A suspected drunk driver is accused of causing a serious crash in hayward. Ktvus Tara Moriarty joins us from the scene to show us the extensive damage. Good morning, tara. Reporter good morning. This looks like a deadly crash but miraculously it was not. The driver apparently allegedly drunk walked away with only a bloody nose. This car is the one he was driving. This is the silver car you can see here. Its completely mangled u underneath it, a classic 1966 mustang that the opener was keeping here for storage purposes. Let me show you exactly the path of this car. Were here on grove way. This is near western boulevard just south of the 238 580 split. If we kind of come over here, this all happened around 2 30 this morning. You can see that the tow truck is here on scene. They will be taking away several cars. Take a look at the damage. This is all of the glass and debris that the car hit on its way. It tore through this front yard here. Took out a couple of branches from the tree, tore up this whole all of the glass, everything. And this bmw thats sitting in the driveway over here, this also sustained some damage. And then if we walk over here, if we can kind of turn and walk the other direction, we can show you it actually hit a car parked at the end of the street. That is what the first car it hit. Over here is momam. Hes one of the neighbors to tell us exactly what happened. Did you hear the crash this morning . Yes. Yes, i hear big boom. Yeah. It looks like a reporter did you come running outside . Yeah. I looked through the window and yeah, i saw the car right on top of that mustang over there. Yeah. Reporter and then the driver, he appeared to be drunk . Yeah. Yeah, definitely. Yes. Reporter all right. He was drunk and this gentleman, he was over there. I came out. Everything was quiet. Thank you, tara. Well, the chp is investigating a deadly new years day freeway crash in oakland. It happened hours ago on interstate 580 near park boulevard. The chp says a white suv veered off the highway and flipped over. A female passenger was killed. The male driver was transported to the hospital with minor injuries. Its still not clear what caused the suv to go off the highway. And the chp is also trying to determine the cause of a deadly new years eve crash in a remote area of west marin county. The car you see ended up in the water after the rollover accident near tomales bay early yesterday evening. The chp says a passenger was killed when the car flipped over and landed on its roof near shoreline highway. Bystanders came to the rescue of the driver who was not seriously hurt. And San Francisco police have arrested a driver in a deadly new years eve accident that killed a 7yearold girl. Police say a mother and her two children were crossing polk when the driver of the car turned right and hit them. The mother and 4yearold boy are expected to recover. The 7yearold girl died from her injuries. Pedestrians were in the crosswalk with the light and the vehicle had the light as well. Because the vehicle was making a righthand turn and the vehicles are in the cross walk, the vehicle is obligated to yield to the passengers. The driver did stop and is cooperating with police. Police say at this point, it does not appear that drugs or alcohol played a role in the accident. The chp this morning will release the number of arrests it made during the new years eve drunk driving crackdown. Put your feet together. Arms down your side. Follow my finger with your eyes only. Dont move your head. This driver was among several pulled over while we were on a ride hey long with the chp ride along with the chp. The man took a field sobriety test but was not arrested. Officers arrested 208 people for drunk driving in the bay area. Gunfire marked new years eve in oakland. Around 9 30 a young person was shot on walnut creek street and 04th avenue 104th avenue. The victim was hit in the chest and rushed to the hospital in critical condition. There are no suspects at this time. There are at least two other shootings last night in oakland as well. The first happened just before 9 00 at 54th and Martin Luther king, junior way. A man was shot in the leg but he is expected to be okay. Around 9 10, a woman was also shot in the chest on the 1800 block of 22nd avenue. She was taken to the hospital where she was later pronounced dead. No arrests have been made in any cases so far. 7 07. People across the bay area celebrated the new year with fireworks. This is what it looked like at the stroke of midnight in oakland. Although there were no official works in the show, you can see illegal fireworks lit up the skies. There were extra patrols out looking for illegal fireworks. An estimated 200,000 people showed up to see the big new years eve Fireworks Show in San Francisco. [ cheers ] the crowd started showing up to the embarcadero early to get a good spot for the fireworks display. One