Reporter but according to this former fbi special agent and Security Consultant jeff harp, while the u. S. Government has been able to hack the phones of germanys chancellor Angela Merkel or even the president of brazil, the fbi lacks the tech know how to open a common iphone. A device is more complicated to get into than just simply listening over a wire. Reporter this Technology Analyst says the complications start with the thousands of possible combinations for the four digit code to open the phone. With enough brute force and enough to super Computing Power they probably could do it. But whether they could do it on a given phone in time to actually have useful information is very doubtful. Reporter but heres the real problem. If you dont crack the phone within, say, 10 tries, the phone reacts by wiping itself clean. Thats what the bureau doesnt want to do. They are trying to preserve the evidence. Its very possible that they are working on how to break that encrypted device but it makes more sense, if you know somebody that has the key to a lock to ask them for the key to the lock rather than working on try to make a new key that may or may not fit. Apple said it doesnt have the key. They say that they dont have it and they dont want to create it. The worry is that that software could get into the wrong hands. First of all, it could be misused by government. And second of all it could get into the hands of others who might use it for criminal purposes and apple has a lot riding on saying that we have secure phones. Not only to its customers in the u. S. But all around the world. Reporter how vital is this information, do you think, to the investigation . Well, its unknown. Right now we havent been able to determine, you know, what was the cause for this person to go on this shooting rampage for him and his wife. They would like to try to figure out, were others involved . Really interesting. Really is. We could go a lot of different ways with this thing. What do you think is the next step . I think the court battle between apple and then the u. S. Government that goes all the way to the Supreme Court because apple is going to want to be told what to do in this case. And its a world market that not only wants a phone that works but one that stays secure. Ill put you one better. What happens if they wind up with a cell phone before the attack happens and the phone might have information about an upcoming attack . Specifically, whats taking the District Attorney so long to make a decision in this case . It has been about three months since it emerged. Its outrageous that nothing has happened. Reporter he is referring to this a video that shows two Alameda County sheriffs deputies in a San Francisco alley striking Stanislaus Petrov with their nightsticks over and over. The beating went on for at least 15 minutes. [ screaming ] we can see continuously beating and you can hear the batons hitting against bone and flesh and mr. Petrovs screaming. [ sirens ] reporter just before he was beaten, police say he stole a car and crashed into two patrol cars then led police on a chase over the bay bridge. Its one of the most horrendous beating videos i have seen even worse than the rodney king case in many ways. And yet theres been no action. Reporter Luis Santamaria and paul waiver the two deputies are on paid administrative leave. Will they face charges . Thats up to the San Francisco District Attorney and he isnt saying but a Law Enforcement source says the case has gotten complicated recently and may be delaying that decision. Turns out that in addition to the two deputies the d. A. Is now investigating whether at least two other deputies on the scene possibly more may have also broken the law. Has to be able to prove the case beyond a reasonable doubt. Right now, i dont think people should be too concerned but as time goes on, i would say if it gets to six months or more i think we should all be asking questions about why nothing has happened. The Alameda County District Attorney has decided not to pursue any charges against him. No charges there. But what about for the deputies . No specific date. The apparent frontrunner is a city councilwoman and frequent 49er critic lisa gillmor. If she lands the mayors job, her appoint would represent a Seismic Shift in the balance of power on the city council and could have wide ranging implications for the citys relationship with the 49ers. Theres too many back room deals going on. And im very hopeful that with new leadership in the form of i hope mayor gilmore well get that transparency. As revenue goes up every year the process to collect that tax revenue has not progressed in decades. Some government Officials Say that taxpayers are paying the price and distributors say its costing them their safety. Reporter theres plenty of green to go around at the Harborside Health center in oakland and theres more in its safe. Because the industry legal in the state but not federally, harborside cant use banks or credit cards for anything, including paying taxes. Its absurd. Its dangerous. It is not in the interests of public safety. Reporter its a taxable industry in the state that 1600 dispensaries bring in close to 570 million of taxable income each year.
