Lets begin with our pentagon correspondent, barbara starr. She has the very latest. Reporter tonight yemens capital sanaa is still on edge with violence and uncertainty but for now, at least for now, the state department is holding firm no immediate plans to evacuate the embassy. Even as Houthi Rebels surround the president ial palace in sanaa, the u. S. Is uncertain it can or will work with the rebel group. For now, the assessment the Houthi Rebels are not antiamerican. But what happens next is the question. The u. S. Says president hadi is still the leader of yemen. He and the rebels appear headed towards some type of agreement. That has led the state department to hope it will not have to evacuate the embassy just a day after an embassy car was shot at. Our personnel are well protected. We have strong and multiple security personnel there. We have been building that up over a period of time. Reporter but not everyone agrees staying put is a good idea. I think we ought to get our people out. I dont want to see a hostage situation. Reporter the fate of the u. S. Embassy, just one crisis point for washington in yemens unraveling. We cannot permanently disengage with yemen so i think that we should be constantly evaluating. Reporter the u. S. Worry, with no clear control by president hadis government the u. S. Risks losing its partner in the fight to stop al qaeda in the Arabian Peninsula. The Obama Administration has been trying to increase counterterrorism funding to yemen. Since 2006 more than 400 million has gone to training yemens Commando Forces helping improve its air force surveillance capabilities as well as coast guard patrol forces. Even before the houthi takeover the violence in yemen had made it impossible for much of the cooperation to continue other than drone strikes against al qaeda fighters. Many u. S. Officials point out u. S. Embassies in libya, syria and somalia have been shuttered due to ongoing threats of terrorism. The state department for now doesnt want yemen to be the next. We believe it is in our National Security interest to have a presence there, and a strong presence there, which is one that we continue to have. Reporter but make no mistake, tonight two u. S. Navy warships are still offshore ready to go if an order was to come to the pentagon to evacuate the embassy. There are other ships nearby as well right . Reporter there are other ships nearby just in case. The pentagon is saying they will take their cues from the state department it will be up to the state department to decide but we also know president obama is getting regular updates, regular briefings, about the intelligence about what is going on in yemen, and the potential risk there to the u. S. Embassy. Wolf . Thanks, barbara starr. Lets go to yemen. Our Senior International correspondent, nick patonwalsh, is the only Tv Correspondent on the ground in yemen. You had a chance to check out the president s residence today. What did you see there . Reporter after all the dealing we have heard in the last few hours and which effectively it seems the houthis have agreed to pull away from the key buildings like the president ial residence we were at this morning and the president ial palace they overran yesterday, in exchange for releaseing the chief of staff of the president , they will be able to have a hand in rewriting lots of the new constitution that was supposed to come in and get their hands on power, too. But really power seems to be being decided on the streets today. There are many cabinet official levels absolutely concerned this is a terrifying precedent, frankly, for the future of yemen. Around the president ial residence as you see there, we were talking to the men on top of the tank these young houthis, very young, some of them a bit dazed by the power they seem to have got on the streets, about who is the president. One of them as you saw there just pointed to himself, the people are the president. Now of course president hadi is still president on paper, still president frankly in the eyes of the houthis but the houthis it seems have managed to craft a very powerful political compromise here which some are concerned leaves hadi has a figurehead but the houthis really controlling the shots here. That must be concerning for washington because as barbara mentioned, they are pro iranian. They are not necessarily out to harm the u. S. But they may have different designs on the level of cooperation yemen has with washington. Wolf . One of those houthi slogans, very popular with the houthis, death to america. As you know the Yemenbased Al Qaeda in the Arabian Peninsula, they released a chilling new video. You are there on the ground for us nick. Tell us about this video. Reporter this video was released a few days ago and it doesnt really directly address the paris attacks but does call for more lone wolf attacks, it does suggest in fact that if somebody has a desire to carry out attacks against the west against the infidels it is better if they can stay in those western countries and carry out attacks there rather than leave the country and move themselves away from the infidels they so despise so an overt call for lone wolves across western countries to stay in place and launch attacks. Thats deeply terrifying for many western agencies because they saw the Charlie Hebdo attacks. They are still trying to assess how close the kouachi brothers were in yemen, how much preparation they had here and how