An uncovering situation in ferguson, officer darren is speaking out for the first time about the shooting that killed Michael Brown. Wilson says the altercation began after he asked the teenager to move out from the middle of the street. After a verbal exchange, wilson says he reached into his police car and grabbed for his gun. The officer says brown punched him in the face. Is there anything you could have done differently that would have prevented that killing from taking place . No. Nothing . No. And you are absolutely convinced when you look through your heart and your mind that if Michael Brown were white, this would have gone down in exactly the same way . Yes. No question in. No question. Something you think will always haunt you . I dont think its the haunting. Its always going to be something that happened. You are, you have a very clean conscience. The reason i have a clean conscience. I know i did my job right. Im just curious, so we have stated and i have stated repeatedly that there are two criminal Justice Systems in america. I know. Black, young men, especially, are no longer treated worse in the streets, theyre treated worse in the court systems, all the way through, but white kids get away with, black kids dont get away w. All right, so everybody agrees with that. Okay. Everybody agrees with that. Yeah. That said. If whats in the grand jury sorority true and if i stood in the middle of the street in front of that Police Officer and then ran to his car and started punching him and grabbing for his gun, does anybody presume that i would not be treated the same way . Because i will tell you, cops areeto everybody when you dont do what cops tell you to do. If thats what happened, i think its what the grand jury says. So i just, there is an element of race, but as far as this specific event and this cop goes, im just curious, discuss anybody on this panel believe that if i confronted a cop, a new york cop, lets say, Staten Island, the cop said, get out of the street and i said no and i started swearing at him, i went up, i started punching him, i started grabbing at him like the grand jury report says, if that is, fact, true, what would that Staten Island cop do . Steve, you lived in new york a while, what would a new york city cop do to me, white guy . Well, at that point in time, probably exactly what he did do, with i is to try to recover his gun. The gun went off. I think there is two other pieces to this, one is that you are a big guy, brown was a big guy, and its a little different
tan if me or catty or somebody were in a fight with a cop. I agree with that guy coming at me. Id be scared. The cop is a big guy. He is 6 4. The critical part is when brown ran away and turned back at him, thats where, of course the fatal shots were fired. Let me ask if i were running, is roland in yet . I hope you caught the first part of it. I did. We put a lot of things on the table, young black pen are treated badly, the criminal Justice System is not fair to them, et cetera, et cetera, i think we all agree with that. Im talking about as we look at this cop, and his testimony last night, George Stephanopoulis at one point said did it have to do with the color of his skin . Im 6 4, i weigh too much, im a big guy. If i come at a cop, if i go to
the car, if we believe the grand jury report, do we believe the cop would act differently towards me tan Michael Brown . Ill ask you this question, how many times have we done stories on white men who have been shot and killed by cops . I mean, we have seen im sure white pen have been killed by cops, but there is not the racial component. Follow me here, heres one of the issue s the we begin to talk about just the grand jury. You understand, though, when i say, roland, like white cop kills 6 4 white guy. Thats not the story that this is. Because there is the racial component in ferguson, which, of course, thats a horrible racial provide down there. I understand. Also i take into account the fact that Darren Wilson was at a Previous Police department that was disbanded because of various problems. Heres the other issue that jumps 0u9, Darren Wilson is offering testimony it was a given or put together six weeks
afterwards. He never did an Actual Police report right after the firsthand. So part of the problem here is that Darren Wilson had an opportunity to literally six weeks later say, well, this is what happened as opposed to right after. So part of the problem here is also how Ferguson Police investigated this particular case. Now, am i am alegend that he changed his story . Im not saying, what im saying is, we would have a different view if we got his view of what happened immediately afterwards. Right. We didnt get that. And ro roland, let me say to back that up, im not saying that he lied in front of the grand jury testimony. But you can be coached. You can be prepared. The one thing that did jump to my mind as i was reading this testimony was he kept talking about the hand on the waist band. Right. He kept repeating