MSNBCW All In With Chris Hayes January 23, 2019

It is now day 32 of the trump shutdown and with millions of americans continuing to suffer, donald trump is once again demonstrating why he has over seen the longest shutdown in u. S. History. Because it is impossible to negotiate in good faith with the president of the United States. On saturday youll remember the president offered what he billed as a compromising end to the shutdown. It was, gently, a nonstarter. Negotiated with his own Vice President s and son in law he hired to work in the white house in exchange for the billions, trump offered only temporary protections but the Trump Administration itself has put into legal limbo. So it was not good deal. In fact it would have encouraged trump to take hostages in the future. Only now we know the trump truth. It was more like a scam. Last night Senate Republicans posted the trumpapproved legislative text they plan to vote on this thursday. And in addition to what trump promised, it included radical provisions he conveniently forgot to mention that would drastically restrict asylum. Conservative legal writer said this would and should get zero votes from democrats. Writing this is not the compromise trump said. It would bar children from el salvador, guatemala and el salvador. There is no system set up for them to do that and it would require these children to continue to live among the violence theyre so desperately trying to escape and that is just one of the hardline new limits on asylum the president is demanding to open the government to pay for the wall that mexico was supposed to pay for. The shutdown only began because he wouldnt sign a bill to keep the government open that had pass would wide bipartisan support. And remember last year when he made this promise. You that far away from comp rehence vr Immigration Reform and if you wanted to go that final step, i think you should do it. From the senate, from the house comes back with an agreement, i will be signing it. Im not going to say oh, gee, i want this or that. Clear as day. That was broadcast. Come back with a deal. Im signing it. Im not going to say oh, gee. And they came with an agreement and trump wouldnt sign it. Instead try to lower since the 20s. And fbi agents said the shutdown was hampering sex trafficking probes and the breadlineses for federal workers are growing in washington and beyond. Democrats desperately want to find a way to get the Government Back on track but theyre dealing with a president s whos not a trustworthy partner. He will hide the truth and lie and change his minds over and over again and that is why were suffering through the longest shutdown in history and 2459s thats why the only way to deal with this president is to defeat him. Joining me for former Vice President ial candidate, tim kahne. Senator, can you make deal with this president s . Do you agree that the bad faith makes it essentially impossible to strike any kind of deal on immigration . Up until today hes shown a fantastic ability to blow up a deal and no ability to make a deal and especially no ability to make a deal with democrats. He doesnt even want to talk to us or take our views into account but now he has to deal with a Democratic House and and strong unified democrat sen one has huge restrictions to asylum, no permanent refreev d. A. C. A. And the other have a resolution to open until february 8th. How do you understand these two votes . I tell you what should happen. We should reject the president s proposal jammed down our throats with no chance to adjust or change it but put in committee where we can have a hearing about it and offer amendments to it and we should pass the bill just opening government until february 8th to give us the opportunity to dialogue about and improve the trump proposal. Thats what i hope well do on thursday. Reject the trump proposal and reopen government. I was at the food the restaurant today that jose andres hasope frnd federal employees. Its a cold day in washington and it looks like a breadline out of the depression. People waiting in the cold to get their soup or sandwich. But were not in a depression. The white house says the econaim is great and the stock market is great. So why are people waiting in a bread line like during this . Its because of this president. Your preference is you move the president s proposal through a normal committee process, amendments and changes. Heres the problem. Weve been through this rodeo twice. Funding for the wall, d. A. C. A. Reprieve. He tore it up and wanted immigration restrictions that would be the most ownerous since 1920 and now he says ive made a deal with myself and Vice President and son in law, democrats enjoy and in the fine print are massive changes to asylum. Wont that just happen again . Do you see my point here . I get you. Can you deal with him . Its less dealing with him and more with each other. The four elements of the president s proposal, border security, dreamers, temporary protect status, these are issues we can find accord can on and we need be willing to be an Article One Branch and the house would have to act. The president s going toing have to decide what hes going to do. What i ubto is when the majority leader says we cant act until the president says mother may i. No, we put the bill on his desk. If he vetoes it, then were going to focus on overriding the veto. But we need letting his every whim from congress doing what they should do. Mcconnell is holding these two votes he thinks theyll fail. And then arent we just back to square one . Am i missing something . If were right, were back to square one. But i think theres enormous precer for republicans to vote yes on the february 8th version as long as they believe democrats will engage with them in a discussion about these topic. Set the president aside. And i think