Whistleblower complaint that the Trump Administration is trying to keep secret from congress. Two people familiar with the matter telling the Washington Post that it centers on ukraine. Nbc news has not confirmed that ukraine is at the center of the issue though. And the white house did not immediately respond to a request for comment. The post citing two former u. S. Officials, previously reported that the complaint was made by a u. S. Intel official who was alarmed by a promise the president made to a foreign leader in a phone conversation. Trump spoke with the new president of ukraine on july 25th, the whistleblower complaint was filed less than three weeks later. Ukraine is significant because of reporting that the president was withholding military aid to that country. While at the same time trumps personal lawyer, rudy giuliani, was pushing for the Ukrainian Government to investigate democratic president ial frontrunner joe biden, and his son hunter. The confluence of these two stories has the house investigation of the Trump Administration, if the Trump Administration withheld aid to assist the president s reelection effort and the Washington PostEditorial Board accused the president of trying to meddle in the, ukraine to meddle in the election on his behalf. Meanwhile, the president denies the Washington Post report that he made a promise to a foreign leader tweeting another fake news story out there. It never ends. Virtually any time i speak on the phone to a foreign leader i understand there may be many people listening from various u. S. Agencies not to mention those from the other country itself. No problem. Is anybody dumb enough to say that i would Say Something inappropriate with a foreign leader while on such a potentially heavily populated call. The House Intelligence Committee chairman adam schiff is threatening legal action against the Trump Administration for reversing to hand over the contends of the whistleblower complaint. The Inspector General of the Intelligence Community met with the committee yesterday for a closed door briefing. A congressional source telling nbc news the Inspector General declined to reveal to lawmakers the substance of the whistleblower complaint. Someone is trying to manipulate the system to keep information about an urgent matter from the congress. I believe that there is an effort to prevent this information getting to congress, and if the assertion is accurate that the department of justice has made and the dni has affirmed that this involves a potentially privileged communication, then at one level or another, it likely involves either the president or people around him. So meanwhile, acting director of national intention, joe mcguire, is scheduled to appear before the House Intel Committee next thursday, the senate Intel Committee is also expecting to be briefed by mcguire next week. According to nbc news, the number of complaints made to the intel watchdogs confidential hot line has more than doubled since President Trump took office. According to the latest public record, or public report by the Inspector General of the Intelligence Community, the hot line received 563 contacts last year. That is up from 251 in 2016. And 369 in 2017. The report doesnt describe the complaints or tally how many of those to the level of an urgent concern a category series complaints that must be turned 0 ever to congress. Talk to me about this report that ukraine may be involved in all of this. What do you make of that complaint by the government whistleblower . Well, i think the speculation at this point, and a lot of this is speculation, because there are so many unanswered questions, is that perhaps this has to do with an issue that the House Democrats already are investigating, whether or not the president s attorney rudy giuliani, who you just mentioned, and we heard a sound clip from, tried to pressure the ukrainian president to open an investigation into joe biden, perhaps President Trumps 2020 political rival in the general election, we dont know yet, but concerning allegations and unsubstantiated allegations at this point, that joe biden tried to influence the Ukrainian Government to, you know, to, on behalf of his sons business interests. And so right now, you know, theres so many questions that are unanswered, but tongues are wagging in washington, this is a mystery that is consuming this city, and will consume this city, because there are still so many unanswered questions. So to that point, with the fact that washington is going to be consumed by it, certainly members of congress on the democratic side, as they start to pull some of these threads. What kind of impact might this actually have on President Trump, Going Forward . Well, you know, a big question that i have at this point, is will this whistleblower come forward. You heard adam sif, the Intelligence Committee chairman yesterday saying basically his lines of communication are open if the whistleblower does want to come forward and reach out to the House Democrats and the Intelligence Committee. So you know, we will be watching to find out if that is in fact, the case. If this whistleblower wants to get out there in the public spotlight, if this whistleblower, it seems like, will have a platform at least with the Intelligence Committee, perhaps there could be public hearings, we dont know yet, but you know, these are some of the story lines that well be watching as this story moves forward. That would certainly be a huge ask, to put the pressure on the whistleblower. Some people have been saying to come forward. Some people saying if there is no traction on this by congress within a week, he should come forward with the information. He or she. Absolutely. Scott wong, thank you. We like to pick you on everything that is happening in the world legally speaking and the big story i think this morning is to do with this whistle blower, i think a lot of people might be watching to say what happens in a situation like this legally speaking when you have the branches of government at odds and a private citizen, a government worker potentially with an explosive complaint against the chief executive. Legally speaking, how could this play out . We have federal laws that encourage citizens and federal Government Employees to blow the whistle, to talk about something that they see illegal and to report it, and then we give those people protections. Now, the