The Program Director for madd in the bay area was part of a panel that spoke to several state judges tuesdayabout the need for changes to pretrial detention policies. Theres no real pretrial detention reform for those offenders, as theyre just out there waiting months on end to even be charged. Thats the case with yarenit malihan, the driver in septembers deadl y crash on i680. She still hasnt been formally charged in that case, nor in the previous dui she had in june of 2016. Then just last week, she got arrested again for public intoxication. Then, to get arrested again, and she has not been formally charged, its been a real slap in the face not only for us and the work that we do, but for the family as well. Just another low blow. Thomas, who has been working with the dunn family closely since the accident, had already planned on talking about them on mondays panel. Then she had to add to her notes when she heard about malihan getting arrested again. Malihans license was revoked in december but not before that because of dmv protocol for adrugged driving that differs from adrunk driving. Impairment is impairment. And so while you can kindasome people try to distinguish the two; we think they all fall within the same category. Meanwhile, malihan is no longer in custody for fridays arrest. Police found her lying in the street, took her to a hospital, and then got a call from the emergency room saying she had left by herself. Officers found her wandering the streets, apparently drunk. The strange circumstances are even more examples madd will use to call for change. Not only how to we process duis, but how do we help people who are chemically dependent to alcohol or drugs .
