Reporter terrorists murdered 130 people in paris in november 2015. The youtube videos showing isis warning about attacks on france started about a year before. Isis could not function without social media. It would be 50 guys standing in the desert jumping up and down chanting around a fire. Reporter in the attack, Nohemi Gonzalez was shot in the chest and died. She was 26yearold, a student at cal state long beach studying abroad. The estate is suing google as the parent company. Social media sites including google allow isis to use their sites to conduct their terrorist operation, to raise money, radicalize individuals, and plan terror. Reporter victims can sue anyone who gives substantial assistance to a terrorist. Another law says website owners cannot be sued for what other people put on their site. They dont have to police it. They can take it down. They can leave it up. They can do whatever they want. And they are immune from any kind of repercussions for that. Reporter google used this special immunity to ask a federal judge to throw out the gonzalez lawsuit. At a hearing today in oakland, the judge seemed ready to side with google. This is tough. She was hard on us. Reporter lawyers for google refused to comment but if the judge does dismiss the case, the plaintiffs will have to reasonable. They dont because they believe they are immune. Reporter the judge did not say when she will issue a ruling on this case. She can take as long as she wants. Youre a lawyer. I mean, when you look at this thing, um, on the surface from a legal standpoint, will she toss it or let in go . Based on what we sauteed, she probably will toss some or part of this case. She just did not seem willing to go into new legal territory. But there was one argument that she did seem interested in. And that is the fact that ads can run next to these isis videos and then payments get made. Potentially to isis. And google is making money off that. So she may dismiss some of the case but maybe ask the plaintiffs to come back with more on that argument related to funding and not the publishing part that they get the immunity for. New moves today in the battle over bringing a pot club to San Franciscos sunset district. The city gave the green light but now, as jackie ward records, opponents say it will go against state law. Today, a nonprofit that describes itself as a group that defends Civil Liberties but what the Southern Poverty Law Center called a hate group is officially getting involved. The Pacific Justice institute says where the city already approved to put a dispensary is illegal. No matter how strong of a lobby these marijuana dispensaries may have, they still must comply with the law. The law is very clear. Kiet. Reporter this is only just begun. On one hand you have a church thats been here for over a centuries. On the other, you have neighbors split. Some say that the church is affecting quality of life in the neighborhood. Others say that the church is adding value to the community. The city says this is a tough situation and they are caught in the middle. The First Baptist church has been on this corner palo alto serving the poor and needy for more than 100 years. But after a brief informal meeting with city Code Enforcement officers this year, the pastor suddenly got this sternly worded letter from the city telling him he must cease all nonreligious activity and that his tenants [ music ] reporter which include a music school, psychologist and the peninsula peace and justice center, to get out by august 17th or face severe fines. [ music ] reporter for years, the church has rented the space on the second floor to music classes, choirs, dance clubs, and hosted dinners and weddings. The problem is that the neighborhood is only zoned for residential. The city received many complaints about traffic and double parking and decided all the tenants violated zoning laws. The says the definition of church has changed overnight and its no longer what happens on sunday morning. The definition of church in 2017, theres a bigger issue that the city has to somehow come to grips with. Otherwise, they are going to be, you know, putting every church in palo alto out of business. Reporter one of the tenants getting kicked out is sarah cooper who among other things counsels teenagers struggling with thoughts of suicide. She got six weeks notice to vacate and tried to get an attention is with the citys lead Code Enforcements officer saying the Real Estate Market now is brutal. And mr. Reporter this person lived across the street for 39 years and admits there are some traffic and parking issues but wants the church to work it out with the city. Its never too late to sit down and talk about it. Reporter and the city released a written statement but declined an oncamera interview. The statement says our goal is to balance neighborhood concerns with our zoning laws and find a solution that works for everybody. We are asking the church to apply for appropriate permits where possible and to help relocate those activities that arent allowed in residential neighborhoods. Activists and tenants protested statewide today calling on lawmakers to pass legislation for more affordable housing. Among the locations, the Pleasant Hill office of the California Apartment Association. Protestors are demanding a statewide freeze on rent increases. They also want lawmakers to repeal the hawkins act. That bans rent control for singlefamily homes built after 1995. Tenant groups say rising rents are forcing families out on the streets. When they are receiving rent increases from 200 to 500 to 600 from one month to the next, its making it really hard for people to live. And the California Apartment Association says policies like rent control only contribute to housing shortages. And tenants should focus their activism on demanding more housing in their communities. Airbnb facing a new lawsuit. A 51yearold santa fe woman claims she was sexually assaulted by her airbnb host. She charges that the rental Share Company failed to do background checks on all hosts. We reached out to airbnb for a comment. The company said, quote, we are outraged by the report of what happened to our guest and we immediately removed this host from our platform. Nothing like this should ever happen. Airbnb says they do perform background checks. The woman ofs lawyer said the host previously was on trial for assault and battery involving an exgirlfriend. A ruling by the state Supreme Court over californias highspeed rail. The court said the huge rail project is not exempt from californias strict environmental reviews. The Rail Authority had argued that it should be exempt because of federal law. The ruling likely opens the way now for new lawsuits to block the project using the states Environmental Quality act. The new smart train in the north bay will have an extra stop in downtown novato by the end of next year at the site of a train depot south of grant avenue and the city has already started building it. Now the metropolitan Transportation Commission has approved a grant on half a Million Dollars to make sure the project is completed. You have about a quarter of novatos population living within a mile of the station. This will encourage folks to to either get on the train to commute to work or perhaps stop in that location as a destination. The new money will be used to create a pickup and dropoff area along with parking and lighting. Any day now, the federal government could give smart train the green light to begin service.
