To waive an Arraignment Appearance in Fulton County after embracing the spectacle from his previous three arraignments. Six more trump codefendants, including former Chief Of Staff mark meadows, Jeffrey Clark and former trump attorney john eastman have entered not guilty pleas and filed waivers for their arraignments. The trump 2024 campaign has been boosted by the massive legal challenges with trump now in a dead heat in a hypothetical rematch with joe biden. Joining me garrett haake, joyce vance and jackie alemany. Garrett, start things off. We have had multiple pleas this morning right up against the deadline. Take us through what we know so far. Reporter theres just one of the 19 codefendants who has not entered a plea thus far. A relatively minor player in the saga. One of the Elections Officials caught up in the broader rico case here. Donald trump having filed his Appearance Waiver last week. We knew would not be attending. As you pointed out at the top, its a Split Decision for the trump campaign. They have raised so much money around his legal problems. Particularly around his appearances in various courtrooms, be they in new york or his surrender in georgia a few weeks ago where they raised more than 7 million. Now they are trying to raise money off the fact he is not going, pointing out it will be televised, its a spectacle that he doesnt need to participate in, even though those have benefitted him. We are looking out for, that im most looking out for, doesnt have to do with tomorrows hearing at all, which sounds like it will be a lot of paperwork. Its a decision about the mark meadows next step. Meadows has been arguing that his case belongs in Federal Court, even though he pled not guilty via waiver this morning. That decision from the judge about whether his case will move to Federal Court remains outstanding. To me, thats the most interesting next shoe to drop in this saga. Im so happy you brought that up. Jackie, weigh in on that for us. Especially how you see Rudy Giuliani there, his mug shot, second from the former president , how he is watching how this plays out with mark meadows as to whether he can move this thing to a Federal Court. Yeah. We have been waiting for trumps lawyers to actually follow meadows and file to have these charges tried federally. His lawyers have yet do that. As garrett noted, its likely because they are waiting to see how things shake out. We saw meadows appear before the judge last week in trying to make this argument that he was acting in his capacity as a federal official, as a gatekeeper for the former president. Seeking to depict his involvement as part of his duties as trumps top aide in the white house and his senior advisor. His attorneys have obviously argued that this should qualify the case for federal removal. In that situation, he would then be more likely to potentially dismiss those charges if the case did ultimately get moved. Its a little bit of a long shot case here. There are many people on the ground, particularly in georgia, who have said that meadows very clearly was not acting in his capacity as a federal official because he didnt have the rights constitutionally to begin with to intervene in a State Election when he was part of the efforts that trump was taking to overturn the results of the election, like pressuring officials, like Francis Watson and the former secretary of the and the Secretary Of State at the time to try to identify these unsubstantiated claims of voter fraud. It is interesting that trumps lawyers have yet to actually go ahead and file this motion for federal removal. Its likely because there are a host of others who are also in line to do this. They are waiting to see how which way the judge ultimately falls on this. Joyce, this is a two part. Does his argument qualify for moving to a Federal Court . At what point do you expect to get a decision on this from the judge . Judge jones decision will turn on whether mark meadows was working for Candidate Trump or President Trump when he acted in georgia. If he cant establish that he was working for the then president , his odds of removing this case become slim to none. The judge is aware that this is an unprecedented issue. It will be a Precedent Setting Decision at least for this case. I think he will take his time to get it right, knowing that regardless of who wins and who loses here, it is likely to land in the 11th circuit. Theres a lot of law coming out of this circuit, including a Supreme Court case involving two birmingham judges who tried to remove a civil case from state court to Federal Court. The analysis is indistinguishable between federal criminal cases and federal civil cases in this regard. So the judge has his work cut out for him to get it right. All that to say, i dont expect to see an opinion today. How massive of an undertaking, joyce, does fani willis have here when you have 18 codefendants, all tried to sever their cases from one another, a former president of the United States trying to push the can down the road when it comes to his trial date, a former Chief Of Staff trying to get his moved to a Federal Court . Talk about the undertaking d. A. Willis has and how realistic that trump could see a trial date before the 24 election. Its a big case with a lot of moving