Wasnt ready to give an answer on impeachment or the 25th amendment, but didnt rule it out. How many she noted there were 40 of House Republicans voted to certify the election. Who of that group could join . Its hard to see how many people in that group will come out and publicly support getting rid of the president because for so many of those republicans, not joining on to the objection, was a big step within itself and probably would have been much smaller if the riots didnt happen yesterday. You know, the president is losing grip of the Republican Party, but theyve also the Republican Party, so many of them, have also been pretty silent today. Were hearing statements up and down the board from democrats. We heard from the speaker of the house calling for calling the president dangerous and theres a sense of urgency to act immediately. If we have that sound of pelosi, if we could play that so we can hear it in her voice. Lets listen. I join the Senate Democratic leader in calling on the Vice President to remove this president by immediately invoking the 25th amendment. If the Vice President and cabinet do not act, the congress may be prepared to move forward with impeachment. That is the overwhelming sentiment of my caucus. Reporter that is a key republican that is also necessary in this plan, Vice President mike pence, Chuck Schumer the democratic leader held a News Conference up in new york where he said he and pelosi called the Vice President this morning. They were on hold for 25 minutes. Finally were told the Vice President was not going to come to the phone. Thats why he and pelosi have come out publicly urging the Vice President to join and for these 25th amendment proceedings to begin, chuck. Tom winter, there are arrests being made on the capitol right now for those who had stormed the capitol yesterday, including one man who was armed with 9 mm. With ammunition and a bullet proof vest. What else are you learning . Reporter thats right, kate. Thats Christopher Alberts who was arrested yesterday at 7 30 p. M. In the course of clearing the capitol. When they made this arrest, this individual apparently had a handgun on him, as well as a bullet proof vest, 12 rounds of ammo. That was one of the individuals arrested. Another individual and im working on that persons name, was arrested for repeatedly punching an officer with a closed fist. Today what were getting is a very barebones charging document. Not one of these big expansive indictments we might see in a normal case. These are the basic facts in order for the feds to move forward with a federal case and have the necessary facts to make an arrest. Were getting preliminary details here right now, katy. Two individuals have been charged. I may have received an update with additional charges. Hang on one second. The other individual is mark leffingwell. Hes been charged with trespassing, assaulting an officer and violent entry on Capitol Grounds. That was the person who struck the officer. Christopher alberts apparently tried to flee. He was identified by Law Enforcement enforcement. He said he was carrying the gun for protection and did not intend on using the firearm to harm anyone. The ages and hometowns of these individuals have not been included in the charging documents according to Pete Williams who just updated us on this. Bottom line, two people charged federally. Expect more based on the statements from the acting attorney general Jeffrey Rosen and other federal Law Enforcement agencies. D. C. Has very strict gun laws. Carrying a loaded handgun on Capitol Grounds is not legal. We have some 80 odd arrests between Capitol Police, those are d. C. Charges, as well as local police there. Ali velshi, youre outside the capitol now. Were surprised that there arent more arrests. All those people came out of the building. How were they let go . Were hearing pictures are being matched and postings are being sent to cities around the country to try to find and identify some of these people who were posing in pelosis office and sitting inside the chamber and holding guns. Why were they let to walk out and not swooped up . Reporter well, a lot of video weve been looking at. The first video was how people got in, kind of amazing. You would see a few Police Officers and they would storm. One of the things inside the capitol is theres a lot of cameras. Everybody who was in there who didnt have their face covered, their pictures are there. There should be more arrests. What you can see in front of the capitol is 7foot fencing has been put up. Its a beautiful day. There would normally be a lot more people around here. There are a lot of police around here now. You have state police from new jersey, virginia, pennsylvania. You have maryland police. You have Maryland National guard and virginia National Guard all over here. Theres a lot of action. Theres still some small protest groups around. We had a couple trucks go by with trump flags on them. Just over there were hearing reports of a suspicious package. The bomb squad is there. The question you ask is the main question. The rest of us knew a lot of people were descending on d. C. We knew and were signalled by donald trump that they were going to march to the capitol. It caught folks at the capitol off guard. The sergeant of arms has offered his resignation. The chief of Capitol Police has not. Nance pelosi is calling for