts while in office. But the governments attorney, michael dreeben, said such president ial immunity has no foundation in the constitution or the Supreme Courts history. This court has never recognized absolute criminal immunity for any public official. His novel theory would immunize former president s for criminal liability for bribery, treason, sedition, murder, and here conspiring to use fraud to overturn the results of an election and perpetuate himself in power. The Supreme Court justices acknowledged the magnitude of the hearing, and for more than 2. 5 hours wednesday, they grilled attorneys on both sides. Do you differentiate between the president acting as president and the president acting as candidate . Trumps attorney said immunity should not cover private acts, but should cover official acts and the organization of alternate slates of electors. Was trump taking official action . Justice Ketanji Brown jackson asked about the dangers of immunity. The potential for criminal liability is taken off the table. Wouldnt there be a significant risk that future president s would be emboldened to commit crimes with abandon while theyre in office . Justice elena kagan questioned if a president ordered a military coup, would it be considered immune . Trumps attorney said it would be an official act, but should be addressed through impeachment. The justices pressed trumps attorney on the question of how to distinguish between official and unofficial acts. No mans above the law and that the president can be prosecuted after he leaves office for his private conduct. Is that right . We agree with that. And then the question becomes, as weve been exploring here today a little bit about how to segregate private from official conduct that may or may not enjoy some immunity. Of the nine justices, three were nominated by trump, gorsuch, barrett and kavanaugh. But there was no really clear indication from their questions on how they plan to vote on this. Okay, so what happens next . Now that theyve heard the arguments, what are the courts options . Well, they could outright reject this immunity claim that would basically mean that it could be set for trial. The second option could be that they accept it, and that would put a complete stop on the case. And then another option could be that they say we need to have more clarity. Lets send it down to a lower court. But then of course, that could delay the trial past the november election. And if trump is elected, he could basically tell the doj to stop the case and stop the prosecution. Okay. So it can play out a number of different ways. All right. Well be watching. Gianna. Thank you. Meantime, the former president was back in a new york courtroom today. Hes on trial accused of falsifying Business Records in relation to alleged hush money payments to an adult film actress in the run up to the 2016 president ial election, when the former publisher of the National Enquirer talked about the agreement he had with mr. Trump to buy and kill negative stories during the 2016 campaign, david pecker said, by the time the Stormy Daniels story started shopping around, hed already paid for two catch and kill deals, and he says he wasnt interested in making a third. Mr. Mr. Trump has pleaded not guilty and says he plans to testify. Be sure ill testify even if your lawyers tell you not to, i dont care. I did nothing wrong. Meanwhile, prosecutors have accused trump of violating a gag order for the 14th time. They say theyre angry that they had to find out through news reports that the city is about to have a major parking crackdown, which theyll have to enforce and they say that puts them in danger. Ktvu tom vacar joins us now from San Francisco with more on this story. Tom well, almost everybody doesnt want to see a lot more parking tickets being issued, including most of the folks who actually hang them on cars as 16 San Francisco parking control officers say previous stepped up Parking Enforcements or fine increases have led to increased threats and even assaults, making their work more dangerous without consulting them in advance, which puts a target on our backs and, you know, it puts us in a in a precarious situation with the residents and the challenges that we face. It shouldnt just be a top down decision. Its not thoughtful at all. And that should not be how we govern. We still havent gotten a date, an actual date when well be doing that. Officers also say drug addicted, mentally ill as well as unhoused people. Add to their dangers. Thats especially true in these unarmed officers are being directed to ticket People Living in their vehicles during encampment removals, as well as having to enforce parking rules at open air drug markets, weapons and, you know, vicious animals. We encounter that on a daily basis. They already dont like us. So i feel like this extra enforcement is just going to make them have much more animosity towards us officers. Schexnayder learned that after ticketing a car in front of its angry owner, i followed me about 2 or 3 blocks and waited for me at the stoplight, approached my vehicle, punched the window and cut my muni station. Agents say they experienced much of the same everything in the subway. What you see on the street is happening in the subway. Also this is an important issue all by itself, but theres Something Else and its for