much dance they had when they went back to france. He goes on to say in that particular video you are seeing goes on to say that in fact they have had a success now, the level of campaigning means 60 embassies have been closed around the world. Clearly, aqap keeping a tally of the impact of their actions in this region and other regions, too, and how that limits the u. S. Diplomatic capability in some areas. We do know they are concerned here but i should point out, evacuation seems pretty far off. The embassy here has been on low footing in terms of staff since september, only essential personnel, heightened security profile. Frankly, it will take a lot for them to be calling the u. S. Even as the United States worries about al qaeda growing stronger and stronger and the chaos of yemen, there is also a chilling new threat emerging there with potentially grave implications for the United States and its allies. Toronto we arenight we are told isis has established a presence inside yemen and has already engaged in at least one fight against its rivals from al qaeda there. If this escalates, it could further destabilize that key u. S. Ally in the war on terror. Disturbing new information tonight on the most dangerous terrorist groups taking advantage of the chaos in yemen. Cnn has learned isis is now active and recruiting inside yemen, according to a yemeni official who says isis militants engaged in a gun battle against rivals from al qaeda in the Arabian Peninsula, in the eastern provinces of yemen last month. Isis may be in yemen to compete with the Al Qaeda Group there. Yemen is significant in islam. It is a place where we have seen attacks against the United States. It also has been a major feeder for foreign fighters. For years, al qaeda in the Arabian Peninsula has dominated the terrorist foothold in yemen and the yemeni official says aqap still far outnumbers isis there with hundreds of fighters compared to dozens for isis. A u. S. Counterterrorism official tells cnn aqaps leadership and key technical experts remain committed to plotting against western targets. In a new video, a top aqap leader renewed the groups call to launch attacks. I think the target as we unusually saw is going to be the europeans simply because of their ease to get on to the continent but ultimately their aim is the United States. A u. S. Official tells us american intelligence is working intensively to track aqaps leaders. The most wanted . Aqaps founder, the man who approves targets and orders attacks. And the groups master bomb maker, who is behind the Christmas Day underwear bomb plot and the attempt to place bombs in printer cartridges. Both attacks targeted the United States. Both almost succeeded. Once a body was placed inside a body in an attempt to kill saudi arabias interior minister. He detonated it in a meeting where he was in theory surrendering to the saudi prince. This was an assassination attempt that failed but it illustrates the length to which somebody like him will go to try to achieve the target. Now officials and analysts worry aqap and isis will compete inside yemen to see who can strike america and its allies first and hardest. They could lead an attack against the u. S. Embassy in sanaa which is vulnerable. It could also direct its attention north ward to saudi arabia. The foothold isis has in yemen is still very small, according to the yemeni official we spoke with but isis is trying to lure recruits from aqap, promising them that isis has more money to fund operations. We are told aqap is struggling to raise money right now. Brian, you have also received some new information on how Aqap Al Qaeda in the Arabian Peninsula which is based in yemen, has changed its tactics recently right . Thats right. The yemeni official says aqap responding to the pressure its under from u. S. Drone strikes and from Yemeni Forces is now operating in smaller cells, dispersing its fighters more. Its main tactics now are targeted assassinations of yemeni officials and houthi leaders. Brian todd reporting, thank you. The stakes clearly are huge in yemen. A lot is riding on this socalled tentative deal especially the u. S. Led fight against al qaeda. Joining us now is the spokesman for yemens embassy here in washington mohammed al bashr. What do you make about this notion brian just reporting that isis in addition to aqap isis is now on the ground in yemen, sort of competing with al qaeda for influence, for prestige for recruits. Isis started recruiting a few months ago. They are competing with aqap. This is not new information. Its been going on for months. But things are getting more intense, especially with the recent events in the capital sanaa as you have been reporting throughout the day. The situation is fluid, its critical. The government was paralyzed, parts of the government was dysfunctional but we did not reach the point of no return. Things are difficult but there are things that are moving forward but isis is operating in yemen, aqap obviously is operating in yemen. Yes. These are the two big threats to the United States. Yes. I dont think a lot of Americans Care if houthis are involved in yemen or whatever. They are worried about al qaeda. They are worried about isis and they should be right . Americans should care about the houthis because the houthis are now a component of the yemeni political structure and its also a component thats challenging the government at times and we need to figure out a way