Kamala harris. 60 days for the reelection and four days from the debate. If you don't mind mind letting me finish we can have a conversation. What to expect from the first debate between kamala harris and donald trump. Wrong. Wrong. It's been proved over and over again. Reporter: the new york criminal sentencing the latest trump spends the day in another court. If the defendant put his hands on her skirt why doesn't that qualify? the republican nominee's alibi for sexual assault. She would not have been the chosen one, she would not have been the chosen one. The trump vance ticket makes it known, school shootings are a fact of life we need to get over. I don't like this, i don't like that this is a fact of life. But you have to get over it. All in starts right now. Good evening from new york i am chris hayes, we are 60 days out from election day and if you were hoping to see donald trump go to jail before then it's not happening it was never going to happen before the election and it's officially not happening. Sentencing was supposed to happen this month for the 34 felony convictions in the new york hush money case. Today a manhattan judge agreed to delay his sentencing until late in november after the election we have more on that later. There's one event coming in just four days the first possibly the only debate between donald trump and vice president kamala harris. The debate will be hosted by the abc news philadelphia next tuesday according to the rules there will be no live audiences or opening statements in the hour and a half debate only moderators could ask the candidates questions and what's been painted as a win for the candidates in the might be muted when they are not on the clock to answer questions. The team wanted microphones to be out so viewers could hear all of trump's outbursts both camps see the debate as a make or break moment the most consequential debate in modern presidential history was almost certainly last month between president biden and donald trump in june. That debate was ultimately what led to president biden taking the unprecedented step of choosing to forgo the democratic party nomination so vice president harris could claim the top of the democratic ticket. Since then the campaign has been rolling and the trump polling lead has evaporated and it's down in the national polling average now which is why some insiders recently told the guardian they are praying for a debate when to boost the candidate. So it's probably going to be the biggest audience either candidate will speak to it will have certainly enormous ratings. He's been in dozens of debates. I think it will be his seventh when he does the general election. The debate with biden he was uncharacteristically sharp and focused for the first 20 minutes or so before he completely unraveled. For example here's one of his answers in the debate. The paris accord was going to cost us $1 trillion and china nothing and russia nothing and india nothing. It was a ripoff of the united states and i ended it because i didn't want to waste that money because they treated us horribly. No one was paying into this. It was a disaster but everything he said just now, i will give you an example, i'm the one that got the insulin down for the seniors and i took care of the seniors. What he is doing is destroying our medical programs because the migrants coming in and want everyone, look, of the biggest heart on this stage i guarantee and i want to take care of people but we are destroying our country and they are taking over the schools, hospitals, and they will take over social security. Is destroying social security, medicare, and medicaid. That's like a standard trump debate riff, almost everything he said there was completely untrue. Biden is the one who capped insulin at $35 a month with the bill he signed into law but what do you think the question was that he was answering there? give it a guess you're probably wrong. Former president trump you have vowed to end your opponents climate initiative but will you take any action as president to slow the climate crisis? the answer is no. Donald trump doesn't really have anything of substance to say if you move him off of any of his rally rifts the border, etc. he's got nothing but as the night goes on the more off topic he gets. We have seen that in the debate and with his convention speech. There will be zero fact checking of trump after the wild rant so the unanswered question is how harris will deal with this on the debate stage which would be the first time she and trump meet in person. She's reportedly been in debate prep with a former clinton aide standing in as he did in 2016. He has experience including in the presidential primary. At one point in the debates when the discussion and harris stalled the spotlight by calling out joe biden. I would like to speak on the issue. Okay. On the issue of race, i could not agree more that this is an issue that is not being talked about truthfully or honestly. There isn't a black man i know be here relative, friend, or coworker who hasn't been the subject of some form of profiling or discrimination. My sister and i had to deal with the neighbor who told us her parents couldn't play with us because we were black and i will say also in this campaign we have heard, i will direct this at vice president biden, i do not believe you are a racist. I agree with you when you commit yourself to the importance of finding common ground but i also believe and it's personal, it was hurtful, to hear you talk about the reputations of two united states senators who built their reputations and careers on the segregation of race in this country. It was not only that but you also worked with them to oppose busing. There was a little girl in california who was part of the second class to integrate her public schools. She was bussed to school every day. That little girl was me. So i will tell you that on this subject, it cannot be an intellectual debate among democrats, we have to take this seriously and we have to act swiftly. As the attorney general of california i was proud to put in place a requirement that my special agent would wear body cameras and keep those