On the same day that president obama sat down in the white house with congressional leadership following the midterm elections and on the same day the pentagon announced u. S. Military presence in iraq will double. At the end of a very busy news day today, the white house said tomorrow the president will officially nominate lynch to succeed attorney genric holder. He has been confirmed by the senate in 2000 and in 2010, both times by acclimation. She also charged Michael Grimm with wire fraud and perjury earlier this year. President obama was able to tell some clear accomplishments. The good news is today we saw another good set of jobs numbers. We now have 56 consecutive months of job growth. More than 10. 6 million jobs have been created and the Unemployment Rate is now down to 5. 8 . Even as we enter into a new congress, the Previous Congress has promised to make progress on a bunch of fronts. Much need to be done this year during the current lame duck congress, according to the white house. Like emergency funding to combat ebola. And the request for an additional 5. 6 billion in the fight against isis. It will deemployee 1500 additional personnel to iraq in the coming months in what it calls a noncombat role. That deployment will double the u. S. Troop presence in iraq. Todays twohour lunch meeting also dwoet edwoeted a healthy af time to what has emerged as the biggest brewing bulge in the white house. Soon after Speaker John Boehner departed the white house, his Office Issued a statement reading ditto from House Majority leader, kecvin mccarthy. We also expressed to him if more executive actions are taken, that will make it difficult for us to always work together. We think we should start with a fresh start. Weve got a lot of bills in this house that have moved to the senate on economics, on Jobs Creation and thats really where our focus should be. To me, we should have the wisdom to listen but the courage to lead. And i think january should be an opportunity that we focus on that. And not have a situation why do executive orders when you have a legislative process which the americans expect to see. Ive got to go. And a veteran of you were there, youve been the majority, youve been the minority. Youve lived through the financial crisis and the first few years of the obama administration. What do you think of this fight thats now brewing over the immigration issue . I think the republicans are not to draw substantively. First of all, with notion hes preempting them, the senate can pass a bipartisan bill. It was a bipartisan bill that passed in the United States senate that wouldnt even come up in the house. I just heard my former colleague Kevin Mccarthy that the house didnt take it up. The Senate Passed a bipart san bill and the house wouldnt let the subject come up. They refused to do anything. So you think he should do it . Yes. Exactly what he should do has to be he cannot abdicate a statute, but theres one other point. The terrible statement they both made and mitch will be stopped from working together when they do agree. That is the essence of obstructionism. You agree, i work with people on this and i dont work with them on that. But theres threat. If you do what you may have the legal right to do, who i think the president couldnt do it within his constitutional right, we will withhold elsewhere. In other words, what theyre saying is we think it would be good Public Policy for you not to work together. But youll with so mad, you wont do it. Theyre saying the same thing. Hes saying if he does that immigration thing, it would be like waving a red flag in front of the bull. His party is the bull. A dumb, outraged animal overreacting to a piece of cloth. And if the president does what he has a legal right to do, theyre going to punish the country by not doing other things that they think are good. A really important point. What youre saying there bears some emphasis. The whole way that working across a lot of differences works. You just find the venn diagram and ignore all the crazy instances. Youve got to establish this. Tray gallery, whos a Big Tea Party guy and they put in charge of benghazi, he actually said in the kNew York Times that he hd a meeting with eric holder and we owe for jail people. Its a perpetuation and he said, you know, a lot of people on our side, conservative republicans, agree with holder on this whole question of reform. But we cant do anything because of his position on samesex marriage. Thats the whole definition of extremism. If you disagree with one issue, they will punish the country. So youve got this immigration fight. Theres two other things that are sort of cued up. Shes been its a smart move by the white house because shes got impeccable credentials. Shes the first black woman ha that would be attorney general. Shes a prosecutor. They cant claim that shes a body with no particular law enforcemented. Shes from brooklyn. Whats your position . I think they will confirm her. Unless they can definitely find out something. Remember, the filibuster doesnt work. And let me just address any potential objection to them doing it in the lame duck session session. You mentioned one of the things that i was thinking. The Republican House impeached bill clinton, the technical term, he wasnt convicted, but they impeached bill clinton of the lameduck session in 1998. Its the members of congress who were elected in 1998 were voting, one of the articles wouldnt have passed. Several voted to impeach bill clinton and several didnt work. You can impeach a president , but you cant confirm an attorney general . Thats ridiculous. Woe