for both the houthis and the government to coexist and work together. Is it possible . It is possible. Today we inked an agreement, the president with his advisors and the houthis, nine to ten point agreement which will give them access. But that just adds to a disarray of the country. Yemen has weakened economy and political upheaval. Aqap is very active. Personally my family were affected by an extended relative was executed pointblank in the military hospital. By aqap . By aqap. By a foreign militant. How do you know these isis socalled terrorists who are now in yemen are really isis . They are promoting themselves of isis. Its the rebranding of a new militant group. They are understanding, they initially started recruiting from inside aqap ranks and now they expanded and try to recruit from tribal areas. There are diplomats, military expatriots, private citizens working for ngos in yemen right now but there may be more than that right . Yes. How Many American citizens would you estimate are in yemen right now . There are hundreds if not thousands of yemeniamerican citizens. In addition to diplomats and military . These are dual nationals. They are u. S. Citizens from the u. S. Perspective, they may be yemeni citizens as well but they are also United States citizens. When you say thousands, how many thousands of yemeni americans are there living in yemen right now . Our estimates is around quarter of a million yemeni american citizens. In the United States. We are not sure who is now in the country and who is here in the u. S. They travel back and forth freely. So theres a quarter of a million dual citizens. I assume most of them are here in the United States but youre saying there are several thousand who are in yemen right now. The state department would have better statistics because they are the ones who ask the yemeni the american citizens in yemen to register with the state department. How safe are these people . Is it time for the u. S. To get them out of there . Today, we have a bold new opportunity for us to work with our friends in the international community, particularly the kingdom of saudi arabia and the United States. This is not the time to back out and leave. We may not have tomorrow. Because of this sentive dealtentative deal with the houthis . But the saudis dont like this deal do they . They dont like the houthis. A lot of people dont like the houthis at this point but like i said earlier, they are now a fact of life. They are now a dominant force in many of the northern provinces and wleee will have to coexist and live with them. I want you to stand by. This strategy of taking out terrorists who threaten us while supporting partners on the front lines is one that we have successfully pursued in yemen and somalia for years. That was only a few months ago. That doesnt seem to be so successful this operation right now. Somalia, the u. S. Had to shut down the embassy, get all americans out of somalia and theres a potential that could happen in yemen now too. I think president obama was mentioning yemen in the context that u. S. Had minimum footprint, boots on the ground was very limited to marines protecting the embassy and advisors helping the Yemeni Military equip and train. Thats the difference. There are hundreds of u. S. Military personnel on the ground in yemen right, not just 100 marines who protect the embassy but a lot of others who work with yemen, these drone strikes, they target for killing al qaeda suspects and others. There are a lot of American Military personnel on the ground. I dont have the exact number of u. S. Personnel that are linked to the u. S. Government on the ground but its fair to say with the diplomats and advisors and ngos that it could be close to 100. Close to what . To a hundred. 200 . 100. In addition to the hundred marines, you mean . I mean the entire staff at this point i think its safe to say youre just talking about diplomats or diplomats and military . And staff. I think its a lot more. Thats what ive heard. We can doublecheck that. Obviously they are in a very vulnerable situation. Senator angus king raised the possibility this morning when he was on cnns new day the great fear is that many of these americans could be taken hostage. Thats a real problem, isnt it . U. S. Embassy in sanaa is very well protected. Forget about the embassy. What about the americans outside of the embassy . Most of them are in the u. S. Embassy and in the residence for the u. S. Embassy which is in the same area. So they are very well protected boy Yemeni Forces and theres enough security personnel but the Yemeni Forces cant even protect the president of yemen. The chief of staff has been taken by the Houthi Rebels. What happened with the chief of staff with the Houthi Rebels and what happened with the president ial palace this falls under this deeply rooted political crisis which has been going on for some time. I think the u. S. Presence in yemen is not really related to the political crisis at this point. If there is a deal between the government and the Houthi Rebels the saudis hate that what do they do . I think its the best thing for the saudi government to continue supporting president hadi. Hes the legitimate constitutional leader of yemen and the Prime Minister and chairman for the council. So without the saudi support, yemen put it this way. Yemen will become a failed state. Some people say it already is a failed state. Its not yet a failed state. Yemen