cameras on. A testament to her performance and to biden's humility he chose her as his running mate after that exchange which was the exchange of that debate series. It gave her a chance to debate the sitting vice president mike pence. I think the american people know that this is a president who put america first and the american people i believe with my heart could be proud of the sacrifices they've made and have saved countless american lives. Senator harris, would you like to respond? absolutely whatever the vice president is claiming the administration has done, this clearly hasn't worked. Looking at 210,000 bodies in our country, american lives that have been lost in families that are grieving that loss, and you know, vice president is the head of the task force. He knew on january 28 how serious it was. Thanks to bob woodward we learned that they knew about it and when this was exposed the vice president said when asked well why didn't you tell anybody, he said because the president wanted people to remain calm. Susan, this is important. Mr. Vice president i am speaking. You got 15 more seconds and then we will give the vice president a chance. I want to ask the american people how calm were you when you are panicked about where you were going to get your next piece of toilet paper, when your kids were sent home from school and they didn't know when they could return? she's never debated trump before and it's a different matter completely. I'm not sure anyone has really figured this out yet. A former republican congressman in florida, a strategist who served as the senior advisor for the 2020 bidenharris campaign. This is the framework i was thinking of. Joe biden did a good job since the debate. It's unclear what winning the debate gets you in some senses because with trump what could you show about trump that has not been shown already so my question is, what do you see as being the goal for harris in this? you have to control what you can control. You have a huge audience and an opportunity to speak to them. What are you trying to do independent from what he does? i want to be very frank vice president harris is the underdog here, it will be the third cycle president were former president trump has debated in a presidential debate. With that, vice president harris will make her policy positions clear and continue to make she will push back on the dangerous extremist rhetoric that comes from president trump. I think vice president harris as we have seen in the clips prior as well as what we had seen in the judiciary hearings, she's very clear on prosecuting. I want us to make sure when we are watching someone for the first time having a presidential debate against the former president, someone who could not be controlled and to be honest in this campaign, these stipulations harris campaign has agreed to so it will be interesting to look at this and i'm looking forward to seeing how unpresidential president trump looks and how presidential vice president harris looks. Harris is worried she will be handcuffed by the debate rules by the biden campaign when he was the nominee but harris will fact checked donald trump. She wanted to do some interrupting herself. They finalized it to meet the candidates. Advisors are scrambling to re white to rewrite their playbook. I'm not sure that the exchange has been for the vice president that this will be the defining moment. I don't think there's anything donald trump could do which would really move a persuadable voter but i think there's a lot that vice president harris can't. With donald trump we've seen it all, he's assaulted vicks rooms he's assaulted victims. You name it he's done it. There's nothing more for him to do than move the needle on but with vice president harris i think it is less about how she answers or what she says in her answers than how. We know she will do well on the debate. She played the clips of someone who's a seasoned prosecutor and seasoned at the debate. The ultimate question for the voters who will be taking the measure of vice president harris at the debate is not whether they believe her or if they believe in her. Coming off of the momentum of the democratic national convention, there was this swell and support of people saying i believe in vice president harris as the person to lead the country. I believe price vice president harris is the boat we should take. They will take the debate stage. This is the person i believe in. Whether or not they will vote for donald trump, vice president harris has the enormous upside. There's almost you know, sort of not taking the bait. She showed herself adept in terms of the campaign stuff. The interview she got. That's him doing what he does. It is harder in the room and one of the difficult things, he said those lies about i did the insulin, he will say these things that you've got this kind of, you know a fork in the road. A decision tree. What he said about july, do you go back and rebut that or how do you do miss dismiss this to move on and not get pulled into spending all of your time fact checking the things he says that aren't true? i think that's a unique position that the democratic nominee is in. Especially if the moderators don't do fact checking i will say i think what they have on their side is the fact that a lot of these lies, getting fact checked by the administration. His lies could be fact checked with the policy positions and plans moving forward. There are so many ways that creatively vice president harris could rebut his lies and also tell the american people what she plans to do going forward. There's so many policies that they continue to roll out. They are seeing the difference. They are seeing donald trump, they are trying to stay on message and be clear about our policies. I think that idea that you have got however tens of many people he ends millions of people watching. In some ways he's an obstacle to you communicating with them and to them about what you want to do so i don't know how money people know, they've got a good ambitious affordable housing agenda. It's the most affordable housing agenda i've seen for a democratic national candidate in the time of covered