Argued the d. C. Circuit doesnt have a high enough caseload. There just arent enough cases there to justify a full complement of 11 judges. I would note the same republican senators did not make that argument in 2005 when the Senate Confirmed Janice Rogers brown and Thomas Griffith to the tenth and 11th judgeships on the d. C. Circuit.