parts. But you know, thats the job. Thats what fani willis does for a living day in and day out. Its worth noting that this morning, georgias Attorney General indicted a rico case with 61 defendants. What shes doing is large in scope. It involves a former president. Its important because it involves Election Interference in 2020. Its not really outside of her wheelhouse. Thats difficult to explain that this is what the voters in Fulton County, georgia, elected her to do in cases that involve Violent Crime and politics and public corruption and all sorts of fraud. Its what she does. Garrett, wasnt to pivot for a moment. I know we are getting news on minority leader mitch mcconnell, hearing from his doctor after he froze publically two different times. What are we hearing on this . Reporter his office has released a statement from the capitol physician, the Senate Physician here saying that this physician has consulted with several neurologists who have seen mcconnell. Mcconnells office tells me thats four. And some other tests that have been done, including an mri. The physician has found in indication of any stroke or seizure related symptoms, nothing related to parkinsons disease. Ticking off some of the more serious possibilities that could have afflicted him. He is fit to return to duty. We will see Mcconnell Return to duty this afternoon when he is expected to speak on the senate floor. It will be the first time he has spoken publically since that episode late last week. A lot of folks, myself among them, will watch that closely for signs of his health and his recovery. This all stems from the fall and concussion he suffered in march of this year. Any expectation, garrett, that he or his office plans to further address this, or just move on when we hear from him . Mcconnell is most comfortable saying nothing about anything, particularly about limbself when himself when he doesnt want to. We wont hear much about this until his weekly conference. We will probably hear more comments tomorrow. I dont think it will be part of his speech today. Thank you. Meeting of the minds. Welcome back. North koreas leader kim jongun may travel to russia this month for talks with president Vladimir Putin. The white house is telling us this could occur on monday. Mr. Putin wants mr. Kim to agree to send russia Artillery Shells and antitank missiles. Mr. Kim would like rush so to provide north korea with technology for satellites and Nuclear Powered submarines, according to american and allied officials. The last time that kim met putin was in april of 2019. At the time, kim traveling by Armored Train to the Pacific Coast of russia where they could meet possibly again. Joining me to talk about this is kier simmons. Talk about the implications of a meeting, a trip like this. The implications are multiple. First of all, as you laid out there, its simply a question of the two countries trying to do a deal. You are right to point out that the last time the two leaders met, President Putin and kim jongun, was in 2019. I was there to witness that. With many other reporters. He traveled by Armored Train, as you say. I think this is an extension of that relationship. A reheating of the relationship in the sense that since then we have had the covid pandemic. That had an enormous impact on north korea. I think what theyre doing is trying to negotiate, i suspect pyongyang thinks it has leverage given that russia needs munitions, especially the kind that north korea has for its war with ukraine. I think theres also another interesting thing to take away from this, which adds to this really body of evidence that this is becoming an attritional war. Potentially, its going to last a long time, maybe a very long time. Russia as well as ukraine are looking for munitions and armaments to enable them to sustain their campaigns in that conflict. Theres twofold things going on. Theres what the United States is saying and doing about it, and theres the timing of this meeting which seems some what suspect as well. I want to talk about what the United States is saying about this and why, in fact, they are publicizing it. John kirby last week saying publically warning publically Arms Negotiations between russia and north korea are advancing. We know russia obtained weapons previously from iran. Why would the americans, why would john kirby be going public with this, warning us about it . I think the target is actually beijing. Kirby is, i think, correctly the administration is showing the chinese that we are tracking this. We have a bead on this. We are very aware of it. We are concerned about it. Thats one target. The second is pyongyang, is to say to the dictator there that, again, we are aware of this. I think that the value in doing that is to ensure that our allies and partners and friends see that russia has options. Meaning that, we need to stand strong and continue sending the munitions from our side of this divide. Final thought, you mentioned the word attrition. I think keir did. Its not only the equipment that putin is burning through, its people. The other metric to watch here is, how is he going to make up for the troops on the battlefield . Dont look for north koreans to show up. He will have to go elsewhere. Talk to me about the timing here. We saw