This is a win for the constitution and congress and a win in our fight to restore the separation of powers. The legal fight started almost two years ago with president obama frustrated with republicans, sidestepped congress and signed the executive orders allowing lowpriority undocumented immigran immigrants to stay in the u. What we found was this proposal does not have enough support to pass the senate and we saw a lot of tension not just in the senate but also in the house. Tonight, democrats end their 25hour demonstration on the house floor. And promise to take their fight over gun control to the november election. We must never, ever give up slam or give in we must keep the faith and we must come back here on july the 5th, more determined than ever before. Reporter after a dramatic allnight session where democrats shouted shame, shame, shame. Reporter and tried to shut down all action in the chamber. Well, were going to take this protest in one form or another through november 8th. Reporter in a private meeting today, democrats presented different strategies for keeping the issue alive. But concluded it was time to call it quits despite the public claims there should be no break until theres a bill on gun control. You know democrats, were all presenting a different plan right now. So when we see our democracy descend in this way, it is not a good way. Reporter a bipartisan compromise to deny people on the nofly list fail to demonstrate it could pass the senate. Surely, on an issue of this importance we should be able to come together and work for commonsense solutions. Reporter now, the reason why that proposal failed, the opposition from republicans and the nra, they did not like how the bill was structured in terms of due process for those denied the right for a firearm. Susan collins of maine was very frustrated that Republican Leaders were putting together an alternative plan and put republican support towards that and not hers. Manu raju on the hill for us. Brianna, the bill that they were talking about was my bill. I introduced it back in 2007 to say if youre on the terrorist watch list, you cannot buy a gun. Before we get to paul ryan, the democrats are totally hypocritical. They controlled the house for the first four years that i had that bill, the democrats controlled the house and the second sfwtwo years they controd the presidency and refused to move it. It never moved at all. It went nowhere now suddenly they are making it a big issue. There is a hypocrisy. Also the fundraising. I disagree with paul. I think we should vote on it. The fact is, paul is the speaker and there have been a lot of bills that didnt come up as every members of congress. The democrats, what they did last night, it was really like a gang that was trying to take over the house. That served no purpose. I think what Susan Collins was trying to do in the senate was the best thipg. I think what happened last night made it harder to make progress in the senate because it made it more partisan than it already was. Wasnt one of the things that it made it more difficult for Susan Collins was this alternative republican measure that siphoned off votes . Yeah. Listen, i dont want to tell the senate how to do their business but i agree, based on what Susan Collins said, that was the wrong thing. I think the Republican Party, as an institution, has to realize that the American People do not want terrorists to be people on the terrorist watch list to be able to buy guns. In fact, donald trump, hes right now our hes going to lead our ticket, he also agrees with that. I was talking with him this afternoon, that people should not be able, if they are on the terrorist watch list, should not be able to buy guns and republicans raised the argument of due process. Well, the fact is, theres a difference in due process between the person losing his liberty and a person having a reasonable restriction put on a right. And to me, as long as there is reasonable belief that this person could be a terror suspect, the government has the absolute right and obligation to keep that person from getting a gun and the court make as final decision. Under my bill, under Susan Collins bill, senator feinsteins bill, one way or the other, if you feel you should not be on the list, you can go to court and have the judge make the decision. And the vast majority of americans, congressman, completely believe the same thing as you. The cnn orc poll has found that 90 of republicans and 85 of democrats support these gun control measures, to prevent people on the terrorist watch list or no flylist from buying guns. When youre looking at other members of your party or even democrats, some of whom may be opposed to this other other measures, what is it in the face of the overwhelming support or other measures that prompts them to say, im not going to listen to the American People, im going this way . The way the lines are drawn in congress, the hardcore republican voters, they are strongly progun. And they look upon any legislation at all as being an infringement of their secondamendment rights and that really controls the day. And i think its wrong and i think were living too much in our own world. And same with the democrats, by the way. They are trying to say this wasnt a terrorist issue its everything. Guns are part of it. The thing is, if were going to defeat isis, this has to be a fullcourt press and having for surveillance and take whatever weapons you can. It really makes you wonder if anything can Pass Congress when youre talking about something that has to do it all with guns. What kind of changes would need to be made, in order for Something Like this, that has the overwhelming support of congress, to Pass Congress . Well, ironically enough, donald trump could be the game changer. Hes strongly supporting that someone on the watch list should not be able to buy a gun. It doesnt have to be my bill, and also willing to make concessions. I was really disappointed that the bill didnt get more than 52 votes. Also, i think the antics of the democrats in the house floor, which i found really shameful, made it such a partisan issue that it made it more difficult for republican senators