Oliver is very british. Henry the ix has a nice ring to it. The president spoke on friday very impromptu. He spoke for nearly 20 minutes like 17, 18 minutes. Cenk thats correct exactly right. Talking about the Trayvon Martin verdict. It was almost an empty pressroom if you have a chance of looking of him walking in and reporters running back in. He spoke, he spoke from the heart, and reminded everybody of the time after the murder of Trayvon Martin that he pointed out that Trayvon Martin could have been his son and he expanded on that. You know, when Trayvon Martin was first shot i said that this could have been my son. Another way of saying that is Trayvon Martin could have been me. 35 years ago. Powerful stuff. He continued pointing out that even the fact that hes president of the United States, and very significant player in politics in illinois, and the United States senator, he, too, had been profiled, and profiled often. There are very few africanamerican men in this country who havent had the experience of being followed when theyre shopping in department stores, that includes me. There are very few africanamerican men who havent had the experience of walking across the street and hearing the locks click on the doors of cars. That happens to me, at least before i was senator. So powerful stuff. Obviously most of White America appears to be outraged by it. Cenk well,. Heresi thought he said Something Else that was interesting. He pointed out that black america gets frustrated. If they feel there is no context, and context is being denied and all that contribute the president said, to a sense that if a white male is involved in this scenario from top to bottom, the aftermath might have been different. I think thats what angered people on the right as he said what were not allowed to say which we all do in private conversations, look, if it would have been a black kid shooting a white kid, he would have been arrested right away. Whenever truth is spoken about racial relations because theyre still strained, and theyre still exist. When you have the conversation someone has to admit that something wrong is going on in our country and america is perfect. Cenk it occurred to me whenever we want to talk about guns after a tragedy they always say too soon, the right wing, they dont want you talking about guns. In the case of race theyre saying too late. We solved it. Dont talk about that. But always the reason not to talk about those things that they dont want to talk about. You mentioned racism and you played the race card even if its in the case of obvious racism or forget racism, thats a trigger word. Racial inequities, racial problems, racial issues, which are important. Not surprisingly, fox news having seconds to digest what the president said decided he was a race baiter and sean hannity one of the least serious people in america had this to say. Now the president said trayvon could have been me 35 years ago. This is a particularly helpful comment. Is that the president admitting because he was part of the gang and he smoked pot and did a little blow, im not sure how to interpret that we know that tradition vontrayvon had been smoking pot that night, what does that mean. Cenk it shows how sean hannity perceives Trayvon Martin, and anybody in his role. Oh trayvon smoked pot so obama must have smoked pot. No, the thing that was similar was that he was profile. Tommy christopher is from immediateimmediate, and he joins us as well. Tommy, its very expected when president obama gave this speech and i remember when we did the online show after the speech here on the young turks, and we said, oh, here it comes fox news, theyre definitely going to do this. Had a do you think . They did do it, sean hannity does attack the president in this way. In the end do we look at it and say, fox news criticizes him they look ridiculous, and so what . Thank god he gave the speech, and it doesnt have a down side. Or am i seeing it wrong and it does have a down side with fox news viewers white folks you tell me. First of all on the royal baby, i would like to get five bucks down on matchelbelum if i could. The fact that sean hannity could not go more than five minutes without telling a lie. The toxicology report showed that a small amount of thc in his system, which meant he was not smoking pot that night. There was sean hannity and a few horrible reactions from the usual suspects, ted nugent, but Chris Wallace came out and this morning Joe Scarborough was taking hannity to task, and john mccain praised the president s speech. I found those things surprising. Like you i listen to people who are critical of the president from the left. He was wrong or maybe he didnt say enough. Its like they hadnt been watching for five years. When the president said something about arresting the guy in his own house, people freaked out. Im surprised the president went as far as did he. He said, im done talking about this verdict. He very pointedly did not saysomebody said, president do you respect the verdict . He didnt say that. He said the trial was professional. Nobody barfed on themselves, they delivered a verdict and thats our system. He pointedly did not say we must respect the verdict. This is not going to be your grandfathers speech. He went right to it. Hey, you know what, this is how it is. Im