good evening, i'm elizabeth cook. i'm ken bastida. the victim was om the water near a sea lion attacks a swimmer in the bay. who came to the rescue! i'm elizabeth cook. >> the victim pulled bleeding from the water this afternoon! andria borba is there tonight. andria? >> reporter: ken, elizabeth, the victim was taken to san francisco general hospital and is in serious condition from that bite. the soft waves at aquatic park lured swimmers into the waters of the san francisco bay where exercise comes with the chilly lap of mother nature and her inhabitants, including the sea lions who call this pier 39 home. >> it was a few years back. but just somebody's toes nibble on the outside, nothing to fear. >> reporter: this afternoon, around 2:00 p.m., a swimmer was outside the cove entrance when a sea lion began pursuing him. >> he originally said the sea lion was coming at him and he felt threatened. that's when he started splashing water and yelled at him to get away. >> reporter: but the sea lion persisted and attacked. >> he yelled at it and then the sea lion came up and bit him on the arm. he used his arapahoe county to push it away. it went away and he never saw it again. >> reporter: that swimmer, a man in his 50s, bloodied and injured made his way to the cove. a sailboat headed back to saucily doe. >> it turns out -- sausalito. it turns out he was fighting with a sea lion. so we picked him up. he wanted to go back to shore. but i knew it was deep. >> he was bleeding a lot? >> the back is soaked. >> reporter: sfpd's marine unit had the gray goose drop the district off at their dock. all marine officers were recently emt certified. >> we saw what looked like a bite wound on his right upper arm. and it was uncontrolled bleeding when he came on our dock. >> reporter: they applied a tourniquet and put the victim in an ambulance headed to the hospital. swimmers took to the bay. >> you just have to be comfortable being here. no worries. >> yeah. i mean, you have more chances to get hit by a car. >> reporter: marine wildlife experts say it's not unusual this time of year for sea lions to get aggressive because of mating season but rarely do they act out quite like this. live at aquatic park, andria borba, kpix 5. >> witnesses said it was a death trap. tonight a judge agrees ordering two men to stand trial for last year's deadly ghost ship warehouse fire. but christin ayers tells us there's one big unanswered question that could hurt the prosecution's case. >> reporter: the decision by judge jeffery horner means two men who used to live at the ghost ship warehouse, derick almena and massa drive, will stand trial for -- and max harris will stand several counts for manslaughter. a lawyer for the families of 12 ghost ship warehouse victims says this is the outcome her clients were hoping for. >> i thought the evidence was overwhelming. >> reporter: today a judge agreed, concluding that master tenant derick almena and a dj who lived at the warehouse, max harris, should stand trial. there's sufficient cause that both defendants are legally responsible for what happened that night and the deaths of 36 people, the judge said. >> they were running the place. they built the place. there was so much in there that was a tinderbox. >> reporter: judge horner called the warehouse a death trap. >> this was not a death trap. it was orderly. it was clean. it was wholesome. >> reporter: derick almena's defense attorney blamed the owner of the property and the city of oakland for the fire. in a courtroom today, officials testified the fire was likely electrical. >> derick almena and harris contributed to this terrible setup of the electrical system. >> reporter: but investigators were never able to pinpoint an exact cause. defense attorneys say that fact alone could work in derick almena and harris' favor. >> was it a candle? they don't know what it was! they can't tell us anything. >> reporter: a trial would not begin for at least 6 to 8 months. christin ayers, in oakland, kpix 5. tonight a third man is charged with murder in a brutal attack on an 88-year-old san jose woman known as ms. flo. willy king, initially charged as an accessory. he lived across the street from flo douglas and is accused of helping the other two suspects by casing her home. douglas was beaten so badly in the 2016 home invasion robbery that she later died of her injuries. all three of these suspects were formally indicted today on murder charges. zachery quinn and johnny brown, jr., could get life without parol if convicted. king faces a maximum sentence of 25 years to life. tonight the plug is pulled on net neutrality. the fcc rolled back obama era legislations on internet providers. what does this mean for you? veronica de la cruz breaks it down. veronica? >> reporter: critics say the repeal could change how americans go online. tonight santa clara county and several state attorneys general are threatening lawsuits. providers like comcast, verizon, and at&t stand to gain the most from the repeal. they'll be able to charge more and offer less. republican fcc chairman pushed for the change. he says the obama era rules kept service providers from expanding. >> high speed nec networks has declined by billions of dollars. >> reporter: smaller companies could lose out, especially those in smaller, rural areas. scott weaner said he would introduce legislation for net neutrality in california. >> we need to take back the internet and make sure it's there for everyone. >> reporter: bay area companies opposed to the repeal including netflix, twitter, google, and air bnb. the appeal will not take effect for another couple months. veronica de la cruz, kpix 5. tomorrow the public will be able to pay their respects to san francisco mayor ed lee who died suddenly two days ago. flowers, cards, and candles line the steps of city hall tonight. and flags continue to fly at half staff. tomorrow, his body will lay at the rotunda in city hall. there will be a public viewing and then on sunday, there will be a celebration of life at 3:00 p.m. also at city hall. a somber procession in southern california tonight for a firefighter killed while battling the thomas fire. 32-year-old cory iverson was from san diego. he leafs behind a young daughter and pregnant wife -- leaves behind a young daughter and pregnant wife. no details on how exactly he died. the thomas fire is now the fourth largest wildfire ever in california. nearly 250,000 acres have burned and only 35% contained. and more than 700 homes are destroyed. meantime tonight, top artists are banning together once again in san