Would the president rally behind that bill . So, first, id have to get back on you on the ambassadors credentials. I dont know. We can check with the department of state and figure that out. I dont know that right off the top of my held, and im not going to comment we dont put out administration statements on policy until the bill has gone through. The president , as you know, campaigned for 18 months on replacing the Affordable Care act. Where is his plan . Hes working with congress. I think i just answered that question, but hes working with speaker ryan. I mean, youre acting [inaudible] does he owe the American People something now . And i think hes been very clear that he owes the American People a result thats going to lower costs and provide more access. Thats what he continues to work with speaker ryan on. I think the speaker was very clear on it that theyre having meetings both legislatively and at the principal level. And as you heard speaker ryan, we continue to be optimistic about competing this thing by the end of this year. Its a mammoth bill, what they passed, and weve got to make sure we get it right. Premiums have skyrocketed, access and options have gone down. We need to make sure we dont do this in a way thats going to end up with the same results. John roberts. Well, remember, tonight is about restraining order, were not i understand, but i think its important to explain this to everyone, john, because i know to you get it, and so many i just want to make sure. Tonight is about the restraining order. It has nothing to do with the merits of the case, and thats why i think we feel confident. The question is, does the restraining order get lifted or not. But regardless of what happens tonight, the merits of the case still need to be, to discuss. And i think the merits of the case as they were in boston are ones that we feel very confident on, because the law is Crystal Clear on this. The president has the authority to do this, it was done so in an interagency process that insured that all the appropriate people were consulted. We went through that with flying colors. But as you pointed out, but if he does not prevail, if the ninth circuit, will he take im not going to get lets see where it goes first. Our goal is to get to a point we can argue it on the merits. Weve been very cheer on immigration what clear on immigration what the president s priorities would be. Theres going to be continued progress on the wall and on immigration as a whole, so were going to have plenty of time to address this. Right now hes trying to do it in a very systematic way in accordance to where we find the biggest problems. Hes been very clear in the past that those who are in this country that pose a threat to us or with a criminal record are where his priorities are going to be first and foremost, and were going to move through the rest of the folks in this country illegally. This president s not going to sit by and let iran flout its violations or its apparent be violations to the joint agreement. But he will continue to take action as he sees fit. The president s also made clear time and time again that hes not going to project what those actions will be, and he will not take anything off the table. On thursday, weather permitting, the president is going to meet with Airline Executives from throughout the country. Two complaints from Airline Executives as well as the Pilots Association have been, one, that Norwegian Airlines got a special advantage, a foreign carrier permit from the Obama Administration, and also that the airlines of the emirates9, the Arab Emirates are state subsidized, and both cases are violations of the blue skies act between the u. S. And the e. U. Is this something hes going to address, and is he considering upending president obamas foreign carrier permit . Well, again, thatll be something that thatll be decided when they meet, what theyll talk about. Obviously, the president s going to want to talk about Economic Growth and job creation, how hes enacting orders to make sure the countrys safe. On the case of norwegian, my understanding if im correct there is a deal in which theyre having 50 president of the crews and the 50 of the crews and pilots are american based, theyre flying boeing planes. Theres a huge economic interest that america has in that deal right now. I dont want to get ahead of the president on that. But just to be clear, i mean, we are talking about u. S. Jobs both in terms of the people who are, you know, serving those planes and the person whos building those planes. Thats a very big difference. Zeke. Sean, a few minutes ago you said the president wanted to remind the American People on how prevalent terrorist attacks are and that the earth is a dangerous place. That kind of breaks the rhetoric weve seen of [inaudible] bipartisan administrations have used when it comes to terrorist attacks, encouraging americans to go about their thats not yeah, his message to the American People is he is fully committed to doing everything he can to keep the country safe. And i think that theres a big difference between what youre saying and the point that he was making yesterday. And i think what hes getting at, he was making a point to the exposure that attacks get. And i think thats what he was getting at, is that we see these things, and theyre becoming too prevalent. And i think thats why he wants to become evervigilant, to make sure we dont ever get lax. We need to be reminded that places and groups like isis continue to seek to do us harm, and it is his job as commander in chief to do everything he can to get ahead of the curve and keep this country safe. I think when you look at the poll that came out last week, and i think it was 67 of the American People agreed with his proposition to put further restrictions