Reporter it looks that way, at least the one announced with this kind of fanfare. Nbc news has obtained a letter from the chairman of that House Oversight committee, elijah cummings, to the white house, announcing he is opening an investigation into the White House Security clearance process, over what he calls grave breaches of National Security involving people that he says had access to classified information who shouldnt have. This is an interesting case, craig, because even the republicans on the committee, when they controlled it, acknowledged that there were some problems with the security clearance process, and started their own inquiry last year. They appeared to get nowhere. The white house rebuffed their requests for documents. Now, of course, chairman cummings and the democrats have said theyll issue a subpoena if the white house does not grant this request for documents. Right now, it is a chairmans letter, asking nicely by firmly for the documents. It is a wideranging request and promises to put a spotlight on the president s soninlaw, jared kushner. If youll recall, there were issues with his security clearance. At one point, it was downgraded because he hadnt fully filled out his Financial Disclosure forms. Then there were reports he had his clearance restored. Months later, the Washington Post reported he didnt have a full, top secret sci clearance to review the sensitive documents in the government. There were also issues around rob porter, the former staff secretary accused by former partners of domestic violence. Besides that, he got clearance to see the most sensitive documents in the white house. Even john kelly, when chief of staff, acknowledged there were problems with the security clearance process. Now, House Democrats want to air all the dirty laundry. They want the documents, and theyre prepared to issue a subpoena to get them, craig. Breaking news off the top. Ken, thank you. Susan page. I think they should be worried about this investigation and all the others to follow. This is not going to be the last time, and it is not going to be the only committee in the house that will be pursuing the white house on a variety offish shoo y of issues, some involving the president , some the russia probe, some just agencies taking action for the last two years with little congressional overnight. That is about to end. Susan, let me read an investigation into White House Security clearances by nbc news. This is from roughly a year ago. More than 130 political appointees working in the executive office of the president did not have permanent security clearances as of november 2017, including the president s daughter, soninlaw, and his top legal counsel, according to internal white house documents that were obtained by nbc news. How far reaching do we surmise this investigation could be . Oh, it is going to be very far reaching. One of the things that came to mind right away is when that investigation of the some of the folks working in bedminster, trumps golf club in new jersey, there was Illegal Immigrants who were here illegally, and they got secret service pins. How did they get through secret service . How did they get their clearance, and they werent even in the country legally . I think theyre going to have a lot of explaining to do on how what their process and their procedures are. David, a number of freshman, highprofile democrats on this committee, most notably, perhaps, cortez. What does this investigation mean for their agenda specifically . Well, i think it is an important platform for freshman lawmakers to get their voice out, to start to establish how theyre going to act on the national stage. What i think is interesting about this investigation in particular is it does show some restraint. You could start with something very political, you know, as a democrat. There are about 40,000 things id love to know the answers to, but theyre starting with something that is National Security related. I think it is pretty likely that the white house was not super organized here. Maybe not super lawabiding. Theyre starting with the lowhanging fruit. Isnt this typically how all of these investigations start . They start with something fairly narrow, then all of a sudden, after a few months, it is revealed that, oh, well, this oh, and this, oh, and this. Six months from now, you know where we are. I worked in the Obama White House with the investigation with benghazi. No, thats not how they all work. Its how some of them go. Remember, there was an investigation to a real estate deal, and somehow, it blew up. Thats right. Another big story were following on this wednesday, shutdown day 33. President trumps advice to republicans, pray. Pummelled by awful new polling, convinced hell win, the president pushing prayer and a new slogan to win money for his wall. In two tweets this morning, he summoned his inner don draper with a jingle. Heres a jingle. Build a wall, crime will fall. Even the president admits, however, the slogan may need help from the almighty. Quote, this is the new theme for two years, until the wall is finished, under construction now. Of the Republican Party, use it and pray. His theme coming ahead of two senate votes tomorrow. Two big votes, two competing visions to open the government. The biggest dividing line, billions for the president s border wall. Both also may need prayer if either is to succeed. Susan, ill come back to you. 33 days in, going to be a second missed paycheck for a few hundred thousand workers. Where is the urgency in either chamber of congress . Yeah, where is the urgency . The fact is, were in a stage where the fact that the senate is going to have votes on two measures that are almost certain to fail is seen as at least a tiny step forward. At least theyre bringing something up. At least Mitch Mcconnell, the Senate Republican leader, seems to be engaged, after what was a long slumber during this shutdown. Perhaps this will demonstrate to both sides, and especially to President Trump, that the votes are not there for the path that hes chosen. Even prayer isnt going to get him over the finish line. Senate Majority Leader Mitch Mcconnell once pledged hed not hold votes that werent passable. What happened to that pledge . Why hold