On February 10, 2021, the Federal Circuit in
Infinity Computer Products, Inc. v. Oki Data Americas, Inc., No. 20-1189 (Fed. Cir. 2021) affirmed a decision by the U.S. District Court of Delaware that patent claims were invalid for indefiniteness based on conflicting positions taken by the patentee during prosecution. Specifically, the Federal Circuit held that the conflicting positions leave one of ordinary skill without reasonable certainty regarding the scope of the invention. This Federal Circuit decision is a reminder to patent applicants that piecemeal success before the Patent Office that does not conform to a coherent overarching prosecution strategy can invalidate patent rights.

Infinity Computer Products ("Infinity") sued Oki Data in the District of Delaware for infringement of four patents.  The District Court found the patents invalid due to indefiniteness and the Federal Circuit affirmed.  This case serves to illustrate two important points in patent law: (i) taking contradictory positions during prosecution will be held against the applicant, and (ii) the Federal Circuit will take said contradictory positions to an unnecessary extreme in order to support a holding of indefiniteness.

In this week’s Case of the Week, the Federal Circuit affirmed a district court’s JMOL ruling that asserted claims of two related pharmaceutical patents were invalid because their shared specification did not enable the full scope of the claims. The patents were directed to synthetic antibodies used in high cholesterol treatments that operate by binding to specified amino acids (or “residues”) of enzyme PCSK9, thereby blocking PCSK9 from binding to LDL cholesterol receptors (“LDLR”) and permitting those receptors to remove LDL cholesterol from the bloodstream.
The claims at issue contained dual functional limitations, requiring that a claimed antibody both bind to at least one or two of numerous listed PCSK9 residues (i.e., in ranges from one or two residues to all of them), and that the antibodies block the PCSK9/LDLR interaction. Appellee Sanofi contended that because there are millions of antibody candidates potentially falling within the scope of the claims, and because antibody generation is unpredictable, practicing the full scope of the claims would require substantial trial and error in screening each candidate antibody for the claimed binding and blocking functionalities. Appellant patent owner Amgen contended that in finding the claims not enabled, the district court erred by focusing on the effort required to discover and make every embodiment of the claims, that the patent adequately disclosed the required screening methods, and that the examples provided were sufficiently structurally representative to enable the claims.

WERT – As of Friday morning, the Van Wert County Health District is
reporting a total of 66 confirmed cases of COVID-19 for Van Wert County.
Of those 66 cases, 58 are recovered, and there are 7 active cases.
Currently,
there is one person hospitalized for COVID-19 and Van Wert is still
reporting one death. According to the state dashboard, found on
coronavirus.ohio.gov, there are 5 probable cases of COVID-19 in the
county. Probable cases are those who haven’t had a test, but show
symptoms of the virus and may live with someone who has tested positive.

DeWine says Ohio will look at reliability of rapid COVID testing

Governor Mike DeWine was back in action Friday after getting a false positive reading on a rapid COVID-19 test. 
DeWine did his coronavirus briefing from his home in Cedarville Friday afternoon.  The governor called the last 24 hours a rollercoaster, after getting a positive test result before meeting President Trump on his Ohio trip.  Then returning to Columbus where he, First Lady Fran DeWine and his staff got “polymerase chain reaction” or PCR test which came back negative.  While there are some advantages to doing rapid testing, the governor says the reliability of the test needs to be questioned. 
“We have entered into an agreement of with Maryland and other states to start looking at this,” says Gov. Mike DeWine.  “It's a conversation, frankly, that I will have with Governor (Larry)Hogan.  I meant to call him this morning, but I ran out of time and will call him later today. So, you learn, look you learn, every experience in life you learn and going through that experience yesterday, pushed my head down right in it and said Hey lets look at this reliability of this test.”

Ohio Governor Mike DeWine and Lt. Governor Jon Husted Friday provided the following update on the status of the state's response to the COVID-19 pandemic. 
SCHOOL BROADBAND CONNECTIVITY:
Lt. Governor Husted announced Friday that schools can begin applying for the new BroadbandOhio Connectivity Grant on Monday, Aug. 10.
A total of $50 million will be allocated through the grant program to help provide hotspots and internet-enabled devices to students.
Schools can begin applying for this grant opportunity at https://ohio-k12.help/broadbandohio-connectivity-grant/. The public website will be live today; however, schools will not be able to apply until Monday.
