TO: SHELLEY JOURDAIN, RANDALL JOURDAIN, RED LAKE BAND OF CHIPPEWA INDIANS AND ALL OTHER PERSONS UNKNOWN CLAIMING ANY RIGHT, TITLE, ESTATE, INTEREST OR LIEN IN THE REAL ESTATE DESCRIBED IN CITY OF BEMIDJI RESOLUTION AND ORDER HEREIN, ALSO THE UNKNOWN HEIRS OF ANY PERSON ABOVE NAMED, WHO MAY BE DECEASED: RESOLUTION NO. 6262 A RESOLUTION TO REPAIR OR REMOVE STRUCTURE(S) LOCATED AT 2309 CALIHAN AVENUE NE BE IT RESOLVED BY THE CITY COUNCIL OF BEMIDJI, MINNESOTA, AS FOLLOWS: 1. Pursuant to Minnesota Statutes, Section 463.15 to 463.261 the Council of the City of Bemidji, having duly considered the matter, finds the building to be hazardous and a hazard to public safety and health at 2309 Calihan Avenue NE, Bemidji, Minnesota, on premises legally described as: Lot 4, Block 1, Omichs Second Addition to Bemidji, less the West Half thereof, and less that part of the Westerly 4.75 feet of the East Half of said Lot 4 which lies Southwesterly of the following described line: Beginning at a point on the West line of the East Half of the said Lot 4, distant 3.45 feet Northerly of the Southwest corner thereof, thence running Southeasterly to a point on the South line of said East Half of said Lot 4, distant 4.75 feet easterly of the Southwest corner thereof, Beltrami County, according to the plat on file with the Beltrami County Recorder; Parcel 80.02921.00, to be hazardous and a hazard to public safety and health. 2. The grounds for such determination are as follows: Inadequate maintenance of the interior and exterior of the structure, fire hazard, dilapidation, unsanitary conditions and other known or unknown hazardous conditions to public health and safety (photos on file). 3. Pursuant to the foregoing findings and in accordance with Minnesota Statutes, Section 463.15 to 463.261, the Council hereby orders that the record owners of said hazardous building raze or remove the same, or within the time limited below, make the following repairs: • Exterior and interior must be brought up to current code. • Electrical, heating, and plumbing must be brought up to current code. 4. It is further ordered that unless action is commenced to raze or remove said building within twenty (20) days after service of this order and completed within sixty (60) days of such service, or unless such repairs are commenced within twenty (20) days after service of this order and completed within sixty (60) days after service, or answer served upon the City of Bemidji in the manner provided for the service of answer in a civil action within twenty (20) days from the date of service of this order, then the City of Bemidji will move the District Court of Beltrami County for summary enforcement of this order. 5. The Council further orders that if the City is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the real estate concerned and collected in accordance with Minnesota Statute, required by law. 6. It is further ordered that the proper city officer is hereby authorized and directed to cause service of this order to be made upon the persons, and in the manner, required by law.