a vote if you know the measure is doomed from the beginning . Because theres pressure coming from his from other republicans, especially those up for reelection in 2020. This is a good step. It is a signal that at least theres a conversation thats going to be had. It is the only offramp for the president , to have this settled between Mitch Mcconnell and nancy pelosi. At this point, im just hoping that leader mcconnell just has a little sliver left in him of what it is to be a public servant, not just be a political pawn for the president. David, i want to play something that trumps top economic adviser said today. Before i do that, are you at all surprised that, so far at least, your party appears to be totally unified, in terms of its messaging . So far, at least, publicly, i have not seen a single democrat weaver on whether they should engage in any sort of negotiation before the government is reopened. Well, you know, theres the open quote, i belong to no organized political party. I am a democrat. In that sense, im always surprised when we manage to hold it together and stay organized. I think in this case, we understand, that if you cave to this kind of hostage taking, the only thing youll get is more hostage taking. You dont reward bad behavior. Exactly. Heres the president s top economic adviser. I believe this is larry kudlow. Extended for the whole quarter, and given the fact that the First Quarter tends to be low because of residual seasonali seasonality, you could end up close to zero. The Second Quarter number would be humongous, if the government reopened. Not larry kudlow. It was kevin. Could the shutdown go on that long . I wish i knew. This thing seems to be going on for a long time. The strangest thing of all is that it would be so easy to end this shutdown. All that needs to happen is for President Trump to decide, lets reopen the government, or Mitch Mcconnell to decide, lets make reopening the government a priority. So this is a temper tantrum that has taken on historic proportions. Here we are. Susan, is there a way for the president to save face and still reopen the government . Yes. You can declare a state of emergency along the border, then agree to reopen the government. Thatd be one thing. He can also take a deal that is not the nature of a compromise is both sides do things they dont want to do, that they didnt want to do at the beginning. He can accept some deal that extended daca protections permanently and got him money for a wall. That was a deal democrats were willing to make last year and declare victory. Yes, i think there are ways that he could save face and get out of this. So far, he hasnt signalled any willingness to do either of those things. Susan, new polling out, and it is consistent with more recent polling weve seen. It is terrible for the president. 72 of folks asked tell cbs the border wall is not worth the shutdown. Worse for trump, theyre giving Speaker Pelosi higher marks on handling the shutdown negotiations. 47 for pelosi. 35 for trump. The president doesnt seem to be overly concerned with polling. How concerned should your party be . Well, the president is always concerned about polling. He tends to talk about it only when it is in his favor. The Republican Party should be very concerned about it. These are horrible numbers. Whats reflected in this polling is, people care about other people. They relate to the fact that they themselves cannot go more than one or two paychecks without hitting a crisis in their financial life. So it is now sacrificing families for a wall that, even the president s supporters say, compared to letting your family be destroyed and kicked out on the street because you cant pay the rent, theres no question which is more important. Lets get people back to work. David, let me read something about President Trumps embattled state of the union speech. This is something he told peter baker of the New York Times. I think there is a number of really serious, major challenges facing the United States right now. Almost none of us think that one of those big challenges is the lack of a wall on the border. The president clearly does. Steven miller clearly does. Most americans dont. One of the most important things you can do as a president is focus on the right thing at the right time. A statement contradicting trumps public position. Is this the Tipping Point . I dont think it is a Tipping Point for rudy. Its elevated, again, the concerns that have been there for a while. Rudys first interviews he gave with sean hannity back last spring also raised alarms that he was up to the task of dealing with what was really a highprofile, very fastmoving investigation. It puts the president s legal liability front and center, his president ial term, as well. Rudy managed to stay afloat. He isnt really involved in the legal back and forth details. Hes more of President Trumps tv lawyer. Hes the one arguing and being sort of serving as the spokesman. It is a position that the white house itself cant really take legally. They need to defer questions to outside lawyers. Theyve gone with Rudy Giuliani. All the mistakes hes made, ethii think the president still sees him as reflecting his view. How can the president still see him as someone who is remotely effective, if he continues to say things on television that are either flat out wrong, that he has to go back and, literally a few hours later, its not what i meant. What i meant was. He does it almost weekly. How could the president still think he is remotely effective at even being a tv surrogate . I think youre putting your finger straight on it. Rudy has, throughout this process, caused problem, and a lot of people outside of President Trump have been urging him, you might want to look for someone else. Remember, we went through this process last may, looking for someone. Nearly hired joe who was on fox news, arguing on behalf of the president , just not in a formal capacity. Rudy has been doing this job without taking a paycheck. Wait a minute, he doesnt get paid for it . No. Hes been doing this pro bono from the start, according to rudy. Wow. What would be his motivation . Whats in this for Rudy Giuliani, other than appearing on cable news regularly . I think thats partly