keeping it real. This is what happens to black men in america. He didnt do that thing that he did in the 2008 speech where he said, white people have resentment no, were not talking about white people today. This is not about them. This iswhitepeople are not the ones getting killed from this. Im surprised about the criticism from the left. I know there was a backlash from sean hannity and scarborough. Here is scarborough taking on sean hannity as we wish would go on a daily basis. Really . Is that a new stashed . We would like go across College Campuses in america and tell white boys if they have marijuana in their system theyre fair game. Or if they walk in a neighborhood and act in in an untoward way. And there is no defense for shooting down a young black man in a middle class neighborhood with skittles. Cenk Joe Scarborough voice of sanity on the right. Who would have seen that coming. Hes right and there is defense of the president coming from some of the right wing as tommy pointed out, john mccain did likewise on television. Another thing that tommy pointed out, an attack from the left, tavis smile smiley saying that he did not act forcibly enough. Did he not walk to the podium for an impromptu address to the nation. He was pushed to that podium. Pressure building from inside the white house, pushed him to the podium. Im glad he finally arrived. But when he left the podium he still had not answer the most pointed question, where do we go from here . That question remains unanswered from the perspective of the president. Cenk i think thats unfair. I watched the whole speech, and the president outlined three things he said we should do next. Thats the question that tavis smiley was posing there. In general as the president not spoken out about this enough or forcibly enough . I open that up to the panel. Jayar, you know, weve been talking about this. Whats your take on it . I think its up to anyone to have a decision of how far he should go. Heres a start. We should accept what we can get from this point. What has been happening . And we have a lot of complaints about president obama is hes afraid to do certain things to a larger extent because of the criticism hes going to get from people who are never going to accept him in the first place. Thats the push maybe down grading everything he did say. But smiley wants more to happen on this. That makes sense to me. The point that i dont know if i made it on this show particularly yet whenever you have representatives of any minority, latino representatives, black representatives, asian representatives. We have a latino, we have a black guy, we have a black president. The point of having these representatives should not be to let you not do anything that represent these people that they now represent but maybe if they look out for their different parts of their constituency because theyve lived a particular american lifestyle that no one else has the point of them being there is to represent the under represented in our country. The minute they get there theyre supposed to shut up and talk about the life that maybe he had lived. If you say we have latino representatives and they speak out for latino immigrants, thats what theyre supposed to do. None else stands up for latino immigrants or blacks because we dont have anyone in the office. When is sean hannity going to get a friggin break. Cenk that cuts both ways. President obama i agree whole heartedly with tavis smiley. You and i have had this discussion on the online shows president obama has been very shy looking out for africanamericans because by god they would criticize him. Its the black president trying to help black people. Yeah, he should help black people, white people etc. But here i dont see what tavis smiley is saying. Im predisposed of agreeing with him, but i dont know what he could have done. I think it was one of the best speeches of his five years in office. It reminds me of the speech he gave in philadelphia in 2008 about race. Cenk what is he supposed to do, lets go get zimmerman . Or declare were out preempting the Justice Department. Were definitely doing a federal case. You cant do that as president. Tommy, is smiley out of bounds here . Well, i understand how he feels. I dont think there is a liberal on earth who hasnt sat by many times over the last five years and been, like, damn, can you just please call something out . Like when joe wilson when you lie. Or when Newt Gringrich literally said that black people are satisfied with food stamps. I know i would have been happy with the president to say that is racist as all hell. But the problem isi understand the frustration, but what do you call a barack obama who constantly speaks out about race . Attorney obama. Thats what you call him. Hes been reelected to a second term. Hes freer to speak out but if he had done this before, he would have run the risk of not being reelected. What good would that have done anybody. Cenk the bottom line now is well see him in the second term. This is a good first step. If he lines up delivering for the people who honestly voted him in. Thats a huge part of his constituency. Well see tavis smiley, and others saying finally seeing action. Next, a case involving in New York Times reporter. He must reveal his source or he will will go to jail. Is this personal, or