That in that order as we look at how the president is answering that question as to whether hes going to have a sitdown, no that is different than what he had said before. That he was open to it and whether thats even relevant is it . Whether the president says hes going to sit down with mueller or answer questions is smoke filled coffee house nonsense for the president , because ultimately, the only opinion that matters is mueller. Is he going to call the president s bluff. Is he going to issue a subpoena if the president refuses to submit swrwritten answers to questions which is not something that you normally see in the world of criminal defense. Prosecutors and white collar cases or ever do not hand over written questions like this. So we are in the Twilight Zone of criminal defense as it is but in this case, even if trump waffles and changes his mind, ultimately its what mueller tries to do and what a court ultimately interprets about whether or not a president can be subpoenaed. What does it say, then, about muellers strategy and what hes focusing on . Because we also know what he is not answering. Hes not answering questions about obstruction of justice. You mean trump is not answering . Thats right. Trump is not answering questions about obstruction of justice, but i hate to go back to this, but whether or not he answers questions about obstruction, whether the president personally, and i think he personally believes he has done nothing, at least thats what he seems to say. But thats not enough to absolve you of a criminal offense if you personally believe what you were doing was fine patr federal prisons are full of people who believe what they were doing was fine. The calculus we had to discuss on a sunday are all of the flippers, some of them still out there that are adding to the things that are going through his head weve got Paul Manafort still out there. Michael cohen as well. All sorts just this past week, and that very pressure thats on this president. Which is exactly why donald trump is going to do everything in his power not to ever have to testify. He may say whatever hes going to say on tv, but i believe that he does know that hes done something wrong, because donald trump has been doing things wrong ever since he was a developer in the city of manhattan. I mean, in the city of new york city so i dont buy that hes that he thinks hes what he does think is he believes hes someone above the law, not someone who is conforming with the law. Donald trump is many thing, but he knows what hes doing. The acting attorney general, what democrats might do, what republicans might do before the end of this congress. I mean, republicans have shown themselves to be very underhanded. We know that they know for a fact they are doing things that are wrong. They know they are doing things that are shady theyre trying to push their way through and push their will through before there is a changing of guards come january. The idea that trump decided right on november 7th that he was going to push sessions out and bring on whitaker and know that whitaker has been a stalwart of saying the Mueller Investigation is a witch hunt and all of these things, he knew what he was doing. He knew he was going to bring this to the supreme court, that he had already put kavanaugh there. He is playing the large game here, the wide game. I think that democrats are consistently only looking at whats in front of us instead of looking at the big picture when the republicans are really good at looking at. Part of this is to save the mueller move jeff flake is one that is standing for it. We understand he had quite a back and forthwith mitch mcconnell. How can democrats take that . I think a lot is that people are failing to understand that in six weeks democrats are going to take control of the house of representatives and there are going to be 14 committees going at the Trump Administration and what mueller is and what mueller has done is going to recede very far into the background. I dont actually think that there is any President Trump collusion with russia. Maybe mueller will indict his son. Maybe mueller will be satisfied with having indicted and gotten convictions of his onetime chairman but the entire focus of the attack on trump legally has been mueller, because republicans had control of the house and senate. With democrats in control of the house, the issues that are most pressing, not what happened in 2016, but the behavior of the Trump Administration as it has been in office is going to come under legislative review and attack and a lot of the focus that this network has had on mueller is going to seem like yesterdays news, because were going to be looking at todays news and tomorrows news. Were going to be looking at thursday when we expect this commentary these answers to be reaching, again, Robert Mueller and what that might mean on timing for him. Thats it for this topic tear rar tara, thank you. President trump says a full report on the murder of Jamal Khashoggi will be coming tuesday. Well, President Trump confirms that the United States has the audio recording that allegedly depicts the murder of saudi journalist Jamal Khashoggi. Its a suffering tape its a terrible tape ive been fully briefed. Theres no reason to hear it i said should i . They said theres no reason. I know exactly everything that went on with the tape. What happened it was very vooiolent very vicious. In addition nbc reporting that the cia has concluded that saudi crown pirince ordered