the russian president in this vulnerable state after the advance by prigozhin who we know has confirmed to be dead. You talk about the ukraine offensive, which has not been going as well as ukrainian would have liked. They have recently, i believe, just yesterday replaced their defense minister. Talk about the timing of this meeting considering what is happening geopolitically. Lets think about this as though it were the godfather. This is one family reaching out to another for assistance and weapons systems. Its a moment of putin demonstrating that he has the ability to move around. It comes off timing could haves off after the brics meeting, brazil, russia, india, south africa, china, that was held down in south africa. This is putin kind of flexing his international muscle showing that he has options. As you mentioned, he is getting more advanced systems from the iranians. He is trying to convince china, thats the main ball for putin. He is trying to convince china to come in on his side. I think xi is too smart for that. I think one should be worried about the other one stabbing them in the back the second they turn around. Are we still seeing Vladimir Putin in a vulnerable state . Is this an indication of that at all . You dont know because you are into pure putinology. Things can come out of nowhere in that world. I do think what happened with prigozhin is the reasserting of the russian bureaucracy, if you like. This Enormous Network of relationships that President Putin and the people around him have. Prigozhin was always in a difficult position when he was talking on, not putin, but the people around him. He was taking on the system. You have seen the system reassert itself. In some ways, you could argue President Putin is stronger now as a result of that. That being said, of course, i could be wrong. I think to go to, i think the other aspect of this is what it were seeing is the russians and the chinese and now looking at the north koreans, trying to create this alternative international sphere. Its notable both president xi and President Putin are not going to g20, but putin will go to china and meet with xi at a conference there later in the year. You can see the way they are knitted together by this determination to try to weaken u. S. Influence around the world. Hence the warning from kirby. Thank you. Federal court, another ringleader of the january 6 insurrection will receive a lengthy prison sentence. The founder of the extremist oath keepers received an 18year sentence on a similar charge and conviction. Ken dilanian is joining me now with more on this. Ken, give us some back story on this trial. Is it likely that the government is actually going to get as many years for tarrio as they want . Reporter no. Its very clear from what the judge did last week with tarrios four codefendants that he doesnt see this case the same way the prosecution does. They are asking for around three decades. They got between 15 and 18 years. Still lengthy prison sentences. It will be interesting to see whether this judge hands tarrio the longest sentence of any january 6 defendant. If he gave him 19, that would be the longest. Rhodes got 18 years. Here is the thing. Prosecutors say theres no group that was more responsible for the violent on january 6 than the proud boys. Tarrio was the leader. He wasnt there. He had been banned from the city because he had been arrested. Evidence at the trial showed he was talking to them in a group chat. Afterwards, he said, make no mistake, we did this. Prosecutors say he showed no remorse. The proud boys in general viewed themselves as Donald Trumps army. They came to washington to do violence, to keep trump in power. They were headed to the capitol even before trump gave his famous speech. They were responsible for every significant breach of the window, broken window, every breached gate and door. Thats why prosecutors see them as different and are asking for in this case 33 years for their leader. The judge doesnt appear to see it that way. He is concerned about sentencing disparities. Its interesting to note that tarrio met with rhodes in a Parking Garage the night before the attack that happens to be the garage where many of us at nbc news park our cars and other News Organizations are there. We are not sure of the significance of the meeting. Both of those groups were crucial to what happened on january 6. Ken dilanian for us. We will watch for that later this afternoon. The mass exodus from burning man is underway in nevada with two to threehour waits reported after 70,000 people got trapped following a massive rainstorm that turned it into a muddy mess. Its rare not to have a couple threats out there. This isnt anything thats going to surprise anyone. Let me advance the maps and talk about the next storm. Tropical depression 13 just named that by the Hurricane Center. Here is where its located, out in the atlantic, far away from any land. Its five, six days away from land areas. This has a lot of potential. This is probably going to be a big storm, major hurricane, maybe category 4. The Hurricane Center does that. The first concern are the Leeward Islands and the virgin islands. Thats just on the southern edge of the cone. Notice most of the cone is to the north. 