is it political . A lot of my work happens by doing the things that im given to doing anyway, by staying in touch with everything that is going on politically and putting my own nuance on it. In reality its not like they actually care. This is purely about political grandstanding. Ive worn lots of hats, but ive always kept this going. Ive been doing politics now for a dozen years. vo hes been called the epic politics man. Hes Michael Shure and his arena is the war room. These republicans in congress that think the world ends at the Atlantic Ocean border and Pacific Ocean border. The bloggers and the people that are sort of compiling the best of the day. I do a lot of looking at those people as well. Not only does senator rubio just care about rich people, but somehow he thinks raising the the middle class. But we do care about them right . Cenk welcome back to the the young turks weve got a great panel for you. Tommy christopher, ben mankiewicz, jayar jackson. And an old friend of ours who we interviewed back in the radio days when he had done that story about how he had binladen cornered in bora bora. That was james risen. He came on the young turks back when we were on sirius light radio. Ben and i interviewed him. He said for the first time that the New York Times held the story until after after after the 04 election because they didnt want to politicize it. But james risen has done Great Stories and now hes about to get in trouble. James riser reporter for the n times. Worked for the l. A. Times. And now hes in trouble with his book. And in it he had significant information that came from a c. I. A. Informant who we know is jeffrey sterling. Now. Ben mankiewicz also hosts the turner classic movies. So jeffrey sterling has been hit with ten criminal charge related to leaking information basically violating the espionage act. The issue now, of course, should james risen we believe him to be the informant. He has not been found guilty of being the informant now that he has been chargedded. But the issue has been and a lower federal court agreed that risen did not have to testify in the trial. But last week in a very embarrassing decision for the Obama Administration given where they are in cultivating and smoothing over their relationship with the media the Fourth Circuit court of appeals in richmond, which covers the d. C. Area, covers the nsa and covers the c. I. A. And covers the fbi, ruled 2 1 that risen will have to testify at that trial. Obviously that is a risen said hell go to jail before he testifies. Basically what the judge has determined is this is information, this is a criminal trial, not a civil trial the evidence that the government needs against sterling, they cannot get any other way except by calling james risen as a witness, who is now being compelled to testify. Cenk you know, they say that like he had witnessed a crime. There is another witness. The crime itself was leaking to him according to the government. Thats it, you destroyed freedom of the press. Any time anybody leaks to the press they must go to court and they will go to jail if they dont say who their source is. I dont blew that the Obama Administration is embarrassed. Poor them, but heres what they can do. Risen will appeal. He doesnt want to go to jail. We know hes going to appeal. The government can say were dropping the case. Or simply avoid the legal battle over it and say were not going to call james risen. Problem solved. Theyre pretending to do federal media shield laws. The administration despises the press, and they have prosecuteed more whistle blowers. Buildingly, mediainterestingly show, media watchdog groups were pleased with what holder was doing. The Justice Department spoke person said look, we agree with the decision, and were discussing how to proceed which i felt was at least at that moment giving them an out of were not entirely positive that well proceed against james risen. They will, and tommy, let me throw it to you. Here is my theory on the Obama Administration. Its not like holder and obama came in and said, god we hate freedom of the press. Were going to squash it. Its the intelligence agencies come to them and very easily intimidate them and oh, my god hell be soft on National Security if you dont crush all these leakers and break their spine and drink their spinal fluid. President obama is like, right away sir right way sir. Now i ask the question, am i over stating it . [ laughing ] tommy, whats your take on it . Yes i that i so. The spinal fluid is a little much. I dont like when people lump all the leakers together. Obama has prosecuteed more likersi think in this case this is a bad decision. I think its a bad moon risen if you will. The government need to protect their secrets. Let them go after the people who are leaking. Fine. There is a much higher bar to me before you go after the reporter. I dont think this meets it. Being able to compel the reporter to just reveal his sources would completely destroy the freedom of the press. I think there is a critique that make the intelligence agencies put pressure on obama because he doesnt want to seem weak on security. But people on the left dont like the way the lapped landscape has chicagochanged. There are more leakers, its hard for detect these things and its something that should be looked at