key is, what is it actually that theyre reporting . In many cases sometimes people report things that really dont have, dont fit within the whistleblower statute. They may not be entitled to that protection. But generally speaking, our government encouraging people to come forward and essentially blow the whistle on something that they see that is illegal. One of the biggest areas of wrongdoing and it doesnt necessarily apply here is the area of waste, or embezzlement, things that have to do with money and under some federal laws there can be a bounty, a kind of reward for people who do whistle blow and reveal government fraud, or illegal spending or Something Like that. So two things. What type of job, or Security Protection does the individual have if they were to publicly come forward. And then secondly, what are the ramifications on the executive branch in general, or possibly the president , if it were to be revealed that a conversation was had in which there was a tit for tat, quid proquo, you investigate this and well give you the money . Two ways of looking a at this. First, if federal law protects someones job and protects them from employment retaliation for reporting, the practical effect is this is such a high profile situation, that this individual, whoever it may be, may find that even though their job could be preserved, that the fact that Everybody Knows who it is, may make them radio active for future government employment. So that is a challenge and thats why many observers have suggested that the mere fact of doing this as a kind of kamikaze approach, that this is a onetime deal, even if that job somehow was protected under federal law, the political and practical effect is that your job employment prospects change dramatically after Something Like this. Im proud the Financial Services and general government bill included a bipartisan amendment providing another 250 million for the administration and security of elections. To help states improve their defenses and shore up the voting system. Im proud to help develop and cosponsor it in commit. That will bring the total allocation to Election Security listen to this to more than 600 million since fiscal 28. Its a crucial issue. And minority leader Chuck Schumer reacted to mcconnells apparent turnaround on Election Security later on the senate floor. Leader mccomfortable kept saying we dont need the money. I made umpteen speeches here at this chair and the republican leader denied the need, but now, thank god he has seen the light. A spokesperson for mcconnell told the Washington Post that schumer was mischaracterizing the Republican Leaders position and maintained that the amendment was really a continuation of previous years funding. President trump has filed a lawsuit in his bid to keep officials in new york from gaining access to his tax return, filing the suit against the Manhattan District Attorney in the Southern District yesterday, naming vance and the top preparer as defendants. The suit claims that vance should not get trumps tax returns arguing that a sitting president is not subject to the criminal process while he is in office. It is something that a lot of people still will not give up on. Thats exactly right. I mean democrats want to make sure that they have President Trumps tax returns in hand, so that they can scrutinize it, for any irregularities, obviously there has been a lot of allegations made against the president , regarding you know, perhaps not paying enough taxes, or certain payments that were made to people, and in the california case, i expect this to, once the final ruling comes out, to be appealed to an appellate court, it is entirely possible that this ends up somehow in the Supreme Court, where the Supreme Court would be ruling on the president s taxes. The House Democrats are still seeking the federal tax returns, but richard neil, the ways and means chairman, specifically, but right now, as we know, with many issues, President Trump is stonewalling and preventing the release of his tax returns. So President Trump is fighting on multiple fronts here. The local level, with the manhattan d. A. At the state level in california. And at the federal level with House Democrats. I have a feeling the president is going to be fighting this thing tooth and nail all the way to the very end. Lets talk about this aboutface, despite mcconnells team says that this is not necessarily an aboutface, a reup in funding with regard to Election Security. What does this mean for state funding as 2020 approaches . Well, it means that states, it looks like states will be receiving a chunk of money to help shore up their election systems amid reports that russia and other foreign governments continue to try to influence our elections, especially the 2020 elections. We know there were attempts, in the recent 2018 election, that looks like theyre continuing to try to influence our elections. Democrats are saying this simply is not enough money for this type of Election Security. They want 600 million, as was passed by House Democrats in the house bill. And so perhaps this ends up somewhere in the middle between 600 and 280, were not sure, but it means states will have some funding to help shore up Election Security. Take all of this that youve been talking about, with everything that weve been discussing, and give me your best analysis on whether or not we will have another Government Shutdown come the end of november. It seems like there is a short term spending bill you want him to be the grim reaper of news this morning . Youre better informed than us, how do you see this playing out . What are the rumblings in dc . Be optimistic, wong. In the past we had Government Shutdowns because President Trump insisted on funding for his border wall and that issue has been sort of taken off the table because he is, you know, using other methods to get that money, taking it from the department of defense, the pentagon, and some of those construction projects, so that issue has not really been centered to the funding fight. You saw yesterday the house easily passed a cr, so were at least funded through thanksgiving. That will be sort of the next goaround is whether we have a shutdown right before thanksgiving. Most likely, i think what the congress is going to do is punt it to christmas, and then they could in fact, punt it again as they often do in this town. Such good punters.