democratic politics. It could go pretty well. One in 20 voters might know about this. It's the opportunity to do that. Whatever he is saying. It's an opportunity to communicate that. I think vice president harris would be dismissive of donald trump. Focus on engaging with the moderators and to your point, the moderators have to do more this time. They've got to call a lie a life like you did during the last debate other otherwise it's not a newsworthy event if they let this go unchecked but if you are vice president harris from the economy to the renewed strength of america on the world stage to positions on protecting democracy or access to healthcare and access to education and the stock market, focus in on talking about your records or plans for giving up the future with the moderator and prepare for the pushback with hard questions. To me that is the exchange that will sell this for vice president harris between her and moderators. It's not hard to get him to take the bait. He wanted to relitigate the suckers and losers talking about fallen soldiers he returned to that. There's some things if you bring them up in the election that wasn't stolen. He will go to them over and over and over. So that's another thing he's got against him. Finally i will say if you could fit in 10 to 15 minutes debating your respective golf games then you are a winner, you would want to do that as much as possible. Thank you very much. The judge overseeing his sentencing for his conviction on 34 felony counts and a hush money payment in the 2016 election decided to hold off imposing punishment. Trump was originally set to learn his fate 12 days from today on september 18 but instead the judge posting sentencing until december 26 after the 2024 election. This means that he will face no criminal consequences for any of his actions before the voters weigh in on election day. Donald trump and his legal team were in another new york courtroom and appellate court arguing to overturn his euguen kiely verdict. He set less than 20 feet away from carol. Once he returned to trump tower he repeated some of the same lines that got him into an $83 million hole. This case involved a woman who wrote a book and i guess she says something in the book. I first heard about this in the white house and i denied this story because it isn't true. I've got no idea who she is. I never met her. As far as i know i never met her and i never touched her. I would have had no interest in meeting her in any way, there is never a claim or a police report. There was never anything mentioned or any publicity. 30 or 40 years ago whenever this took place. Carol says the assault took place 28 years ago in 1996. According to the department of justice nearly 70% of sexual assaults went unreported in the 1990s. Despite his insistence, that the case was fabricated and that e jean carroll was lying, he received full due process in the matter. Her lawyers presented the case to a jury and after hearing arguments and the ex president's defense, the jury believed e jean carroll and found trump was liable for sexual abuse and defaming her by saying what you just heard him say there. We should note here he didn't need to be in court today, you don't have to show to your own appellate argument he could have let his lawyer handle it but he chose to be in the courtroom to put on a spectacle in front of voters in front of american flags spending an hour disparaging e jean carroll. Not just that he also spent time insulting and attacking numerous other women because there are many women who've accused him of sexual assault throughout the years, the kind of sexual assault he once bragged on on tape including one who give testimony in her case. There were two witnesses, one is a woman who's followed me for years. She said in 1979 i was in an airplane, we became very intimate. Passengers were coming into the plane and she said i was making out with her and then after 15 minutes and then she changed her story a couple of times maybe it was quicker that i grabbed her when she had had enough so think about the impracticality of this. I'm famous i'm in a plane people are coming into the plane and i'm looking at a woman that i grab her and i start kissing her and making out with her what are the chances of this happening what are the chances? frankly, i know you will say it's a terrible thing to say but it could not have happened, it didn't happen and she would not have been the chosen one, she would not have been the chosen one. Just to be clear when he says the chosen one the person i would choose to sexually assault, that's what he means by the chosen one. She wouldn't have been the person i would choose to sexually assault, of all of the defenses he's decided to throw out there, he's spouted before about e jean carroll and these other women, these women victims of sexual assault, they hear him say this. Donald trump in a packed legal day with his hush money sentencing postponed until nearly thinks giving during arguments over why they should overturn a jury verdict finding him liable for sexual abuse and defamation. Legal correspondent attorney has been following his case closely. Recently retired from the new york state supreme court bench serving as the criminal court judge and as a prosecutor in the manhattan district attorney's office and they join me now. It's great to have you here. On one hand he was really between a rock and a hard place if you went forward today there was 50% of the people out there who are bound to think he was biased and unfair and if you didn't go forward, the anti trump people are angry at him. He was faced with neither the people who didn't press him to go forward today. They seem to be fine more or less with postponement they weren't saying emphatically. I think the judge doesn't have to follow with either lawyer it does get more difficult to appear fair or impartial if no one is pressing you to do one thing or the other. What's the logic in this delay? the logic is that he doesn't want to be perceived as putting his thumb on the scale of the election. He says he views himself as an impartial jurist but because of the appearance of partiality will be there if i