individually. Cenk not buying it at all. Part of the landscape changing was dick cheney and bush came in and said, except when we leak well aggressively go after the leakers, and obama he we looked to obama to change that landscape. But he furthered the landscape. He has been worse than bush and cheney on that front. What is interesting on this, these are different judges interpreting the 1972 Supreme Court decision to compel reporters to testify in a criminal case if they could give the relevant information. But every judge including the federal Trial Court Judge who heard this case first, he interpreted it differently. And then the appeal would be the Fourth Circuit. Judge william byrd traxler, who sound like he would be fun at a party, said the following cenk couldnt be more clear in his decision that risen had to testify. Then there is judge roger gregory, who has a defending opinion that we all agree with whats interesting about that, which we agree with, correct . Judge roger gregory, which was the name of my handyman growing up at my house who ironically fell off the roof and died. Cenk thats very depressing. A sidebar. Cenk hmm. Roger gregory who offered the di the dissenting opinion was appointed by george w. Bush. The judge who agreed the majority opinion was appointed to the bench by president barack obama. In this limited small sample size, its completely reversed into guy who wrote the majority opinion is the name of the handyman who jumped on the roof. And. I think is shows how the world has changed. The world has changed so much, at least our country, has changed so much on the way things get leaked and the things that our government does. There are probably some instances of things we need to protect from leakers in our government, and there are some safety things, but the problem is we go after everyone now for everything that i think the public is start to go now think man, theyre going after them for a lot of things and every single thing that is put out there, they may be doing more things wrong than we even know. The trust on our government by the very legal acts is just every moment. Cenk we got to go to a break. Look tommy i know what youre saying. I know the government has to go after leakers to some degree but there is no sense of bounds any more. And on risen and rosen alone this administration has been unprecedented in its crackdown of reporters and its unacceptable. When we come back well talk about unacceptable. What happened to this woman was a travesty. Not only was she raped, she was put in prison for being raped. And if you thought i was angry with the Obama Administration, wait until you get a load of me on this. Cenk back on the young turks. A horrible story out of dubai over which i go ahead arounded by. Robin, go. Here is the sorry of Marte Deborah Dalelv, the best way to hear the story is to hear it in her own words. I got to the Police Station i told them my story. He asked me did you call the police because you didnt like it . I said, of course i didnt like it. They dont believe me. She claimed to have been held with no charge or contact with the outside world. Four days later she found out she was charged with having unlawful sex. Sex outside of marriage is banned in of the uae. On july 16th he was sentenced to 12 months to that crime in addition to jail time for alcohol consumption. She said she was advised to say that the sex was voluntary to get the charges dropped. But when she did the police added a charge of making a false statement. Lets go to the beginning of the story as i listen to this, the key part is Marte Deborah Dalelv who is doing business is in dubai her colleague offered to walk her to her hotel and he raped her. She did exactly what you would want any rape victim to do. She reported the rape to the police, and you heard what happened. Cenk when you asked the uae about this, they of course do not answer. And they are apparently embarrassed by their laws, but if they are i got an idea, maybe change them. She was pardoned today. Cenk woo. She was parted. Not only was she pardoned, but her rapist was pardoned as well. In order to have a conviction of rape, you have to have a confession by the perpetrator or four adult male witnesses need to testify. Cenk let me make a couple of things clear here. The reason for that is it comes out of the quran. You need to have four witnesses to say this guy did something wrong, not just rape but for all crimes. The horrible repercussions that come out of this, in the case of rape it is nearly impossible to prove. If there are four males sitting around, theyre part of a gang rape. And they all say no, no, she wanted it. So since she reports the rape, but you cant get four witnesses against them, they say well, you admitted you had sex outside of marriage, youre guilty. They almost always lock up the woman who has been raped. Right. So thats obviously horrible, terribly indecent and immoral thing to do which they base is on morality, of course. Since its hard to prove any case, what winds up happening is torture proliferates in this country because they must get a confession. Who is sitting with four male witnesses to witness the crimes. So the conscientious prosecutor tortures because its literally the only way he can get it done. Dubai touts itself as a modern day society. They