khashoggis killing. The state department disputes that report saying recent reports indicating that the u. S. Government has made a final conclusion are inaccurate. There remain numerous Unanswered Questions with respect to the murder of mr. Khashoggi. President trump was briefed on the matter by the cia saturday the president promised new answers by tuesday joining us now, ellen farcus, former secretary of defense and msnbc National Analyst danny sav savalez. Lets start with you on this when you hear the development of what is happening coming out of two departments, we also have, again, the 17 individuals that now face sanctions from the department of trueasury you have the state department saying hang on a second. You have the krirkscia going thd happen and others going wait until tuesday. Its the kind of stalling where you had an earlier segment where kimberly was saying this is a lot like what trump does when he doesnt want to face the reality, for example, with what the russian government did to our elections. I think the president is stalling because he doesnt want to face the reality because the entire middle east plan that theyve come up with we dont really know what that plan is, but its based on this close relationship with saudi arabia brokered by his soninlaw jared kushner. But the turkish government has a different plan, and they will probably leak this or reveal to the public the whole entire horrific tape if thats what it takes to get the u. S. Government to take a harder line against the crown prince, because the turkish government wants him gone from the scene. And he should be danny, talk about the n magnitsky act is how this is related to the khashoggi case. It had to do with the jailing of a russian lawyer and its about essentially an embargo we put on russia, but as it relates here, the general idea is that when government officials, when government leaders engage in this kind of behavior, we sanction as a country. You keep in mind this is also a violation of International Law there are many other laws that potentially a lie hepply here a have a missing body case they create a lot of challenges for getting answers to critical questions. John, it was decided by John Mccaffrey in the last hour, and he said this about turkey, it was a turkey, saudi arabia, u. S. Die n dynamic. Turkey gone as far as an ally in this country what happened with saudi arabia does put the United States a catch 22 if wooe were to reject what mbs has done, the question is probably being asked what do you lose well, you lose a potentially innovative effort to take a new look at the middle east and we fashion the alliances and the connections between america and countries in the middle east we were clearly tilting towards the sunni nations against the shiites in iran. There are friendly gestures and friendly openings between isreal and saudi arabia which was almost unthinkable 25 years ago or ten years ago the fact that all of this is happening seemed very interesting and the possibility that we were breaking open something that was very sclerotic. Two things that really cant happen now we know too much about the recklessness at the very minimum, the recklessness and possible psychopathy but turkey just through 15,000 journalists in jail. Its not as erdogan is some friend of free speech. Thats exactly what general mccaffrey was saying here. This is definitely your space here add in iran and you really dont have much to pick from. Right we have problems with turkey, first of all, over the operation in syria, over their border because the best fighting force that the u. S. Is allied with are the kurds and the turks are upset about that of course, we have the Biggest Issue between us and turkey is the fact that the turkish government, president erdogan wants a turkish man, but with a residency in the United States, a green card holder wants him extradited with no evidence that hes committed any kind of crime, but the turkish government says that he conducted a coup and on that basis he wanted us to render this man to turkey theres a whole back story there. In any event, we have a problematic relationship with turkey as john just mentioned. Its not a liberal democracy in turkey but i think on this issue, the turkish government is right. We should be standing with our nato ally turkey. Again, the killing of a journalist in the United States, a columnist here in the United States for a u. S. Paper and that is what were focused on evelyn, thank you so much. Danny and john still ahead, a surge in the death toll, a number of people missing from the california wildfires. Youd be better off just taking your money and throwing it right into the harbor. Im regret that. If you guessed theyre tabs that turn into liquid as you chew, so you can swish and clean your whole mouth instantly, then you were correct. And that was a really good guess. Nice job. In northern california, the death toll from the devastating wildfire there, that fire alone now stands at 76. And with nearly 1,300 people still unaccounted for. And there are fine other fires theyre watching in the state. Today hundreds of people who have already been displaced from their homes because of the socalled camp fire have been called to evacuate their temporary shelters because of another concern. Rainstorms. Firefighters are continuing the effort to stop the fire that has already destroyed almost 150,000 acres, an area that is roughly the size of the city of chicago. Scott pallone is in paradise, california. Whats