In California, the color of suffering is the juicy purple of seedless grapes. In Alabama and Alaska, it’s blood-colored. Blue signifies safety in many states, unless the blue is navy and you’re in Utah, in which case it communicates total catastrophe — the worst conditions possible. In New Mexico, nothing is better than green except for a color the governor’s office used to call “green-plus,” before it was changed to turquoise.

STATEN ISLAND, N.Y. New York schools and school districts can’t require students to consent to coronavirus (COVID-19) testing in order to attend in-person instruction, state education officials said Tuesday in a new directive.
Kathleen DeCataldo, assistant commissioner at the New York State Education Department (NYSED), sent the directive to superintendents and administrators of schools across the state, explaining that school districts can’t make consent to testing a condition for children attending in-person school and extracurricular activities. ....

GLOVERSVILLE The Gloversville Enlarged School District is acting now to secure parental consent to implement coronavirus testing of students to prepare for a possible mandate from the state.
Ahead of the holiday recess, parents received permission slips for students attending school under the district’s hybrid attendance model to undergo regular coronavirus surveillance testing to continue in-person instruction if required by the state.
Superintendent David Halloran on Thursday estimated that just under 20 percent of district students returned completed consent forms following the resumption of school on Jan. 4.
“Not as many as we would like but we have several hundred,” said Halloran. ....

Federal Judges Again Say ‘No’ to Cuomo’s Limits on Church Attendance
Gov. Andrew Cuomo lost another round in federal court when a three-judge panel from the U.S. 2nd Circuit Court of Appeals vacated a lower court’s prior decision favoring the New York Democrat’s severe limits on worship gatherings.
In a highly unusual Jan. 5 ruling, the judges rejected an injunction against the limits sought by Catholic priest Steven Soos, but, at the same time, remanded the case to the lower federal district court.
The lower court was instructed to reconsider its prior decision upholding Cuomo’s directive in light of the Supreme Court’s Nov. 25, 2020, ruling in Catholic Diocese of Brooklyn v. Andrew M. Cuomo, Governor of New York. ....

New York's COVID-19 action plan could limit construction's essential status

UPDATE: Dec. 18: New York officials have issued additional guidance about construction’s essential status that seems to indicate that even in the areas hardest hit by the coronavirus outbreak, construction will most likely remain essential.
Based on the latest clarification, the Associated General Contractors of New York State told its members in an emailed update yesterday that it believes the following applies:
If a region becomes a “Red Zone,” the guidance at this link on essential business applies. This guidance deems construction broadly essential, saying that projects may continue, but any work that can be done remotely such as office-based work must proceed remotely to the extent practicable. Employees who are not directly involved in in-person work at the business location/construction site are prohibited. ....
