It is not clear that the oral testimony which was given by the accuser has weakened. Memories fade for natural reasons. That full at have to side that the evidence is not Strong Enough to continue pursuing an indictment. Also coming up or earlier this year a french judge ruled in favor of a rooster in a noise complaint smell the defendant is a duck will the same justice applied to birds of a different feather. I dont think im not well so these ducks are a problem my ducks make new ones. And this bothers the neighborhood of what. You our viewers on p. B. S. In the United States and all around the world that welcome we begin the day in which the 2 cases against julian the songs became the one k. So against julian of songe the world knows the songs as the founder of wiki leaks and the man accused by the u. S. Of helping carry out one of the biggest leaks of classified documents in history but there is a 2nd legal case against assad make that there was a 2nd case in 2012 women in sweden accused of songe of rape and Sexual Assault spent almost a decade avoiding extradition to sweden from the u. K. Because he feared that sweden would then hand him over to the u. S. Or today sweden drop is investigation the prosecutor saying that too much time has passed with sweden out of the picture that makes the legal question surrounding a songe simpler for the u. K. The United States wants britain to hand over a songe to face charges connected to that major leak of classified documents a songe says that he is protected by the 1st amendment right to free speech in the u. S. But washington says he broke the wall. This is how his sentence began this may Julian Assange we storm a courthouse after a judge refused his plea to stay free the wiki leaks founder had cleaned himself up since British Police tracked him from the Ecuadorian Embassy just weeks earlier. Outside the Court Supporters were vocal in their anger at the sentence many see as someone who is a hero for exposing abuses of power and championing free speach. The case against the songs in britain arose when 2 swedish women accused him of Sexual Assault and rape in 2010 a song sought refuge in the Ecuadorian Embassy afraid that sweden could extradite him to the u. S. He faced prosecution that the wiki leaks release of millions of classified documents since his sentence started in britain as on shes lawyers have turned their attention to the u. S. Extradition request authorities there have charged him with conspiring to break into a pentagon Computer System this case is and has always been about the risk of extradition to the United States. Weve been saying since 2010 that that risk is real and we now have a provisional extradition requests from the United States. Its a battle a song shes been fighting for months from prison but fighting extradition could take much longer. And for more im joined tonight by Joshua Rosenberg hughes a british legal commentator he joins us from cambridge in england mr rosenberg its good to have you on the program id like to get your take on what happened today after 9 years we hear from swedish prosecutors that the evidence is too weak what do you make of their. Its not a story just because the evidence doesnt change what a person said is she wants to enter besides the injured party and thats the 1st plane of social assault has submitted a credible and reliable version of events about the state statements in an extensive detail but the prosecutor but my overall assessment gives that initial situation has been weakened to such an extent but there is no longer any reason to continue the investigation i suppose what the prosecutors say is that memories fade didnt alleged many years ago now and sweetness we know has statutes of limitation in other words it would be too new to prosecute after a certain amount of time and 6 spot so maybe thats the thinking behind it how did it would be difficult to get the big shot off of this time but with me ask you this i mean maybe maybe swedish law is different from u. K. Law in this matter but the depositions that the the 2 women gave back in 2010 isnt that used in the can use regardless if 3 years have passed if 5 years have passed me wouldnt the deposition be just as good today as it was 9 years ago as long as the statute of limitations has run out. Thats a very fair point and the statute of limitations knock visually right out but you would expect that the witnesses would be cool to give oral evidence you would expect that they would be crossexamined and that perhaps is more difficult d but maybe theres another point i dont think it is as you report it like Julian Assange did in prison hes serving prison sentence here in the u. K. For jumping bail for not surrendering bail and he was sentenced to did it for that but he more of a just standing extradition to the United States. And legally the swedish will say to you that any prison sentence. In london the squinting the possibility of extradition would count towards any prison sentence in might get if he would be sent to sweep in other words this apps option and use a pending extradition how do you see what do you what do you see the whitely hood of him being extradited to the u. S. Is being do you think that he will be sent to america. Certainly the chance is being sent to United States critiques and the reason for that is that until today there were 2 extradition requests before the British Government im sick critic asked to disarm and one was from sweden one was from the United States the only secure state has to decide which one to give