that. At the moment theres some action around here. A lot of police and a lot of National Guard. The rest of d. C. Looks like a ghost town. Everybody else disappeared. A lot of people were day trippers for this yesterday. As soon as the curfew was imposed last night at 6 00 p. M. , most people chaleared out. D. C. Looks unusually quiet with a heavy Police Military and security presence around the capitol while theyre trying to figure out where these people are who walked in and walked out. Lets hope it stays quiet. There are real concerns it wont. Rush limbaugh is on his radio show talking about violence saying theres a lot of people calling for the end of the violence. Theres also the question of pardons. Weve been talking about this story before all this violence broke out. There had been talk about the president wanting to pardon himself, members of his family. Is that playing into any of the considerations in moving quickly on this . Katy, there are two reasons. First is National Security. What went through your mind when you watched those events unfold . Well, i was watching with my teenage daughters. They looked at me and said, mom, i thought you said 2021 was going to be better. Anyone who was paying attention saw this play out in michigan eight, nine months ago. I called on donald trump i called and spoke directly to mike pence. I called on Republican Leaders in michigan. We have to bring the heat down. The Death Threats were rolling in. None of them did a darn thing. Months later, the very people that stormed our capitol with long guns and automatic rifles meant to intimidate law makers which is what happened last night, some of those very people were implicated in the plot to kidnap and kill me. Words have consequences. We have a leader in our white house who has been egging this on, who has been encouraging and excusing this. These same people threatening to kill me who he tweeted were very fine people i should negotiate with. We didnt hear anybody in the Republican Party say domestic terrorism will not stand. Now were seeing people stand up. Im glad they are now. Whether im the target or dr. Fauci or the secretary of state of georgia or the whole congress, its wrong. These people need to be held accountable and people on both sides of the aisle know were americans before we think about oufr ouf ourselves individually. Is your Law Enforcement in a state of heightened security for what could happen in michigan, as you said, we saw the Michigan State house stormed earlier . Yesterday there was another protest. There have been protests. People can come together and demonstrate. Thats not in and of itself domestic terrorism. What we saw last night, what we saw play out in my capitol earlier last year, thats scary. Thats when people are trying to incite violence, threaten one anothers safety. We had someone call into a bomb threat into our capitol this morning. The police investigated. There was nothing there. I have checked in with my colleagues across the country. Its not unique to measuichigan. I know this kind of incitement is encouraging this horrible behavior across our country. We cant turn a blind eye when it happens to one person. Everyone of us has a duty to call it what it is. These are domestic terrorists. They need to be held accountable. Im grateful to see people are taking this seriously now. I think about what would have happened if they had when it started eight months ago. We had the congresswoman on earlier and we all recall what happened when she was questioning attorney general barr about what happened to you and the assault on your capitol and he said he didnt know anything about it. All the praise he might be trying to get yesterday by condemning what the president did yesterday, he never followed up on that. You had support from the fbi, but not from the attorney general of the United States. Thats the level it has to be at. Its not going to be the president. The New York Times now reports President Trump has discussed pardoning himself with multiple aides. Joining us now is washington correspondent for the New York Times mike schmidt. This is the president talking to aides about pardoning himself amidst his legal exposure in the last few days. Tell me what you learned. In several conversations since the election, the president has told aides he is considering this. This is something that he thinks he may have to do. Its a highly controversial move. It would be one of the most extreme uses of president ial power ever. If it was something that stuck and would take some time to figure out if it would stick. Its something the courts would have to decide. It would in many ways put the president above the law. Theres a Justice Department policy saying a sitting president cannot be indicted. If a president could pardon themselves, there would be no way to hold a president accountable. A lot more than just Donald Trumps criminal fate would be riding on such a pardon. Of course, we understand our own nbc reporting was hes had these conversations with Rudy Giuliani. Giuliani has denied it. Sources are telling nbc that has taken place. Its one reason not to resign because he wants to pardon himself, but he can only pardon himself for federal crimes, not for any state crimes that may be brewing against him. Correct. We believe in the next two weeks he will complete that and do some more. Something else in the