that, which, of course, is justification. I didnt know if he was going for a gun or not. There were eyewitnesses that said, including a little girl, that said he was charging at him like a football player. Heres the other issue. He had basketball shorts. Thats an elastic waist band. One of the witnesses said you cant, a gun can not just sit in those kind of shorts, if that kind of big guy is running, that gun will slide, supposedly he had a gun. If he is doing a full charge at you. Only for people at home who are saying why are they talking about the waist band . He kept talking about the waist band. He kept coming up, its kind of like when my kids Say Something way too much. You are giving yourself away. Heres the best one, he is punching me, he stops, he takes a cigar and tells his friends, hold these, you go at the punching. So, okay, if im punching a dude, im not going to stop and say, say, bro, hold my cigars for a second and let me go back
to punching. Again, lisa bloom did a great job of literally going through and breaking down a lot of discrepancys and how mccullough did not push back on a lot of his testimony and took it at face value. I think those of us who sit in studios on tv are trying to read a mans heart. We dont know. What we do know is what the evidence says, we dont know if hes racist, made a decision based on race. What we can ask, though, is based on the evidence, why did officer wilson do certain things . I think its fair to ask him if he had to shoot 12 times to take this man down, did he have to kill him, with the threat so great, you had to unload 12 bullets into this guy . I guess what we know from the testimony, from everybodys testimony is that there was the altercation in the street. He charged the car. There was a fight inside the car and then he ran away and he
turned back around and started chargeing at him again . Right. The question is, when he was charging at him, did he have to shoot him . Right. I guess thats what constitutes a charge, he was 100 feet away. He wasnt in his face. A couple things. The first thing is obviously there are a lot of aspects of this that are not handled well. The officer was allowed to back to his barracks, before anybody tests, takes his own gun, puts it in a pastic. They didnt have the regular prosecutor. By the way, that wouldnt happen in new york, isnt there a fatal shooting, a cop shoots somebody, everything stops, the investigators come in . Oh, yeah. The cop is not going back to the barracks . They did go to the hospital and measure his wounds. So you have real questions around how it was handled. You had cops conflicting reports. A preupon drans report in a
direction of events we have been talking about. I do honestly think if what is said is true that this cop was sitting in hills car being punched and wrestled for his gun, this huge guy runs away, turns back at you, im not sure any of us would behave completely rationally, was it elastic . Was it not elastic . How many shots should i fire . Should i aim at his knees . I will say also, should a 6 4 guy leak me is running, charging at ap co, thats a little bit different than you charging at a cop. You know . So again, were trying to get, like we said, into his head. You asked the question and George Stephanopoulis asked the question would there be any difference . This to me is key. Its very hard for us sitting here to say categoryically there would have been no difference. Thats correct. Also, maybe e members of the
black community are almost entirely saying they believe there would have been a difference. Thats almost as important. Its very important. You look at all the stats, blacks and whites get picked up for a traffic crime as often as each other, three times more often blacks will be cuffed and arrested in those circumstances than whites are. Right. They are coming at this with a history of mistrust and the thinking and the evidence is there to support them that they are unfairly targeted. So its hard for them to look at this report and say, and to believe officer wilson when he says, if Michael Browned a been white, i would have acted exactly the same way. Let me get one more story in here, for this block the Weekly Standard is drawing attention to the way president obama acted on immigration. The article notes, however, over the past few days, the white house says the president s action falls within the current law. Here is how the president addressed it yesterday while speaking in chicago. You are absolutely right that there have been significant numbers of deportations. Thats true. But what youre not paying attention to is the fact that i just took an action to change the law. Okay. So, we have weekly stand up. You can just put obama colon. This doesnt have to do with the Weekly Standard. This is barak obama the president of the United States, i see you smirking. What am i going to say . This is the moment, this is the moment in perry mason, you will remember this. I do. Where perry mason, well, madam. I killed him, i killed him, whatever, this is a moment in perry mason the defendant admits, i stole the jewelry, when the president says, i took action to change the law and seen unconstitutional. Its pretty jaring. I mean, we knew, i knew at least