her 2 additional its entirely clear whether the government would have said it was sweet because 1st sweden or maybe the charges not to state. And the. State that brought would this go away because theres now only one its fish now certainly thats been challenged to the court to the senate but its only one request and question whether he can this week what would happen if he sort of said sweet would you that good state lets all go ive liked you to just take a listen to part of what the editor in chief of wiki leaks has said about the case against Julian Assange is in the United States take a listen. Julians lawyers. Said today they want to talk to you. But this patient pete dismissed taj it should be. And on the basis of an International Treaty or a bilateral treaty between the United States and the United Kingdom the treaty actually between treaty which basically states that you cannot actually died in it but you put a political offense and thats exactly what is being done here and its shameful that we select we spending time in court mr rosenberg how do you see this he said that what Julian Assange is accused of is a political of thin as the United States says that he is guilty of espionage and leaking classified material that is certainly not more than a political offense in the eyes of the United States how do you as a u. K. Of war expert how do you see it. Well obviously this is something thats going to mean all of you doubt the cold you know education in this hearing states for february the full court that has to decide whether it is to be extradited this is one of the arguments it may well go to a higher court it may take some months to get this it may go back to the United KingdomSupreme Court but you can see why hes all getting its political and you can see why the United States is all good but is not political this is simply a criminal d offense this is breaking we have an official secrets act here in this country islamic countries too in other words restrictions on providing tax audit station to the public so that is a question that is going to be out there now its a perfectly legitimate question and they are going to come down with the promises which signboards will get but it is all given to the scientists was quote. The sway of the courts here in the United Kingdom but it should not be its like United States mr aznar before we let you go i want to ask you on one more question and in this age of braggs it with a bell finally take place knowing that the United States wants julius on to be extradited. Do you think that that reduces the likelihood that the u. K. Would ever decide not to extradite him i mean do you see the politics of brechts it influencing this legal decision. No it is he said there are certainly cases where the British Government business as refuse to say that somebody for trial it states people suffering from mental difficulties for example that it was a computer it was not sent. And you can see certain steps susan we wouldnt be appropriate to do so and its rich it used to be that joint legal political d purpose was but expression now as well else all its issues its that they ultimately up to the last minute but its very much a Legal Process im sure that the government whichever government is elected office of the general election whatever happens to bricks it the government wait and see what the courts say the courts say this is not political its perfectly possible for it to be its not to be very surprised that it got the biggest moments of the decision it. Just rosenberg british legal commentator joining us tonight from cambridge and in the mysteries where we appreciate your time and your insights tonight thank you. In the multis journalist stephanie good leitz was known as a one woman wiki leaks for her work highlighting corruption in malta and its long been speculated that her murder 2 years ago was because of her investigative work or now maltese Prime Minister in terms of moscato has said that he will guarantee a president ial pardon for a man arrested last week and that man says that he knows who killed death deletes. And the Prime Minister said that the pardon is dependent on the subject cooperating with the Murder Investigation take a listen. Did it and even if it might go i signed its lets end it there soon on the face of this person you just have the assurance that if they collaborate with the police and the information they give you sufficient to prosecute the mastermind of this crime and this person will get a president ial pardon as much for a presidency. While at that press conference a reporter asked about alleged links between the ringleaders behind the murder and the government of the Prime Minister take a listen to this it might well be sure to discuss the name on the show if the most the mind is sort of and found to have business relations with anyone in your cabinet or a member of stuff with as they do feel government and kind of the moment to for the plate and i think that i would be really jumping the gun ok yeah its you jumping the gun to talk about that and a lot more im joined now by Keith Mcauliffe hes a journalist for the times of malta joining us tonight from the lead to malta the times the newspaper that 1st reported this story its good to have you on the show kids let me leave the couple what that reporter asked the Prime Minister saying ill give this man a pardon him if he cooperates that you would assume means that the Prime Minister is confident that whatever this man says is not going to implicate the Prime Minister or his inner circle