[ simultaneous talking ] sean Sara Carter Thank You [ simultaneous talking ] sean Fox News Contributor Jonathan Turley is with us as well Jonathan Turley we appreciate you being with those we will get your take first on the argument before the Supreme Court today on the issue of immunity i always thought the better argument was limited immunity not absolute immunity putting all of that aside i thought a lot of interesting points were brought out by the justices if i may and i think that if you look at the comments of Clarence Thomas who said what about president s that have been leading to efforts abroad or arguments about barack obama and killing drone strikes americans i thought those opening arguments by the trump attorney was a well thought out argument or the same thing with george w. Bush and the argument they made there, will the will this apply to all future president s will it be in the back of their mind as they make lifeanddeath decisions which is a big part of their job. I thought that these were pretty penetrating questions from the justices that three liberal justices made very clear early on they were going to vote with special council but the remainder of the justices were concerned about arguments on both sides they didnt like the sweeping aspects of the trump Team Argument but they also did not like the sweeping argument of the Special Counsel and chief Justice John Roberts delivered a Haymaker On The Dc Circuit Quoting a line from them which basically said that these acts can be prosecuted because they are being prosecuted and that circular language really sort of produced some chuckles in the room but roberts was asked a very serious question, how can that be the standard for president s, it looked like they were trying to sort of grope in the darkness and find a third option, something that gives protection to president s while not giving them carte blanche. Sean i agree i did see your expost about Wavering Rebuttal which i agree with you, that was a little unexpected and frankly an opportunity missed in my view. I was very surprised when chief Justice Roberts turned to Trump Council and said rebuttal and he said no thank you and that is something that you rarely see there was a lot still on the table and i dont know of any circumstance quite frankly where you ever pass on rebuttal in the spring court. Let me ask you this i dont see a definitive ruling against trump, i know that its not wise to maybe listen to Oral Arguments and think about how these justices ultimately will rule i think ultimately a majority of justices, and this is my impression they seem inclined to ruled the former president s have protection from criminal charges but not absolute immunity i dont know if that means remanding it down to a lower court i dont know if that means that they will give instructions to a lower court earth they will just outright decided right there, what are your thoughts . If this trajectory continues for Oral Arguments it was a good day for donald trump because there were five justices that were clearly not buying into the Dc Circuit Approach that does not mean that they are going to say that trump is immune to prosecution but at a minimum if that is the case they would likely have to remand it to the District Court to say we need you to develop this record of it further if they do that it is hard to see how this could possibly be tried before the election and if former President Trump is made the next president then jack smith may never see a jury in this case it could and the prosecution. That and of course the other case at the hearing unrelated to donald trump involving people with january 6th that could also impact the Special Counsels case against trump as well, professor Jonathan Turley thank you sir here with moral harvard law professor Alan Dershowitz is with us, fox news legal analyst gregg jarrett, greg we will start with you tonight i will let you pick it up at any point, i have always felt that limited immunity was the better argument from what i got out of the Oral Arguments and from what i was gleaning from what the justices were asking they seem to be inclined to go that way but that was my impression you know far more than me. I think youre right Brett Cavanaugh for example pose the question what is to stop a creative prosecutor from using a vague statute to criminally charge a president especially a prosecutor from the opposing party and Gore Search Warrant about prosecutor is misusing criminal law to target political opponents and alito warned of a Slippery Slope with a loser in an election always getting prosecuted like in banana republics so its been clear to me that this is the court that will grant some form of immunity because they were focusing so much on the Nixon Versus Fitzgerald Case that did give president s immunity from civil lawsuits with certain conditions and i think that the court may extend that immunity protection to criminal prosecutions because of the same reasoning applying in the alternative they may say well we are going to send it back to the lower court with guidance on Immunity Parameters and allow that court to craft the rule for for the review but either way i think
