Of the neighborhoods for the gunman continues. One dead two wounded, one serious. And, of course, well be checking back on this and bring you updates as they come in. Back here tonight, fans are streaming in for the 49ers preseason finale taking on the chargers one hour from now in a game that you will only see right here on kpix 5. Some fans have been tailgating for hours already. Tonight is the first game during a workday and the question has been, what will this do for the already bad traffic in the Santa Clara Valley . Mike sugerman is in the Stadium Parking lot right now. Mike, hows it looking . Reporter well, its looking good and can you spell that . Oh, my gosh can you smell that . Oh, my gosh, whats that . Marinaded chicken. Reporter they are playing the chargers. You guys are brothers . Yes, we are. Reporter youre fighting brothers right now. What time did you get here . We were here about 2 30. Reporter thats one of the reasons the traffic may not be as bad as you might think. A lot of santa clara is not here and a lot of people showed up early tonight. Plenty of ways to get in and around santa clara today but chris wont be using them. Today im working from home. Reporter normally he works tech support in one of the big office parks in santa clara. But among his neighbors is levis stadium and levis stadium is a very popular neighborhood spot tonight. Should i have gone to work, i would probably have to leave before 2 00 to avoid the traffic or parking lot situations at the stadium. Reporter anybody here working today . [ pause ] reporter anybody here . This complex on tasman drive crickets. Alpha networks. One guy in there. Near empty offices and plenty of room to park at the complexes we visited. Going to be a challenge today. Reporter among those who didnt have the option of working at home, u. P. S. Driver levee luna. I just got to work around it get creative, you know, maybe deliver the stops that are closer to the stadium first and then work my way this way. Reporter the game doesnt start until 7 00. But heres why locals didnt want to be around all day. How was the traffic . Not bad. Reporter its 3. 5 hours early its 2 45. Reporter what are you doing here . We were here at like 12 45 actually. But its football season. We dont care if its exhibition or not,. Reporter practicing their tailgate for the regular season. Chris wont be enjoying barbecue. He will be happily watching at home after his workday at home. This is the newest jersey jarryd hayne from australia. Im an australian. Reporter wearing the australian jersey. Yeah whoo reporter brandnew. All right. This was the first time there was a game during the week in three weeks in three weeks on the 22nd there will be a monday night regular season game. This is a regular test. Who is going to win . 9ers, baby, whoo reporter could have figured that. In santa clara, mike sugerman, kpix 5. Thats what it looks like where mike is. This is what it looks like from chopper 5 looking down. You can see, yeah, a lot of cars have already moved into those parking lots. More people on the highway and surface streets. It will be busy in the next hour or so. The whole south bay is jammed. Some of that is regular 6 p. M. Commute traffic and some is game traffic. But it spells slowdowns for a lot of folks especially along 101 and 237 near santa clara. Now as for the game itself, it is the last dress rehearsal for the 49ers and their new head coach. After this, every point counts. Kpix 5s sports director Dennis Odonnell is live for us inside the stadium right now. Dennis. Reporter veronica, i just heard sugermans report. He stole my thunder yeah. Hayne is the hottest thing going right now. Its rare that you got a jersey before a player makes the football team. But the word on the street is that number 38 is going to be on the regular season roster. 53 player roster for San Francisco now. The australian exrugby star leads the team in the rushing and has arguably been the preseason mvp. He is being hounded by the australian press. They have 20 people here to cover him last game. Theres been a report that he is a lock to make the 53man roster but the 49ers deny that. I spoke with him recently. Whats been the most difficult transition from rugby to the nfl . Oh, i think the whole game in general. Im still getting used to my pads and running off the blocks and the right, um, you know, i run plays and what not so a whole bunch of things probably not just one single area. I think the whole game in general. Im just trying my best every week and studying and, you know, just really enjoying the process. Reporter now, i didnt realize it at the time but that oneonone interview, veronica and ken, is the only one that jarryd hayne has done because he contracted to do a documentary so he is not doing oneonones so next time im going to say exclusive. Bring that jersey back. We want that here. Reporter oh, yeah, ill have him autograph it for you, veronica. Thank you. Dont forget to watch the game right here on kpix 5 at 7 00. Dennis is back tonight at 10 00 for the 5th quarter postgame show and if you are looking for cbs prime time lineup check out our sister station kbcw 44 cable 12. Nightbeat will be preempted. There is other news to talk about tonight. Three correctional deputies are accused of killing a jail inmate. Santa clara county jail deputies are under arrest after a coroner found evidence of bluntforce trauma. Sources told our len ramirez theres strong evidence there. Lenny. Reporter well, thats right, ken. Some of the evidence includes Video Evidence not of the actual beating because that allegedly took place in the cell and theres no camera coverage in those cells but