woman already had her spot planned out before she got there. For teenagers, anyone driving under the age of 18 can no longer send or receive texts while behind the wheel, not even with handsfree technology. Teens had been allowed to use voice activation, handsfree devices but not anymore. Texting by hand while driving was outlawed back in 2009. Theres also a new law spelling out the rights of transgender students in school. The law states that students can participate in sports and use restrooms that reflect their gender identity, regardless of what is listed on their birth certificate. The law could be suspended in opponents collect enough signatures to place the issue on the november ballot. The boy scouts of america is beginning this new year with groundbreaking new policy. Starting today, openly gay boys can join the scouts for the first time in the organizations 103yearold history. The new policy is winning praise for many gay right supporters around the country. A United Airlines flight was forced to make an unscheduled landing after the pilot started having heart problems midflight. The plane was on its way from iowa to colorado monday night when the copilot noticed the pilot was really sick. The copilot then decided to land in nebraska. 154 passengers were on board at the time, including two nurses, who rushed to help. It was chaotic at the front. They extradited him out of the cockpit and then laid him on the floor right up there in the first class area and they got an id on him. The pilot was taken to a nearby hospital and is expected to recover. 7 14. Former First Lady Barbara Bush remains in the hospital this morning. The 88yearold is being treated for early signs of pneumonia. She was admitted to Methodist Hospital in houston last night. Friends and family are sending her well wishes for a quick recovery. Well, shes a tough gal who will outlive us all but our love is with her because shes not just the former first lady of america, shes at the first lady of our hearts. The hospital says mrs. Bush is in great spirits. There has been an outpouring for support for a little girl fighting brain cancer and her family is giving back. Her family held a blood drive at the church of the jesus christ latter day of saints in livermore. She was diagnosed with a brain tumor three months ago. Her family says the blood drive is their way of helping others going through the same thing. People have been there to help us. This is the only way we know to give back is to is good. Shes already had 14plus transfusions. Hundreds of people have been showing their support for delaney on facebook. Her father says delaney will have to go through more transfusions and chemotherapy as part of the ongoing treatment. Today is the day the new healthcare reforms under the Affordable Care act kick in. So far, more than 2 Million People have signed up for insurance through state and federal healthcare exchanges. In california, 400,000 people signed up through the covered california exchange. Under the law, all americans must have healthcare coverage by march 31st or face a fine. The law guarantees no one can be denied coverage for preexisting coverage. Starting today, some workers in the bay area will be getting paid more. The minimum wage is going up in san jose because of an ordinance passed by voters last year. Carriage riders are opposing the decision fearing they will be out of a job. San Francisco Police have identified the man they say led officers on a chase through the city. Police say 29yearold jack samuel started the pursuit before 9 00 on monday night in the bayview district. The chase went onto interstate 280, 19th avenue and into golden gate park. It ended when he crashed into a concrete barrier. One officer was hit by samuels car who was treated and released. Another officer opened fire hitting the suspects car. Police in gilroy are asking for the publics help searching for a bank robber. Was captured on a surveillance camera as he robbed a union bank at santa teresa boulevard yesterday afternoon. Hes described as white, in his mid20s without facial hair. He was wearing a black bearable cap, a black hooded wet shirt and white tennis shoes. We begin this halfhour with a new years eve accident thats claimed the life of a little girl in San Francisco. She was walking with with her mother and brother with her mother and brother when a car turned into them. Claudine wong is live with more. Reporter well, the driver involved in the crash is facing vehicular manslaughter charges. It happened at this intersection at polk and ellis in San Francisco. The 7yearold was in the crosswalk with her mother and brother. This all happened around 8 00 last night. Police say a mother and her children were crossing polk when the driver of the car turned right and hit them. The 4yearold boy is expected to recover. The 7yearolded died and the the 7yearold died. Pedestrians