on people. , to make sure that we have countries who are sending people to our country that they are coming here for peaceful purposes and that if we cant guarantee those countries have the proper vetting and systems in place when theyre outbound to the United States, then we need to do what we can. And he will do what he has to as president to make sure that this countrys safe. And that so i think theres a, the point that he was making was not, was not to put fear in anybody, but to rather reassure them that as president of the United States he is taking every single step to do what, to do what he has to to get ahead of the threat, to get ahead of the concerns so were not looking in the Rearview Mirror thinking what could we have done, that were preventing lives, where its the raid in whether its the raid in yemen, the law that hes enacting, hes going to do what he can to make sure the homeland is protected and safe. Mara. Thank you. I have two questions, one of on [inaudible] and one on health care. When the president tweeted if something happens, blame the judge and the court system, did he mean if a terrorist attack is committed by somebody from these seven countries or any terrorist attack should be blamed on the judge . I think the point that the tweet is pretty clear. But i think his point is that kind of dovetails what i was just saying to zeke. Hes doing everything he can, and he walks into office, theres seven countries that the Obama Administration has already identified as not having the proper systems in place to guarantee our safety. And i think his Immediate Reaction is to do what he has to do to make sure that were not looking back and saying you know what we should have done . We should have had stricter vetting in place for those seven countries. So he took immediate and Decisive Action to make sure this country and our people are protected. Making sure we dont have a regret that a month from now, two months from now or a year from now we havent done something to protect people. So he acted as quick and decisively as possible to make sure that we put the systems in place to protect our people. And that, i dont think theres any other way to read that. Yeah, len on health care, can i just get my of course. You just said hell negotiate price, and thats something he yeah he ran on negotiating prices for medicare drug prices, and i just want you to clarify because when he met with big pharma the other day, before the meeting he said we have no choice, we have of to get prices down. Right. After the meeting he said he would oppose anything that makes it harder for these companies to bring their drugs to market including price fixing by medicare. So is he for medicare negotiating drug prices or not . Hes for it, yes. Hes still for it. Absolutely. Okay. The president when you look at drug costs, and not just drug costs, the u. S. Government has not done frankly, the easier way to look at this is what other countries have done, negotiating costs to end keep those down. That drives up Health Care Costs for every american, but particularly theres a huge burden on americas seniors who are so much more reliant on drug prices. And i think in many cases you have People Living on a fixed income, and Health Care Costs, rising Health Care Costs and prescription drugs continue to be a burden on their ability to live out their lives in a much more enjoyable manner. And so his commitment is to make sure that he does what he can. And i think rather successfully uses his skills as a businessman to drive them down. Margaret. Sean, can you clarify two things. Secretary kerry kelly, excuse me, when he was on the hill today said that the administration right now is not looking at adding other countries to the temporary travel ban list. Is the white house still giving itself room to add some countries to that list . Well, i think what he, what his point was is that right now hes not doing it. You have to look at his testimony in context. I think he went through the fact that were still in this review process, that he is committed to making sure that we looked at all other countries. Be but as of this moment, there is no immediate desire to add to that. Hes looking at all the other countries, the procedures we have with them, the systems we have in place to check them. To nothing is final until the end of the review period. I had a second question. Oh, im sorry. So still leaving room to do that. Something that the president continues to say as a phrase, and im hoping you can define it for us, is that this is about who truly loves america. How do you quantify that . What is the president thinking of . Is that a specific test . What does that mean . Look, i think theres a i think president , you know, his goal is to make sure that people arent coming here to do us harm, that theyre going through the proper extreme vetting in cases where we dont have the information required to make a good judgment on them based on what their countrys willing to provide, that we are taking the proper, necessary steps to protect our people. But he doesnt if someones coming here to to do us harm oro espouse things that that would give us an indication theyre not coming here for the right reason, we need to, a, vet them, and, b, unless were 100 certain, keep them out of the country. Its a background check. Its a background check its not. To the sense that we can, extreme vetting is what hes talked about. If theres any cause for concern, he wants to go to every step possible to make sure that people who are entering this country are doing so because they want to come here for the right reasons and for peaceful reasons. Yeah. On korea [inaudible] south korean knows that trump is very good friend of theirs and [inaudible] most important part of [inaudible] what would what what is