we're giving you formal notice of our intent to cancel your visa. this is your last chance to cancel here. essentially what the judge has found is that djokovic was not treated fairly, was not treated reasonably. all he wanted was a few more thundershowers get advice from lawyers and so forth and he should have been allowed to do so. it seems primarily on that reason alone, his visa has been canceled. now for what happens next, well, we understand the ball is very much in the court of the federal government. the court was told by the government's lawyer that immigration minister alex hawk will now consider his options here, and specifically whether or not to deploy his personal power to cancel a visa. so we wait to hear whether or not that will happen. it was acknowledged within the court that if he does so, that would very likely go along with a three-year ban from entering the country. so if that were to happen, it could very well mean novak djokovic could not return here to play for another three years.

that border patrol is a very important issue. the amount of hard work that all australians have gone through in the past two years, what they've given up in order to fight covid, that the australian government is not going to be told by anybody or threatened by anybody coming into this country without a vaccination, even though it is legal to come into australia without being vaccinated if you get approval. and that is what novak djokovic had done. and so we see even though it's a win for novak djokovic at the moment, there will still be a nervous wait to see whether the immigration minister indeed decides to cancel his visa yet again. >> yeah, we'll watch to see what happens. tracy holmes, many thanks joining us from sydney, australia. appreciate it. thanks, rosemary. >> we will have much more on the novak djokovic saga just ahead. also, talks between the u.s. and russia over ukraine will soon get under way in switzerland. a live report from geneva coming

as you say, a source close to the investigation is saying that the australia border force is looking into his travel declaration to see if there was false information on it. now, what we say is that one of the questions is have you or do you intend to travel in the 14 days before arrival in australia? djokovic ticked the box that said no. but in fact there have been photos that have emerged of him both in spain and serbia in the 14 days before coming to australia. so this is something that the australia border force is looking into at this point. and, remember, we still haven't heard from the immigration minister, alex hawk, he still reserves the right to personally intervene and to cancel djokovic's visa. we heard from his office today and they say that they are still considering the situation in due process. now, it is something that is just continuing to roll here as djokovic does try and move forward and say that he does

remaining" podcast. good to have you with us. >> thanks for having me. >> so how likely is it that australia's immigration minister will decide to throw djokovic out of the country? >> he's certainly made it clear they're reserving that right and weighing the issue carefully, referring to wanting to take some due diligence and time not to make a rash decision. it will be potentially a unilateral decision that is reserved to this immigration minister, alex hawk, who has this power under the australian laws to overturn this decision fairly unilaterally by himself. the question is will this be something that the australian government wants to pursue politically? is this something that's going to be seen as expedient, pushing this djokovic story? but the fact is in terms of where they got to where they are in the case now, the victory that djokovic won in his appeal was very much on procedural grounds, not so much on the substance of if his exemption really was worthwhile and should

friday, which means that thursday when we expected something from the immigration minister, it didn't come, so the speculation is friday we might hear whether alex hawk is going to personally intervenale and revoke that gvisa for djokovic. he was training today. we saw the draw for the australian open showing they are going on regardless, assuming he will be part of it. but we simply don't know at this point. we heard from the prime minister, scott morrison, on thursday. he was asked about this as he is every time he is in public, saying that, again, the rules are the rules, saying that having a visa is different from entering into the country and in the vaccination process during the pandemic. you have to be vaccinated or you have to have a medical exemption showing a medical reason why you are not vaccinated. so he is sticking to his guns at this point. but we still don't know whether or not the immigration minister
