>> commissioners good evening you'll say in your binder my reports it's pretty thin right now. as you know, the data breakers was last weekend we got a fair amount of complaints so far as abandons and so forth. and there's a lot of house parties which people with compliant when asked to turn down music. we had one fatality at data breakers one person drunk fell off a roof and unfortunately did not survive the fall. this is to my knowledge this is the first time we had a data breakers that is unfortunate. but overall the event was pretty much as it was in the past one sad note. and you see a few items here we had - let's see where - we had an officer assaulted on broadway with someone resisting and a few issues at the parlor. we have the officer here who will talk about it but overall the report for the last two weeks it's been quiet. for the data breakers a lot of people weren't out. saturday night is pretty quiet and that continued. i'm short and to the point any questions >> please tell me if i should wait for the officer to ask questions on the parlor. there were two assaults in our park? >> correct. >> and then atmosphere and then 434 broadway what's 434? >> that's where the incident happened not related to any venue. >> with that we have a memorial day long weekend coming up any events we need to, about? >> there's a carnival that's big but as this commission knows carnival is planned most and most in advance. this year will be slightly different it be at the last minute the community came together so the event will happen. so the carnival the footprint is bigger or smaller? the stages are smaller. there's been a smaller stage so the sound will be used at the carnival will be less. the feept itself is bigger not by much though to bring in more food and vendors and so on >> 630 jackson. >> yes. >> can you give me a discrepancy is that the one by montgomery? >> yes. >> those people are spill out on the sidewalk? >> yes, if the commissioner he might be able to go into more detail. and we've had problems in the past and they clean up and we get problems and they clean up. but prominently we've got credit card fraud and also good neighbor policy sound and crowd control. it's not we have violation more sound issues >> do they have a doorman? >> they do. >> anyone else? okay. is there public comment on the director's report? >> commissioner maybe a little bit of help on the cb d on broadway. i believe that's going to be heard at 10:00 a.m. this it thursday >> thank you any other public comment on the executive report? > >>. seeing none. ms. came in and or somebody? >> commissioners we brought this - thank you - two weeks ago and this gentleman had an incident he couldn't attend. this is a venue that's had a problem we've tried to a work for sometime. there should be a timeline in your binder for a sound test it was probably related to their petition in may 2011 and now it's may 2013 and in between there's been, you know, kwiefl efforts by staff and the venue to fix the sound problem. we felt we have not been successful at our level so we bring it to you you're the policy committee that oversees what staff does. it's time for you to give us direction. i know that the venue is here and they can speak for themselves on what they've done. i hope the neighbors are here to talk about their experience over the two years ago. i know they came before you for a permit. i'll let - if you have questions initially or we can continue >> i want to ask a couple of questions on the sound system between 8:30 p.m. and 10:00 p.m. you have varies locations listed. i want to be sure i understand. the first one on the sidewalk. the d b you took four redirect examination. i want to know and then so the next one is the venue front door it then goes up to 73 and 72 and then the venue main room between that and 94 and then the upstairs office stop me when i'm wrong and is roof is 59 and 23 wood ward is anywhere from 41 to 48 and then wood ward it's 46 to 49 is that all correct it's done the same day? >> so where is wood ward street. >> it's the alleyway directly behind there's a venue and a restaurants on the corner and a gas station on that block and a scooter and there's some commercial use and in some residential areas. i believe there's one side entrance but it's about 85, 90 percent residence >> so the original sound test the noise level was between 49 and 71 in the daylight. what would you say the sound is between 8:30 and 10:00 p.m. >> your referring to the original sound - >> i understand. >> it's between the traffic so far as the street traffic that's why you have such a brood range of ambient there. their ambiance between those times where the one street is quiet and then it picks up because of traffic noise >> so in keeping with the code because i'm trying to be clear. if we say the ambient is 4 in the afternoon the sound ambient was as low as 36 >> it's internal. >> that's you inside? >> that's correct. >> thank you very much for that clarification. r of these inside expect the roof and sidewalk they're all inside? >> that's correct. >> anybody else have any questions? is the permit holder here >> i believe so. >> come down on. >> i - my company manages the brick and mortar. >> okay. you want to talk a little bit about your sound issues? >> our sound issues -- the brick and motor had been there and there was no record we're in the permit process and we basketball it when we were given the permit. several months later after we were, you know, started operating the shows it was almost 6 months later some people had some noise complaints. we went to a company that we do a lot of sound work a large company in san francisco. we asked him for their remedies. they had two sound folks couldn't and they referred us to the west coast sound company. we've done about 4 rounds of proving and unlike a plumbing problem like a water leak acoustic engineering is not quite that straightforward. we conducted our own tests and worked closely with the avoid technologies that do so the sound equipment we had two of their engineers. it seems like everything speed up in march and april as we went through this so-called we had a waiver of the citations. we've gone back and cancelled shows for 5 days and brought in construction crews and started the processed again. one of the main sources of the sound proof material the component or consultant breaks down the sound element. so we'd have to wait for more shipments to wait for the construction to restart. every time someone asked us to do something we responder and we've not hide. my partner and a have been in business for many years we bought the business next door, we met with the neighbors. by our count there's 5 hundred folks that live within the area. i've walked through and tried to get folks inform you understand. some neighbors have let us conduct our own tests. if itself it low frequency brob or high. i'm not an expert. but allowing that allows us to address what exactly is the issue in terms of the sound where it's coming from. we were told by one company to seal up a wall and we ended up fixing that. this is not going to happen overnight. we just had another - we did have another meeting with our neighbors last night to review the work. we've had several folks write letters saying yes. you've solid the problem. the restaurants that shares the wall with us on the right has no problem with sound noise. and the immediate business behind don't have a sound problem that anywhere. we have a problem there's a space between our believe and another group of permit buildings that are behind us. basically, there's a space that separates us. i do realize there's 3 neighbors there that are having sound issues. we had a meeting that was cancelled and another one we were reviewed to do test readings. we're doing what we need to do. ? an area of san francisco we believe in. we've brought many of our neighbors have mentioned how street crime has stopped and graffiti and trash issues. we've been there to help the neighborhood clean up >> how many individual complaints have we he received? >> i don't have a count but every weekend both of us are cop complaints of a variety of neighbors about hearing specifically telling us what their hearing and what time their hearing it. >> let me just tell you that that place was other clubs however, the other clubs don't play the sound like of music you're playing. so heavy metal has a different sound. so far as them being sound engineers although west coast sounds is. that was a good company. you've done 4 sound like levels and put space b