it. Rudy hasnt been in the headlines, in the spotlight going back to his 2008 president ial campaign. I think he was seen as someone who was left out. He didnt want one of the jobs he was offered in the trump cabinet. This makes him more relevant. I think he loves the headlines. He loves engaging with reporters on a regular basis. The mistakes that are made, i think he sees them as just part of the, you know, noise and the chaos that surrounds this. Also, it also helps to trickle out the bad news. Maybe there is a method in the madness, in terms of what giuliani has been doing, leaking out or dropping small pieces he knows are going to come ultim e ultimately, to lessen the damage when, ultimately, we see a final whatever the report is that comes out from robert mueller. You think the president eventually fires him . Its hard to say. Can he fire someone youre not paying . What . Can you fire someone youre not paying . Can you fire a volunteer . Find a new spokesman and say, youre no longer going on tv, representing the president. Itd be hard for rudy to stop talking to reporters, even when it is said and done. Trump cycled through a lot of lawyers. Ty cobb, mark dowd, all in positions like this before. It is unusual to be having these conversations with Rudy Giuliani not lasting longer. One of the questions is whether this investigation is going to be around for much longer. If it is just through march, which some people suggest, then i think maybe rudy is sticking around. We just saw Something Big with the Michael Flynn case, where maybe were not going to have a trial in a case involving his partner. That could push the case into the fall, which suggests Robert Muellers investigation is going to be around longer. Maybe President Trump might need to look for somebody different in the time. Images in this case of a kentucky teenager wearing a make America Great again hat and a native american elder beating a drum. Driving people to the familiar and, at times, the convenient. We are seeing resounding backlash to this video of Nathan Philips and Nick Sandmann standing with their faces inches from each other, as crowds surround them shouting. Reviewing all the video we have of this incident, we see the moment does not start here. Sandmann and his dozens of classmates had finished attending an antiabortion rally, when they converged with five hebrew israelites, a movement growing more militant. Both that group and the group of students have accused the other of hurling insults. What is unclear in the video is who actually started the confrontation. Today show colleague, Savannah Guthrie, sat down with Nick Sandmann, the student, to talk about the video, the moment, and the backlash. Do you feel from this experience that you owe anybody an apology . Do you see your own fault in any way . As far as standing there, i had every right to do so. I dont my position is that i was not disrespectful to mr. Philips. I respect him. Id like to talk to him. I mean, in hindsight, i wish we could have walked away and avoided the whole thing. But i cant say im sorry for listening to him and standing there. Do you think it was a good idea to start chanting back at the protesters . In hindsight, i wish we had just found another spot to wait for our buses, but at the time, being positive seemed better than letting them slander us with all of these things. So i wish we could have walked away. What some people see as a young kid with a smirk on his face. Mmhmm. What would you say for people who see that and are making a judgment about who you are . Well, people judge me based off one expression, which i wasnt smirking. People have assumed thats what i had. Theyve gone from there to titling me and tablabeling me a racist person, one who is disrespectful to adults. Theyve had to assume so many things to get there without consulting anyone who can give them the opposite story. We should note, we reached out to the other man in the video, Nathan Philips, to comment on sandmanns statement, that he has nothing to apologize for. He did not provide comment. He has told us in previous interviews that he walked between the students to intervene, but soon felt threatened when the students surrounded him. Professor, thank you for your time. After savannahs interview aired, there was backlash to even hearing that young mans take on what happened. Are we at a point in our society where we cant even hear out a possible explanation of things . Well, i think were always going to face people who have their assumptions affirmed by video footage and the like. Folks who are in their isolated silos, craig. I think more than anything, underneath some of the backlash against hearing the young man is this question, who are allowed the innocence of childhood, right . You saw the image. Then there was this attempt to kind of give a fuller account of the young man. I think a lot of folks were asking the question, when why do we always do this in these sorts of cases, when white boys are involved, and what do we do, how do we react when brown and black kids are involved . People saw the difference. I think that was underneath it all, if that makes sense to you. It does. It makes a lot of sense to me. One of the things that the young man did not say in the interview, two simple words, im sorry. Had he uttered those words, would that have changed any of this . It would have reflected a little selfawareness on the part of the young man. I mean, when you look at that entire video, craig, no matter where it starts, how it starts, what you see are a lot of young men acting out. You can say it is boys being boys. It is the kind of culture that many of us know intimately, that produces all sorts of things, that sometimes go awry, right . If he would have said im sorry, it would have reflected a kind of selfawareness about the circumstances and the situations, and a respect for Nathan Philips. What we saw instead was the hiring of a pr firm. What we saw instead was this becoming a part, a chess piece in the ongoing culture wars. What we saw is this incident, and the reactions to it, becoming part of a reaction by the right to what they perceive as, you know, the tyranny of political correctness. This entered into the toxic culture of race in this