got the announcement from the pentagon today. What i thought was there was lots of stern and drag on this. But very little policy degs agreement, as far as i can to e tell. It seems like whats going to happen is both parties were going to be passed to give the president prior authorization. Both sides agreed to put it off until after the election. I give the president question. E credit. He said i will bomb them if they use chemical weapons. And he then said, which was entirely appropriate, if congress will aught rise that. He didnt defie congress. He was attacked. My own view is that this is a great mistake. Look, the advisors are fighters. I havent talked to one guy who had been in iraq several times. Am i right standing next to them and shooting . Ofg it does. You dont go into battle with people. And as far as trainers are concerned, why would they need trainers. Who trained isil . Who trained the taliban. Ets not as if the people on our side, you dont hear them about the good guys. But the people who were hoping win, they dont have any di disadvantage of others kbept morale and training. Whats your read on john boehner. Youve been next to the guy. You know the guy pretty well. Earlier today, the Supreme Court upheld the constitutionality of the Affordable Care act. In doing so, theyve reaffirmed a fundamental princips principl. That here in america, in the wealthiest nation on earth, no illness or accident lead to any familys financial ruin. After all the legislative battles of obamacare and the endless, endless political fights, when the Supreme Court upheld the mandate, it felt like president obamas signature law was cemented. That was until today. Yet, another challenge to obamacare, this time on hinging on a constitution with a single phrase in the text of the law. That issue, one of the 36 states can offer the insurance subsidies that make the whole Affordable Care act work. Those subsidies are available through an exchange established by the state under section 1311 under the Patient Protection and Affordable Care act. It later establishes that if a state elects not to set up its own exchange, that responsibility falls to the government. It has been evident, ive got to say, to just about nearly everyone, that congress intended the subsidies to be offered through both state and federal exchanges. In fact, some of the chairs of the real valevant congressional committees just had in an op ad last week. Some opponents of obamacare argue that that single phrase in the law should be interpreted literally. Up to this point, their argument has only managed to convince a few conservative judges. Now, it will go before the Supreme Court. If a majority of the justices buy the argument, listen to this, 4. 7 Million People would lose their subsidies and probably their insurance and the individual market, as a whole, could very well fall entirely apart. Mplts joini joining me now, tom goldstein. Tom, are you surprised they took the case . Im not. The issue is so important. The legal question, even though the administration is likely to win, is really close. The justices are familiar with the law. They decided, i think, that they need to take it now because a lot of the provisions that are affected by the sub sill days go into effect over the next couple of years. So theyve decided weve got to get an answer. Why do you think you just said the administration is likely to win. Why do you say that . Everybody knows this stay chut is a bit of a wet mess. That there are a bunch of provisions in it that arent clear. And there are hundreds of them that the administration has had to implement the biggest provisions in the laws. This is just one of those where there are other provisions of the same law in which everybody agrees that they have to be referring to the federal government. Look, because the law says the states will establish the exchange, thats why theres the reference to the state establishes exchanges. But the law also says hey, if the states wont step up and do it, the federal government has to take care of it. Heres one of the things that i think about. The Supreme Court is a legal body that exists in the role of politics. When i think about the day that the Supreme Court announces to 5 Million People, youre now going to pay 2,0 2,000 more or 3,000 more in insurance that you cannot afford. I just imagine what that can do for the institution of the court for the court to announce such a thing. I have to say that if i think the justices really believe that the law required that result, they would do it. They would say go back to congress and get a new law. If its a close case, the law says the doctrine of the Supreme Court says you give the administration the benefit of the doubt. What i really learned in the last challenge to obama care that you talked about in introduintr introducing the story, that the five justices there decided that this is a political question. Its not one thats going to be resolved by the sbreem court. Weve been debating for decades. I think the same thing is going to happen here. You made this key point, i just want to sort of reaffirm this. Statutory interpretation is a complicated undertaking. Agencies have to do it all the time. They get contested a lot. Theres a pretty good Supreme Court pres dent that says you defie the agencies, right . Right. The job of the executive branch is to put the laws into effect. So the federal ledge e register, which is the document that produces these regulations, thiss got to be hundreds of thousands of pages of regulations. And the rule of law is if the stay chut is ambiguous and the arraign