The Supreme Court's reign of destruction is only beginning.


In many ways the 2020 term at the Supreme Court followed the progression of the coronavirus. There were different phases and stages, distinct strains and variants; there was death and grief and new life and rebirth. And through it all there was gaslighting and denial. Until about a week ago, we heard a lot of mediastories of a confounding and unpredictable court, with improbable lineups and unlikely bedfellows. And sure, there has been a lot of that. But Thursday saw a change in narrative with the thunking down of two cases that seemed to poke at the very fabric of democracy; a one-two punch that took aim at Section 2 of the Voting Rights Act and the ability to challenge election laws that burden racial minorities, and seemingly opened the floodgate to unaccountable and untraceable dark money flooding into a system that is already drowning in it. It almost defies comprehension that a Supreme Court that devoted so much energy, all year long, to appearing removed from partisan politics, chose the very last day of the term to let us know that when the rubber hits the road, partisan politics is what matters.

Naturally, the parents sued.
That was my first reaction months ago to news the Supreme Court would hear the case of a high school cheerleader who sued her school district after she was booted from the cheerleading squad for a vulgar post on Snapchat.
We’re a litigious society, so of course the parents made cheerleading a federal case. Really, folks?
But. Why were school officials in the eastern Pennsylvania town so calcified and controlling they couldn’t find a teachable moment in the social media rant of a 14 year old?
Brandi Levy had blown off steam not at school but on her personal cell phone to her friends on a Saturday afternoon at the Cocoa Hut convenience store.

In a Win for Student Speech, Supreme Court Rules in Favor of the 'Snapchat Cheerleader'


Mahanoy Area School District v. B.L., the case can finally live up to the hype.
“The Court made clear that schools’ power to limit campus speech is not unlimited,” says Jeff Rosen, president and CEO of the National Constitution Center, a nonprofit. “Schools can’t act like parents when disciplining off-campus speech. Students do have important First Amendment interests.”
Jen Reidel, a high school civics teacher in Washington state, had been following the case closely since last fall. She teaches a law and society class to students in Bellingham, and with her school still doing remote learning, she felt she had to find an especially interesting case to capture students’ attention through the screen. Just any Supreme Court case wouldn’t be enough to reach through those “black tiles” on Zoom and engage her students.

'First Amendment did not allow public schools to punish students for speech outside school grounds'
The Supreme Court on Wednesday ruled that a Pennsylvania school district had violated the First Amendment by punishing a student for a vulgar social-media message sent away from school grounds.
The vote was 8 to 1, with Justice Clarence Thomas dissenting.

The case concerned Brandi Levy, a Pennsylvania high school student who had expressed her dismay over not making the varsity cheerleading squad by sending a colourful Snapchat message to about 250 people.
She sent the message on a Saturday from the Cocoa Hut, a convenience store popular with teenagers. It included an image of Levy and a friend with their middle fingers raised, along with a string of words expressing the same sentiment. Using a swear word four times, Levy objected to “school”, “softball”, “cheer” and “everything”.