would be a failed state not because of terrorism or political upheaval. Its not going to be because of the current situation. Yemen will be a failed state if the economy collapses. If the economy collapses, theres no turning back. This is a golden opportunity for us to work on and we have reached so far with the transition process, we are inching towards finishing the Constitution Holding referendum and general elections and the people of yemen will decide who their next leaders will be. Heres what worries the u. S. In particular. There is a bomb maker for Aqap Al Qaeda in the Arabian Peninsula, who is on the loose right now. Hes at large and apparently hes giving instructions on how to build hard to detect bombs to take down aircraft right . Yes. Why is he so hard to find because i know your government has been looking for him, u. S. Has been looking for him. If the u. S. Had an idea where he was, they would send a drone over him with a hellfire missile and kill him. Aqap and the bomb making capabilities they worry us more than just the americans. The same day the Charlie Hebdo attack happened and 12 parisians were killed Police Cadets were brutally killed. Yemenis are being killed day in and day out by aqap and their supporters. You saw this new video they released today saying to people around the world you dont have to come here just go ahead and kill americans. They are promoting the lone wolf tactic. This is something that its very troubling but al qaeda is a mutual enemy and we are going to continue working with our regional allies with the u. S. An urgent call to Emergency Services reporting a woman quote stabbed in the head. Witnesses and police say the attacker boarded a bus in tel aviv stabbing the driver and several passengers before fleeing on foot. As passengers scrambled out, the assailant runs from the scene. Dramatic video shows him stabbing another woman who falls to the ground. In all, nine wounded, four seriously. Before he can make a getaway, the attacker a 22yearold palestinian from the west bank is shot in the leg and cuffed by two Prison Authority guards before he was arrested and interrogated by police. Moses collins said he already is haunted by what i heard coming from the bus. A lot of shouting a lot of shouting for police, for ambulance. Its not something easy to see. Ten people plus stabbed and a lot of, lot of, lot of blood. Reporter in calls to Emergency Services victims make desperate pleas for help. One woman says she was stabbed in the back and is covered in blood. The family of the attacker told cnn and israeli authorities he is not affiliated with any groups and was driven by the suffering of palestinians killed by israel during last summers war in gaza. Last november two palestinians stormed a jerusalem synagogue with butcher knives, killing five jews. One line of inquiry thats emerging is that he may have tried to fake his own death last year. The families have said that in october they received word that he had been killed in syria. Of course that turns out not to be true because he then went on to greece to be the ringleader in this plot in belgium allegedly. So very interesting live inquiry that he might have tried to fake his own death to go off the radar screen so that he could move across to greece and direct this plot. Guys everybody stand by. New reports paint a terrifying picture of the final minutes before the airasia jet crashed with cockpit alarms going off as the jet fell out of the sky before crashing into the java sea, killing all 162 people on board. Lets bring in our national correspondent, suzanne malveaux. She is getting new information. What are you learning . We are learning today that indonesian Officials Say the cockpit voice recorder reveals alarms and warnings that were going off indicating that the plane was possibly stalling. The flight data recorder contains the planes speed and altitude during that time. It reveals a steep climb and then a descent. So earlier today, i got into a Flight Simulator to learn firsthand what might have taken place in flight 8501s last moments. In the terrifying last moments of airasia flight 8501 sounds of alarms going off in the cockpit can be heard on the planes black boxes, according to the indonesian transportation minister. At first, the plane rapidly climbs at a rate of 6,000 feet per minute. Passengers would have been driven down into their seats. They would have felt very heavy. They would have felt like they weighed twice what they do but they wouldnt have blacked out. Reporter seconds later, the aircraft stalls then starts to fall. In an a320, a stall warning sounds like this. Stall stall its descending 1500 feet within six seconds, so the flight keeps descending faster until the point of 24,000 feet and radar cannot detect it. Reporter at that point, flight 8501 crashes into the java sea. Just pull back. Reporter using a Flight Simulator, flying instructor kirk tucker of freeway aviation shows me what happens when a plane stalls. Okay. This is the stall . Thats the stall warning and now regardless of how much we pull back we cannot get the airplane to stay flying. So now we have to push down. Reporter this is unnatural, right, for a pilot to put this nose down towards the ground to get out of a stall . That requires training because its pretty scary. It does require training. Its a little bit counterintuitive. Reporter tucker says the treacherous weather could have made recovering from the