sure that this has political implications. And this is an election year. The buck stopped with the mayor. Muni writes. Our parking control officers are provided deescalation training, selfdefense tools and have access to our internal dispatch center that communicates directly with sfpd for any assistance they need. Now, the agency also says that since 2018, crime on the muni is down 48, but ridership is also down 29, which when you do the math, suggests that crime is actually down just 19. It happened at the Martin Luther king junior regional shoreline on april 5th. Faison and a friend were hanging out near his car. A parks police car pulled up and noticed faisons car had expired tags. Faison ran off and went into the water between the park and the oakland airport. The familys Attorney Says an officer tased faison in his back when he was knee deep in water. They didnt take off their equipment, but they watched him, the familys attorney, jamir davis, says officers acted improperly. It shouldnt take an attorney to tell you that electricity and water dont mix. Were bold enough to do that, but not brave enough to jump in and save them. Besides east Bay Regional Park Police, Oakland Police and fire and the Alameda County Sheriffs Office were all on scene. Authorities say they tried unsuccessfully to get help from the coast guard, the Park District and county officials did not want to comment because of potential litigation. Now, the family has indeed filed legal claims against both the east bay Regional Park district and Alameda County, the first steps toward formal lawsuits. Live in oakland. Officials with San Franciscos Public Utilities commission say they are pushing ahead with plans to buy the electric grid from pg and e and run it as a public utility. The city gave an update on those efforts in a webinar this morning. Officials say that clean power sf already provides more than 70 of the electricity used in San Francisco. They say that pg and e has rejected their offer of 2. 5 billion to purchase the power grid, so it is now asked the state Public Utilities commission for an independent valuation of the grid. Pg has failure to propose what it thinks is a fair price, is a roadblock, and is causing delays. The valuation proceeding gets both parties to the table and allows for public input. It will help to resolve the what is a fair price issue. The cpuc hearings on valuing the citys electric grid are set to start later this year. A decision is expected in 2025. We will have a look at all the excitement and a sneak peek inside the 49ers draft war room and in barry weather clouds moving in right now and overnight. Theres a possibility we could have a few sprinkles or a few light showers, but the patt n will usc star caleb williams. Yeah, and theres lots of speculation as to whether the 49 ers might make some big moves as well. Ktvu Jason Appelbaum live at 49ers headquarters in santa clara. Jason yeah. Christian. You know, right behind me, this is the 49ers press room, where, head coach Kyle Shanahan and general manager john lynch. They will take the podium in a few hours after the 40 niners make their selection or trade their pick. They have the 31st pick overall, ten picks in all in this draft. And we want to take you inside. Whats going on with them right now . A little sneak peek into their draft room. This is from years past. Take a look, the 40 niners, all the key Decision Makers are in that room. Lynch shanahan gathered together. Theyve compiled, compiled a list of players they are considering drafting, whether based on need or best player available, theyve got their big board up on the wall and lynch, shanahan. They carry the most weight when it comes to who to select. But owner and ceo jed york, hes also in the room. He has a voice as well. And right before they make their pick, theyll call the player, let them know that his life is about to change forever. And then theres some celebration on both ends. According to lynch, the 40 niners have given first round grades to 22 players, so they are hoping that one of those is available when they make their first selection later today. But if not, maybe they trade down and acquire more picks. And then there are the gold helmet players, as they call them, lynch says. These are the players who in their eyes are the cream of the crop, the best of the best in terms of what the niners are looking for. I believe we were about 16 gold helmets and we like keeping that standard high. You always want to give more. Lets lets stick to our standards because the reason our hit rate is high is because it is such a high standard. We do well with those guys because it takes into account everything we believe in. You know, thats thats talent, thats spirit. And you know, playing like a 40 niner back to throw. Okay. Another thing were keeping a close eye on is whether or not wide receiver Brandon Aiyuk will still be a niner after today. Aiyuk is in the final year of his contract. Its going to pay him 14 million. Thats a lot of money. But he is looking for a multi year deal for a whole lot more than that. And hes staying away from the 40 niners practice facility from where we are now presumably until he gets what he wants which is paid or traded. Theres a report out today that the niners may be interested in trading either aiyuk or deebo samuel. If they can move