to vote for senator collins. In the end, thats no excuse. We get paid to do the job and our job is to protect the American People. Does it come down to the nra, that there are members of congress in your party even though they are looking at the poll number, ultimately when it comes to election day, the nra they think is going to carry the day and get voters to out of them . The nra does have power and its that the hard core voters, in many of the districts, are nra supporters and members and believe in it strongly. But again, im hoping that maybe someone like donald trump and i spoke with him today to tell them, listen, i believe the terrorists or people on the terrorist watch list should be able to buy a gun because i believe that some of the probable cause measures are not sufficient. I think it shows that the president overreached and not just overreached but went far beyond the executive powers. I am one of those who favor Immigration Reform and you find members of congress who do but they clearly feel that the president was wrong. Congress has to find a way to get to these issues. And i can be critical of republicans but ill tell you, theres very little room for compromise. Maybe when this election is over, when Ronald Reagan and tip oneil hes the most conservative president we ever had in the 20th century and constantly compromising for tip oneil. If he got 70 of what he was looking for, that was considered a victory. Today, if you get less than 90 , you get attacked on talk radio and over the internet and we have to find a way to stand up to that. And convince the American People getting a job done is important. That when you make a legitimate compromise based on principle, thats not selling out. Thats what democracy is all about. New york is very different from the states in the south and the west and they are very different than us. We have to realize those differences and try to find a way to find our community. Donald trump, of course, has said many controversial things about immigrants and about his immigration plan. Weve seen recent poll numbers coming out of florida that show hes not doing too well against Hillary Clinton and compared to other states that have less hispanic populations. Are you worried that this is going to hurt him, not just in florida but in places like colorado that he needs to get in order to get to the white house . Well, i sense the reaction that is there but from now until november he has to explain why he believes on balance his policies are going to be helpful to the average hispanic family. How do you go from building a wall and making mexico to making mexico pay for it to really pivoting from that in a way that can change the hearts and minds of people currently against him when youre talking about just a few months . Well, he has to show that illegal immigration as opposed to legal and show why illegal immigration benefits everyone and once the illegal immigration issue can be resolved by having stronger borders, that is the way that we can find a way to have real comprehensive Immigration Reform. So he has to show that its not helping anyone to be allowing illegal people to have any incentive to come to this country to get any type of amnesty or have a president like president obama who is violating the law and going beyond his constitutional powers by issuing these executive orders. We are a democracy and we are a republic and the Congress Passes the laws and the president signs them. Now, obviously, congress should be doing more. But what donald trump needs to show is that his policies, maybe tough love, if you want to call it that, its up to him to articulate that. He hasnt been able to do it until now and he needs to find a way to show that Hillary Clintons views are not going to help anybody and if we are going to resolve this issue, we need to go forward in an honest way. We are following breaking news. A controversial split decision at the Supreme Court has dealt a devastating blow to president obamas immigration policy. Also breaking, democrats pushing for stricter gun control legislation have abruptly ended their daylong sitin on the house floor. We are joined by senior political commentator and former adviser to president obama, david axelrod, jeffrey toobin, mark preston, and chief Political Correspondent dana bash. Jeffrey, lets talk about this order today. Listening to president obama, it sounded like he was saying dont worry too much, this doesnt iviscerate the things that i was trying to get done but how this will matter for the next president. Walk us through his order and what it will mean for the next president. What happened is the Supreme Court split 44, which meant the lower court was affirmed, even though its not now a precedent for the whole country. What president obama tried to do was, he said this 4 Million People whose children are american citizens but they are illegally in the country, he said we are not going to try to deport you and we are going to set up a procedure whereby you can get working papers and start to integrate yourself into american society. What the court said today by splitting this way is that the deportation process doesnt change. They are not going to be deported. But this process of letting them get work papers, that was outside the president s power. He is not allowed to do that unilaterally. So that process ends and these people are now in limbo in terms of their right to get jobs and join the americans. This will be a big issue for the next president , whoever that is, could either keep or repeal some of his executive orders. They could obviously nominate Supreme Court justices and effect this situation even further. But david, when we heard president obama trying to mobilize americans, trying to mobilize voters and certainly hispanic voters, that are a key part, how much is this going to mobilize those folks . Well, as if we needed any stake raising in this election. It certainly shone a light on the states, like colorado, florida, nevada, where hispanic voters could be divisive, these are swing states, certainly the Hillary Clinton forces will be using this and also generally it underscores what having a split Supreme Court means