the answer remains to be seen. as of right now, all roads still lead to the house. voting on those contempt resolutions next there is day. now, republicans are arguing that they intentionally wrote the formal impeachment inquiry resolution to back date all subpoenas and making them valid. but hunter biden's attorneys are arguing that they are legally invalid, and they called this contempt resolution impermissible and misplaced. now, they're arguing that despite that, hunter biden would be willing to come for a hearing or disposition with the new subpoena. they prefer a hybrid model of a closed-door deposition in the public hearing. now, the house oversight and judiciary committees have not yet indicated whether they will issue a new subpoena, but here's what we do know. first, i want to play a bit of chairman comer's thinking from before this letter, in light of hunter biden's appearance.

first step. is there a two-tier system of justice that protects this family? >> do you have confidence in the justice system at this point? especially after what you just saw for him to get away twice, first in december and now? >> i don't. i think that's where they can shine. they can provide that equal justice under the law. let's see if they do it. they did it a couple of years ago when democrats issued contempt resolutions against steve bannon and other individuals. so let's see if they will hold this family accountable for failing to appear before congress in the same way. >> harris: i appreciate your time today. i know you are busy. you have to go back into that room and we'll cover this as it continues to unfold. thank you. >> thank you. >> harris: let's bring in phil holloway, criminal defense attorney, former assistant district attorney as well.

you have other defendants asking to move ahead very quickly with trial dates this october in a couple of cases. and then you have former president trump trying to delay, delay, delay as much as he can. >> yeah, and then in georgia you see just how quickly things shift. mark meadows didn't just spend all that time and energy trying to duck the jan.6 committee. there were four people that faced those contempt resolutions from the congress. two were indicted navarro and bannon, the other two, meadows and scovino were not. one, he didn't want to talk about it, which might be self-interest, and two, at times claiming he couldn't talk about it, that there were legal bars to that. all that went up in smoke. he talked about knit court for five hours. he certainly could have taken

grievances versus issues, do any issues get discussed? does this become the main factor as we look at a presidential campaign? >> well, i think it is important to look at congress right now, at least the house, as part of trump's campaign. look, there's a lot of people who don't want donald trump to be the nominee going forward. but the people who are there, jim jordan, as mentioned, kevin mccarthy, elise stefanic, they will have to be on donald trump's -- they will probably do a lot of his meddling and what he would like to see investigated for joe biden, so it is hard to separate the two. this is going to be a major team. they don't have a whole lot of legislative agenda to be working on. they have a lot of free time, frankly, so yes, they may not be able to get a lot from the d.o.j., but they've got a lot of time to send press releases and a lot of time to pass contempt

as well as staff. we need help, right away. >> let's bring in our panel, we have elliott williams, olivia troye, and david urban with us, tonight. elliott, i just start with you. legally, what has changed now that we've seen all this? >> now that a lot has changed, legally, to paraphrase taylor swift here, we are never ever, ever, seeing the testimony of donald trump before the january six committee. it was a powerful statement, it is congress saying that they will issue a subpoena to affirm a former president of the united states, but will not get him to show up. number one, the clock, they don't have enough time. >> what is the recourse? how can they enforce the subpoena? >> number one, they can sue him, we can file contempt resolutions and vote on it, and send it to the justice department. the justice department can charge him with contempt of congress, now the question is, that is going to be a legal fight. whether you like donald, trump or not, he is going to challenge it. he has a right to challenge it.

over a month ago there were two different contempt resolutions. the first one was a criminal contempt resolution which the u.s. attorney for the district of columbia will not be enforcing. the second resolution was a civil contempt resolution which allows the house of representatives to essentially hire lawyers and go fight the administration in court to try to get a hold of the documents. bill: on the civil side, i see, okay. there are things in there based on law the civil versus criminal. james inhoff says this would be a very serious issue come the election in november for barack obama. is he right on that? if so how so. >> absolutely. this shows that this administration has failed to hold people who did wrong, and they are now named. we have names now of people who did bad things on the taxpayers' dime who essentially armed the mexican drug cartels.

member of the house oversight and reform committee. let me start off with attorney general holder in denmark answering more questions about what we all witnessed yesterday. let me play his remarks. >> we put before the committee a proposal that would have allowed for the resolution of that matter consistent with the way in which these have been resolved in the past through negotiation. i think the possibility still exists that it can happen in that way. >> congressman cummings said yesterday to chairman issa it didn't have to happen, it didn't have to come to this. what are your feelings today? >> i think that's absolutely the case. this should be and still can be negotiated, and typically that's what happens with contempt resolutions. what's interesting here is there's never been an attorney general that's been held in contempt by the house ever before. this will be a first.
