where does this listened? unfortuntely it end else at the taxpayers wallet. $16 for a muffin. eight for a cup of coffee. great prices if you own the joint but in this case it's your tax dollars at wait. also tonight, toppers tracking a warm up, but it may be too wet to notice. plus, when this near riot broke out after a duke-maryland game, some cops were caught on tape beating the crowd. now, indictments are in. and tonight two prince georges county police officers have been charged with assault for beating up a student. >> the incident last march after students took to the streets celebrating the university of maryland's basketball win over the hated blue devils of duke. this piece of video went viral and it shows the cops kicking and hitting students and add to the outrage, mckenna was later charged with assaulting the police but after this video surfaced those charges were dropped. gary nurenberg is at the scene of the beating with reaction from students to the charges. gary? >> reporter: well derek, the police chief at the time said he was outraged when he saw that tape of the beating along this wall. today a grand jury decided it was criminal. the video is just a chapter in that nights story. some kids seemed so out of control. the police chief at the time called it a "large unruly and destructive mob." >> a lot of the cops just did a lot of things. >> patty sullivan was in the middle of it that night. police made an impression. >> it was ridiculous because i knew people like girls that were like that had like gas in their eye just because they were just targeting everybody, and i guess it's good they were actually held accountable for it even though it was a year later. >> but would the indictments have happened without something other than student allegations? >> i think it's just lucky that they actually had the video to show what really happened so there's actually accountability. i think it just kind of scares me to think like what could have happened if there was no video. >> kids, police, cross purposes. >> a lot of times when there's a large crowd that's unruly both students and police officers at the same time are at odds with what they want to have happen and police officers are just trying to keep the peace and make sure nothing bad happens where students are just trying to have as much fun as possible. >> there is skepticism about police, the indictments welcomed. >> i think it's a good thing because cops aren't usually held accountable for their actions and i don't think it's right when cops take their authority and abuse it, so i am glad they're being indicted. >> now that the cops have been charged i think it's the right thing that happened. >> reaction to the indictment? some just looked at the tapes. >> i think it would be very well called for because no matter what anyone does, you shouldn't get beaten up for something like that. >> officers reginald baker and james hard it son have been and remain on administrative leave, paid, still getting checks from prince georges county taxpayers. the indictments are just the first. the states attorney says her investigation continues and the fbi is investigating civil rights violations. that, derek and anita, could result in federal charges. >> well, thank you, gary. new at 11, in less than two months time another man jumped the white house fence. the secret service says the man climbed over the fence near the western entrance gate and ran towards the white house. he had his arms wide open as he ran directly toward officers ordering him directly down to the ground. the man had a back pan on but it was harmless. imagine after you get to the metro after a hard day on the job you only find pieces of shattered glass and your property gone. >> now imagine the people who did this are about to attack you. that is what one man faced last night at a station seemingly plagued with crime. only on 9, the victim spoke to ken molestina who joins us live from the metro stop. >> reporter: it happened here at the largo town center parking garage. the victim says it was bad enough he was burglarized but then moments later he said he found himself running away from what he believed was an attempted attack. >> i approached my car and i realized it had been vandalized. >> christopher knock found his car window smashed when he got to his car monday night, his electronics were gone, stereo system ripped out of the dashboard. >> that when was the car behind me actually started up an started coming in my direction. >> the young man believed whoever was inside that car was responsible for breaking into his blank mustang and was coming after him next. >> i think when they saw me they thought there was another opportunity to maybe get more stuff. >> he tells 9 news, no one, not even metro transit police were around to stop what was happening. that's when he panicked. >> so i just decided to run and i ran into the elevator and, you know, lost the people who were pursuing me. >> this isn't the first time thieves terrorized metro riders. you might recall it was in may of this year that a daughter and father also fell victims during a violent carjacking and in that case the daughter was shot but survived. the father was badly beaten before the thugs made off with their car. knock is now hoping both police and riders realize there is a need for added security at this metro station. >> everybody said be vigilant to protect themselves and others especially at night in the metro and as a community we need to come together and just let people know that it really isn't acceptable. >> now the victim says eventually he was able to dial 911 and he says about a dozen police officers came out here today. want to let you know 9 news earlier today did check in with both metro transit police and pg county police. both agencies told us they had no record of this happening and there for, couldn't give us anymore details. live in largo, 9 news now. well the results are coming in in prince georges county. voters in district 6 headed off to the to choose the candidates who will fill leslie johnson's old county council seat and with 73% of the precincts reporting democrat derek leon davis is in the lead with 55% of the votes and arthur turner is in second place with about 19%. now whoever wins will be facing off with republican day gardner in the october 18th general election. gardner ran unopposed. johnson stepped down back in july after admitting she destroyed evidence in the federal probe of her husband on corruption charges. her sentencing is scheduled for october 13th. tonight muffins and coffee have joined $600 toilet seats in the federal governments hall of shame. as matt jablow tells us, incredible expenses of your money at waste. >> reporter: a cup of coffee and a muffin in northwest washington will cost you $4.50. >> cup of coffee is $2 and muffin is 2.50. >> pretty reasonable by most peoples standards, unbelievably reasonable by the standards of those who plan conferences for the department of justice. in a report released today, the d. o. j.'s inspector generals office said the justice september vastly