stall impossible. Its not uncommon to get svere updrafts inside of a thunderstorm or Something Like that where it can be very disorienting to the pilot. Reporter the biggest piece of wreckage is at the bottom of the ocean where investigators suspect many bodies are trapped inside. Bad passenger continues to make the recovery effort difficult. Translator still quite high wind speeds out there, ten to 20 knots and waves two to three meters high. We can dive but its hard to reach the sea bed. Reporter the head of the National Transport Safety Committee tells cnn the preliminary report on airasia flight 8501 will be issued next week 30 days after the crash, as required by the Civil Aviation organization. Its not going to be made public. Only the final report must be shared. Investigators, they have up to a year to complete that. A lot of unanswered questions. A lot of the recovery work to find the bodies too. Many of them. Thanks very much. Joining us now our aviation correspondent richard quest. What might have caused this plane suddenly to start climbing six to eight times the normal rate . Is this potentially a mechanical problem in an air bus a320 . There are so many flies around the world right now . Reporter we just dont know. It could be an updraft. We know the pilot had requested permission to climb. So you could end up wolf with a combination of events. He could be doing a commanded climb as the same time as you get an updraft. There could be all sorts of reasons. It does seem highly likely that the climb is related to the stall and a drop in the speed which, of course eventually takes the aircraft out of the sky. What we heard in suzanne malveauxs report about stall warnings we heard similar things in many other incidents notably air france 447, wolf where the plane was climbing it stalled, we heard the warnings and the plane crashed. This sounds very similar to that air France Flight 447 with the stall. You see a similar scenario unfolding . Reporter in a sense that if it is a stall, you are talking about a High Altitude stall. The plane is flying in the cruise. The pilots are commanding an altitude increase climbing. The plane loses speed. This is very unusual, wolf. Lets put this into full context so passengers righthand concerned about this. High altitude stalls or High Altitude are very few and far between. The margin for error is much tighter than it is further down. So this is why this is so serious, this incident. This is why, frankly, listen to what suzanne was saying im staggered tonight that the indonesians are not prepared to release the preliminary report. They dont have to release it. But it was released in 370, it was released in 17, the ntsb releases. Theres no reason or justification for not releasing the interim preliminary report. The indonesian transportation minister says the pilots voices were drowned out by the sound of the alarms including the one indicating the plane was stalling. Why was there no may day calls if there were warnings something was wrong . Reporter because there would be no need to wolf. At that particular time if the aircraft is stalled and you are falling out of the sky first of all, you are concentrating remember the old rule, afshnavigate the plane. Theres no purpose. Theres nothing the ground can do other than maybe clear airspace. This particular point, you are talking about an aircraft that is in extreme. The end is close unless they do something very fast. Even then it might not be possible. So wolf, you are not looking at doing a may day. You are talking about just flying the plane. You had a chance to speak with tony fernandez, the airasia ceo about the moment when he found out the plane had crashed. Let me play a clip from your interview. A lot of these groups they are competing for power but they are competing for the same group of fighters here. Its possible that a fighter can be loyal to one group but also supportive of the other group. With the exception of the Yemen Government, which is in tatters, seep s tatters, seems to be on the verge of collapse they made the United States. Another group taking advantage of the a failed state. You see in yemen, you see libya becoming a haven for these groups. Its a problem going forward. Thanks very much. Breaking new, in the paris terror investigation, cnn has learned that the terrorists appear to have urged about Six Associates to leave france before the plot was carried out. Reporter wolf the concern among officials i have been speaking with is that the associates of the paris suspects could pop up in isis propaganda videos or even worse, be recruited to attack the west. This as we learn more about the four suspects in custody here in paris. Today for the first time the paris prosecutor is identifying four suspects charged in connection with the paris attacks whose dna was found on Amedy Coulibaly car, gun and glove found at the crime scene. But the Prosecutor Says authorities are still investigating whether the four suspects were actually complicit in the attacks. He says we think that there is a group of individuals who contributed and that this has effectively served the terrorists to commit the attacks. Its the others on the run, suspected cohorts of Amedy Coulibaly and the chowkouachi brothers that have authorities on on edge. They urged associates to leave france before the attacks, including Hayat Boumeddiene, believes to be seen here in video with coulibaly over the summer walking by a