Weve got a dismal jobs report on friday and remind you 74,000 jobs added in september. The Labor Participation rate falling to the lowest level in 36 years, but the market more or less shrugged off the bad news. David kotok is here from cumberland advisors. That was big news and they sort of shrugged it off. Nobody knows what the numbers mean. 74,000 is a number and we dont know what its going to be. Confident is a mile wide, were going to get revisions and learn what the number really was two months later. Charles is that the new deal then . Data comes out and we ignore it until its revised . Theres a trap here. Last june the fed started rhetoric based on numbers in the employment report and then the revisions came out and you could say to yourself would you have done or said what you did or said if you had the revisions and knew the real number . Were playing that game again now off this employment. What were seeing is essentially, this is the time of year where the december number historically gets revised. We saw the november number, for example, get revised upwards. On average, we see anywhere from 46,000 to 50,000 in the upward revision for the december number and also, we see this massive nonfarm Payroll Employment benchmark series revision thats going to come, too. Charles right liz we could get a bump up. Charles david, lets say we get a bump up 50,000, the best Case Scenario liz by 50,000. Charles and thats pretty abysmal. If the rally goes from the Federal Reserve to a great u. S. Economy, that disproves that. Thats a long baton pass. When you think of inequality youre taking a snapshot of income youre not looking at consumption, quality of life and youre also not looking at income mobility and thats what matters in america. Can you pull yourself up from being poor the argument being made in the Obama Administration cites that some study that goes from 1979 to, you know, whatever, 2010, that said that 1 own a greater share of wealth. So therefore they extrapolate is there a national wealth, theres ownership being taken out of. This is about growth not redistribution. And thats the problem with the Obama Administration. They dont want to talk about the lack of job growth under their watch, instead, its a diversion toward income inequality. How do you get to income inequality, you dont have good jobs, you have mixed jobs. And also, guys, i think its so interesting because if someone makes a billion and im making a hundred grand i could say, hey, the gap is too wide. I mean, the bottom part of this has if we are he going to fix it, the idea is not to go after people who are successful, its to somehow create that mobility you that you were talking about. We wouldnt be talking about this and the president wouldnt be making speeches about income inequality if we had an expanding economy. If you look back at the last several decades, when do people move up the ladder fastest . Well, when we have an expansion. When we have the reagan growth rates. The problem is that the president has given us a 2 economy and unfortunately, when you have a 2 economy, theres fewer opportunities for people on those bottom rungs to move up and more opportunity for politicians to say, well, vote for me, ill give you some money so you cant im figure it out. A final point, the poverty rates have been notoriously historically skewed because they dont include medicare, medicaid, income earned tax credit. Charles that adds up. What is there some accountability . When do the victims occasionally look in the mirror and say is there something i can do, something i can do so im not obese or get a better job . Its interesting that people would want to live that way to undermine themselves and junt c cut undercut themselves and say that society has to fix what i created. I was curious where you were going to fall into place, whats your take on that . I dont see a conflict of interest. Im used to Companies TakingCompanies Public and later on putting a buy, sell or hold rating on it. I dont see a conflict of interest. To me as long as everything is put out into the open, you know, full disclosure, that i think its okay. So bottom line, Goldman Sachs had the ability to do this, its legal for them to do this, theyre in the business of doing this and i think that that i think that everythings clean. You know, i guess what some people are saying, theyre talking their book. You know. Surprise, surprise. Surprise, surprise, but remember you go back assuming theyre always taking their book. You go back to the giant scandal, the henry blogets kicked out because they tell well take you public and have an analyst pump the stock. Surprisedly thats illegal and some people think its an end way around it. I dont see it, but some people do. The analysts have a take on it, assume they do. The plot thickens in the retail hacking story, target now saying more than 110 million customers personal information may have been stolen in the prechristmas Security Breach and retailer Neiman Marcus saying that hackers gained access to the Customer Data base and now there are reports that there are another three retailers that may have been hacked as well. And john mcafee says he saw it coming. John, how come you saw it coming and none of the retailers did . Well, i had my ear to the ground, thats number one. You know, im still connected with the Security Community very, very intensely. Here is something that no ones talking about. There are 114 million households in america that target alone, 110 million cards were stolen. Its kind of like were at the point of trying to close the barn door after all the cows have left. Think about it, we are in a very serious situation. The thing with Neiman Marcus a brilliant move on the hackers part because the credit limit for the Neiman Marcus cards, and until 2011 used American Express or proprietary cards, the limits are 50,000. And people buying mercedes and Diamond Rings with the cards, a serious problem. Charles john, here is the thing, you say its a serious problem. We feel like its a serious problem. When you look at the reaction of the companies and the stock market, theres a yawn. A lot of consumers sort of have come to grips with the idea that their information will periodically be stolen. What is it that is main street and wall street are missing with this thing . Well, the first thing thats missing is, keep in mind, the Neiman Marcus hasnt Neiman Marcus only announced it because someone pressured them. It happened in mid december, december 15th, its almost a month later and the public does not know that their information was stolen. In one month, i