agency is charged with. Thanks for being here. It was not a total sweep for the democrats because theyre not going to have control of the state senate. It means quomo is in the governor ship. And that is a really big deal. Because progressives in new york desperately wanted unified democratic control of the government so they can pass a bunch of progressive legislation. Andrew quomo, a guy that you think would be in favor of that, hes a democrat afterall, has been kind of ambivalent. Hes got kind of a thing about ticking off liberals. He made a promise to a family here in new york called the working families party. They both needed each other even though they both hated each other. They wanted to appear on their ball lot line so they could get a lot of votes. And so they came to an greemt. Andrew quomo would get the nomination, but hed have to go out and campaign hard to get that senate majority. This is what he told me. Lets unify around the simple goal taking back the senate. Democrats in rural areas,. Up state, down state, we can do this. Politics is often about seizing the moment. And this is our moment. To seize. If youre thinking of that video and saying it looks like a hostage video, you wonder if theres a gun pointed at him offcamera, youre not mistaken. Almost soon after that, cuomo seemed to pretty sharply back away. He didnt spend a ton of time campaigning from e from senate democrats. He took a ton of money and decided to spend it on starting an entirely new political par tiff focusing on women. Which, of course, who could be opposed to that. He called it the Womens Equality Party. It was just created by andrew cuomo with a spare campaign pad which isw. E. P. Sure did look li the initials w. F. P. They thought that andrew cuomo spent a couple millions of Campaign Cash to work for the group of progressives that he had managed to get the nomination from. Are you following . Okay. Heres where it gets interesting. The womans equality party, they have a list of supporters on their web site. One of the names is a woman whos been on this show. Weve had her on a show to talk about a variety of issues. Shes an activist in brooklyn. I noticed before she tweeted i never signed on. I never attended any events or rallies. That needs to be corrected. I am on it. Hmm. There are also some other supporters, prominent ones, who would later urge not to support the equality party, but, instead, the open families party. You can see they all released videos urging people to vote that way. So we talked to the Womens Equality Party and said whats the deal here . Todays ebola news is that by the end of the day, texas will be free of the deadly ebola virus. As for the isis threat, New York Times reports this week that the deadly terrifying isis force appears to be stalling. They were the dominating features in the campaign season. We know that conservatives and liberals sites conservatives more than it does liberals. In a recent study, john hibbing arguing that conservatives have something called negativity virus reacting to threats of greater negativity than their liberal counter parts. Yeah, i think, like, the perfect expression of that for me was when representative mike cowley from pennsylvania would suggest that they would infect themselves with ebola, fly back to the United States and commit bioterrorism. And there was this interesting dynamic that was playing to the media im part of that media but were covering isis and ebola which are pretty much genuine news stories and the campaign trail. They were all pumping this. We know that this is particularly conservative. It does. I also dont think, though, that democrats should conceive republicans. News e these are real threats. The threat of losing your job, the threat of dying. The democrats in this midterm messaged that for example another ferguson might happen. That had an effect on turnout. And i doebt think that all fears are rationed. Youre calling for a kind of race to the fear bottom. No, no, no. You confect fears to real issues that that voters are legitima legitimately anxious about. Those are rational fears to have. Theres also a fear about being so grossly instrumental to me. Nobody else running around. I think the war on messaging was clunky. It seemed like the democrats had Nothing Better than hoping for another richard murdoch. Imstead of connecting those issues to economic future, the economic ability to do. I think thats politically awesome. The work is scary. It is anxietyproducing. Government hacked into her home and computers in an attempt to interfere with her rereporting. A cbs executive came to doubt the impartiality of her reporting, conservative groups honored atkinson as a mainstream ally. She contributes her news to a combination of liberal bias and a network afraid to anchor powerful forces. She maintains the network increasingly refused to air her stories on benghazi though in all analysis, theyve ran more newscasts on benghazi. So theres this claim about hacking in the book thats the sort of the center of the book. And in response to people questioning it or wanting further corroboration, you released this cell phone video. I think we have it. Could we show that video for a second . So this, as you see, its like a word document. Theres just words being erased. Seriously, your hands arent on the keyboard. Theres just words being erased right in front of you, which, as a writer, would be terrifying, actually. I could think of nothing more terrifying. But is the claim of some Government Entity hacking your computer in realtime . No. Thank you for asking. And it was not released, just to