the plan here as they are worried about in 48 hours to get up to 4 inches of rain which can be good but also can be good. Good for the fire fight, but not good for just about everything else. Were kind of getting into the next phase of this, which is we have literally tens of thousands of people who have been displaced. Some of them about ten miles down the road to a walmart parking lot in chico, set up a tent city there. Thats not a good place to be in the rain. Theres no service there is. There are shelters set up, more of them that are being opened up. Some people are going there. But thats been an issue as well. All of the resources taxed. Im joined by the mayor of chico. Tell us what the status is with all of these people and how are you going to absorb them. Im not sure how weve absorbed them this far. We dont really know where everybody is. Walmart is the obvious one because you can drive by and see it. Theres thousands of people in home, in shelters. Thats going to be the biggest challenge for the city of chico in the weeks to come, how do we continue to absorb and care for all of these what amounts to be refugees. The walmart parking lot, lets set the scene there. That was never supposed to be an evacuation sight, to the people are being encouraged to leave. Theyre being encouraged to leave and you have to have compassion for them, because theyre at the bottom of the hill. They can kind of look up and feel wow, thats my spot. We understand they might not want to go to a shelter, because they feel closer to what was their home. But as you mentioned, the rains coming, the colds coming. Were encourage them, lets get to these shelters. There are shelters. We brought buss in to help move the people that want to move, but quite frankly, not everybody wants to go. Right. And its not just the near term with rains next week. This is an area that had a housing shortage to begin with. Paradise did. Chico had a very big housing crisis. Its going to be a while. Weve got the best development community. Fema is going to do some things. In the immediate term, the shelter is the place to go. Its going to be years before paradise looks anywhere like it used to be. Weve got to find something to do. Whats the need at this point for people that are looking at this and see this cries snsis . Whats the need . Im so glad you asked, and ive got to thank you you and your organization. We talked about the north Valley Community organization the other day on hard ball. They started making 1,000 a minute. We need money. Feem ma fema, the state agencies, were getting state and federal support, but the local people on the ground that are in touch with the residents of paradise, that are in touch with the nonprofits, the north Valley Foundation has been the catch all, get the money out to the people that need it. Something as simple as a 20 gift card to walmart, to a 10yearold kid thats lost his house, its a little bit of happiness and hope and it makes a big, big difference. Just to set the scene and the geography for the people that dont know it, your town chico is about ten miles down the road from here. Paradise is sort of separate. Its a lot of retirees, but youre going to feel this. We do feel it. Were going to continue to feel it. Were going to make it right. California is a lot of funky things, but when this state comes tgts with the peop comes together with the community of chico, it will get rebuilt. Well do everything we can with all the resources we can get. The entire city is pulling to help the town of paradise. We have rain next week. Thats the immediate issue. But rain, you talk about mud slides. You talk about all of the other issues. How are you set up to handle that . The city of chico is not set up to help with that at all and thats where fema, California Office of emergency service, were in Constant Contact with him. Yesterday the president was here with both the governor and the governor elect. The fact that you get those three people in the room together means miracles can happen. Were getting all of the federal aid we need to do the things a little municipality cant do. Our thoughts are with you. Clearly quite an issue here and its going to continue going through all of these phases, even as they try and get this camp fire under control. Richard. Scott, thank you so much for your reporting. Our best, of course, to the mayor there who has been speaking to us over the recent days. Joining me now, carol will, communication director of california professional firefighters. Good to see you again. We spoke yesterday as we were looking at some of the progress. The numbers are increasing. I think that those on the ground, the officials are saying, but dont overplay that, but we have seen the death count go up. We also have seen the number go unaccounted for go from 1,000 to almost 1,300. How would you reflect on that quickly . I think from the standpoint of the first responders, the primary difficulty is simply the process of the sort of grim process of going through the town of paradise and trying to identify folks. Theres about 600 personnel up on the scene right now, including me. Many firefighters who have just come off the front lines are involved in that very wrenching process. And thats something, actually, that one wonders if that can be complicated by the rain thats in the forecast as well. But its just a very slow process and its the sort of thing that will take itself toll, not just obviously on the community, but also on those who are