can empty someones bank account and keep in mind, the new data stolen. I think two hits on target the first one for 40 million at the point of sale the next one 70 million which gleaned home phone numbers, email addresses, everything personal except the Social Security number however with all the information, getting the Social Security number is trivial. You know, we are in a situation where companies are just being la say fair about i want to let you know immediately. And my card was compromised Neiman Marcus in august and i found out ten days ago, you know, luckily, no one cleaned me out, but to your point, who has to step up to the plate here, the retailer, the credit card company, and obviously, theres technology that can make this better, who is going to step up and make it better for us . Well, i think that congress has to step up first and enact laws that will force retailers to if youre a retailer, if youre Neiman Marcus you sure as heck do not want to announce to the world that all of your credit card information was stolen. Thats going to make your business tank for a while. Just like target, had a terrible christmas because of the announcement of their theft. So, we have to force these companies to let us know. Because its not just a matter of someone using your credit card and then you can say, well, i didnt do it. People will start stealing identities, buying houses using your identity. General motors says its never been closer to paying a dividend, but some varney viewers wont buy the stock and they say its for moral reasons because of the bailouts. Because the taxpayer lost 10 1 2 billion dollars and the company doesnt have to pay the government back. I think some taxpayers who arent buying in gm think we should be paid a dividend because we were the ones that bailed them out. Dan akerson says that this was a net win for taxpayers because of the cost of pensions and how much more money the government could have lost and left the taxpayers on the hook for, that the bailout was the right thing to do. That doesnt change the mindset of the investor who feels theyve bailed out this auto maker and never got anything back for it, why should they be shelling out a dividend to those folks. Charles the thing though, ford had a pretty, two weeks ago ford had bad news and the stock took a pretty big hit. This morning, the Chevy Silverado was voted truck of the year and the sting corvette. Democrats, i think, are trying to distance themselves from the Health Care Law. The last couple of amendments offered in the house, 20some democrats voted for it and 30some and now 67 democrats are trying to distance themselves from the Health Care Law. I want to have a vote on this in the senate. Harry reid is continuing to block it and the president said this isnt necessary, but it is necessary, and americans want that information. Charles lets talk about obamacare a little bit more and the idea that not enough young people are signing up and if you do the math, and you think about how much its going to cost, right now the way its configured at some point it goes into some sort of economic or financial death spiral. Youre absolutely right. Very few people first read the bill and second, do the math. Charles who could read it. They wanted 7 Million People to sign up right during this period of time and theyre way below ttose numbers. The big thing as you say the disproportionate thing they needed healthy young people to buy the insurance they dont need, dont want, will never use and cant afford to pay for older sicker people and theyre not signing up. We dont know the numbers yet, how many have signed up and the government talks about the numbers that have gone through. We dont know if theyve actually paid, you know, they dont have their cards yet or their numbers. Charles even some people put in their cards, and the Insurance Companies havent received information on the other side. Its a serious boondoggle no matter how you look at it. Here we are, fox business, small businesses, companies with less than 50 employees, they by law dont have to provide insurance, but we know that 20 million americans are covered that way and now theyre going to get waves of cancellations. And harkens back to obamacare and to the Supreme Courts unique interpretation of congresss power under the constitution. What the court has said, congress can only regulate Human Behavior in the 17 specific areas that have been granted to it in the constitution. But it can tax and spend in any areas it wants and it can impose obligations of compliance with its commands in order to receive the tax benefits. So, for example, congress could not write a law saying everybodys got to go to work from 9 to 5. But congress could say, if youre going to receive food stamps, you have to work from 9 to 5. So, if the question is, can congress do this . The answer is yes. If the question is, should congress do this . Thats, thats a political question and that that presumes that congress should be in the business of food stamps in the first place, which is someehing, of course, nowhere authorized in the confusion. Charles they are in the business of food stamps. And weve become a food stamp nation, maybe you didnt want to answer the question, but its a valid question. Should people put some skin in eive benefits, taxpayer funded benefits . It would be a way of decreasing the amount of money that is spent on food stamps because a lot of people simply will not work and they dont choose to. I dont know about you you, sandra, when you say that, some people say its heartless. Do something. Never do it be the alarm clock. There would be too many exceptions in the law and people who were not able bodied and youre arguing that this could happen by congress if they were able bodied americans on food stamps, right . Im saying that the Supreme Court would not invalidate it. I think there are way too many exemption is exceptions to make it possible. The only time you need to get off the sofa is twice a month when the check is in the mailbox. Why do we do this . Why do we do it in the first place . Do we somehow think its good to steal money from those who work hard and give it to people who choose not to work . Because were a compassionate nation. Little money for doing nothing. What about the compassion of those from whom the money is taken in order. The other side of the argument is they are so advantaged that they get so much that they reap everything from this great nation, that the people on the other end getting the and i know youre on my side of the argument, but youre coming across pretty effectively.