clarify in response to questions about the case, for example. It was just a video prereleased before the book came out. That i would call a visual anecdote of something that happened some months after the three Computer Forensics exams confirmed these islely sophisticated remote intrusions. Hacking is one way to call it, i guess. But i consider it as nontechnical person, a longterm monitoring and surveillance based on the dates that the Computer Forensics showed. I just want to connect the video to that. You think its an instance of some remote surveillance. The video was an instance of when i was working at home, at a time in particular, facing a lot of specific pushback and problems of the white house, in fact, that day, in particular, of which the access of my computer, i couldnt control it for a period of time. And although some people have kind of mistakingly, without the forensics of the context analyzed it. What really happened was pages were wiping in a matter of a couple of seconds. It wasnt sort of a backspace key or a delete key on the computer being held down. Theres been a number of accounts of people looking at this third hand, computer experts saying this looks like someone with a stuck key or something. I guess my question about this video is this is a really big claim. Its not a claim thats implausible on its face the government would hack into a reporters computer. That seemed i could be persuaded by that claim. Particularly the idea that live as youre watching, someone is remotely presummablely that youve loaded this file, remotely deleting your text in front of you, what is the evidence of that happening . You mean besides med observing it happening . Well, computers do crazy things all of the time. Like my computer will do nutty things where i went through periods where my laptop was clicking on stuff i wasnt clicking on and i didnt think theres the nsa. And certainly i didnt when things were happening the year before. It was only after sources and then the Computer Forensics exam. So with that context, the months of time that passed after that under which i was getting more and more forensic evidence about what they were doing and what they were capable of. One of the things that forensics evidence showed was although they were monitoring me surreptitiously, they had the opportunity to monitor me remotely as if e i was sitting in fropt of it. Im sorry. Let me just ask this question. Who is the they . In which sentence, im sorry. The they were able to surveil. Who is the they . Whoever it would be that is responsible. But who is that . Therein lies the question. I think that thats a large part of what the Computer Forensics investigation is aiming toward. You write in the book that the source told you who it was, right . Yes, yes. So then you should then you know. I think i know who was responsible in the macro sense for being behind the effort. Not necessarily the guy sitting behind the keyboard if such a thing exists. That was based on a human source that i trust and its not something that im comfortable with naming and releasing. So theres one source who told you unnamed who is doing this to your computer or who is engineering what you say is the surveillance of the computer . Thats right. Now, when you talk about this well, you dont want to name that person or expose that source . I just have reasons. Im following the advice of my attorney. Im just not comfortable with using the name right now. I dont think its a good idea. Cheryl, heres my question to you. Youre a reporter, youre a dogged reporter, as shown in the book. Theres that old saying as an editor, if your mother says she loves you, check it out. Theres that feeling that big claims mean big corroboration. It just seems when im going through your book and im watching the interviews, its, like, theres some unnamed forensic experts. I cant talk to them. Theres one guy whos named, but he has a confidentiality agreement. And so theres an unnamed source. Maybe its true, but it just seems so impossible to independently verify that what you are alleging, which is a really big deal crime committed against you and a violation of the constitution, that theres nothing i could hold onto to kind of double check the work . I get it and i will say two things to that. I think there will be more information fort coming. Some people will never be satsz filled with what they hear. But i also think ive seen people who ask questions keep a great deal of understandable ske skepticism on me and none of the entities raising with the socalled counter experts, to my surprise, would be willing to expert an opinion on something for which they have no forensic evidence and no first hand information. And, yet, their claims being une kwif cably accepted and without their questio their credentials being questioned. Thats part of the problem i discuss in the book. Theres a little bit of an asymmetry. And, again, i want to be very clear about this. The idea that the u. S. Government would surveil or hack into the computer of a journalist is a, both a serious accusation and, b, not to me ridiculous or implausible and the kind of thing you should just schlup off. I could see that happeningment we know the powers the nsa has. But i guess my question is is there any way that me, chris hayes, can talk to someone . Is there an independent forensic expert that i can sit at the computer with . Is there any way that we can confirm this in a publicly accessible way . I think that you can look at a partial press release that partially discusses one of the three forensic exams that cbs news put out that confirmed