appellate jurisdiction and should dismiss the appeal and return the case to district court for trial promptly. i'll spare you the specific and technical legal arguments behind this. suffice it to say, it is been turning some heads and legal circles. and it now appears the court of appeals may be opening to hearing arguments to that argument. to that validity, as well. if the judges service active to that argument, it would be a kind of elegant way to ensure that donald trump still sees his day in court before the election while still leaving the door open for him to appeal immunity grants after a potential conviction. that's when the bulk of appeals happen in criminal cases. now, it's worth reiterating that the immunity grounds that trump is basing his appeal on are remarkably broad. he is essentially saying the president should be able to operate with near impunity, installing himself as a dictator who's completely unaccountable to the american legal system. i want to talk about the immunity question. this latest development from

in a crucial time in primary season. >> plus 30, plus 40 points maybe not the biggest concern. that's the point that people are missing to some degree. the trial itself, elie, he is going to be sitting in a courtroom. we are going to be hearing arguments. it is not going to be pr statements and people yelling on tv. this is in a courtroom. what does that mean? take people inside that courtroom. >> yeah. it's a whole different ball game. i think yesterday was a reality hit for donald trump's team. it is clear we are going to have one, maybe two trials between now and the election. when you're on a criminal trial, you have to physically be there as the defendant. we remember the e. jean carroll trial a few months ago. that was a civil case. he will have to be physically in the courtroom. it's a full day. it's a long day. trials usually start 9, 10 in the morning and go to 4, 5 in the afternoon. he will be in d.c. he will be in florida. and so he will be physically off the campaign trail. i think it will be really interesting to see from a political perspective how does that play? presumably he'll be getting wall to wall coverage.
