The Gibson Law Firm sues contractors over alleged new office construction flaws

HOUSTON A Houston law firm is suing a contractor and flooring subcontractor claiming numerous deficiencies in the construction of their new offices, including uneven flooring and defective electrical circuits.   Jason Gibson and Jason A. Gibson PC doing business as The Gibson Law Firm filed a complaint April 19 in Harris County District Court against Dunhill Development & Construction LLC and Gulfcoast Flooring & Services LLC alleging breach contract, misappropriation of construction trust funds, fraud and breach of express warranty and breach of implied warranty. The plaintiffs claim that on Sept. 28, 2018, they contracted with Dunhill for the management and complete construction of their new law firm office on Kirby Drive in Houston. Nurse beaten by patient sues employer for failing to protect him

HOUSTON   A nurse working at a healthcare facility in Harris County who was attacked and beaten by a patient is claiming his former employer failed to protect its workers. Murrey Burnside filed a complaint April 19 in Harris County District Court against Res-Care Inc., doing business as BrightSpring Health Services, BrightSpring Health Services and John Doe alleging negligence.  Burnside alleges in his complaint that while working as a nurse for Res-Care and BrightSpring Health in Harris County on April 4, 2019, he was violently attacked and beaten by a patient being transported within the facility. He claims that as a result of the attack, he suffered severe physical and emotional injuries including physical impairment and disfigurement as well as loss of earnings. 

Couple sues HOA, security company after home burglary

HOUSTON A Houston couple claims they lost half a million dollars in jewelry that was stolen from their home due to the negligence of their homeowners association and its contracted security provider.  Swapnil Agarwal and Deepika Agarwal filed a complaint April 18 in Harris County District Court against Universal Protection Service LP and Royal Oaks Residential Community Owners Ass n Inc., alleging negligence.  According to their complaint, the plaintiffs live in the Royal Oaks community in Houston and pay dues that cover security expenses for the neighborhood which adjoins a country club. They allege that the defendants have been negligent in protecting their neighborhood which resulted in their home being burglarized on Aug. 3, 2020, and the loss of $500,000 in jewelry which was taken from their residence.  

Woman alleges surgeon damaged bile duct during gallbladder removal, sues for $1M

HOUSTON A woman alleges a surgeon damaged her bile duct during a laparoscopic procedure to remove her gallbladder.  Yenny Marcos filed a complaint April 19 in Harris County District Court against Nicholas Stephens, M.D., and Nicholas Stephens, M.D., PLLC alleging negligence.  According to her complaint, Marcos underwent a laparoscopic cholecystectomy on Aug. 22, 2019, performed by Stephens. She alleges that on Sept. 9, 2019, she had to be admitted to the hospital and was diagnosed with a common bile duct leak.   She further alleges that the leak was due to a hepatic duct transection which happened during her cholecystectomy that was peformed by Stephens. Marcos also alleges that she had to undergo further surgeries to repair her bile duct damage which was caused by Stephens and claims Stephens was negligent in failing to properly identify the common bile duct/and or common hepatic duct prior to transecting.  

Former Shell executive sues alleging pregnancy, disability discrimination

HOUSTON A former Shell executive is alleging she faced discrimination due to her pregnancy and colon cancer diagnosis and was terminated in retaliation.  Julia Shur filed a compliant April 12 in Harris County District Court against Shell Exploration & Production Company alleging violation of the Texas Commission on Human Rights Act  Shur began working for Shell in October of 2015, as a general manager, earned more than $650,000 per year and led and closed multi-million dollar transactions for the company, according to her suit. Shur claims in the fall of 2016, she began reporting to a new manager, Scott Porter, and from October 2017 through April 2018, took maternity leave.