country. So the young man has no room in interesting sorts of ways to grow. In some ways, by accepting some level of responsibility for what happened. I want to talk about a specific detail of the video thats gotten a lot of intention. The hat that hes wearing. This make America Great again hat, theyve become quite popular, the red hats. Sandm sandmann told savannah he bought the hat that day from a vendor in d. C. That hat has become symbolic of a lot of things in this country. To some, it is nearly a hat that dons a political slogan that the president popularized. For others, it is an invitation for confrontation. Some referred to the hat as a modern day version of the confederate battle flag. Do we think that the same reaction would have been had on both sides if he werent wearing that hat . Probably not. There was a sense in which the hat announced a certain set of political commitments. Alisa described the hat as a modern day white sheet. I think thats how she described it. Make America Great again is a nostalgic longing for the 19d 5 1950s, the ethos, a society organize ad along the lines of segregation, where browns were to stay in their place, and white people were to be treated differently according to the color of their skin. Yes, i think if the hats werent involved, it might not have been as intense. But there were also words. There were a lot of people who said that, you know, build the wall, build the wall, said that was shouted. We saw footage later on of the young men cat calling at young women walking by. Theres so much there that we need to unpack. I also think this, craig, quickly, i want to emphasize a point i made earlier. Who are who do we allow to be innocent . Tamir rice was 12, and the cops thought he was 20. We have study after study showing that young black girls arent seen as innocent. You know, then we just had recently, in miami, mike bartlett, in a backs up, guns down protest by black men and women, trying to protect their neighborhoods, don a gun at children. At children. There was no outrage in interesting sorts of ways. He was arrested, but there is no outrage. Underneath this is this sense of hypocrisy. Underneath this is a double standard. Underneath this is that we give privilege to these white kids. He can sit down with Savannah Guthrie and redeem himself, but then there are all these other folk who we just presume, you know, who arent so innocent. Eddie, well leave it there. The impact of the shutdown reaching far beyond the federal work force, many who rely on the government for services and, in some cases, for their very freedom are being affected, as well. President trump scored one of the biggest bipartisan wins of his presidency when he signed something called the first step act. It is a criminal Justice Reform bill. He signed it last month, but the conversation about that bipartisan success did not last long. The Government Shutdown would start just hours later. The New York Times reports the shutdown could delay the implementation of those reforms championed by the trump administration. That includes the Early Release for some lowrisk inmates. Edward douglas was one of the first inmates released under the new law. The Government Shutdown did not delay his release. He joins me now from chicago. Edward, first of all, how are you doing . How is the adjustment been since you got out . Well, im doing fine. Im still adjusting. You know, its still a process, but you know, its something that has to happen. Whats been the biggest hurdle to the adjustment . Whats been the hardest part to adjust . Well, just adjusting, just the years you had away from your family and, you know, the city changed, catching the bus. You know, have to go through the lines, long lines to get your ids. You know, thats adjustments. You were serving, as i understand it, a life sentence for selling small amounts of crack cocaine. Yes. What did the program that gave you an Early Release, what did that mean to you . It means a lot, you know. Its just showing that they going in the right direction, you know, to help others, you know, like myself, too. It means a lot because i never thought that i would serve the life sentence, you know. Ive been in 15 years, 11 months, 10 days. What was it like when you walked into your home with your family waiting there . Oh, man. I was just blown away. You know, just seeing my daughters. When i left, my oldest, she was a teenager. The youngest was 8. Now, theyre grown women, married, got kids. You know, seeing my grandkids. I was just blown away. Seeing my mother, you know, just the struggle that she had coming to see me. The whole 15 years. You know, now, she dont have to make those trips no more. A lot of families like yours are having a hard time getting answers about a possible release because of this Government Shutdown. The New York Times reporting that they cant get anybody on the phone to answer their questions. What was the process like to get your release . Well, actually, it started, we was locked down that particular day. 110, we were locked down. My counselor came to my door, and i was laying in the bed reading a book. He opened the door, so i jumped up like, you know, whats going on . He told me the judge wanted to talk to me. It still hadnt registered, you know. I was just, okay, the judge wants to talk to me. So he came back 15 minutes later, and he said, your lawyer wants to talk with you. When you come out, come to my room and you can use the phone. After i came out, went to his office, called my lawyer, she just told me that im a have a Conference Call at 11 30 with the judge. He gonna sign off on my immediate release. You know, they want this to be an officer here. Once she told me that, i just dropped the phone and just started crying. They was crying with me. So this program that seems to be threatened because of the shutdown that led to your release. Right. Do you think that there should be more folks like you, who are allowed to leave prison early . Definitely. Its a lot of them who have been in there 25, 30 years, that still in there waiting for, you know, their turn. You know, i came in way after them, and they cases are just similar, you know. Were not going to go into their cases but, you know, they deserve it, too.