were in the crosswalk with the light and the vehicle had the light as well. Because the vehicle is making a righthand turn and the pedestrians are in a crosswalk, the vehicle is obligated to yield to pedestrians. Reporter the driver did stop and is cooperating with Police Police say it does not appear that drugs or alcohol played a role in the accident. Thank you. In fremont, a car slammed into a group of people killing one woman and leaving a baby in critical condition. Police say a 19yearold woman and a 17yearold girl were walking across paseo padre parkway and mowry avenue before 10 00 last night. The 19yearold was carrying a 3monthold baby. Investigators say a truck hit them. Half an hour ago, we learned that the 19yearold died from her injuries while the baby boy remains in the hospital with lifethreatening injuries. Were still investigating the collision, we havent determined if any laws are broken, if there was any impairment or anything else of that nature. Police continue to investigate to see who if anyone is at fault. The 17yearold woman was also hurt but her injuries are not lifethreatening. The 64yearold driver did remain at the scene. The roadway was blocked for about five hours overnight as officers investigated the crash. 7 33. A medical facility in new york says it is willing to accept 13 yearold jahi mcmath if her family can get her there. Jahis family wants breathing and feeding tubes surgically implanted to allow her to be transferred. But oakland Childrens Hospital which considers the girl to be dead says it is ethically wrong to perform surgery on a body. You are setting up road blocks at every road that we try to go down to save jahi. Because imagine this if jahi does come back as we hope, imagine what childrens is gonna have to face. The court and three physicians have ruled this young lady dead. Shes not coming back under any circumstances and thats sad, sad thats the sad, sad truth. A judge ordered Childrens Hospital to maintain jahi aventilater until at jahis ventilator at least until next tuesday. A spokesperson for the terry shiavo says they are working with the jahi family. After a long battle, her feeding tube was removed in 2005 and she died. The facility in new york where jahi may be transferred is called new beginnings and is dedicated to terry she shiavo. Jahis uncle says i will fight for you forever, jahi. The Rocky Mountain state is making history on this new years day in 2014. Colorado is now the first state in the nation to allow the sale of marijuana for recreational use. Retail pot sales officially began. Starting today, anyone over the age of 21 can buy up to an ounce of marijuana. This is something that the nation is watching us for and the city and a lot of other entities have been working hard to make sure that everything is done in a presis manner that accommodates everybodys needs. Now, there are posters and fliers posted across the state spelling out the new rules in colorado. They include you cannot smoke pot in public. You cant drive under the influence of pot. You cant give the marijuana to anyone under 21 and you cannot take the pot out of the state. Happening today protesters in oakland plan a vgeil to mark the fifth anniversary of the death of oscar grant. Bart police officer, johannes mehserle, shot and killed him at the fruitvale b. A. R. T. Station on new years day 2009. Todays vigil is set to begin at noon at the fruitvale station. Members of oscar grants family are expected to attend along with the director of fruitvale station. Thats the movie based on oscar grants life and death. There was a Large Police Presence around Oakland City Hall last night. Officers were called in after occupy oakland called for a demonstration protesting the shooting as well as other issues. Police were on alert all night. But the demonstration never took place. A brentwood man has been charged on suspicion of lying to police about the deaths of two dogs. Prosecutors accuse 32yearold jonathan crisp of protecting his father who shot and killed the neighbors dogs in september because they broke into his chicken coop and killed about 20 chickens. He told animal control he had killed the dogs. He faces a misdemeanor obstruction count. His father will not be charged because its legal to kill dogs in california while protecting poultry. Despite last nights shootings we mentioned earlier, oakland along with richmond showed significant drops in deadly violence in 2013. A church in oakland held the annual memorial for homicide victims. There were 89 crosses on display, signifying all of those killed in oakland last year up until yesterday afternoon. 125 people were killed in 2012. Thats nearly 30 decline but still, some say its too many. I got more loved ones up here, people i know, people i grew up with, i know they are like family. Its hard. When is it gonna stop . The city of richmond has experienced a large drop in violent crime. There were 43 homicides in 2009. 