most important part of trump [inaudible] most parent part of important part of the policy. Thank you. He had a conversation the other day, and we look forward to fulfilling that conversation. I think, obviously, the threat of north korea is the most prominent issue that faces south korea and our alliance right now. He wants to reassure the south korean government that we are going to do what we can to make sure that we stand with south korea and that we prevent any further hostile actions from north korea. So i think that the safety of our country, of south korea, of the region are going to be, clearly, the greatest focus of yeah. [inaudible] when the president submits his budget, is he committed to pushing congress to approve sufficient funding for all American Students to have either an outstanding Public School education or the public funding for them to reach an outstanding private School Education . Look, i think the president s talked extensively about education during the primary, whether its, you know, an associates degree, a bachelors degree, ph. D. Or votechnical education that weve got to give students these days the options they need for the work force, that a votech education isome cases is whats in the interest of students in terms of their success and giving them the skills to work on cars or become a computer engineer or whatever. But as we head into, as we look towards the future, weve got to make sure that were preparing our students to have the skill set that they need. And its also the retraining aspect of that, that as people get older and Certain Industries start to turn the corner because of technology that were allowing people the opportunity for restraining to retraining to give them the skill sets they need to continue to be productive. As you will see, look, we literally will swear in the secretary of education hopefully later this evening, which we will let you all know, probably around the 5 or 6 00 hour, but thatll be something hes going to continue to have a conversation with secretary devos about. And its unfortunate we havent been able to have this conversation sooner because it was held up for so long, but i think thats something that secretary devos will be speaking a lot about, about the Education Funding and skill set and opportunities that we give not just our children, but people older in life who are looking to get back into the work force through another avenue. He does it kind of abruptly, have you noticed . All of a sudden says thats it, walks out. He did criticize democrats pretty heavily for their delay tactics and overall obstruction that he cited in washington right now while also stressing that the president is going to prevail in his executive order on immigration. Of course, were going to be listening to those oral arguments before the ninth Circuit Court of appeals in just a few hours. Theres a lot to going on. Im trish regan. Let me ask you, hows the messaging going, in your view . You just saw sean spicer there with the press. There were no huge fireworks as we have sometimes seen, but overall whats your thought in terms of how theyre getting their message out . Yeah. Well, look, today was a good day for them, he had a good briefing x the democrats gave them an advantage. I think spicer is right, the democrats have made a big mistake by opposing in toto, en banc as the french would say President Trumps cabinet appointees. Better for them thats a strategy thats playing to the hard left of the Democratic Party. If they wanted to grab the voters who are up for grabs, the Americans Still trying to make up their opinion about trump, then they might have gone after a few select nominees and really made those people, you know, those nominees the issue. But instead they look like theyre opposing everybody, and it just comes off as a partisan trish just throwing darts at the wall to see what sticks, right . Yeah, yeah. Trish and after a while theres a certain amount of fatigue from the American Voters saying, okay, all theyre doing is crying all the time, and theyre not offering a solution. Yeah. Thats right. And, look, i think the administration has also benefit inside the last few days, i think it started with secretary kellys News Conference explaining the executive order. You saw spicer today at the news briefing defend it in a very appropriate way. Would that they had taken, struck that same tone and had that many advocates and allies out there explaining it rather than dumping it out at 5 45 on a friday night. They didnt even have the copy of the order for nearly two hours, didnt have anybody else able to come out and explain what was happening for almost two hours trish a little too hastily done, in your view. Way too hastily trish you heard their excuse, right, karl . They just didnt want to give anybody a heads up that this was coming other than those that were critical to the operation because they felt like, you know, it was an opportunity for people to slip in in the 11th hour. Well, fine. Fine. They should have had people working at the white house they didnt have any briefing papers on this, they didnt have anything they could hand the press that explained it. They had no group of experts standing by from within the administration to answer questions. They didnt have the secretary of homeland secretary aware of exactly whengoing out and standing by the president. If theyd had those kind of things, sure, dont go out and tell the public, oh, on Tuesday Morning at 9 00 heres what were going to do trish maybe thats a little bit of naivete, right . Hes there in the white house, hes use to doing things that he would do as chief executive, and part of his job and part of his staffs job, frankly, is to make sure that the messaging is done proposerly. Thats an example of where it got him into