Jewish Institution in paris. Sources close to the investigation believe they were scoping out jewish sites leading up to the attacks. A Law Enforcement source tells cnn, the concern is they could be hiding in the safe haven of syria. Soon try to attack the west. Meanwhile, two weeks after the attacks, paris remains under heightened security with soldiers and police guarding landmarks and jewish sites. He said 3,000 people need to be under surveillance and the number of people linked to Terror Networks in iraq and syria has jumped 130 in just one year. Another jihadi hot bed, bellgianbelgian. They raided a home at the request of french authorities, part of the wider Anti Terrorism investigation. This as the manhunt continues for an operative, abdelhamid abaaoud. They believe he was directing a plot from greece that may have included attempts to murder Police Officers. On the other side the government has to allow a rewriting in some degree we dont know how significant, but substantial under the text of the agreement, of the new constitution of the hauthis objected to. They have to let them have key figures in government and they have to give the hauthis concession in the province east of the capital where there have been clashes. A substantial concession from the government. We dont know whether or not the president is is in alone or will retain some sort of hand on the levers of power here. Nick tell us about this new aqap this al qaeda video that was released today telling its supporters dont worry about coming to yemen where they are, just kill americans in particular. Reporter this was recorded ahead of the paris attacks but is being pushed out again as al qaeda in the Arabian Peninsula try to reinvigorate their following around the world sick sickening after they claimed responsible for Charlie Hebdo. This message is stark. It says you may be im paraphrasing. You may be depressed, but you may want to leave. Dont do that. Stay where you are and launch attacks against the west where they are. A remarkable call for a lone wolf people who share this kind of idea not to seek to leave but stay there and cause Violent Attacks there. It goes on the spokesperson we saw in the claim for responsibility for the Charlie Hebdo attacks, he goes on to say that they believe they have managed to close 16 embassies through what they refer to as external work, operations against the west. And basically says that the incitement will stop the severity of the disbelievers. A troubling message there from the spokesperson for aqap. They feel they are on the front foot and encouraging people to say where they are and cause attacks in the west rather than try and leave. Thats very, very disturbing. Thanks very much. How worried are you about this new al qaeda video telling people out there, their supporters dont worry about coming here stay where you are and kill westerners kill americans . I think you hear the president of the United States talk last night about how committed we are to taking on the threats of terrorism around the world. Its not just al qaeda. Its isil. Its boko haram. But certainly were not only aware and concerned, its one of the Top Priorities of the administration to fight this terrorism, to work with partners around the world, including the Yemen Government. When you have groups like isis and al qaeda competing with each other now for dominance, if you will that makes these terrorist organizations even more dangerous, doesnt it . Well theres no question its a sick race to the bottom wolf. I dont have any conferirmation of the level or success of recruitment of isil in yemen. But i can tell you that our partnership with the Yemen Government oncounterterrorism which is ongoing, is something were focused on taking on all threats of terrorism. Aqap has a large presence there. But any threat any counterterrorism threat is one we will work on. We heard the spokesman for the Yemen Embassy tell us there are hundreds of american diplomats, official americans in yemen right now but there are nows of u. S. Citizens many of them yemen american dual citizens there right now. Here is the question. Are they safe . We dont get into numbers because we think it puts the men and women serving at risk. We understand there are a lot of numbers out there. I can tell you that one of the Top Priorities of the president of the United States the secretary of state, everybody who works in this building that im in right now is the safety and security of american citizens. We weigh that very very heavily. But we look at a range of factors. Thats a conversation thats ongoing. Were not just monitoring it. Were discussing internally the situation and what the right steps are. Nothing has changed at this point in time in terms of our presence there. Why does the evacuation proposal stand right now . We know there are two u. S. Ships right off the coast. How close are you, the state department, to ordering an ee evacuation of all american diplomat diplomats . We always have to be ready. Theres a lot of violence right now. Theres a lot of tension. Its our responsibility to take every step necessary as a government to be prepared. But we have not changed or made a decision to move forward with an evacuation. Obviously, we continue to discuss internally what the right steps are. You talked a little bit about steps that were taken, a tentative political agreement. Obviously, thats a positive step. Implementation is key from here. We