18 in 2012 and 16 last year. Police credit more resources including several dozen detectives working in specialized units from homicide to narcotics. Vallejo was one bay area city where the homicide rate went up. There were 25 homicides in 2013. Thats compared to 16 the previous year. In san jose, they saw a slight improvement in 2013. There were 43 homicides compared to 46 in 2012. A number of new gun control laws hit the books in california today. One law requires the state to collect specific information about shot gun and rifle purchases. That information would then be stored on a computer base. In the past, only handgun purchases were permanently recorded in california. This new gun law and others led to a lastminute rush on gun and ammunition sales at gun Stores Across the state. Starting this weeks. Ged test will be completely different. The test will focus on Critical Thinking schools and use more standards that could make it harder to pass. Test takers will be required to use a computer instead of a pencil and paper and it will also cost more to take the test. It is the first update to the test in more than a decade. 7 39. People in a small town in north dakota are back home after a train explosion forced them to evacuate. The fire is now 90 out. Investigators say a train carrying grain derailed and knocked several cars from a separate train off its tracks. That train was hauling crude oil. The chp is investigating a suspected drunk driving crash in hayward. It happened two hours ago on grove way. Tara moriarty joins us live from the scene to show us the extent of damage. And you mentioned it runs the length of a football field. Reporter thats right. When you look at the damage, its really amazing that no one was killed. Take a look at this mustang. The car that the drunk driver was driving landed on top of this car, this is a classic 64 mustang. The driver walked away with barely a scratch. Only a bloody nose. Officers say it happened around 5 30 this morning on grove way near western boulevard just south of 238 580 split. The chp says the driver was speeding over Railroad Tracks and went airborne, slammed into a parked car, a speed limit sign, plowed through two front yards, fences, damaged a bmw and then landed on top of the mustang. Neighbors say they heard the twisting of metal and ran outside. The driver was in the back seat of the car. Reporter he didnt have his seat belt on . No. Reporter and i understand he had a bloody nose . He had a bloody nose, kind of out of it. You could smell alcohol. He was drunk. He said he wasnt but you could tell he was drunk. Reporter officers say the driver was taken to the hospital an will be charged with dui. The tow truck has taken two of the three trucks away. You can see this empty beer bottle here that actually you can tell its been split open and theres beer laying on the sidewalk. Thats what fell out of the car according to witnesses. Weve discovered that this mustangs owner is actually out of the country. He brought this car to his friends house to keep it safe while he was away. Thank you, tara. The chp is investigating a deadly new years day freeway crash in oakland. It happened hours ago on interstate 580 near park boulevard. The chp says a white suv veered off the highway and flipped over. Female passenger was killed. The male driver was transpored to the transported to the hospital with minor injuries. Its still not clear what caused the suv to go off the highway. The chp is trying to determine the cause of a deadly new years eve crash in a remote area of west marin county. You can see the car ended up in the water after the rollover accident near tamales bayer iy yesterday evening. A passenger was killed when the car flipped over and landed on the roof near shore line highway. Bystanders came to the rescue of the driver who was not seriously hurt. The 88yearold is being treated for early signs of pneumonia. She was admitted to Methodist Hospital in houston last night. Friends and family are sending her well wishes for a quick recovery. The hospital says shes in great spirits and is being visited by her husband and family members. There has been an outpouring of support for a little girl from livermore who is fighting brain cancer. Now her family is giving back. Yesterday, the parents of 2 yearold Delaney Newton held a blood drive at the church of jesus christ of latterday saints in livermore. Delaney was diagnosed with a brain tumor three months ago. Her family says the blood drive is their way of helping other children and families going through the same thing. People have been there to help us. This is the only way we know to give back is to is blood. You know, shes already had 14 plus transfusions. Hundreds of people have been showing support on facebook. Her father says she will have to go through more transfukeses and chemotherapy as part of her ongoing treatment. Today is the day the new healthcare reforms under the new Affordable Care act kick in. And the new year means bigger paychecks for some local workers. The two bay area cities seeing an increase in their minimum wage. It is 8 24. Both the San Francisco police and Fire Departments have put up the help wanted sign. There are currently 1450 firefighters in the city but the Department Tells the examiner it needs up to 600 more firefighters to handle the citys population growth. By the year 2040, San Francisco is projected to grow by a third to nearly 1. 