Trump will stay in trial, accusing of beating may 20th 2024. Without any political context, he will be in court and not on the Campaign Trail for at least two weeks between Super Tuesday and the Republican National convention. That break would be bad news for any candidate, but its especially unfortunate for trump, who is trying to outrun or at least run alongside multiple doj investigations. The Justice Department confirming earlier this week that trump is a target of its Election Interference Case, prosecutors cited several possible statues, including conspiracy to defraud the United States. Trump waits for that next indictment, the Washington Post reports he is quote, making the centerpiece of his candidacy an appeal to stay out of prison. Not only does trump want president ial immunity, hes also relying on Campaign Donations to pay his growing legal fees. And for now, the Republican Party is rallying behind him, even his rivals from the white house refused to hold Trump Accountable for january 6th. Former Vice President mike pence, as usual, downplaying a mob that was chanting to hang him. I had no right to overturn the election. President trump was wrong, he was wrong still. And his reckless words on that day endangered my family and all of us. Glenn im not convinced it was criminal. And i hope that with the possibility of another indictment coming against the president , i hope it doesnt come to that. The bought doing a lot of work in that sentence. Joining me now, former republican congressman david jolly of florida, he is an as nbc political analyst. Also with me, former u. S. Attorney harry litman, he is a Legal Affairs columnist for the l. A. Times and host of a podcast. And luke broadwater, congressional reporter for the new york times. It is good to see you all. Harry, we have a date to circle on the calendar, at least for now, may 20th 20 2024, for the start of the special counsels documents case. What do you make of the date judge cannon picked this week . Alicia, we need a date, but with an eraser on it and a white board. Because thats im not surprised she said it then, but we know its just an overture for trump to start pushing, because thats in particular when theyll really be at the end of that period, all kinds of litigation over the calls sulfide procedures, part of the case. The classified documents. And thats the one thing thats challenging and could take up time. So really, hes starting almost a year out of the box, and hes got six months to go. Im sure thats how hes looking at it, and hell have some cards to play, especially with the classified documents. What do you mean by cards to play . The classified documents, hes got a lot of things that. Bring most of them are really meritless. But when it comes to classified documents, theres a prescribed set of procedures that we have to do with can the jury see them, how much can the defense actually sanitize them, because these are, after all, classified documents. Thats a Big Push And Pull and tug of war, even with good and for any case, and thats where he has his best shot at really imposing additional delays, and getting for him passed the finish line of november 2024. David jolly, understanding the huge asterisk that harry has just placed on that date, if you look at it and just sort of imagine the possibility of its proximity to Super Tuesday, to the convention, i think the fuller picture of just how challenging this is going to be, not just for donald trump himself, but for a republican field that has not wanted to go head first, attack him head on, with the exception of Chris Christie into a secondary degree hutchinson, you heard pence there saying what happened on january 6th, it wasnt good, it wasnt right. But saying i am not sure it was a criminal. Talk to me about the challenges of all of this for trump himself politically, and for the republican field. Yeah, alicia, i would say for the challenge for the country as well, who was possibly going to be facing an unimaginable choice next november, and finding ourselves in an unimaginable historic moment. But for donald trump himself, he got exactly what he wanted. What we do know is that indictments dont hurt him, they help him. So if youre up by 30 points, what you dont want to introduce is the unknown of a trial before the republican primary is over. It will be over by may. At this point it looks like donald trump will secure the nomination sometime in march, and then to harrys point, that actually introduces some new novel legal questions as well that i think play perfectly legally to donald trump. Would he have reason to raise a question of delano as a Major Party Nominee on a ballot against an incumbent president . Perhaps. We just dont know. So then what does it mean for the rest of the republican field . They still have not figured out how their words can define donald trump. At this point, the rest of the republican field is just worried about how theyre defining themselves. Am i being too critical . And might not be increment cool enough . How do i kind of ancient to this moment . Mike pence is a perfect example. Donald trump should not have did it, he put my family at risk, but i hope he doesnt get in trouble for it, even though we saw the Guy Rappelling down from the balcony and we know that a protester got shot outside of the house. The security of the nation in the capital was at risk that day. I think that mike pence whatever it is is the nonsense well continue to see from republican candidates. I appreciate that. You remind me the greatest states are for the country. Listen, its not just 2024 contenders that have this on their mind. Theres a push by republicans in the house to expunge trumps impeachment. Youve got Speaker Mccarthy saying he supports it, denying he made any deal about it with trump, what is your reporting telling you . Yeah. He does support it, he doesnt deny that there was some sort of secret deal, but we do know that they talked about it and he told trump that he would talk to the republican conference about it. And we do know that at Least Stefanik has introduced the expungement, shes the number three republican along with Marjorie Taylor greene, whos maybe the most famous republican in congress at the moment. So it does have momentum, it probably could pass, sometime in the fall perhaps, but again, it doesnt really do anything. Right. So whats the point, luke . Its totally a symbolism thing. Its to tell trump were with you 100 , those bad democrats of the past, they were erasing them from history, but of course you cant actually erase what happened in congress. Everybody saw the impeachments, we know what happened. So its not like a criminal record that you can sort of you can pan the box or something. Its just