In Olson v. California, a Ninth Circuit panel in March unanimously held that the plaintiffs had plausibly alleged that AB 5 violated their rights under the Equal Protection Clause of the Constitution. AB 5 codified the so-called ABC test, a worker classification test.
Ninth Circuit reviewed challenge to California’s ABC Test, also referred to Assembly Bill 5, California’s test for whether worker classified as independent contractor. In Mobilize the Message, LLC v. Bonta, plaintiffs appealed district court denial of preliminary injunction.
Supreme Court recently refused to grant two separate writs of certiorari seeking judicial review of California’s controversial state statute, Assembly Bill 5. AB5 codifies ABC Test for determining if worker is employee or independent contractor.