140 mile per hour hurricane, that gets your attention. You want nothing to do with that. The same in the Dominican Republic and puerto rico. This is five days from now. After we get past this, our Computer Models, these lines, they deviate a little bit. Theres a couple to the south i dont like. I cant ignore them but i would like to. These others turn it out to sea with more of a threat towards bermuda. A lot of the long range Computer Models do take these red lines and they bend it back up here, maybe just inside of bermuda but off the east coast. The bottom line, this is even if it did head to the east coast, its ten days from now. It will be likely be one of the strongest storms on the planet in a couple days. A battle over Government Spending will suck up much of the oxygen in september. The far right republican members of the house are trying to flex their muscle with a potential biden impeachment proceeding as the president is preparing to potentially take on donald trump again for the white house. Joining me to talk about this is susan page, tim miller and sam stein. Susan, let me start with you on this one. Talking about how september will look. This looming possible impeachment inquiry into president joe biden, along with getting there budget through. The house only in session for 11 days. Its going to be a mess. Its not clear we will avoid a shutdown. Its easier to see how it shuts down than to see how it stays open. Its hard to see how Kevin Mccarthy manages to get funding through the house and keep his job. Thats what we are watching this month. Sam, i want to talk about some of the polling we have been seeing, specifically out of the Wall Street Journal, when we look at possibly a matchup of whats looking more and more like former President Donald Trump and President Biden. Neck and neck out of this poll. I believe former President Trump is polling 46 points ahead of ron desantis. One of the two biggest concerns out of this poll when it comes to president bide reason the economy and his age. The president really over the last couple of days, since friday when the jobs numbers came out, really going after, as he says, his predecessor, the guy before me, now more than ever and addressing the concerns over his age. Lets listen to what he had to say. It was not long ago we were losing jobs in this country. In fact, the guy that held this job before me was just one of two president s in history, left office with fewer jobs in america than when he got elected. The last guy, he looked at the world from park avenue. I look at it from scranton, pennsylvania. The great real estate builder, the last guy, he didnt build a damn thing. What do you make of the pivot . Will it work . Will it resonate, same . The pivot is notable. For a while, they have not been going after trump, at least frontally like this. Clearly, they see the polls that everyone else does. Very likely trump will be the republican nominee. Why beat around the bush . He makes an effective villain. The second part is trickier. Is it effective . If you talk to people in the white house, they would have said, the economy is moving in the right direction, inflation is easing, jobs numbers are great, historic low for black unemployment, gdp growth great. People will feel it. People will see that reflected in the surveys. That has not happened. It hasnt happened. All that being said, just hearing now, john eastman filing a motion to sever his case in georgia. This is going to be in the news cycle repeatedly over the next 18 months, all the way through november. There will come a point in which President Biden needs to talk about, on the campaign trail, who he is facing, a man who has been indicted four times with 90 plus criminal charges under his belt. I think he will. We are four, five months away from the first Republican Caucus or primary vote. I think biden has been stuck between a rock and a hard place on the matter of how to deal with trumps indictments. He has done everything by the book. Hes gone Above And Beyond to not put his thumb on the scale, to not engage. He gave everything to garland who gave everything to a special counsel. We thought biden could have dealt with this more quickly in the aftermath of january 6. He has depoliticized everything. Still, he has republicans who know better and then republicans who dont know better, maga republicans, accusing him of being the man behind the curtain orchestrating these indictments, which is preposterous. Biden is struggling to deal with how much to be up front about this. If he is not getting any credit for doing things by the book, then eventually, you will reach a point where he will have to make the argument more explicitly. I expect he will do this. Theres a question, tim, over opponents talking about the 14th Amendment when it comes to donald trump. If we look at that polling from the Wall Street Journal, its looking like its more and more like President Biden versus former President Donald Trump come 2024, after this primary season is over. The wall street Journal Editorial Board making the argument that would not be a smart move to invoke the 14th Amendment. I want to read for you why. They say if mr. Trump does somehow regain the presidency, in part because democrats insist on renominating a weak President Biden, the