of the common areas and the events leading up to the beating. Im also told that there are multiple independent recorded voice accounts of what happened from some of the inmates in the area about what they saw and what they heard and what they reported to their own family members on telephone calls that were made after the event as you may know, all of those telephone calls being recorded by the jail itself. So this evidence put together shows what may have happened in the events leading up and afterwards of this incustody killing. I want to express my profound sorrow over the loss reporter the sometimes emotional news conference, the sheriff conveyed condolences to the family of inmate Michael James tyree and condemned what she called a violent and cowardly act by three correctional deputies. Matthew farris, jereh lubrin and Rafael Rodriguez were all arrested this morning on suspicion of murder. Each accused murderer was booked, fingerprinted and photographed at the Santa Clara County main jail. The very same jail where they are accused of taking the life of an inmate they swore to protect. Reporter tyree was found dead in his cell thursday last thursday naked lying in feces and vomit. Video shows them entering the cell where they are accused of beating him to death reportedly over his refusal to take medicine. There were internal lacerations of the liver and spleen with significant collection of blood in the abdominal space, that resulted in the death of mr. Tyree. In short, he bled to death internally. Reporter tyree was in jail for petty theft and drug charges. He was due to be released to a Mental Health facility but remained in jail only because none were available. They beat this guy to death. Training isnt the issue. The issue is their conduct. Reporter paula canny is the tyree family attorney. Their conduct was outrageous nobody should beat somebody to death and then leave them in their feces and vomit unattended for an hour. Reporter after the correctional deputies were processed here in Santa Clara County, they were taken to Alameda County and they are in protective custody tonight as this case moves forward. Reporting live in san jose, len ramirez, kpix 5. South bay congressman mike honda has been dogged by questions about his ethics for some time and tonight a congressional report says yes he should be investigated further. Kpix 5s devin fehely is at the congressmans office in santa clara. Devin. Reporter yeah, congressman honda is locked in a very tough battle for reelection and the public release of this report could deal a serious setback not only to his campaign but his career. The newly released report from the office of congressional ethics concludes that there is, quote, substantial reason to believe congressman mike honda misused official resources including staff time which is paid for with taxpayer dollars to the benefit of his campaign. Right now, the news story is not good. The headline is, ethics violations. No congressman wants to have that headline next to his name. Reporter the investigation also found that congressman honda used official work events to drum up support and money for his campaign. Despite repeated requests for an interview today, congressman hondas staff said he was out of town and unavailable. He did release a prepared statement saying, im rightfully proud of my staff for being extraordinarily hard working Public Servants but they are not flawless. As a result of this investigation, i have instituted one of the most aggressive policies in congress on the use of staff. A Political Science professor says the ethical lapses are about fairness of. Give them an unfair advantage. Incumbents already have significant advantages over challengers and if they also have free staff time because their Congressional Staff who are paid by the taxpayers are working on behalf of their campaign, then that gives them a double advantage. Reporter hondas democratic challenger ro khanna was quick to say mike honda abused the trust placed in him. The fact is this investigation will make it even harder for him to deliver results to the people he is meant to represent. A committee will decide what punishment if any congressman honda will face. It has the egg industry scrambling with growing popularity. We have gone to having partnerships with walmart, whole foods, kroger, at record speeds. Reporter in the hundreds of emails obtained by the Guardian Newspaper members of the egg board tried to stop whole foods from selling just mayo and even tried to get a big company to stop making it. The amount of time the board spent thinking and strategizing about how to take this company down does seem a little bit perverse. Reporter josh head of Hampton Creek took the comments with a grain of salt but there were some that stood out. One member of the Egg Association wrote, can we pool our money and put a hit on him . And the Vice President of the board responded, you want me to contact some of my old buddies in brooklyn to pay mr. Him a visit . Yeah, um, that was a pretty strange one to read. Reporter the american egg board responded with this statement. We are aware of the comments made by an american egg employee. While these comments were clearly made in jess they were inappropriate and dont reflect our organizations values. We apologize for any offense. This is an agency of the United States government and theres much more important things to worry about. Reporter well, josh expects the tensions to continue because they are not stopping with just mayo. They are going to unveil new products like just dressing, just pancake mix and just cookie doing and they are also working on a plantbased scramble.