story that stood out to me is the fact that this is now coming in the context of that unbelievable phone call that the president had with the republican georgia secretary of state. There were some questions of legality and issues around that that the New York Times is reporting prompted these conversations to resume on the questions of pardons specifically. That was widely criticized. This is an acknowledgment that he was a bad judge of character with josh hawley, at least as far as hes concerned. Danforth the grandson of the founder of the ralston purina company. I hate saying that word. I struggle with it. This is the single most respected person in the missouri Republican Party. Plenty of people will say hes a bush republican or a rino. I wonder if josh hawley and ted cruz will become the republican skunks at the party. This is one of those danforth sent a major signal to the mainstream Republican Party and republican members of missouri. In st. Louis the st. Louis has been a republican money hub, not for your trump type of folks, but your bush republicans. I think this is going to have impact. I know some will say a retired senator i think it sends a signal. Its going to hurt him locally. It really will hurt him locally, particularly with more traditional republicans. You saw what happened in the suburbs to the georgia republicans. Last night watching the debate on the senate floor, watching mitt romney behind josh hawley as josh hawley was speaking, his eyes were telling. Hearing mitt romney give his own speech, it seemed like one senator after another was directly yelling at both josh hawley and ted cruz. Im going to be curious to see how theyre treated during the next session. And romney got bipartisan applause. That never happens on the senate floor. Thats such a good point. It was a powerful speech. After being forced to shelter in place, several House Democrats are preparing articles of impeachment against senator trump. Joining us now is democratic congresswoman Sheila Jackson lee of texas. Shes on the Homeland Security committee. Congresswoman, you were a vocal supporter of the first round of impeachment. A second impeachment would be unprecedented. He would be the only president to have been impeached twice. Let me just say this incident yesterday, this catastrophic failure of security, this trump dominated violence clearly calls for a recognition by the American People that donald j. Trump has violated and abused his power. Clearly elements of impeachment and certainly he hasnt taken care to execute the laws of the United States. As a member of the black caucus, were interested in impeachment. Im introducing impeachment resolution that speaks to the vileness of what happened yesterday and the direct involvement of President Trump in this violence that was a direct attack on the members of congress and that is illegal, to violently attack members of congress, almost to the extent that all of our leadership would have been in jeopardy if these individuals had had their way. Congresswoman, when these far right extremist groups, these White Supremacy groups, proud boys, however you want to describe them they were there was a time that Homeland Security was tracking these entities. Then we know early on this became something in the Trump Administration that they it seemed to get they didnt want to get near this. Do you think now with this incident, do you think youll use your committee to make sure a biden administration, make sure the dhs this is a domestic terror threat, these White Supremacy groups, proud boys, and they were not treated as such by this administration. Chuck, you are clearly right. For the longest time on our committee we were staunch supporters starting out under the Obama Administration of dealing with tracking right wing violent activists, domestic terrorists. We were right to do that. Our committee was the First Committee to lead out, to suggest that domestic terrorism has surpassed our original foreign operators. We found out that the proud boys and others were enormously vie lend a vie le viole violent and theyre aggressive. Four lives were lost, one by gunfire. A young woman lost her life filled with the fuel of mistruth by this president and mr. Giuliani who said combat by trial. All of that fed into these individuals coming to attack this place. It was no longer a priority for the Trump Administration and frankly we were put in jeopardy. I would say the capitol, the seat of democracy, was put in jeopardy because the president refused to act like a president concerned about the safety and security of members doing their constitutional duty and fail to provide the National Guard and any other support. His own Vice President and family was there in the United States congress. This is a clear violation and, yes, the department of Homeland Security failed, even to do its independent duty of advising others, including the mayor of d. C. , that this was coming in large amounts and that were going to send the National Guard or ask the National Guard to stand up on your behalf. This clearly was a lot of treasonous behavior and needs to be addressed immediately. Congresswoman Sheila Jackson lee, thank you for being with us. With 13 days to go weve got this incredible attack on the capitol, complete disparity between the way Law Enforcement approached these rioters and the protesters from black lives