1 Million People. The Police Department says it will need 300 to 500 additional officers. Starting today, some workers in the bay area will be getting paid a little more. The minimum wage is going up in san jose because of an ordinance passed by voters last year. Also taking effect today is an extension of the green sticker program. That means plugin hybrid drivers can use carpool lanes without meeting the minimum occupancy requirements at least until 2019. The law is one of eight authored by San Francisco state senator yee. San Francisco Police have identified the man they say led officers on a chase through the city. Police say 29yearold Jacques Samuel started the pursuit between 9 00 on monday night in the bayview district. The chase went on to interstate 80, 19th avenue and into golden gate park. Vallejo police say a suspected drunk driver rammed into a patrol car injuring two officers. Now, the police sent us a photo of the accident. You see that right there. You can see the suspects damaged mini cooper along the patrol car as well. The crash happened around 2 15 this morning on georgia and monterey. The driver was arrested on dui charges while the officers suffered minor scrapes but nothing serious. In San Francisco, a 7year old girl was killed in a pedestrian cash crash on new years eve night. She was walking with her mother and younger brother when a car turned right into them. Claudine wong is live at San Francisco General Hospital where the mother and her other child are recovering this morning. We understand you just talked to the witness at the scene. Claudine . Reporter yeah, thats right. We talked to a witness over at the scene where this happened before we came to San Francisco general. As you said, this is where the mother remains. Shes in critical condition. Her 7yearold daughter was killed. Her 4yearold son suffered minor injuries. The accident happened about two miles from where we are at the intersection of polk and ellis. Police tell us the family was in the crosswalk at that intersection at about 8 00 last night when a driver making a right turn hit all three. Police say they are still piecing together everything that happened but tell us the driver stopped and is cooperating with police. In the last hour, we spoke to a man at the intersection about what he and his wife saw and heard. I was my wife got out. Walking down the street. The accident just occurred. Jumped out of his car. Investigators say a truck hit them. Half an hour ago, we learned that the 19yearold died from her injuries while the baby boy remains in the hospital with lifethreatening injuries. Were still investigating the collision. We havent determined if any laws were broken, if theres any impairsment or anything else empairment or anything else of that nature. Police are still investigating to see who if anyone is at fault. The 17yearold woman was also hurt but her injuries are not lifethreatening. The 64yearold driver did remain at the scene and the roadway was blocked for about five hours overnight as officers investigated the crash. 8 34. Three separate shootings marred new years eve in oakland. Around 9 30 a young person was shot near 104th avenue and walnut creek street. The victim was hit in the chest and rushed to the hospital in critical condition. Police have not yet released the persons identity or age. There are no suspects at this time. Around 9 10 a woman was also shot in the chest in the 1800 block of 22nd avenue. She was taken to the hospital where she was later pronounced dead. Colorado is the first state in the nation to allow the sale of marijuana for recreational use. Retail pot sales began just a short time ago. Police were on alert all night long but the demonstration never took place. A medical facility in new york says it is willing to accept 13yearold jahi mcmath if her family can get her there. Jahis family wants breathing and feeding tubes surgically implanted to allow her to be transferred but oakland Childrens Hospital which considers the girl to be dead says it is etically wrong to perform surgery on a body. The chp says the driver was speeding over Railroad Tracks and went airborne, slammed into a parked car, a speed limit sign, plowed through two front yards, fences, damaged a bmw and landed on top of a classic 64 mistang.