overpaid for food and beverages at 10 conferences between 2007 & 2009. two of the best examples of overspending? >> critics of the justice department, frankly even the justice department will say there's not enough over sight but back in 2007 nothing really changed. >> thank you, sir. >> justice department, thank you too. we appreciate it. folks this just in. 9 news now learned of an ongoing investigation into alleged fraud and other irregularitieses at the districts unemployment office. an investigation lead by the cities inspector general. one manager was terminated today. the director of the department of employment services lisa mallory confirmed by phone to our bruce johnson tonight she has terminated gaby frazer from her position as a supervisor in the unemployment claims office. frazer was making $90,000 a year and she is a resident of southeast d.c. and a long time activist among ward 8 democrats. by telephone tonight, frazer confirmed she had recently been placed on administrative leave but she wouldn't say much more than that. the d.c. government is about to take a bigger tax bite from its well to do residents. the council voted to raise taxes on people who make $350,000 a year or more. their tax rate will climb, from 8.5% to 8.95. the council was divided on this issue. take a listen to phil mendleson and jack evans. >> we should have a different higher rate for millionaires and that's what this bill is about. >> it could not be more counter productive to the future of the city to raise our taxes. >> the tax hike would take effect october 1. it's scheduled to remain in place for the next four years bringing in a total of about $106 million extra. topper? >> i'd say i'm more driven. i don't focus on anything else. >> on campuses across the country, young people are using add drugs to study and party harder. a new survey at the university of kentucky found half of juniors and seniors admit to taking the drug. the trend is so common among kids it's popping up on mtv. >> i've been up all night reading websites, books. >> how much aderal did you have today? >> a lot. >> this concerns medical professionals. >> at the short-term, those kind of stimulant medicine can often feel good and in the long run, there are significant problems. >> when abused, add medicine can cause psychological problems, violent behavior, even heart attacks and strokes. lucas lawson, a virginia high schooler died from heart failure after abusing ritalin, another add medication. >> that kind of thing scares people and they realize that it's just stupid. >> but not everyone is getting the message. >> i feel very prepared. got a lot of formulas memorized, a lot of stuff i crammed for and i think i'm going to really rock this testout. >> but at what cost? now i want to emphasize again, the add medication prescribed by physician that is safe and appropriate. the problem happens when this medication is abused. >> so i had a thought if kids are selling this to other kids it's got to be like being a drug dealer. >> it's breaking the law, absolutely. it's breaking the law but the thing is the kids we spoke to who get the stuff illegally they are so not worried about it. they say selling these and abusing these medicine is as common as drinking energy drinks on campuses, and that to me is what is the scary part. >> and they aren't talking caffeine either. >> oh, no not at all. long term health effects so serious stuff. >> thanks, anita. we did get a new story here. election wise this just in with 100% of the precincts reporting, derek leon davis has won the democratic nomination for the prince georges county council seat for district 6 and he will be facing republican day gardner in the october 18th general election. we note that gardner ran unopposed. hard to say rain, rain, go away. >> it did. it rained like 11-1:00 and went away. >> okay. how about tomorrow? >> we'll have a break. it's going to be a little different. we'll salvage the morning and rain and showers come back in the afternoon. it's going to have to be something we get used to and relish the good parts. let's start with the satellite picture and radar combined. i want to point out two things. talk about this earlier. see this in minnesota, it has not moved. that area of low pressure is what we say caught up in the upper levels of the atmosphere that can't move anywhere, it's going to drift east and south and that will send disturbances our way and produce an unsettled weather pattern really right through the weekend and in the meantime all showers went through this morning and really this afternoon, we have breaks in the clouds, the only problem with breaks in the clouds, i had to add patchy dense fog to the forecast, be sure to check in with mr. bernstein tomorrow at 4:25. remember the umbrella. it may look nice when you first leave the house for work or school but you'll need the umbrella later on believe me so afternoon showers on wednesday, the commute looks pretty damp in the evening. nothing crazy, heavy though and then thursday, same old stuff. more showers on thursday. here is a look at the futurecast. by 6:00 in the morning, just clouds and sprinkles up toward gathers bug and then by lunch time, grab your umbrella. showers and all green which means it's all generally light but it's going to still wet the roads. showers in d.c., through prince georges county over to ann, and also down 301 into charles county. now by evening, you'll notice how it really begins to spread out in terms of coverage and it gets a little heavier. we see yellow up around baltimore but for the most part it's still shades of green and by 10 or 11:00 this time tomorrow we see a lot of showers across most of the metro area. we do see yellow now appearing south of fredricksburg, moving across the day into the del marva, and then we get a break thursday morning and activity should redevelop thursday afternoon. so overnight, partly cloudy and comfortable. patchy dense fog and lows in the 60s. by morning, partly sunny and mild, and a shower still possible but for the most part not a bad morning. temperatures in the 60s, winds southeast at 10 and by afternoon, clouds return and mostly cloudy and warmer, showers, maybe a thunderstorm, highs near 80 and winds out of the south southeast at 10. at least it's mild as opposed to being in the 50s and raining so your day planner 60s to start, a little bit of fog. 70s by noon, here come the showers, maybe a thunderstorm and by 5:00, here really come the showers and storms, temperatures 75 to about 80. next three days, do it again on thursday, 82 and we do it again friday temperatures in the upper 70s to near 80 and fall arrives on friday. next seven days, this is kind of good news. the best two days are the next seven are the weekend. that doesn't work out that often. maybe a shower for the terps game but not a big deal, will not affect the game or tailgating. we'll keep sunday dry and we do it all over again monday and tuesday of next week. >> good times. >> okay. so the nats can beat up one of the best teams in baseball, but they're still short of winning half their games?
