Chuck and nancy must give us the votes to give us additional Border Security. Bill what are we learning about the manhunt underway . The manhunt is ongoing and has to be a concern for the police. Theyve been looking for the shooter for 18 hours. They have several hundred agents looking for him. Theyve stepped up security at the Christmas Market in strasbourg and throughout the city and frances border with germany with questioning whether he may have slipped into germany overnight. The police have also identified him. They say he is 29 years old. That he was born in strasbourg. A home grown problem and known to Security Services as a possible terrorist threat. Police say the gunshot wound you mentioned is from one of their own. They exchanged gunfire with him. They say he opened fire at about 8 00 p. M. At what is essentially frances biggest Christmas Market. It attracts more than a million visitors a year. You can imagine how busy it was. Pandemonium ensued and then the police put the historic city on lockdown. Not the first time a Christmas Market has been hit. Berlins was hit two years ago when the assailant drove a car into the Christmas Market killing 12. And this exact market itself in strasbourg was targeted by Al Qaedalinked terrorists in 2000. Were awaiting Michael Cohens sentencing hearing at federal court in manhattan. Cohen pled guilty to charges including lying to congress about a proposed trump real estate project in moscow. Now facing several years in prison. Were covering it from all angles this morning. Alan dershowitz standing by for reaction. We begin first with kevin corke live on the north lawn for us this morning. Any new reaction from the president on this sentencing as we await it . Not yet. But well keep an eye on his twitter feed. If the past is any indication, we figure the president wont miss an opportunity to weigh in on this particular topic. Cohen, as you know, will be sentenced for eight federal crimes he pleaded guilty to back in august as well as a separate charge of lying to congress that he pleaded guilty to in connection with the Mueller Investigation. Part of the plea deal cohen agrees to cooperate with special counsel investigation which could prove pivotal as the probe continues. I want to say what the president about cohens request about no time he said Michael Cohen asked the judge for no prison time. He could do things fraud, loans, taxes, etc. And not serve a long prison term . He makes up stories to get a great and already reduced deal for himself and get his wife and fatherinlaw, who has the money, question mark, off scotfree. He lied for this outcome and should in my opinion serve a full and complete sentence. President s dont usually weigh in on this before theyre properly adjudicated. This is not the usual presidency. I think thats something this president takes great pride in, sandra. Sandra kevin, more fallout from the president s warning yesterday that he would shut down the government if he does not get funding for that border wall. There is no question about that. This man is bound and determined to get funding for the wall or else. And the or else is something we just saw play out yesterday before the nation that dramatic and quite frankly stunning interaction between the president , nancy pelosi and Chuck Schumer yesterday here at the white house. Back to twitter the president talking about this idea of not getting 5 billion for the wall. He tries to draw a distinction here between something the democrats did previously. He says the democrats and president obama gave iran 150 billion and got nothing. They cant give 5 billion for National Security and a wall . Now, we wont get into the fact that was irans money from 1979. I dont want to make people confused. But lets take you through this. The wall was a campaign promise. Many on capitol hill including Lindsey Graham are urging the president to stand his ground, which is exactly what he plans to do. President trump i dont mine owning that issue. Chucks problem is when we last closed down, that was his idea. Honestly he got killed. You know what, rather than us debating who is owning it, ill take it. Ill take it. If we close down the country i will take it because were closing it down for Border Security and i think i win that every single time. Thank you for coming back. What is Michael Cohen up against today, sir . Well, its a very unusual situation where you have two prosecutors, the seventh district urging a long, long sentence saying the cooperation wasnt enough to justify a substantial reduction and then you have the special counsel kind of saying something different. Saying yeah, he did cooperate. My suspicion is that the judge will kind of split the difference and maybe not give him the maximum of four or five years. Unlikely to give him no jail time that his lawyers are seeking but perhaps a shorter sentence of one or two years representing the attempt to cooperate at least with the special counsels office. People cooperate get some reward. Bill help us understand why does muellers office look at him more favorably than the federal prosecutors in new york . I think the federal prosecutors have a deep review of what he has done over the years and looked at his history and financial corruption going back a long time with taxi medallions and other financial corruptions. They look at the whole person whereas mueller only has him for lying and he looks at kind of only a snapshot rather than a video. So its not surprising that prosecutors looking at different aspects of cohens life and cooperation would come up with different recommendations. Now, the judge has to look at it holistically. He has to look at the past, the present, the