on the front lines trying to mitigate this real awful tragedy. I wanted to talk to you today because of the very idea, the very necessity of what your association represents, all the firefighters out there. As you heard me say, the size of the fire roughly about the size cht entire ci of the entire city of chicago in terms of the numbers of acres. The president yesterday mentioned to assist the firefighters that funding would be considered. Is that the constraint you believe to preventing the size of these fires which judge just blown up there in the state of california in the last couple of years . Well, the fire risks that we face in california is the result of a number of factors. The climate, no matter what you think the cause may be, the climate is changing. Were seeing climate extremes in california that we have never seen or that hadnt been seen in memory. The ferocity of the winds, the dryness of the climate. We also have a situation where more and more people are living where the fires go. If you put people where the fires go, that requires that those people be protected and saved. We do have an issue on our forest lands where theres a lot of dead trees, again, because of the climate situation. There are force Management Issues to be undertaken. Thats an area where funding can be an issue, because obviously thats where thats whats required to kind of undertake the kind of clearing that needs to take place. But its not just a one size fits all. Many solutions and funding might address some of those. I think youre talking about thinning, right . Thats removing all of the dead trees, all of the used logging. Thats correct. But then ill throw this on to the discussion here. You talk about the size of california and how large it is. Just to give a sense for folks out there in terms of the wildfires, so far, and this is only year to date, 1. 7 million acres so far. Thats two Rhode Islands. More than two Rhode Islands that have been burnt so far in the state of california. Is it even possible for firefighters to combat just the shear massiveness of the number and acres that are on fire . Well, there are some fires as we saw in this situation where no amount of resources are going to stand up and stop it. But what we can say is there is a need for a broader commitment to fire mitigation and fire response, in particular in the early stages of these fires. Getting resources positioned in areas where we know the fire is going to go or we know people are going to be ahead of red flag warnings. Were starting to do that. Do you have equipment to get it out in time . Do you have the right equipment to get it there . Thats another area where we are short, and getting personnel and getting equipment so that those people can be in the position where they need to be. Were in a new normal in california. We kind of need to recognize that and staff and plan accordingly. Gotcha. Carol, thank you. Great conversation. Well be talking. Again, were going to get this done. Thank you. Thank you. Free reign in a new interview. President trump says if acting attorney general Matthew Whitaker wants to curtail Robert Muellers investigation, hes not going to stop him. As President Trumps legal team prepares for the selfimposed thanksgiving deadline to submit answers to the counsel, President Trump may have something to be thankful for ahead of the holiday. His acting attorney general. Matthew whitaker has openly disparaged the russia investigation and is now poised to make crucial decisions about the very probe. The question might be will whitaker survive the white house amid claims his appointment is unethical or unconstitutional. In an interview with fox news this morning, the president said he would not stop whitaker from limiting the investigation. Its going to be up to him. I think hes very well aware politically. I think hes astute politically. Hes a very smart special respected person. Hes going to do whats right. But you wont overrule him if he decides to curtail . I would not get involved. Our panel returns. Danny, thank you so much. Danielle, thank you. Danny, what is next on this . Go where you want to go my friend. Well, trump now has a person favorable to him in that Office Temporarily appointed. Whether or not that appointment is constitutional is an open question. Whether or not that appointment was the proper succession is an open question. In spite of all, that trump now has essentially a Party Loyalist or a trump loyalist or an antiMueller Investigationist in that seat. So it remains to be seen how whitaker, will he look at this as the worlds eyes are watching me, i should be even handed, or will he decide that i will act consistent with the way ive always believed about this Mueller Probe and do whatever i can . Or he might even continue on as a kind of mole. Bring mueller in. Ask him whats going on thp and then let President Trump in on the direction of the investigation. Theres really two vieds of th sides of this. There is what is happening on whitaker and will democrats and republicans go through a process that answers this question, is it constitutional or unethical. The flip side is this save the mueller movement that is potentially legislation that is somewhat bipartisan. When you look at whitacre, what do you think is going to happen next . Its unclear to me. I think that, one, we need to stop having expectations that there are going to be republicans that do good. They dont exist. The other side is whitaker has told us who he is. He doesnt