because they didnt have a ninth to break the tie and whoever is president is likely if the senate holds firm, its going to have to appoint that or will have a chance to appoint the Supreme Court justice who will have a huge difference on this and many other issues. This is going to play in the election. Theres no doubt about it. Mark, the Supreme Court punted on this today but of course the Lower Court Ruling stands and they are saying, look, this is proof that the president has overused this executive actions, that hes gone beyond where he should. Do they really have the narrative that they are trying to push . I hate to answer it two ways but let me answer it two ways. Because it can be interpreted both ways. Im sure david would preach to this. As the president , you have the power to enact executive actions as president where you see fit and, in this case, barack obama looked at congress and said you dont seem to be, you know, moving forward on my policy. Let alone giving it votes and so im going to take action and its a political play. Now, if you are republicans, you are saying there are three equal branches of government and what weve seen from barack obama is an overplay of his hand and were going to stand our ground. Now, paul ryan, i think, handled a very difficult situation last night over Gun Legislation in allowing House Democrats to essentially take over the house floor on this issue on immigration, you know, who know what is is going to happen, if House Democrats will try to seize on this. Does it play, dana real quick, because i want to ask you about guns, does it play better for democrats or republicans or is this a draw . The Supreme Court . I think the republicans have already been energized on this issue. We saw it. You cant go to a donald trump rally without having this interactive experience about the wall. Thats already a part of their kind of mobilization. And to davids point, on the democratic side, its been there but this is just right now front and center proof that if they really do want to make a difference on this issue and by the they, its hispanic voters, particularly in those swing states, they need to mobilize and focus their energy, presumably, on the democratic candidate. Does this really make sense . But when has donald trump ever done anything that we expect a republican or any candidate, especially the presumptive nominee to do. So maybe it doesnt matter. Mark . It certainly doesnt matter but let me dive deeper into the poll that jeff showed. You dig deeper and 7 in 10 are independents and voters hes really going to need if he wants to win the general election and 56 of those are actually republicans who thinks he needs to separate himself. The problem for donald trump, perhaps not now but in another month or so, are people going to think that he is potentially going to be distracted by working on his businesses if he is elected president of the United States . Well have to see how seriously and fiercely those who are polled really feel about this. I wonder about Something Else that donald trump said where he told hugh hewitt, hes thinking of announcing his cabinet members at the end of the convention. Unconventional, of course. But i wonder, as well, if hes able to say, look, this is who would be in my cabinet and its a serious lineup, if that could help him . That would be the goal, to reassure people that he can govern. The danger is its hard to find cabinet members, the right people for the right jobs. Once you lay them out there, they are targets. If he make as mistake, it only exacerbates his problem of people doubting whether he can govern. I think the risks outweigh the rewards. He has laid out about ten judges hes considering for the United StatesSupreme Court and they are a very serious list that i think established his conservative bona fides with the members of the Republican Party who really care about those things. So at least as far as the justices go, i think it was probably a smart move. As for the cabinet, david is right. The risk is bigger than the board. But the establishment looks at this and says he doesnt necessarily know the order of how you do these things. How concerned are they . I think probably thats not high on their concern list. They have other things to be more concerned with, like raise money, hire staff, make speeches along the lines of the one he made yesterday and dont scare of swing voters. Mark, what do you think . Dana is right. The number one thing for republicans is they dont want to become the target of donald trump. Focus on Hillary Clinton and, by the way, focus on Hillary Clinton. It is just indefensible for the speaker to claim this is a democracy when he wont allow a vote on this. The optics of we are determined to take it up after vacation. That was a decision the majority made to recess without should it have been different, do you think . Is that what youre saying . I think the majority should have stayed in session. Whether it would be productive for House Democrats democrats decided, theres nothing stopping democrats from staying on the house floor. It was broadcast on social media, even though the official cameras were turned off. Why not stay, say we are staying through vacation because this is our commitment. That was a debate we had and discussion we had with leadership. We made the decision it would be more effective frankly to resume when we all return when frankly theres more fresh you are on the gop to act because there are measures they want to take up, they dont want to have to answer questions we have been raising, and we thought we would be more effective when they returned to session. There are a lot of complaints people have about congress, they feel congress isnt in session enough and that members of congress are very dedicated to taking time off instead of being in washington. Doesnt it play into that perception . You know thats something frankly thats played up whenever congress is out of session but frankly from my constituents point of view, they want me accessible, dont want all of my time in washington and theres a popular misnomer when were not voting in session in washington that were somehow on vacation. Most of