will work with the government and see if we can move forward a more peaceful path on the ground. The leader of the opposition labor party, they are upset about this. You understand the concern that this could be seen as interfering in israeli poll lickitics . The Justice Department here in washington is moving toward recommending that no civil rights charges be filed against the former Police Officer Darren Wilson. We are joined by the New York Times reporter michael schmidt. Thanks for joining us. Michael, tell us what you have learned about this justice this is major a major development. What exactly have you learned . Prosecutors at the Justice Department have begun putting together the legal memo to basically rationalize why they are not going to bring civil rights charges against Darren Wilson. Its a high bar to make one of these cases. You have to have some of his mindset. He has to prove his history of being of having racial issues. The evidence here does not support that. It seems like they moved quickly. Well the fbi really pushed hard in the days after the shooting. They sent about 40 agents into ferguson. They interviewed 200 people. They found no real evidence to support the civil rights case. Thats where where he. Joey jackson, what do you think . Are you surprised . Im not surprised for the following reason wolf. In any case what you do is you examine two things. You examine the law and the facts. Remember in a civil rights prosecution, the bar is extraordinarily high. You have to show an intentional deprivation of a civil right. What is that . The right to remain freely. When you look at the statute and when you look at the jury instruction, it says you have to act willfully, motive of an improve purpose with malice and with wickedness. As a result of that it would be problematic if at the state level you cant get an indictment to show at the federal level that you would be able to move forward. It doesnt surprise me. The other thing, when you look at the facts of it remember you have to show intent not recklessness, he was reckless or careless in his actions. When you have conflicting facts come out of the grand jury were the hands up down . Did he grab for his waist band . What kind of interaction was there at the car . What did that lead to . Based upon the many questions and based upon the standard of that i discussed beyond a reasonable doubt, it would be very difficult, wolf to move forward federally with a civil rights charge. Antonio, you are there. How is this going to play the reaction that were likely to see in st. Louis county and ferguson and elsewhere . I think you have a lot of people who will be disappointed if this does turn out to be the case. The community and the family wanted a day in court, an opportunity to see the evidence laid out. It looks like thats not going to happen. I hope we dont have violence as a result of this. The next steps i think are legislative change try to make sure that in cases like they with get a special prosecutor by law and to create a new level of civilian oversight over Police Departments. I hope it remains peaceful. We are seeing video from st. Louis county. Police are looking for 180 suspects who looted a store. Could we see more chaos, anger if wilson doesnt face charges related to Michael Browns death . I hope not. People have a right to protest. We will probably continue to see that. Thats a good thing. But we want to keep them peaceful, nonviolent because violence makes the situation worse. It divides the community in a time we need to come together and make everyone feel like they can get equal protection. Tom, you are not surprised by this decision assuming the New York Times report is accurate . I wouldnt be surprised, no. I think that in this case you have as mike mentioned an intensive investigation. The discussion is actually made by the Civil Rights Division attorneys in washington from the department of justice. They are looking at what it takes to bring one of these cases forward. Its a difficult case to make. As you know, the president in the state of the Union Address, he had pointed words. I will play the clip and we will discuss. We can understand a father who fears his son cant walk home without being had arassed. We understand the wife who wont rest until the Police Officer she married walks through the front door at the end of his shift. Surely we can agree that its a good thing that for the first time in 40 years, the crime rate and the incarceration rate have come down together. Use that as a starting appointment for democrats and republicans, Community Leaders and Law Enforcement to reform americas criminal Justice System so it protects and serves all of us. He was walking clearly a very delicate line trying to make sure that everything he said was sensitive and important. When you heard him say that what was your reaction . I said bravo. As awful as these events are, at some point, as you have heard me say here wolf we all have to sit down and talk about it. He is saying at this point, at least were at the point where we can have some sort of discussion where there is something positive that can come out of these terrible events and that the Justice System and Law Enforcement can be changed in ways they need to be changed. I was also very happy that he mentioned a father or a mother who are worried about their kids being harassed as they walk home and he mentioned Police Officers because thats a very real thing