go ahead to sentence this person i will delay the sentencing and not only will i delay the sentencing i will delay my decision about whether to set aside the verdict itself until after the election so between now and the election the status quo will be the verdict stands. You know, i understand why he is doing that but i found the spectacle of this maddening in many ways. It was a test of like is it true no one is above the law and it's like not really, no, if you've got enough power or enough lawyers and if you are willing to litigate like crazy and you are running for president everyone has to deal with that then you could be above the law but you won't be treated like another defendant but you will be treated differently by the supreme court and differently over the southern district in florida and differently in a new york court. In the end he's getting treated differently everywhere. It's an interesting issue because normally these postconviction motions are standard and are rarely granted. Now you've got the united states supreme court throwing a huge mucky wrench into it. You can't ignore the law of the land. It's a serious legal question , what impact if any does this have on all of these two months of trial that you sat through in the public watched? to the extent that a judge merchan will ponder this to take his time on what is usually of motion it's a smart thing to do. Jury verdict in this case. It's really about these pieces of evidence in particular. Two testimonies by trump accusers who say he abused them in 1979 and 1996 respectively and the access hollywood table. They say it's improper evidence it speaks to his propensity for assault. It's either propensity of it or bad acts evidence but it was introduced improperly through the exception is that you can introduce propensity evidence when it comes to sexual assault which would otherwise constitute federal crimes, specifically enacted statutes by congress. The judge who oversaw is very sort of a tighten of the bench. Not a rookie, it's someone whose reputation precedes him and he made these calls. The circuit said that today. There was an acknowledgment that the judge is a very experienced judge and that the standard of review for the evidentiary decisions is one of abusive discretion. It's not something the federal appeals court will review from the beginning or as a legal standard is but one where they have to give a ton of difference deference to the court. One of the three judges on the panel asking his lawyers why shouldn't we use the standard given that the threshold is this high? they had a hard time to articulate that. Trump was frustrated with lawyers today in which he told them as they stood there. Here he is talking about his legal talent and other things. They have all this legal talent but legal talent cannot overcome rigged judges, they cannot overcome a four percent republican area. I'm disappointed in my legal talent i will be honest with you. They are good people, talented people. Today at the trial they did not mention the dress. I was going to go into the trial and they found out there was nothing on the dress, which i knew. This is something of a nightmare client and one of the things we have seen again is sort of trying to restrain him and he's complaining about the judges in the case. He's also like, you know republicans going after judge merchan's daughter. He says look i don't take this decision lightly. It's the best advance in the interest of justice but i have to wonder, the degree to where this has all this extra pressure with the security situation, your daughter may be getting hauled before congress, the point of the pressures to affect the outcome and as an observer i have to ask if it's working. Look, it's a nightmare that he has perpetuated since spring. The constant attack on the judiciary and the rule of law. It's all rigged. I'm sorry, you know it's a big lie that he keeps saying and saying. At some point, the respect for the rule of law wears down. It shocks me. I sat on the bench over 25 years. I could count on one hand how many people ever threatened me and they had mental health issues. Have you ever seen anyone do this and both of you said yes, people that had severe or acute mental health issues. Yes but it's so abnormal but it's become normalized and it dangerous. It's so normal yesterday in court dc where i was for the conference for the judge was noticeable to me how many marshals were in the courtroom because jack smith and the judge have their own federal marshals. But a bit of a hiccup in north carolina where ballots were supposed to go out today. It's all because this guile has thrown a bit of a into the mix. You see, kennedy spent millions to get him on ballots as a third party candidate. When he found out, that his campaign was hurting trump, he reversed. Those ballots were supposed to go out today but a state appeals court that kennedy's name can be removed without providing a legal justification. The state may still appeal that decision. State attorneys now say printing new ballots without kennedy's names on them could take weeks. A north carolina law says today is the latest those ballots can be sent out. Donald trump may try to deny it, but those are donald trump's plans. We'll revenge does take time. I will say that sometimes revenge can be justified. He'll take control. We'll pay the price. I'm kamala harris, and i approved this message. Today the 14yearold suspect in the georgia school shooting and the boy's father had their first court appearances. They are being prosecuted for the killing of two students and two teachers on wednesday morning. The boy cole gray a student at the school faces four charges of murder and is being tried as an adult. His father, 54yearold collin gray appeared in the same courtroom right after his son. That man faces four counts of involuntary manslaughter, two counts of second degree murder and other charges in connection with the same shooting. The charges against the father stem from his providing a firearm to cole gray with knowledge he was a threat to himself and others, arrest warrants show. That firearm was a black ar15 style semi automatic rifle. They had