see most of the day. couple more dry hours. the temperatures with clouds overhead haven't fallen that much. lehigh valley 37 degrees with mist. 41 in philadelphia. wind is blowing at 13 miles an hour. producing rain starting at 8:00. rain will be steadier. little bit heavier. temperatures climbing in spite of the rain. go even higher than that. get close to 50 this afternoon for philadelphia. 48 degrees. 49 in delaware. and those upper 40s in new jersey until you hit the shore. i'll go through forecast hour by hour to show you when the rain is due into your neighborhood when i'm back in ten minutes. first jessica has first alert traffic. >> starting off in blue route this morning. camera around westchester pike. either way, look at drive time. just a 10 minute trip. not seeing big problems or delays there. take the pa turnpike. reports of an accident. overturned track torp trailer on the westbound side of the turnpi turnpike. partial blocked right now. look at the westbound drive time from route 1 headed to valley forge. no increase yet. keep our eye on that. end up in whitemarsh. crash here: earlier crash pretty much cleared now. down poll and wires. >> breaking overnight. man defended himself when armed robbers stormed his home. one robe e robber is dead. the victim is recovering from a gunshot wound. matt delucia live from the scene. >> trying to protect the family while this was going on. mother and four young girls were inside the house. mother was putting those girls to bed at the time this home invasion and robbery happened. just behind me, in is where it happened here along the 1900 block of pratt street inside one of the homes. take a look at the video here. nbc 10 first on the scene as that family came out of the house and got into a car while police were on the scene. philadelphia police tell us just before 11:00 when this happened. just come home. 27-year-old father heard a knock at the door. answered the door and two men forced their way in at gun point. one man shot in the head. the other guy ran away. the father still in the hospital. expected to survive. the family obviously shaken up. police say this was quite a scene here and as we take another live look. police have left, but detectives have been looking for surveillance cameras in the area. they do say there are several in this area. 11 gunshots fired last night. police calling it a fortunate outcome the mother and the kids inside were not injured. live this morning. nbc 10 news. south jer sif murder suspect in jail this morning. nearly two weeks after police said he killed estranged wife in front of their children. last night police captured him near a strip mall in atlantic county. ended a search which began a few days before christmas. he killed tara o'shea watson at home in commercial township. spoke to her mother, emily, on the phone shortly after the arrest. told us she's still numb, but relieved her family doesn't have to look over her shoulder anymore. >> i really don't think he deserves the death penalty. what i think he deserves is to go to jail and stay there for the rest of his life. what he did, god needs to deal with him. >> victim's mother who lives in tennessee would not say where her five grandchildren are, but that they are somewhere safe. >> search continuie ins for a h and run7boñ driver. bensalem police released this video. the hit and run happened sunday between bristol pike and state road. >> pennsylvania state trooper shot and killed in the line of duty listen laid to rest on thursday. 23-year-old trooper landon weaver was responding to a domestic dispute in huntington county on friday when he was shot. police shot and killed the suspect, 32-year-old jason robinson. weaver graduated from the police academy last summer and got married in june. happening today, congress returns from holidays. lawmakers getting back to work on capitol hill. live in the digital operation center this morning. pat, tell us what we can reasonably expect from new congress. >> new congress already making moves. overnight voted to weaken the independent ethics office that investigations house lawmakers and staff accused of misconduct. it happened during a closed door meeting yesterday. the move gives the ethics oversight role to lawmakers themselves and prevents information about investigations from being released to public. amendment was passed by a vote of 119 to 74. office of congressional ethics was created back in 2008 by a then democratic majority after a serious of congressional scandals. the new congress is expected to vote on this amount today. once sworn in, 52 republicans and 46 democrats in the stat. republican lawmakers are expected to repeal affordable care act. although they have not said how they will replace it. telling democratics to stand ready and fight vigorously to protect it and other priorities. new congress may also investigate russian hacking and influence on the what has dampened the roads in our area. that's cape may. see the mist. no real fog there. find some areas of fog. see some light flog in prelim mou little bit of mist and fog. a lot of clouds for the rest of the area. thickest fog in the mountains. that's actually an improvement. holding at a mile and a half in coatesville. so fog is not really a big issue. the mist is easy to deal with. the rain that is on the way has got some time before it moves in. fortunately the temperatures even though we'll get rain are moving up. in the 30s and 40s. each of the neighborhood above freezing this morning. look at the 40s in delaware. and further to the south in the 40s. middle 40s for louis. that's how we're starting the day. in spite of the rain that's heading our way, the temperatures will be climbing. the rain is steady. this is what we're going to see for most of the day. look at the rain coming down. virginia and west virginia and now into the d.c. area. that's going be easing in to our area this morning after a dry start by 9:00 this morning. look at the rain. wilmington the rain will be falling. by noontime steady rain for just about everyone. little bit lighter just to the north of doylestown. rain continues this afternoon. in fact could see heavier downpours, but the temperature into the low 50s. finally clear out this evening. through it all, stay warm enough that it's only going to be rain for the area. umbrellas going up in philadelphia. no sign of any sunshine for new jersey or the shore and delaware that rain comes in this morning. continues this afternoon. making progress through d.c. we went on the air, it was in virginia that leading edge of the rain, but now here we go. rain quickly pushing through our area. first thing this morning, rain coming in and then look at the rain falling at lunchtime. going to be a dreary rainy day. steady rain continues into the afternoon. could see heavier downpours for the beginning of the evening commute. 