what i give a little bit more detail about in my book. I think these hints of information that you have that corroborate what i say, yes, then there may be, at this point in time, what for someone like you would require a leap of faith. And youre certainly within your right to say hey, i dont see the evidence there. Im not here trying to convince you of something that you find unconvincing. Im just telling you, in this book, my experiences and observations and you can do with that what you will. Considering what they looked at, they paid special attention to a file i had on benghazi and another case. They paid special attention to photographs i had taken relevant to fast and furious. The only theory that i can come up with that makes the most sense, placing it with the forensic evidence and the timing, is that they were surveilling and monitoring me, whoever the interlopers were, to find out who i was speaking to, who was speaking to me much as they were aparentally legally doing who the government was legally doing in the case of Associated Press and fox news. There were efforts to find out what leakers were speaking to these people. And i, too, was dealing with government when i say 8 blistli sour sources that so, again, they is the u. S. My assertion is that the forensic examinations showed that there were government ties, in other word, the very first one said the software used was a commercial, nonattributal software proparietal to a government agency. Now, i dont know everything he used but i was told that the software wruz used by one of four threeletter federal agencies. I certainly didnt suspect that or know about that. I certainly didnt think the government was surveilling me. It was only when the forensics evidence came back. I want to lay out the most cynical interpretation of what youre doing so you can respond to it. Because there are some people interpreting it this way. Heres what they say. You perhaps know theres a very active world of con essentialtive media. It can be very lucrative. People sell a lot of booksment youve got this book. There are a bunch of fox news personalities. People look at this and think oh, well, she just sort of saw the writing on the wall. She was not happy at cbs or being pushed out and she thought i can make myself a big, conservative hero and go out in passion of the conservative media. What do you say to people who are watching this and drawing that interpret taegs. Well, the first thing is discussed in the book. When you take second hand report, for example, you werent at the book party. I dont blame you from picking up the book news. They left out the fact that there were people there from the center for public integrity, whistle blowers, the former director of the acorn office in washington, d. C. This certainly was a very mixed party. But, as the media reported it, yes, they made it sound like some sort of conservative party. Darm isa was there, though, right . Absolutely. There were conservatives and liberals there praising me. Yes, thats true. But the leave out the other part is sort of a syndrome thats been going on in the reporting about what i do. As to whether you think im cashing in on this, youre free to draw that conclusion. I really dont know what to say to that except if you want the read the book and find it interesting, you can draw your own conclusion and some people may say yes, thats exactly whats happening. And others may find it honest and insightful. I will give you points to your response to the 5 00ization youre cashing in saying buy the book and see if you like it or note. Youre sitting here talking to me right noi. Theres some people saying youre a conservative i could care less what your politics are. People should just be honest about them anyway. But people are watching you, like, are we going to see you as a Fox News Contributor or writing for a conservative out let next . Can you tell me right here that thats not the way this is going . I cant tell you whats next. I havent made any decisions or commitments. But i dont know if you eve had a chance to read the book, and maybe not. But many things in there talk about the conservativconservatie news. The idea that this is somehow a book that goes for conservative interest has been perpetuated. That notion by the same people that want to disparage what i do. Theres a lot of stuff about advertisers and editorials and the fluffiness of the fuse and the possibility of investigative reporting and getting it in even when, you know, it might threaten important business centers. So i totally agree. And political stories such as Rachel Maddow about msnbc praising my work. The emmy awards ive won investigating bush administration. For example, the bait and switch on tarp, the bank bail out. The emmy i won last year involving the investigation i did last year on hi pock ra sill of fund raising with the bigmoney donors. So i think its a little oversimilplistic and unfair th paint my book as solely considered in conservative interests. Cheryl, come on. You know where your bread is being buttered right now. You are like the toast of the town over at fox news. I guess if you say so. I would say this is maybe the first or second time ive been invited on your network, but its not because ive chosen who inviets me to speak somewhere. Ive also been on cspan and aljazire quite frequently. E eve had discussions with many Different Networks and places. Im certainly not skewing my appearances. And i think they are sometimes skewed in their reporting, the diverse groups that ive appeared on, disappear when people want to report about me as a conservative.