already been there last year, this is really the detail that sticks out. They've been there and interviewed the teenager about threats posted online to carry out a school shooting. The 14yearold denied making threats. The father said he did not know. He said that his son was struggling and being bullied at school. Investigators concluded the evidence was inconsistent and the case was closed. Then at some point after that visit from law enforcement, the father bought his son the murder weapon for christmas. On wednesday morning, colt grey opened fire at his high school killing two fellow 14yearold students and two teachers and wounding nine others. In georgia, minors are not allowed to possess firearms but it is legal for them to purchase a long gun. Which means, purchasing this weapon was not per se illegal. It wasn't a psycho wanting to make headlines, he went to the school. Contributing writer for rolling stone, joins me now. You've been reporting a lot about red flag laws. So i want to talk about it in a second. This seems like, i mean we had a few of these now. But this seems like the most extreme version of the fact pattern i've seen where, man did the alarm system looked like it was going off. It was super egregious. If you say the word red flag there couldn't have been more of them. You knew there were credible threats that were made and reported to the fbi. So what's the, it's as if it's very strange that a 13yearold boy was able to outwit fbi agents and take his word and his father's word. A lot of huge mistakes were made and this is a problem with the system and why red flag laws exist to fill in the gap s. You're in this precrime world. The cops come and you say, and then what, he hasn't done anything yet. Right, right. Well i mean, the big problem is i mean this is, sort of gets out of the state of america. It's a matter of everything is about what can be done on the back end. And in this case, it's true. You never know it's what's your threshold for risk. What are you comfortable with leaving up to chance. I think most americans would think we're not comfortable leaving things up to chance when someone says they're going to take a gun and murder a lot of people. Even if in the end, they don't do it or maybe they didn't really intend to do it, it's like like what's the upside? the thing that struck me, i saw the case and i'm like, i saw this yesterday i said if you're the father you better lawyer up real quick. When the pattern became clear. But when i saw it's actually buying your kid an ar15 at 14 is legal in georgia. That really blew my mind. Right. It is, i mean it is mind blowing but then if you also think about georgia has been at the forefront of this sort of like red state one up manship that's been going on for the last so years which is to say like who can pass the most extreme, who can pass the most extreme version of like the absence of a gun law. You know what i mean. Most permissible. They've been at the forefront of the guns everywhere movement. They passed a law that permitted guns in bars and churches and government buildings. All these places that have historically ben off limits. And this is the culture. The culture also says we can socialize kids into the guns, into the gun rights movement into owning guns. And we can tell them that you know hey, you know not to, you know point guns at people. But kids cannot be trusted. We're killing ourselves with delusions and myths. Every time for gun safety ranks georgia 46th among states for the strength of its gun laws which is not surprising. So, one of the things you've been reporting on is red flag laws and it seemed like again, all of this is in this context of like the narrow read of like what can you actually get enough votes to. Particularly pursuant to the supreme courts insane juris of the power of the gun lobby and sort of conservative program in legislatures. One of those places was red flag statutes. That has been a place. Like florida for instance. They did pass a red flag law after parkland am i right. Yeah, yeah. A number of states. At this point almost half of american statings have red flag laws and became prominent after parkland and they have the full support of don donald trump and the rifle association. It was considered to be the bipartisan law. It's only temporary. It's not even, it's not a permanent thing it's a you present a risk an imminent risk to yourself or others so either your household members or law enforcement can petition a judge to temporarily have your guns removed and that's it. It's a civil proceedings and there's also a follow up hearing where you get to present contrary evidence. The notion that there's failure of due process. It's a lie. It's a lie. Even those have started to be under attack. That's right. That's what i mean. The way in which everything now is tried, gets politicized at some point for no real reason perhaps because the current president signed a bill into law that provided, a lot of money for red flag laws. He funded a bunch of it. So his name is associated with it, now a view on the right that, we hate red flag laws. There's no reason to oppose them. Do we have evidence, obviously reducing in the aggragate. We heard tons of data suggest that very obvious finding. But specifically, do we have evidence about what stops people who may do something terrible from doing it. We have when it comes to suicide the answer is yes. That's like name restriction, the sign says works which is to say if you deprive someone of what their preferred method then they don't go seeking another one. It's harder to tell when it comes to homicide, mass shootings and that sort of thing, but we do know that, even in this brief period in which red flag laws have existed, there's been a number of credible petitions that have gone before judges and judges have granted them. So it's more like can you prove a counter factual that the events have happened. I don't know but i rather not now. Than what we have here in georgia. Mike, thank you very much. That is all for this week. Alex is here now. Made it through the week. I sure did. Have great weekend. You too. Today we got the news that donald trump's sentence has