right. Well thats what we believe it but the Prime Minister was also very keen to state this is not going to be a blanket president ial pardon the Prime Minister said he himself admitted that hes not very fond of president ial pardons with deference to one particular case about a decade of own director ticking where the person was given a president ial pardon but this evidence wasnt enough to incriminate the suspect so joseph the Prime Minister has always been very skeptical about president ial pardons indeed it has been quite a surprise this development and the british Prime Minister stressed quite a lot this morning in speaking to assume it was before a Cabinet Meeting that he would be giving the president ial pardon on condition that what the suspects will dismiss the men with the same court will actually lead to the identification of the monster mines what keep the out do we know that the this middle man that he is telling the truth how do we know that he knows what he says he knows. Well to be honest i mean people close to the investigation in this they did this does guy hes a taxi driver has a 41 year old texan driver hes been mentioned in the investigation maybe not public it but in private sectors and said it was close to the investigation for a number of months i would say in not only weeks and but for some reason it was only know that the government decided to step up the investigation and decided that this was the right time to offer the president ial pardon somebody something there must have been a turning point whereby the government believes that no its time is ripe to gave the president ial pardon so that this middle man can say who was the monster mine and now the question is not only who but why why was it failed that went on to begin and not just who actually had this plan where you know it has been 2 years since the murder and the investigation basically was was going nowhere so i take your point that something must have happened. To make the Prime Minister say ill give this man a pardon if he cooperates do you know what happened are there sources telling you anything that would indicate a change in the investigation. Whether what is sure is that the government was coming under intense pressure that the investigation is well in progress and in fact the boats a few weeks ago i believe it was around the 2nd anniversary government was criticized for refusing once again to have the f. B. I. On the case that was perceived as some kind of. New government not being very enthusiastic about the case being resolved no one of a sudden the government seems seems to be stepping up its efforts pressure from outside fisher from the council of europe even to launch an inquiry on whether does murder could have been prevented his having to slowly believe many people believe that the government now is realizing that 3 years down the line that this case it was through all of on it can do to sort of this case once and for all what do you think especially times of war that might keep them is as before we run out of time it sounds like based on what we what we are reading and seeing and what youre saying it sounds like the Prime Minister is more concerned about this not becoming a p. R. Disaster than he is about true justice being delivered for this murdered journalist is that a correct assessment wead i think its a bit presumptuous to say its hes more concerned about a p. R. Disaster whats what this did the worst Case Scenario for the Prime Minister is to have a political involvement in this murder if there is a political motive maybe definite i want to get it wasnt me who was very very on the ball when it came to corruption links to the government maybe that would be the worse Case Scenario a clue get it and minister now believes that time has come to do whatever it needs to be done now the time is right to give his president ial pardon may be. Truly light on this case once and for nobody knows exactly what will what will be happening. Do we know keith before we let you go do we do we know who is paying for the defense of the 3 men who have been implicated in this i mean i know that there was a lot of reporting about the funding. And yes there its i mean theyve even sent some documents for forensic examination didnt it states and that costs tens of thousands now apparently these a he suspects they declared they had very low income and didnt employ them going to the immediately say how american they afford such Legal Expenses and to do dece these these foreign sick examination in the United States and that its that is all its also fueling questions the their defense lawyer has been asked about the source of the funds hes being vague but he wouldnt comment. Ok journalist Keith Mccullough from the times of malta joining us tonight from valetta want to keep we appreciate your time and updating us on the story we appreciate it thank you were now id like to bring in on the telephone corrina belive she is the sister of the murdered maltese journalist ethnical in syria she joins me also from the lead. Ms can you hear me. I think here you can and cant yes i can hear you we appreciate you taking the time to talk with us. Id like to get your take on this decision that we have received from the Prime Minister that hes promised a pardon to this middle man if the middle man cooperates and leads the investigation to the the murderer whats your reaction to that. I mean the focusing on the pardon is something it is not really the issue this is really about moving the investigation for didnt it. From what iv