4:00 breaking news. burglar is dead after homeowner opened fire when armed men busted into his home. this happened overnight in frankford. homeowner took two bullets and is now recovering. matt delucia live in frankford. >> reporter: the scene is clear. police are still looking for one of the men who troerrorize ed ts family late last night. family came out of the house and got into a car. happened just before 11:00. family had just come home. mother was putting four girls to bed. all the girls under the age of four. meantime the 27-year-old father answered a knock at the door. at that point, two men forced their way in at gunpoint. the homeowner was shot twice. the homeowner had a gun of his own. shooting one of the men in the head. that man died. the other guy who did this ran away. so police are still looking for him. they are working on getting surveillance video from the neighborhood. the rest of the family obviously shaken up, but uninjured. >> although the homeowner, age 27, was shot by perpetrator, we're still very fortunate that his wife nor any of his four children were struck by gunfire or injured in any way. >> now the father is in serious condition at the hospital right now. he is expected to survive. live in frankford, matt delucia, nbc 10 news. video appearing to show a police officer and teenage girl taking swings at each other are now the focus on investigation. >> that's right. take a look at images that went viral. trying to break up a brawl in southwest philadelphia yesterday. that's when witnesses started recording these videos. one posted on instagram shows the brawl. then the confrontation between the officer and 16-year-old girl involved. another video posted on facebook just shows the incident where the two appear to exchange swings. the girl east best friend was right there. listen. >> i don't think she deserved it. that cop shouldn't have did that. that lady like 30 something. they throw me against the car. throw her. slam her on the ground. she's 16 years old. >> that's awful. look at the officer and her face and look at the young girl not backing down to the officer. >> police have not confirmed the accounts of the incident. investigators are holding the teen and looking at the video. 6:35. family recovering from a close call on new year's eve. bullet flew into house just missing the found a bullet on the floor. right next to the crib. everyone is okay. the blullet was likely fired by someone celebrating new years one or two miles away. search continues this morning for the owner of this pickup truck. want instead a hit and run that critically injured a man riding had iz bike new year's day. police released surveillance video of the truck. did this yesterday. as you can see, it's an older model jumped about eight cents a gallon on new year's day. holiday gas prices the highest since 2014. did not just buy gas tax hikes. experts predict you'll bay 25-50 cents a gallon more. this year because of that decision. and here's where things stand right now in our area. pennsylvania drivers paying an average of $2.57 a gallon. new jersey drivers are paying $2.44 there. delaware, shelling out an courageous battle with cancer. dealt an unexpected financial blow that went unresolved for months. she contacted harry harrison and nbc 10 responds. >> donna says her life is back on track. >> did you have anything fun? >> her outlook on health much brighter than it was two years ago. less than a month after feeling a lump in her chest, doctor found her with life changing news. >> she said well i'm really sorry to tell you it's breast cancer. that was in january of 2015. the following month she underwent seven surgeries. her oncologist here at the hospital prescribed three shots of a drug to help prevent the cancer from returning, but she had to pay more than $1,000 in full for each shot. >> i asked if there was an alternative. >> the doctor's office told her the hospital could administer the shots instead and put her on a payment plan. she took her doctors advice. she had no idea the cost would increase more than ten times. this bill shows the first shot. at $11,000. and two others cost nearly $14,000. her co-pay was 8 grand. >> to be hit with those costs is just unbelievable. >> reporter: she was also hit with a billing error. physical therapy codes listed instead of chancer treatment. she fought the charges and errors for six weeks. telling the hospital they should have told her about the cost beforehand. >> they wouldn't budge. >> so she called nbc 10 responds. we reached out to the hospital to ask about the charges. told us we apologize for the errors on our patient's bill and we have corrected the bill. >> i just want to thank nbc 10 and thank you so much harry. can i get a big hug. >> big hug for you. >> harry harrison. nbc 10 responds. >> to be clear, corrected the coding from physical therapy to cancer treatment. the price of those shots has not changed. however, the hospital did budge a little on the bill. refunding her $3,000 for her time and efforts bringing the total she owes from $8,000 down to five grand. >> if you have a consumer