up into the top ten. Its a very deep draft for receivers and if thats going to happen, its going to have to happen soon. So so christian and julie, thats the scene here. Were going to come back in about an hour and well find out if the 40 niners have made any moves, if theyve drafted anybody made any trades, and if not, were also going to look at when brock purdy was drafted, because we all remember that moment and how his life was changed forever. Yeah i mean, a lot can happen between now and the next couple of days. A lot of high stress, a lot of moving and shaking going around. So they have ten picks. The 40 niners have ten picks. Jason im looking right now. They have one in the first round. Second round third round. Then they have three in the fourth round. So theyre heavy in the later rounds. Whats your sense on what do they need the most. Where do you think theyre going to go here potentially if they do pick in the number 31 spot where are they weak. And where are they going to try to fill . You know, its funny, i was just in the in the media room talking to mike silver and a couple other guys in there. Nobody knows when youre picking top three, theres a pretty good idea or top five when youre 31st overall, the speculation runs from an offensive tackle. Maybe someone that could end up replacing Trent Williams to a wide receiver to an edge rusher, because the 40 niners seem to draft a lot of edge rushers, pass rushers in the first round. So nobody really knows. And i could, you know, we could throw out ten names and they could take somebody totally different. So thats the beauty of the draft. And in fact, nobody will even remember the name that i tell him. If i were to tell him a name because theyd probably take somebody else and id be exonerated anyway. So. All right. Well, we are all its very exciting. Were all watching and waiting to see how it all shakes out, and well be checking in with you a little bit later. Jason. Thank you. Former giants manager dusty baker has won the baseball digest Lifetime Achievement award. Well, this cooler pattern wants to stick around, at least for one more day. And right now, we still have lots of clouds moving into the bay area. Mostly cloudy skies expected overnight with the possibility of maybe some drizzle or borderline light rain that could move in first thing in just in time for the friday morning commute. Take a look at the numbers this afternoon. Lots of 60s out there, a few low 70s out towards san rafael and santa rosa, but temperatures really not moving around too much for tomorrow. So for your friday morning, lots of clouds, maybe some drizzle or some light rain and then into the afternoon hours. Partly cloudy, some gusty winds. We could have winds going up above 25 to 30 miles an hour, and temperatures from the upper 50s to the upper 60s. Look at this. Now heres the forecast model showing you some rainfall to the north. Well have to keep an eye on some of this activity that could be clipping portions of the east bay tomorrow afternoon, parts of the north bay as well, toward, toward solano county. And look at this out toward the sierra. They will pick up some snowfall. This was the scene today looking out from sierra tahoe. Well, people in the bay area and across the country are running into challenges in finding veterinarians and now a new Study Suggests the shortage is only getting worse. Yeah, its a problem in both big cities and in rural communities. Foxs sunny tsai reports from Ventura County. Its common these days to schedule an appointment for your pet and need to wait weeks, if not months, for them to get seen. This applies to both general and urgent care workers here at the Humane Society of Ventura County. Tell me. They tried to book their appointments to max capacity each day to help alleviate this problem, especially since covid, ive never seen Emergency Rooms have to turn people away. And in these cases, they dont always have a veterinarian on staff in an emergency room because of shortages, 47 states are facing some sort of veterinarian shortage, and the high cost of vet school doesnt help the case. Most vets are graduating with an average of about 160,000 in student loans, and then the shortage also goes into the fact that veterinarians, oftentimes, once they graduate, they want to start repaying those loans. And so theyre going to look for more lucrative jobs in larger cities and things like that. Working at municipal shelters, nonprofits, vets are not going to be nearly as lucrative as a private practice. Doctor sisk was the only vet at the Humane Society of Ventura County for several years until last fall. Last fall, the board of directors said, you know what we need to be a bigger part of this solution, so lets hire an additional veterinarian if we can. The shelter is also sending workers into the community to offer low cost vaccinations. When you talk about barriers to access to veterinary care, youre not just talking about the first thing that comes to mind, which is finance, which is very important. But youre also talking about geography. And so while we are close to some large populations, were a little bit further from others. The Humane Society also says teaching the community to be a part of the solution by getting their pets spayed and neutered will also help lower the demand for vet services in ojai, california.