us are spending that time working in our districts, going to community meetings, and being most visible to constituents, something which he value. Here i completely agree that when there are broad issues before the country like gun violence, like the zika crisis, for the majority that has a responsibility to govern, to recess with all of these things unaddressed is deeply irresponsible and i think it reflects poorly on congress. If you throw up your hands, though, and say the majority isnt going to allow us to be on the floor in regular order so we are going to take over, then you leave. And i hear you say you work at home, certainly i understand that, being home, talking to constituents is important. When it comes to this issue on guns, are you better off being at home as individuals or better off being in washington, doing something thats getting a lot of attention maybe where you could bring awareness to the issue than disbursing and it goes away. It is a fair strategic question. But the decision was made, i think probably the right decision that over time attention on the press of what we do on the house floor would dissipate over the recess because the republicans wouldnt be in town, we wouldnt be able to pressure them during the course of ordinary business. So i think it made more sense frankly to come back strong when we resume rather than have the protest the next couple weeks. We intend to take it up again and fight for that vote. I think whats most distressing to the country is if the republicans think it is bad policy as they say, they ought to have the guts to bring it up and vote it down, but they want to hide. In the middle of the night, they ran to their districts and left all of this Unfinished Business. What does it look like when you come back, will we see this again . We will see this again. There will be another sitin . If necessary, yes, a continuation of this. We are insisting on getting votes on this and think the majoritys position is indefensible. What do you think, gloria, first, i want to ask you about donald trump talking about his cabinet, about saying i am going to rule this out long before the election. Obviously that would make his cabinet members targets months ahead of when they normally would be. Do you think this is ignorance about the process or him saying i have serious people to be part of my organization. I think he is trying to beef up his political resume, if you will. We dont know whether he is definitely going to do it or not. He seems to think it sounded like a good idea, wasnt sure if anyone had done that previously, but for him on one hand, he might say okay, these are the really smart, talented experienced people who i want to put in top policy positions. When you havent been in Government Service before and you dont have a government record, you know, that might be an advantage. But as you point out theres a real flip side to this which is that these people also become targets and their credentials are looked at and pored over by those of us in the media. Critics can pounce on them. So, you know, double edged for him and he has to make a decision about that, the same way he makes a decision about picking his Vice President , and when he lets that out of the bag, right . Because anybody who is attached to any candidate, donald trump or anyone else, is going to be picked over. You know, in this case, it could be an asset, we dont know. Do you think, david, theres enough to gain for donald trump to do this . Well, yes and no. I agree with gloria, he is inexperienced, the press picking over his selections, potential selections, it sort of gives him a chance to change the conversation from the last few weeks where he has been criticized as not as serious a candidate as he needs to be, including members of his own party. I think it is a way to pivot. Down the road now he is going to be judged based on some of these selections. Do we get the sense this was something he was trying to purposefully roll out or i want you all to weigh in on this, or something that seemed to appear. Think about one specific example. Chris christie is obviously a big supporter of his, former u. S. Attorney, a candidate for attorney general. Suppose he said tomorrow my attorney general is going to be chris christie. Chris christie is currently under investigation by the u. S. Attorney in new jersey. How can you say that your future attorney general is someone who may be the boss of the person or any position. The complexity that would occur if he started to name people. And by the way, im not sure the people who he would want to name would be dying to have their names out there for eight months being targets themselves. Especially because everything donald trump says going toward all of those having to comment, this statement. It seems like most things are not that planned out in advance by donald trump. What do you think, jeff, about his trip to scotland. Its interesting, the cnn, orc poll, 7 in 10 say he should step down from his business interests if he is going to be president. That should be his business interest. Do you think theres enough pressure to do that or what does that look like Going Forward . You hear him talk about polls. I would like to hear his reaction. First of all, he has relinquished a lot of day to day activity of his businesses to his daughter and sons in one respect. Hes not as in control of the empire as before. Beyond that, i dont think he will. This is who he is, his brand. He loves to appear at his places. The real question, republicans wonder why isnt he in battleground states, he seized, secured the nomination, hasnt traveled as much as they hoped he would. Giving a speech this week in new york city, go to the battleground state. Thats why he wonder at the comfortably leave trump to your. You cant win a general election from fifth avenue in new york city, you cant. Some of the rules havent applied to him, this one, you think it does . And particularly in terms of tax laws and all of the rest, you know, when youre in real estate, when youre in branding, whatever it is, anything that portends to business is going to effect you, by the way whether you run it or whether your children