totally a different scenario. This will be a purely symbolic act. Harry, trumps former lawyer claims another federal indictment is still far off. I want you to take a listen. I know that there are several key witnesses and that they have not yet interview. And so it does give everybody the impression that were talking about an indictment within a week, whereas my personal observation, i think its at least a month away. At least a month away. Harry, what do you think about the timeline . He is whistling in the graveyard. The interview agents, the interviews that they want to do, do not require a grand jury sitting for the most part what you want to do now is the people you need in the grand jury, like will russell, who testified for the first time. You want to lock him in. Everybody else, bernard, they can talk to after. And they can do a trial subpoena. Now, its true, we dont know who else he may want to try to stitch up. Weve heard so far about trump, but to me its customary, not necessary, but customary that the indictment follows a quick order off the Target Letter. And smith i think is all about speed now. So its plausible, hes got a severalweek game plan, but to me its equally if not more plausible he is ready to pull the trigger with one exception, and that is trump gets an opportunity if he requests it to make a final appeal, which will not succeed to the higher ups, but not Merrick Garland higher ups. In the doj and smiths operation. Luke, part of the reason i made you spend part of your saturday with me is because i have to burning questions about congress as it relates to the dojs Target Letter to trump. One is, do you have a sense, as you talked to republicans on the hill, that they are more spooked than they are letting on, by the possibility of a second federal indictment . And given that with the statutes recommended by the january Six Committee, any sense of vindication among former members of the committee . I talked to several members of the committee right after the news came out about what charges were in the Target Letter. And, there stance pretty much is we laid out this case, and weve been hoping the Justice Department would pick it up and run with it. And all the time theyve been agitating for it to be quicker and happen faster, and so they were glad to see that things were moving along, and that their evidence was being put to use and was being built upon. Jack smith certainly has advanced well beyond where the january Six Committee was. He has been able to pierce privileges that were invoked by key witnesses to the january Six Committee, hes been able to interview at least a dozen people that they never got a chance to talk to, highranking people close to trump. So hes gone beyond what they put forward, and in fact, i think you see that with the deprivation of rights under the color of law account, because that was not one of the considerations of the january Six Committee put forward. So, they think that things are moving along and theyre glad to say that the Justice Department has surpassed them. Harry and luke, as always, thank you so much for getting us started. Confirming today that Vice PresidentKamala Harris personally make the decision to travel to florida yesterday. The lastminute trip to respond to the Florida Board Of Education approved new standards for teaching black history. Take a listen to what she had to say. Just yesterday, the state of florida, they decided mental School Students will be told that enslaved people benefit from slavery. They insult us in an attempt to gaslight us and we will not stand for it. Florida governor and president ial candidate ron desantis colin her address absolutely ridiculous and totally adjust. If you ask me, that is more about him than her. Back now our panel, joining the conversation lets talk about the stakes of what is happening in florida. So critical that the Vice President of the United States felt it was personally important for her to travel to the Sunshine State to go on record from the state outlining for people why this is just so dangerous. What do you see as the consequences of what we are watching in florida . The consequences are dire. We are talking about my ancestors here. This is a bit personal to me. The idea that anyone in their right mind would try to make it seem as though slavery was somehow good for the slaves, people who were treated like animals, people who were treated like they were in human. They were not human beings. And somehow we are going to try to change a curriculum to make it seem as though there was some good in . That it was no benefit to being raped. It was no benefit to being, you know, like of bodily autonomy. There is no benefit to that. Teaching is that white does a disservice to the children in the state of florida. It does a disservice to our country. I dont as disservice to our accurate account of history, period. I cannot of course top that. Congressman jolly, it strikes me that you have republicans trying to point to florida as a Bastion Of Freedom, well put that in big quotation marks, while also trying to limit the very basics of what this country was founded on. Yeah, Bastion Of Freedom for which white men, basically, what florida is becoming under the ideology of runs and his party. I think the representative put a perfectly. Rhonda sent us, his entire ethos and brand has been defined by stepping on the futures and full full fortunes of the black and Brown Community and marginalized and lgbt community. That is the brand, that is why he has suffering now nationally. Because he is seeing only for that ethos. There is no traditional republicans republicanism in him. Certainly, you can look at the history of the party to find their themes of racism, xenophobia, and discrimination of marginalized communities. But Ron Desantiss book has been the now nationally and it is an anchor around his neck in national politics. Obviously, what is most important here, representative, is for these larger questions about democracy, but education, about what it is that we are teaching the future generation of leaders. We are also in this very tenuous political moments where so much is at stake, predicated on positions that will be made in the next year and a half. A decision on the part of the Vice President to come to florida, what does that signal to you . I think it signals that this is an important issue. Not only that, i think it signals that this is an issue that will probably make its way into the 2024 elections. Lets be clear, right now what we are seeing and florida and honestly across the country is a lot of Culture War Type issues being brought up. And so we are seeing people a tech education, the types of books that are available for students, were seeing all of