he did that. I have been saying that. This wasnt about bush and reagan doing executive order based on an 86 law that Congress Passed. This is a guy who has been saying i did this because congress wouldnt act. Now hes admitted, i created a law. He proved snl right, doing all this Fact Checking on whether or not that snl skit was right or wrong . He did the executive action. I wish i could think of a snappy witty response. I dont have it at the moment. You want me to take it from bad to worse . Thats pretty bad. I want to hear from the whole panel. If it said id changed the practice of deportation, which is what he should have said. Oh my god. Ive ended the policy to change. The same thing he is saying, he just said it differently. He didnt Say Something all of us didnt know. He just said it. Water that, roland . Is this that big of a deal . Yes, it is, constitutionally, it is. Constitutionally, he can also sign an executive order. The bottom line is congress can still act harry truman also signed an executive order to desegregate the armed forces, people upset, guess what, if you dont leak it, can you go in and change the law, im not tripping on it. Pass a law, pass a bill. The Supreme Court, i dont think tail trip on it, they may say its unconstitutional. Get over him, get over it. You dont like it, pass a bill, get over it. Just pass a bill. Pass a bill. There is so clearly about the president. Lets be clear here, this is about the constitution of the United States. This is about the separation of power. This isnt about james madison, this isnt about whats happened in the past, what will happen in the future. Yes, it is. Its about an imperial presidency, president obama said himself, if the Supreme Court takes all of what the president has said and then about it being unconstitutional and adds this on top of it. Im saying practically, maybe its a big deal, maybe its not. The Supreme Court has to act. They have to rule this unconstitutional. Oh, god. Wait, wait, what makes you tired all about the constitution . You should be tired with the president with the president that is so willfully lets go to the next story. You should be tired of president obama saying its unconstitutional, then im going to do it, tan saying, i dont need corporation i will just write my own law. Well, at this point im happy for the small section of humanity that might actually get some peace out of this, if congress doesnt act. Pass a bill. Just pass a bill. Look, joes point. I get his point. No, you dont. I get so its a big point. Well get to that in a second. Okay. Joes point, it should be litigated to the United StatesSupreme Court to find out whether this is legal or not. I happen to think it is legal. I dont think what he said in chicago is like admissible efdz in the courtroom. We will find out in the fullness of time whether what he did is legal or not. Then well know. Hes had a team looking at whether its legal or not the whole time through this process. Where were they in 2011, 2012, 2013, when the constitutional law professors said it was unconstitutional if he did this. We have a Supreme Court. Its sort of why theyre there. The president came too recess appointments. So he takes some action. The court ruled. They say what, constitutional. They say a former care act. Constitutional. Okay, so he took the action. Thats why theyre there, earn
your paycheck. Rule on it. So what, well see what the court says, then as ike said on this show, the republicans have to pass a bill. So we can go through watching the courts do this or have the republicans pass a bill and avoid everything. If the Supreme Court is just some hobby that we picked up, a constitutional republic. The emotions of this before the Republican Party just pushing everything to try to bring everything down the president is trying to do, im not going on some sort of tear, depending on the president. They have an opportunity to get something done. They have an opportunity to get something done, to function. Thats in this coffee mug. This is legislation. Thats great, pass a bill. They have this coffee mug, this is unconstitutional. This is a Supreme Court stop, this is congress job. I get it. Can i remind you, Congress Passed the feingold, even when
the Congress Passes law the Supreme Court still rules on it. Its a cause, because the Supreme Court rules on what congress does, whether its constitutional or not. No. And they rule on what the president does whether its constitutional or not. Yes. So if you take action he is acting like there is a job. We are not arguing this. You are. We go to chicago and somebody says i changed the law, necessarily means this is more than semantics, it could mean he made a mistake, he could have said, change the pennsylvania we have to leave it to lawyers as to whether he misspoke.