believe in the investigation. He is a supporter of trump, which is why instead of moving Rod Rosenstein up to be the assumed assistant ag that he went this route. We understand why hes doing what hes doing. Hes making these moves because hes doing everything that he can to protect himself. He knows that if this goes to the supreme court, that he just put his buddy kavanaugh in there, that gorsuch is there, that the court is now to the right. Its trumps court. Hes played us. Thats frankly what democrats need to understand. So instead of looking at what is exactly in front of us, we need to be looking down the road. What else could he potentially do . He is gaming. He is strategizing. Every time we think we dont know whats going to come next, we comes up with something else. We need to be just as strategic and thoughtful. How are they going to use their power back . How are we going to move this forward . Those are the things i want democrats to be focused on and not just who is in what seat. This administration plays musical chairs. This is Lindsey Graham today on meet the press. Hes said some things that would be problematic to be confirmed. Having said, that i was very impressed with his attitude, his professionalism, and hes got a very solid resume. I would encourage the president to pick somebody fairly soon. You asked me about mr. Whitaker. I have nothing against him. I dont know if hes the best choice. John, when we look at the republicans, and you were talking with the democrats a second ago, there are a couple that are going to ask some questions too. Flake is certainly one of those. Look, if whitaker or trump do something to interfere with the Mueller Probe and we find out about it, im going to say it again, in six weeks democrats are going to be in charge of the house. That will be grounds for a serious investigation. But before then. It doesnt matter what happens before then. It doesnt . In what way . What is it that you expect to happen . I dont expect anything to happen. The house is not going to be the senate is not going to be in session. Hes probably not going to appoint anybody. If he does, theres not going to be sufficient time to confirm anybody as attorney general. What im saying is youre making a case that the republicans could do terrible things. Right now if anything actually, ive not made that point. I definitely am. You are. Any effort to curtail or tighten or subor nn the Mueller Investigation is going to lead to potential impeachment of President Trump and he knows that and Everybody Knows that and this is all a game of musical chairs. It doesnt matter because come january the political reality of the last two years which is that trump had nothing to fear from capital hill capitol hill is gone. He has plenty to fear from capitol hill. After the break, the first group of migrants have reached tijuana, but they are nowhere near the troops that have been deployed. Weve watched this of this reporting here, evelyn. The very question Going Forward is with military on the border with mexico, and we expect it to go through the holidays and the very cost, its been from tens of millions to weve seen some even hundreds of millions at the moment right now. What does this set the precedent for . Richard, its a huge its a colossal waste of american taxpayer money, of department of defense money. We are sending these roughly 5,000 active duty forces. These people who trained to fight wars, to conduct Peace Keeping operations, putting up wire and building, you know, first aid stations is great, but its not using them to the best of their capabilities and frankly speaking, its a political charade and it will cost one of the think tanks here, the center for budgetary assessments, they estimate around 42 million if they keep them at the current level. Dont forget we also have about 2,000, i believe, National Guard troops already there deployed since april. Thats another several million dollars. I think its actually thats in the hundred millions. So this is almost 200 million at the low end that the department of defense, the u. S. Government is spending on something that is not a National Security vital National Security interest. These troops should be doing other things. Separately, in the same week, theres a Defense Department commission, a commission that congress set up, thats warning that the Defense Department that are military is not ready to go headtohead with china and russia, militarily needs a boost, should we say, and so i think its just a colossal waste. I want to play this for you. This is related to the very point you brought up. This is what she said about, again, the care avan moving clo to the border. It does provide them training. Many of them if they serve in position, they will be doing those missions on the bord zber has this been an approach before such as were seeing on the u. S. mexico border . You have these arguments anytime its not a combat megz. Y theyre trained to go out and conduct basically killing operations. The logistic force, of course, anything they do that involves logistics is useful, but its nothing like deploying to a foreign country and setting up logistics in another country and having a real mission. This is not using them to their optimum and its a lot of money and opportunity cost right now. Its not as if it were a Peace Keeping mission or something where lets say you had a flood of refugees coming, frofror exa, as weve seen from haiti where we werent prepared, we didnt have civilians to help out.