matter. How do we get our head around this, eddie . If youre teaching your students, what would you tell them to think about the Racial Disparity in Law Enforcement . You know, ive been trying to wrap my mind around it, andrea. Every day experience africanamericans are making distinctions. We could get killed during a traffic stop. We could lose our child playing at a park. We see video footage of police peacefully arresting a white man with a knife. We see it all the time. Theres a glaring example in which citizenship operates in this country. There are some that have the right to protest. They feel a sense of possession. Then there are others who are viewed as citizens, but dont have the same right to protest, who are often viewed as those people who should be grateful. I would think about introducing my students to a concept im thinking im mulling around in my head calling it tenuated citizenship. Thats the way it seems. Thats the way it looked yesterday. Just to make the point, these werent protests. These were domestic terrorists by certainly what joe biden said today and what others have said. Exactly. Eddie, were getting some news reporting from our nbc white house unit. Two sources familiar say Vice President mike pence is planning on attending joe bidens inauguration. If he does, its a big break between both the president and the Vice President. Its also unclear the last time the two men spoke. There was reporting that the Vice President s chief of staff was barred from the white house because the president thought he was the one that talked mike pence out of breaking with the constitution. Its unclear if mike pence has even been to the white house yet. How do you interpret this lastminute rift between these two men . You know, donald trump has always operated like he was vladimir, as if only he must live. Were seeing the equivalent of death bed conversions. Pence has been okay with trump for the last four years. Many of us said his presidency posed a threat to the republic. Now we have folk in the process we need to be clear about this. There will be a whole host of republicans in the process of engaging in the recuperation of their standing, of their reputations. So there is going to be, i think, a number of folk who will be distancing themselves from donald trump over the next 13 days. Eddie glod, im short on time. This year people who voted in that way yes, some democrats in the past have objected. Mitch mcconnell raised that point yesterday. Thats a valid point. This year is different. This year this vote is about donald trump and the lies hes proliferating and the violence hes encouraging. Given the context, i certainly would have voted differently. George, you wrote in a column an oped about what happened yesterday, the three repull sieve architects of yesterdays spectacle must be named and forever more shunned. They are donald trump and senators josh hawley and ted cruz. Do you think they will be shunned . I think so for a number of reasons. A, what they did was wicked. In a legislative chamber, politics is a team sport. By forcing these votes mr. Hawley joined by a panicking ted cruz to get in on the fun forced his party into a tremendously awkward position and forced members to take difficult positions. The ethics of Party Politics these people have put themselves on the outside. We have a threeparty system now. We have the democratic party, the cruz hawley party and the Mitch Mcconnell party. When i say shunned, i have in mind the treatment of the senate by joe mccarthy after he had been censored. Thats what i was going to follow up with. When you talk about shunning them, does that mean taking them off their committees . No, i wouldnt think so. Theyre still law makers and have constituents and still represent states. There are more subtle ways of distancing themselves from the people who have embarrassed the party and made everyones life difficult. Like what . Go ahead, katy. Like what . Cutting off republican funds to them, visiting their states and you make clear the Republican Party has been reduced by two. Neither of them can believe they have a future in president ial politics. Weve seen mike pence distance himself from the president after the president shamed him and abused him by the pressure over all this. Now mike pence is reportedly furious with the way hes been treated. We understand hes going to attend the inauguration or hes considering attending. Andrea, look, what mike pence proves is theres no reward for being loyal to donald trump. Donald trump cares only about himself. Cares exclusively about himself. Thats been on display for four years. Mike pence after being probably the most loyal person and certainly, you know, in a very difficult position because mike pence is known to be very religious and very moral, hes tolerated and excused so much of trumps behavior and what does he get in reward . A kick right in the gut here at the end. This doesnt surprise many of us who have known donald trump for who he is for quite sometime, but, yes, it has to be very difficult for Vice President mike pence. George, you know mike pence. How humiliating is this . Your thoughts on that. I think hes been used to humiliation for four years. Lets not praise mr. Pence for not making a choice he did not have. He was asked to exercise a power that by no stretch of the constitutional imagination does he have.