trouble, and now were looking to of arguments in the ninth Circuit Court of appeals. What do you anticipate is going to take from that . Im not certain theres much hope theyll uphold the add many managers position on this, but i think the administration could take it to the d. C. Circuit, court of circuit appeals and get a favorable ruling. But, you know, look, the ninth is liberal. The administration has done a good job of winning the case on the east coast. They didnt have the same opportunity to present their arguments on the west coast until today, unfortunately, theyre in front of a very unfriendly venue, in my opinion. Trish karl, what does it say about our country right now where, you know, you get a judge, a federal judge there in seattle, washington, that is not privy to any of the intelligence that our president actually has been included in on and is making this effectively decision that could result in the president potentially being stripped of one of his critical powers . Well, look, weve been through this in the bush years where we had judges who did not, as you say, have access to the same stream of intelligence. But, look, we have a constitution. That constitution has a separation of powers. It sets up the Judicial Branch which has to rule upon the constitutionality of the actions and measures of not only the president , but also the congress. And this is just the way it is in our m. And we in our system. We put in place, our founders were so concerned about power they wanted it dispersed, they wanted the powers separated between different trish checks and balances, and thats all good and thats healthy, but, but were now looking at a situation where, you know, i dont know, youve got a lot of judges right now, karl, that want to remake the world in their view from the drench as opposed to just upholding the law. Well, i get that. We had the same issue in the bush administration. Id simply say have ultimate confidence that the system will work, that youll be able to move from the district level to the appellate level, if need be, the Supreme Court level and win the argument. I dont think its healthy to be taking personal shots in the actors at this. At the end of the day, we are a nation of laws, not men, and the rule of law is paramount trish i just have 30 seconds ive been through this before. Trish sean spicer wouldnt say whether or not it would go to the Supreme Court, you heard john roberts asking him there. What do you think . If this doesnt hold with the ninth district tonight, where does it go from there . Well, it may go to the d. C. Circuit court of appeals. If the Administration Wins it, then the ball is in the oppositions court. They will appeal it up, the question is whether they go to the d. C. Circuit or straight to the Supreme Court. If it goes all the way to the Supreme Court, whoever won at the appellate level is likely to win at the Supreme Court level because we have a split court, 44, and that means that the appellate decision is kept. The Appeals Court in San Francisco is going to be hearing those arguments over President Trumps executive order on immigration and refugees. Trumps lawyers are making it clear its up to the president to make decisions when it comes to National Security and what noncitizen can do in terms of entering the United States. State lawyers will say this order goes too far. We expect a ruling as early as possibly tonight. The expectation is you can see this one going to the Supreme Court. Were going to take it through the system. Its very important, very important for the country, regardless of me or whoever succeeds at a later date. We have to have security in our country. The Supreme Court, you think . Well see. Hopefully it doesnt have to. Its common sense. You know, some things are law, and im all in favor of that, some things are common sense. Trish for a lot of folks it is common sense, but to those on the ninth circuit which has been known as the nutty ninth, you heard karl rove talking about reputation for going the liberal way of things. It isnt necessarily common sense, you know why . The most reverse court on the circuit. Back in 2011 admonished by the Supreme Court for exhibiting judicial disregard for sound and established principles of law. Yikes joining me is jordan secula for the American Center for law and justice. Good to have you here. Thanks. Thats not a great thing to be cited for when you are a court of law. Tell us more about the ninth circuit. The ninth circuit represents a liberal part of the country, especially the big states there like california, Like Washington state, like oregon, and hawaii. Its a large circuit, but as you said, it is results oriented instead of law oriented. Thats what the Supreme Court admonished it for. The idea of the living constitution so the judges are known for the most part of how do we get to the result we want with the facts and the law in front of us, instead of saying lets just analyze is this constitutional is what was done legal . Whether we like it or not. Thats the role of the courts. Most Circuit Courts are the courts of last resort. When you get to an issue of a president s executive order, trish. Obviously, this could be on a much faster pace to the United States Supreme Court even on the issue of the temporary restraining order. And were only looking at the restraining order and the district judge, there was like no legal analysis whatsoever on how they would be suffering irreparable injury in the state of washington. By the way, i would just say, look, there are economic consequences for sure, to a terrorist attack. Dont tell me there werent consequences to 9 11. Obviously, significantly from a personal level but economic as well. I dont get that argument. I dont get the argument that it hasnt happened before, you cant cite