actually have bars. They actually allow men and women to sleep in hotel rooms together. Cenk woo. They took a stance against human trafficking. You can educate against hulk human trafficking, but what do you do about the victim . There is all this progression entrepreneurialship and womens rights but when it comes to this. I was struck by something that she said. All these terrible things happen where they invariably arrest her for having sex outside of marriage. Then she strikes a deal, just admit it, it will go away, then they hit her with lying to the police. Cenk thats bad intent. Theyre bad people. Theyre not just interpreting the quran wrong or anything like that. When she came in you saw that original piece that we showed you, she said, okay, this is what happened to me, and the guy was, o you really didnt want it . Their assumption especially if youre a western woman obviously you wanted it, right . But it happens to nonwestern women where women have been ganged raped and they get sentenced, etc. If youre not locked up in your fathers basement you must have wanted to be raped. Its horribly indecent. Heres where i wont go over the top, but its not over the top. Anybody watching this will agree with me. You should never send a welcome you love to the united arab emirates. I wouldnt send my mom, my wife, my daughter, are you crazy . This is open season of rape in the uae. If you report rape they will arrest you and put you in jail unless you miraculously had four male witnesses. Its crazy. Its a giant prison for women if you step outside you might be rapeddish, the rapist is certain to get away with it, and if there is enormous International Pressure theyll pardon the woman, and then pardon the rapist with a little insult to the jury. Aha well let the rapist go. We appreciate it, uae. Youre not alone. Expedia. Com that say dont travel to uae if youre a single woman. The uae will get a lousy review on yelp. Lets put this in perspective. Lets look at statistics in the United States to see what the statistics may be like. 54 of rapes and sexual assaults are not reported to the police. Thats here in the United States. So that if you were to take those numbers and assume that theyre higher lack of reporting in the uae then youre figuring about 3 of people in the uae do any time in jail for rape at all. Cenk look, rape is not an issue that is particularly just uae. Obviously, obviously. In fact, in the lack of follow through is not just for the uae. How many stories have we done on this show about rape in the military, when you report to a superior officer they blame you run you out of the military, etc. This is constitutional. This is the uae sanctioning. They never respond. Theyre wrong. They know theyre wrong. What are you going to do put out a press release, if youre raped in this country good luck to you. If you dont have four witnesses well lock you up. We dont think that rape is a big deal. In fact, we punish the woman who has been raped. How can you say that with a straight face . Why have the law . Admit that youre barbaric and get the laws off the books. But you wont because some mulah decided a hundred thousand years ago that he was going to interpret the quran, not the prophet allah but some imam so long ago decided to interpret the quran this way. And these clowns in the uae decide to say yes, the rapist put the woman in jail. Youre sick and barbaric. Do you think it would be effective if the International Community has places like dubai qatar, made an attempt toif there were international not so much sanctions but theyre hosting the world cup and were talking about what happened in dubai, but what has happened in arizona and getting the super bowl because they didnt have Martin Luther king day as a holiday. If they desire to be Significant International players the rest of the world said, look, if youre going to treat women like this, youre going to be an international player. Cenk absolutely. And the. International pressure worked. They decided to let this woman out of jail. Her next court date was supposed to be in september, but all of a sudden cnn plays all these international interviews, and lo and behold shes out today. Cenk one of the reasons they got rid of apartheid in south africa was for rugby. That was forays, why not for gender. The women of uae are imprisoned. They literally cant leave their house. If they leave their house they could be raped. If theyre raped they could be thrown in jail. If you dont take actions on that, what will you take actions on . Thats the story. Its tragic. This is no knock on cnn but and cnn specifically, but by the time something gets to the anchor at cnn, its a done deal. Theyre not talking about how theyre going to cover it. You have to let go of this about the newsroom. Its a take home test to history. The things that do ring true, if youre in the media they take you out of it. The source that gets put on speaker phone. I have people who would never allow themselves to be put on speaker phone. Or when jim keeping asking for 30 minutes with the candidate . Ann romney doesnt get 30 minutes with the candidate. You take that stuff out. That never happens, but on the other hand, youre in the media im in the media, i will keep watching it because thats what i do, its familiar to me, and its like that movie waiting.