run it, you know, there are going to be questions raised about that constantly. The Trump Campaign is trying to keep in good contact with delegates, clearly they want to stop any disgruntled delegate from maybe not having a person to talk to on the campaign, then going to the convention and sort of pursuing this stop trump movement. Are they really worried about a coup . Theyre not worried about a coup necessarily but dont want the optics of a coup, that would be as bad as a coup. He was good about calling people on the phone, delegates, directly. Paul manafort has a good hand on that. Chances are slim of something happening. Another policeman is acquitted of all charges in the death of freddie gray. This time the driver of the police van in which gray was riding when he suffered a fatal spinal injury. Tell us more about the verdict and whats the reaction there . Reporter well, the reaction is mixed as you might expect. Seven different charges, officer Caesar Goodson the driver of the van was charged with, seven acquittals, seven not guilties read in court. While those were being read out, over about a half hour, goodson stared at the judge, didnt move at all. His family in the courtroom was crying as each of those came down. At the end of it all, the last not guilty, one of the other officers acquitted stood up and said yes, and they shook hands. On the other side, Marilyn Mosby, throughout the entire time, shook her head, put her head down, couldnt believe what she was hearing from the judge at that time. From the gray family, were getting some sense from their attorney about how they are doing after this verdict. Can you imagine how hard this has been for this family, particularly freddies mother, it has been very difficult. Can you imagine losing a son under circumstances shrouded in secret. Nobody has found culpable for something that somebody did. Reporter the big question here is what next for the other officers. Four other officers still face trial here. They couldnt get any conviction, not only on the Second Degree murder but misconduct in office, the lowest charge today. If thats the case, many are questioning can they get a conviction for any of the officers. The next trial is due to start july 5th, lieutenant brian rice. Lets talk to senior legal analyst jeffrey toobin, former federal prosecutor. You heard migel, Marilyn Mosby was surprised. I know you were not. These cases have been a fiasco. Prosecutors win about 90 of trials. Theyre now 0 for 2. No convictions at all. Remember what happened here. Marilyn mosby announced charges within a few hours of freddie grays death. There was no extensive investigation. These cases were weak, they were bad cases. We know that freddie grays death was a tragedy but whether it was a crime, so far Marilyn Mosbys office failed completely. If her office failed to prove that with what you know of the evidence, should someone be held criminally responsible for this . Im not here to convict or acquit anyone. All i know is that the two best cases she brought, remember, there are six cases. These were the two strongest cases supposedly, especially the current one, theres been no conviction. It is very hard for me to imagine how the weaker cases will persuade a jury or judge at all. Three more left. Well see. It sounds like the outlook is not good. The outlook is poor. Governor Robert Bentley apologized to the people of alabama for some of his actions but denied having a physical relationship with rebekah mason, 30 years younger than him. Tonight, new information on the stress this family, his family, went through during the scandal. Tonight, the besieged governor of alabama is battling his political enemies, a broadening sex scandal and his own isolation. New details on governor Robert Bentleys alleged affair with his former aid, rebekah mason, revealed in an article in gq magazine. According to gq, his wife took notes on his stand off behavior toward her. It led to her recording a conversation, where the governor is heard speaking to mason. Then he accidentally sent his wife a text with the red rose and the word rebekah. She told her grown sons about her suspicions. They decided to confront her by going to her parents, showed up on their doorstep and confronted them, her parents were taken back, and they called her and there was a confrontation then. Reporter a former Law Enforcement official says he warned him in vain to break off the alleged affair. Governor bentley called me and stated he could not go through with it and end the relationship with miss mason. Reporter even the governors staff tried hard to shield the d the governor wasnt as careful. People told me he would rest his hand on Rebecca Masons hand on his thigh. Gq reports he bought a pickup truck and his Security Officers would sometimes catch up to him alone at a pond where it was assumed he had been with mason. Bentley now accused a former state Law Enforcement officer of using state resources to cover up his relationship. The governor admitted to inappropriate relations but he and Rebecca Mason denied an affair. I have never had a physical affair with mrs. Mason. I can assure the people of alabama that as their governor, i have never done anything illegal. But tonight, there are impeachment proceedings pending against governor bentley. His wife diane divorced him last year, and gq reports he is completely alone in his governor mansion. He hasnt met his most recently born grandchild. Neither the governors office, mrs. Bentley nor Rebecca Mason have responded to cnn inquiries. We reached one of the bentley sons and he hung up on us. The former aide, Rebecca Mason, also married, was married at the time of the scandal. Have she or her husband said anything . They did not respond to our inquiries, but about three months ago, when that phone recording was made public, she said she loved her husband, quote, dearly. Her husband john also posted a statement on social media at that time saying he, quote, long ago resolved the personal issue that was playing out. Interestingly, professed his love and admiration for his wife and called for people to support the families involved and called for people to support governor bentley.