this, because to me thats part of the problem with government, overall. Theyre reactive as opposed to being preemptive. We should be out in front when it comes to terror, jordan. Yeah, trish, the law is very clear. It gives the president this power. Thats whats unfortunate that this is in the ninth circuit honestly because the immigration nationality act says the president , whenever it feels like a group of people, an actual class, is going to be detrimental to our countrys security, you can ban them. Trish thats the law you are citing that gives the president this power. In conflict is the 1965 act which basically says you cant discriminate against religion. He would make the point and lawyers make a point, its not a religious discriminatory ban, if it were, he would say hey, all muslims, not just the seven countries. Real quickly, let me ask you about the significance of the fact were seeing judges that are trying to remake the world as they see fit as opposed to upholding the law. What happened to the legal system and does academia have a role in it. Its the law schools, in law schools you are not learning the constitution, youre learning precedent, Supreme Court cases. Of course, thats important. Youre learning what judges and justices believe about the constitution instead of going to the text. Thats why Supreme Court nominees are important but so are Circuit Court nominees and district Court Nominees from the top to the bottom, and right now, were seeing the effects of judicial this is judicial activism. You cannot like this policy. This is obviously going to be litigated, executive order like this is going to go court, trish, but you didnt have to issue a temporary restraining order on the way you could have let it, let the executive order stand, and then have the case on the merits. Trish it shows what a chaotic state were in in some ways, something i imagine many on the left love are and eating up right now. Jordan, it is good to see you. Good to have your perspective. Much more on this, again, the court is hearing the oral arguments in just a couple of hours. Were back with more intel after this. Trish President Trump pretty fired up about having to take his plan to protect the country to court. State and federal lawyers are arguing over executive order temporarily halting the Refugee Program and entries from seven muslim majority countries. The ultraliberal ninth Circuit Court of appeals is set to hear the case in just over three hours, but its really a steppingstone before the whole thing heads to the Supreme Court. The expectation is that is where this case is going to wind up. Joining me republican strategist Mercedes Schlapp and democratic strategist Jessica Tarlov to talk about the politics of all this. I like to think that a judge is working aggressively to uphold the law as we heard from our last guest, mercedes. Unfortunately a lot of judges, especially those on the left coast are not working to uphold the law but are solving for the equation, the kind of world that they want. So this may be influenced by this judges political views. It may be influenced by his view of how he wants to see the world. How does it affect people who might be on the margin right now that are unsure of trump . Does it actually make them feel as though they want to support the president more because the president should be in charge or are they starting to get nervous . Whats the political ramifications. The judicial activist is a hot topic for republicans for the most part. When you looked at campaign, it was one of the top issues in terms of republicans supporting a donald trump over a Hillary Clinton because what we have seen through the obama years where he appointed over 300 judges is the fact of the courts moving more towards the left. The idea that you can bring on personal and policy considerations into your opinions when youre writing up opinions, being a judge. Of course we know judicial activism undermines american constitution, and so i think when you look at the ninth Circuit Court of appeals, its problematic for donald trump and the executive order. They are known for siding or being sympathetic towards the plaintiff or more so on that case on an immigration case, so i think it represents a very big problem, which is why you will likely see this case going to the Supreme Court, which brings up the other question, the fact that you have this open seat and judge gorsuch, and it really plays into the drama that youre going to see in congress during this confirmation hearing. Trish for sure, and lots of questions if the court is evenly split down the middle. What happens then . Jessica, politics aside for a second. I will try. Trish this is not good for our country. I think that, you know, many people are concerned about sort of the state that were in. As karl rove said, take a deep breath, this is just part of the process, everything will work out fine. The fact that were in this environment right now, and theres a court that has a history of trying to, as you said, remake the world from the bench, thats not good. Well, we have to also acknowledge the fact we have three separate branches of government and supposed to be checks on each other. This is what the judiciary is supposed to do. Im not a lawyer, i cant speak to the constitutionality or not. Well see what the Appeals Court says there. What seems to me and i find disturbing is its as if donald trump doesnt understand what the judiciary is supposed to do here. Sean spicer said its very clear he respects the judiciary. When you call an appointee a judge, george bush appointed, and blame him for attacks may transpire that hes making us less safe by making this ruling, is incredibly disturbing on the part of the president. Not at all. Not at all, jessica. Trish last word to mercedes.