future. Will he still continue to cooperate . And this judge is a very able judge and i suspect that he will give a sentence that represents both points of view of both prosecutors. Bill cohen could still strike a deal whether its today, a week, or a month, or a year from now. You can strike a deal ive seen deals struck after the person got out of prison in order to get some collateral relief. There is never a statute of limitations on striking a deal. Bill if there is one to be struck. The president gave a couple interviews yesterday, one was in the oval office. He told reuters this when they asked about impeachment. It is hard to impeach someone who hasnt done anything wrong. Ifm owe not concerned. I have think the people would revolt if that happened. You wrote the book on that. What did you think when you heard that comment, sir . Its not going to happen, first of all. He wont be impeached unless massive new information comes out. I suspect the special counsel report will include lots and lots of sins based on political and based on circumstantialall evidence but i dont think he will come up with an impeachable offense. Treason, bribery, other high crimes and misdemeanors. The most theyve come up with is a very Questionable Campaign contribution issue that failed years ago. I dont think were in impeachment land and i dont think president s ought to be suggesting any kind of nonlegal response to impeachment. If were to be impeached and removed lawfully, wife i dont think is possible, which i dont think is possible the rule of law would apply and people would have to accept the result. If he were impeached and he challenged that and took it to the Supreme Court, in my book i spell out that possible scenario and whether the president would accept the verdict of the Supreme Court even if he didnt accept the verdict of the senate and house of representatives. Interesting hypothetical of the kind i would present to my law students at harvard but it wont happen in real life. Bill hope you stick around later today. What he told the American People when they elected him is 2016. The single biggest promise we made the voters in that election. So lets stand firm and get it done and i do think nancy pelosi is wrong. I do think there are the votes in the house, House Republicans to pass the 5 billion for the Border Security wall. We should do it as soon as possible. Bill thats a very important point. Will the House Republicans pass it and hand it off to the senate . Because at that point you would have the debate cornered, would you not . Well, we need to have the debate. Thats the fundamental question. We cant say we dont think there are the votes. We have the 60 vote rule in the senate so well forfet and not even try. We have to have the debate and try. If we stand firm we can get it done. After all, this is what the president is proposing is common sense. We need a Border Security wall and need to reform our asylum laws. The caravan issued underscored it. Lets do what is good common sense policy and only one vehicle left to get it done. You have to jump on the train that will go all the way to the station. That train is the appropriation and funding bill. The president said well put it on that bill and stand firm and that is exactly the right thing to do. Bill here is Lindsey Graham saying the following. Here is whats so hypocritical. In february of this year 44 democrats, including schumer, voted for a bill that had 25 billion for a wall. 2013, schumer helped create a bill that i was part of that had 8 billion for a wall. 42 billion for securing the border in other ways. So they want trump to lose more than they want the country to win. Bill what do you think of that . He said he would stick by the president. He said he had had enough of liberal arrogance. Take it on, stare it down, see what happens. Senator graham is right on target. They used to be for common sense policy building a Border Security wall, getting control of our southern border. Now theyre for open borders and abolishing ice. The leader of their party in 2016, secretary clinton talked about a borderless hemisphere. They have changed and a lot of it is about what senator graham said. They are just against anything the president is for. But here is the important thing. The American People are for this. This makes good common sense. So lets put it on the bill and send it to the senate and have the debate and lets win. Bill one more thing. You want to insert 5 billion to wall funding. Catch and release by reforming the asylum laws. How would you do that and why is that important . Its important because the whole caravan issue underscored this is critical. 85 to 90 of the people seeking asylum arent legitimate asylum seekers. Catch and release and they never show up for the hearing. You have to reform that for the caravan concept weve seen unfolding in the country. Those two things, common sense, those two things address the problem. Those two things are what we have to fight for in the bill. The most important is the 5 billion for the wall. Bill do you think Republican Leadership agrees with you in the house . I think were at a point where we have to do it whether they agree or not. They understand we need a wall. Mr. Scalise and mr. Mccarthy have been clear about this. Lets put it on the bill. The funding bill next week. Lets put it on that and have the debate in the United States senate and let senator graham say its the right thing to do and well get it done. I think certainly there is growing disen chan muchment with mays leadership within the conservative party. She is seen as extremely weakkneed in her negotiations with the European Union. She is no Margaret Thatcher. She has cowered