we can find, with like minded colleagues some bipartisan paths forward. What the president will do, who knows. Rather than worry about it, lets do our job and he can figure it out. Thank you for making some time. Absolutely. And joining me is the director of the aclus immigrant project. It was published online last night. This is no compromise. This is a wish list of antiimmigrant proposal. Essentially shutting protections for kids out from central america. Weve never done that to single out a particular group that even the administration would recognize is incredibly violent. Asylum law for everyone and a special asylum law for central american. Children. Children. Where they cant apply in the same way. And theres no judicial review, no ability to say you got it wrong. Its up to a bureaucrat whos sitting in that country to decide whether or not you get asylum. Its a radical, radical change to our asylum law and one that would set a precedent but brings us right back to where we werer before we passed the refugee act in the first place. We recognize we made a mistake, right, in the world war ii era when we turned ships around that came to our shores. Children. Boat loads of children fleeing the nazi. Ethnic and racial prejudice and we decided were not going town that road of saying this group of people can and this group cant. If you meet the statutory standard, you get asylum in this count cannery. Thats an important thing we shouldnt be turning our backs on. Is there continuity in what happened last time between this deal and that one. And this other agenda pushed into. Totally reset. And now were talking about whole set of things that werent mentioned in the president s speech when he supposedly introduced the socalled compromise and were in a different place and with all respect to the senator, i dont think theres enough lipstick you can put on pig. Its really and even the protections it claims to be offering for people who currently have d. A. C. A. Or tps are hollow, narrow. Theyre going to leave people out and slam the door on people in the future. Ill ask you same question. Can any deal be made ever with this president . I saw eyes say i think professionally im supposed to not say no. We have a real problem with this administration and their ability or into provide in good faith. Much less if you go back to february and before that. So its a real problem. But we have to find a way out of it esearchally. Now i want to bring in msnbc goldbering and author of the book everything trump touches dies. My favorite detail from today, one of the things that makes this thing particularly absurd is the crisis on the border. And they had to cancel the meeting on border skurbt. And were not paying the fbi, Law Enforcement. The whole thing is preposterous. And im really disappointed by how people are talking, including to some extent senator kahne and the media in general. Its really not a compromise. Its a sort of upping the ante. First he asks for 5 billion for a wall and he says what if i throw in more prison beds and restrictionses on asylum. Thats not compromise. A continuation of the status quo but worse. So someone likened it to working out a deal with your room nite lower the rent and then taking it to the landlord. Theres finger prints of Steven Miller on this. In the way that he is opposed he wants to reduce immigration, unauthorized, authorized, legal in every possible way because he has concerns about the current majority of the country and thats fundamentally whats driving this. Remember the democrats offered him 25 billion for a wall if they would do d. A. C. A. And president miller decided wasnt what he wanted. Theres something deeply wrong with Steven Miller and maybe some day heelver a relationship with a live human woman. I dont know if that has anything to do with it. Until then hell be in this bizarre hostility to anyone who wants to come to this country. The guys just a dark and weird figure and he wrecks trumps idea that trump is this master negotiator. We have the short of the deal every day where this thing goes crazy and off the rails every time trump speaks bouts it, it gets less likely hes going to get what he wants. At this point the motivation for the democrats to compromise is zero. Theyve offered nothing of substance and stopping on the don from doing this has become something that Democratic Base will not tolerate. Paying for this guys wall. The fact that when you do things like this, then you make the impossible to negotiate. When everyone literally across the ideological spectrum were reading this, were like, whoa, whats all this asylum stuff. You cant negotiate that. If he wanted any of this, he would have done it when he had the leverage of the republican controlled house. He wants to do a dominance move with nancy pelosi and possibly get something he can talk about in his reelection bid but he has no interest in coming to any sort of goodfaith comp can rumize. And hes in a situation where the times wrote a good piece on him that this is an mo from him and walking away from things and basically using the fact that he cares more about winning than the counterparty to basically say yeah, youre go having to to take me to court to gelt your money. In this case theres no court. Theres nothing to force him back to make a good faith offer. Well, chris, i disagree somewhat. Donald trumps numbers are crashing out. These government employees, 800,000 employees right now going into their first full month of not getting paid, look a lot like the middle class folks that trump see as his base. And so i think hes starting to pay a price politically ewith folks that should be supporting him and hes certainly paying a price with the rest of the countrys already deeply posed to the shutdown. And youre right. Trump no shame. But occasionally hell get forced into a box