normal checks and balances will exist. The consequences are likely to be worse for democracy and its institutions than trusting voters and 234 years of sturdy constitutional emmre. What do you make of this . Dont make me agree with the wall street Journal Editorial Board. I hate to be in that position. I respect others who made this argument. It maybe it would have been stronger on january 7, 2021, than now. It would feel less political. As a practical matter, regardless of what you think about the legal merits of this argument, i think there are a lot of things that would very much work in the disfavor of our democracy. I think the response on the right would be huge. I dont think its going to work. I dislike this argument that comes from many on the right, which is like, dont force us to be with President Trump by nominating weak joe biden and doing things to hold trump accountable. Six months after he was found guilty of murdering his wife and son, his lawyers, theyre asking for a new trial on what theyre calling newly discovered evidence that the court clerk tampered with the jury by advising them not to believe murdaughs testimony. Alex murdaugh was sentenced to two consecutive life terms in prison and his attorney is claiming this new evidence could win him a new trial. Nbcs Lindsey Reiser is joining me from columbia, south carolina, where his lawyers are holding a Press Conference just about 90 minutes or so. Also back with us, former District Attorney joyce vance. Lindsey, start things off. This is absolutely wild what we have been hearing so far trickling out what we expect to hear from these attorneys. Talk us through it. Reporter we have been reading through the new allegations in this filing and the allegations of Witness Tampering Center around the county clerk rebecca hill, the overseer of the jurors, she would escort them to and from the courtroom. According to the attorneys, she tampered with the jury by saying dont be fooled with murdaughs testimony in his own defense, instructing them to watch him closely, look at his actions, his movements and one juror understood that to mean he was guilty. Also, she is accused of pressuring the jury to come to a quick verdict, saying that the onset of deliberations that it shouldnt take them long. She is accused of having frequent private conversations with the jury. This was the culmination of six weeks of testimony, three hours of deliberations, murdaugh is currently facing serving two consecutive Life Sentences for the murders of maggie and paul murdaugh. But this new evidence would have to rise to the level of im sure youre going to have this conversation with joyce would have had to have been discoverable threw Due Diligence with the trial, with Witness Tampering you cant understand that until after you talk to the jurors after the fact, also would have to rise to the level that it could change the verdict essentially. That is what a judge is going to have to decide here. Remember, the case is currently under appeal. That is going to have to be on hold, yasmin, while we have this new hearing on motion for a new trial. Really shocking stuff. I guess the overarching question is will this win Alex Murdaugh a new trial. Is this enough to get him a new trial . Before you answer that question, i want to read this motion filed by these attorneys. Some of what lindsey just eloquently laid out here. Miss hill invented a story about a Facebook Post to remove a juror she believed may not vote guilty, pressuring the jurors to reach a guilty verdict, telling them from the outset of their deliberations that it shouldnt take them long, miss hill did these things and these are allegations, of course, to secure for herself a book deal and Media Appearance that would not happen in the event of a mistrial. And then it goes on to say miss hill betrayed her Oath Of Office for money and for fame. Also alleging miss hill had frequent private conversations with the jury foreperson. Talk us through some of what you have been reading here, joyce, the allegations that are being made and could this get a new trial for Alex Murdaugh . So, motions for a new trial are not unusual. But the allegations here are extremely unusual because the judges clerk, the court clerk is entrusted with an Important Role with the jury throughout a trial, especially a lengthy one like this, and part of the clerks role is to make sure that nothing improper happens. So the allegations that the clerk herself is responsible for Improper Conduct with jurors is something very unusual and very shocking. But what we have seen so far is only the defenses version of the facts, only their interpretation of what went on. I think we should withhold judgment until we see a response from the motion for a new trial by the prosecution. If there are problems here with the clerk, if these allegations are true, i would expect to see prosecutors own it. They certainly wouldnt be happy about it. But thats the sort of thing that prosecutors are supposed to do and do in cases where misconduct occurs. It may be, though, that they have an entirely different version of the facts. It is worth noting that the clerk herself immediately denied the allegations when she was asked about them. More to come, that is for sure. Joyce vance, thank you.