francisco to raise money for the north bay wildfire victims. betty yu on the new $100 million pledge. >> reporter: tonight as a sequel to the band together bay area concert which raised $17 million for north bay fire victims, organizers tell me that tonight's show came together within three days after that because so many people wanted to help. [ drums ] ♪ [ music ] >> reporter: red hot chile peppers rocked out on stage. they heard about the tremendous success of the first show. >> the very next day, we got a call from the red hot chile peppers. they said, we want to do a concert also. and now we're raising another $5 million a month later. it's unprecedented here. >> reporter: the tech company is dedicated raising $100 million through a series of benefit concerts to help victims. many affected by the fires are in the crowd tonight. >> just get a break from, you know, all the sadness and everybody, you know, trying to recover. >> reporter: marcus myers went to the first concert. his mom lost four properties in the fires. >> amazingly brutal as you drive through town. >> i lost track of how many friends, families and clients have lost their homes. >> reporter: lucas nelson and ensemble. the san francisco church's choir also entertained the crowd. ♪ [ music ] >> reporter: all the acts played for free. all the money goes to the tipping point emergency relief fund. >> just so wonderful that 100% of the funds -- 100% -- go -- all the money raised -- goes to do good. so there's no overhead. >> reporter: fans came from near and far and lined up as early as 5:00 a.m. for a shot of the best spot in the venue. that band area three is already in the works and fan csu expect this series to turn into a big fundraising movement. in san francisco, betty yu, kpix 5. are you addicted to your cellphone? the answer tonight at 11:00. a minute.. and listen to this. kpix 5's susie steimle tells us, fo all right, if you're addicted to the cellphone you may want to put it down for a minute and listen to this. we're told for the first time state health officials are going on the record about radiation risks. >> we recognize that there are a lot of people in the general public that have some concerns about their cellphones and whether the cellphone -- using the cellphone is safe. >> reporter: this is a big first for the california department of public health. it's releasing guidelines about harmful cellphone radiation and how you can avoid it. >> when you sleep, you keep the cellphone at least arm's length from your body. and also not carrying your cellphone in your pocket, having it either in your purse or not carrying it with you. >> reporter: the research suggests that cellphones could increase our risk for brain cancer and tumors, low sperm count, headache, impaired memory and sleep. >> we're not doing a great job regulating the radiation from he has devices. in fact, it's abysmal. >> reporter: this is a long time coming, he says. he's partially responsible for bringing this to light. he sued the department of health for refusing to release dangers of radiation back in 2009. he won. >> people are being injured and harmed by the delay in having this information accessible to them. >> reporter: so the question remains: does this release mean the state now believes cellphones are dangerous? >> not at all. our position is that the science is evolving. >> all right. so why is the state even releasing these warnings now? well, it says new numbers show that cellphone use is higher than ever. 97% of americans use their cellphones on a regular basis. sky drone 5 showing us the latest edition of the bay area's open space. nonprofits partnered up to purchase the pristine wilderness at half moon bay. the beaches are classified as coastal prairie. the habitat is quickly disappearing as more and more land is developed. >> they're currently used primarily for agriculture, some for housing. so having an untouched piece of the coastal prairie for wildlife is truly exciting for everyone. >> the acquisition will help extend the coastal trail through the city of half moon bay. it'll also protect an important winter habitat for raptors and other birds. well, tonight a fight over a proposed costco store in pleasanton. the location is off johnson drive off 680. da lin on why many fear this store could increase their risk of cancer. >> reporter: this large, vacant site will remain empty for a little longer. a group is suing the city after recently approved construction for a costco. the spokesman is a former pleasanton congressman. he's out of town but sent me this. he claims that costco trucks would increase neighbors' cancer risk due to the long exposure of deasil and other contaminants. pleasanton's city attorney tells me the environmental impact report addresses all those issues. he plans to fight the lawsuit. >> it's another waste of the city's money. we have to defend the lawsuit. >> reporter: costco supporters point to convenience and jobs. >> i am a costco member. with the traffic the way it is, it would be so much more convenient here. >> reporter: opponents say thousands of additional people on johnson drive would create a traffic nightmare. >> there's not enough parking! if costco comes in, it'll be even worse! so -- i -- i really don't see it. >> reporter: supporters say it's the perfect location since it's next to 680 and 580. they point out that other cities like oakland would love to have a costco. in fact, oakland councilman larry reed tried to convince costco to take over this old walmart location. but no success. that's why supporters say let's not drag this on before costco leaves. >> jobs, tax revenue for the city of pleasanton. >> reporter: this could be the opponent's last chance to stop costco. previously, they went to the voters for more than 60% slow -- went to the voters where more than 60% voted for costco. a $52 billion deal. disney is buying most of 21st century fox. the agreement is an all stocks transaction. it doesn't include fox's broadcast and news channels but their movie and cable networks will come into the disney disneyfollowed. -- disneyfold. the wait is finally over! >> i loved it! i was at opening weekend for the original in 1977. and this one impacted me just as much as this one did. for the die hard fans, there's a lot of throwbacks to the original trilogy. >> reporter: all right, so box office analysts estimate the "the last jedi" will do $200 million on opening day. the first, ""star wars" the force awakens did about $250 million on opening day. maria medina, kpix 5. >> i can't look at it! >> don't want to spoil it?