where hes forced to do something. Look, theres only a certain number more day wheres the Border Patrol guys are going to say let me put gas in my car to go to work. Thats a good point because they also are working without pay. On the donald trump owns the largest shutdown and well take a long look at. Im a veteran and the army taught me a lot about commitment. Which i apply to my life and my work. At comcast were commited to delivering the best experience possible, by being on time everytime. And if we are ever late, well give you a automatic twenty dollar credit. My name is antonio and im a technician at comcast. Were working to make things simple, easy and awesome. It appears to me the only person in washington d. C. More shameless than President Trump is Mitch Mcconnell. Remember he warned him that a Government Shutdown was not good idea. I think a Government Shutdown is not good option. Thats my view. The American People dont like it. I dont know how many times you remember my favorite country saying theres no education in the second kick of a mule. Weve been down this path before and i dont believe well go down this path again. Then the shutdown happened and Mitch Mcconnell just disappeared. Almost as if he wasnt going to let himself get kicked. At any point the at least since january he could have allowed a senate vote on any of the nine democratic proposals to reopen the government instead he called them pointless show votes. But now that the president has worked out a deal with himself, mcconnell is going to hold a vote. The shutdown dist iled the essence of mcconnells position, in trumps washington, a man of instugzs and establishment, whose legacy is now tied to a president who is hell bent on burning that to the ground. Great piece. Heres my theory. I think mcconnell is the closest trump has to a dick cheney that exists. I think thats a plausible theory. Theyve had a curiously sim beotic relationship during trumps time in office. And mcconnell in many ways has buteroused trumps ambitions he didnt have an idea of how he was going to pursue it. There are things that. Huge stock piling of he knows enough about government whereas trump does not. In many ways e hes a virtuoso and really the only person who has mastered the senate, which is largely a function of the way that he a great example. And i think most people seem not capable. Your point about him understanding bet than anyone. And talking about we can come together and negotiate. This is him talking about the decision to sort of block the nominee, whoever it was, when Justice Scalia died and we can asked him about the legacy. He said i dont think so. I think the most consequential call was to not fill the scalia seat. Massive hardball but he didnt care. I think youre right. He has an argument for why its not departure. Both his and detractors would believe this is rob con. Its hard for me to imagine this rule not holding for any future president. Its hard to see how anybody gelts on the supreme court. No more divide and rule nominees. Hard to imagine that happening. There will be arguments why that shouldnt happen. Where do you see his role now in the shutdown . He very much has tried to stay out of the glare of cameras. You cant find him. And hes pointed to the role he played in defusing some of these thing in the obama years and there was a nixon goes to china aspect of him negotiating with joe biden. He can point to getting a lot for conservatives that people in the tea party who are not as tactically savvy about these things, they would not have been able to get. The president is the problem. He knows the president is the problem, even if he cant say it. Thats the thing remark lk. Hes on camera saying dont do this and his amazing ability to come before the cameras and say he never said that. And he negotiated a temporary solutions with ryan before he left office and the main thing that made that not a viable solution was trumps decision to demand a wall. And i think he knows theres not a good way out of this but an interesting situation where i think his partisan loyalties are and pretty interesting point of conflict. We always know which one of those two wins. Coming up as the Mueller Probe continues in rel silence. I think the best companys succeed as a team and our shirts from custom ink help bring us together. Com much will be off limits according to two Republican Committee members. In a letter to cohens attornae they say they were told by cohens Media Advisor that his testimony will exclude any matter under investigation. It would include both the russia probe and finance crimes investigated by new york and if it is true, it means cohens hearing would produce new answers about whether the president of the United States broke the law and if he has continued to do so in office. They dont want to step on investigators toes. But as Investigative Reporter pointed out there is no historical precedence for that kind of approach. When sam irvin held the Senate Watergate hearings, did he ask arch bald coxs permission . When he began impeach hearings, did he ask for permissions to do so . No, because everybody accepted that congress had a job to do. Year going to see whether Elijah Cummings and schiff will do their job here and that means public, not behind doors. What lets start with the basic thrust of what michael said last night. The need for public transparent hearings. What do you think of that . I think its obviously a terrific idea where its appropriate. I dont think youre going to see any of the chairman shrink from their responsibilitieses. I know particularly on the Intelligence Committee to return a level offious seriousness. But there are public hearings scheduled in front of the Oversight Committee. The committees are just getting constituted this week. I think youll see very aggressive oversight by