for the Family Members of Police Officers. They worry about their loved ones not coming home at night. Im glad he did that. I hope there is no violence. They would have to march on washington rather than ferguson. Because the decision came from washington. When he said those words, we can understand a father who fears his son cant walk home without being harassed. He meant being harassed by police . Thats what he meant. Listen parents worry about their children being harassed by a number of different events or people. But he meant by Police Officers in that particular case. Joey jackson, the federal investigation isnt over. Theres a broader civil rights investigation into the entire Ferguson Police department. Thats open . Thats right. In addition to the actual civil rights violation that was pointed to Darren Wilson there was a broader pattern and practice issue. What does that mean . It means that they will look into whether or not theres a pattern or practice of excessive force, were they stopping people of color in disproportionate numbers . Exactly what is going on in the Police Department . I think based upon that we may or may not see structural changes within that organization moving forward so that its more inclusive and practices are carried out in a way that i think would make that community a little bit more secure a little bit safe and a little bit more trusting of the Law Enforcement officials. This broader civil rights investigation, this could go on for a year or two or even three, right . These things dont go quickly. It could. Frankly, i would like to seat department of justice expand this beyond ferguson. Ferguson is a very small municipality in st. Louis county one of 90. Dozens of municipalities have similar circumstances and the same patterns they target young africanamerican men. What are you hearing about this broader investigation, michael . Certainly, if theres action thats where its going to be. It will as they were saying take time. But what could happen is they would bring in anticipate outsider to oversee the department and make sure they are not violating the law as they were in the past. You are familiar with the second investigation as well right . That one is not being conducted against officer wilson. Its the patterns and practices of the defendant. Is the department engaged in activity which is violating rights and abusive techniques. Don, you spent a lot of time there. There were 60 Police Officers in ferguson all but two or three were white, right . All but a handful were white. Listen thats an issue within itself. If you looked at Police Departments in illinois as a whole, you will find that they are very similar and across the country in many ways its similar. Not in all places but in many places. But the problem goes beyond that. The problem is also that it is tough to find minority officers. Many people who are minorities have a distrust of Police Departments. They dont necessarily want to be Police Officers. Those who do really have their pick about which department they will join. Would you rather join a Ferguson Police department or a st. Louis Police Department or a new york city Police Department . If you are a minority and you are a good Police Officer, you have really your choice as to which department. They want to have this vote because they know they can get a bipartisan vote on this on sanctions. They can embarrass the president. It works for all of them. By the way, i think they have a right to be. And the question that i have is will netanyahu make a stop at the white house or at the state department . If hes invited. You know this better than anybody, what is so rich about this is that boehner is taking advantage of terrible relations between netanyahu and obama since day one of the Obama Administration. So he is taking advantage of that and, as you said the whole concept of netanyahu coming here will help him back home. That matters because republicans want him in office because hes the guy in israel. I want to talk about something that happened last night. This is so much fun. The president was speaking about equal pay for women. I want to play this clip. Watch this. Thats why this Congress Still needs to pass a law that makes sure a woman is paid the same as a man for doing the same work. [ applause ] you see joe biden, the Vice President , standing. You see john boehner sitting. Even though i assume he thinks if a woman does exactly the same thing as a man, the woman deserves equal pay. You know theres the paycheck fairness act, which was raised before the 2014 mid term elections by democrats. They wanted republicans to vote on this measure. It didnt pass. Republicans dont think its right way to do things. It would give women the right to sue if they discover that their male counterparts are not making as much money. For whatever reason they disagree on this he needed to stand up. Because in theory pay equity is something that i think a lot of republicans support. And its look at that. The republicans are reaching out. They are trying to get more support. They are. On this particular note, what the Speakers Office says is he didnt stand up because he doesnt like the way democrats want to go about it, not that he isnt for equal pay for women. The optics of which when to stand, when to not, its tricky for both parties. On your point about reaching out to women, what is going on right now on capitol hill is fascinating. Great story on cnn.
