what happened? inside the delaware courtroom earlier, abruptly changed his plants is only surviving son, hunter biden was convicted on all three felony gun charges just that he was facing today. hours later, hunter biden was standing on the tarmac, as you can see here, to greet his father when marine one landed in delaware it was striking to see the two of them embrace for the first time since that guilty verdict came down. in his only comment so far on the matter, president biden said, in part in his statement i am the president, but i am also a dad because he also praised his son for overcoming a battle with drug addiction. but this conviction also comes in the middle of a presidential election. there was also a message tonight and biden statement regarding his role as president he said that he will accept the outcome of this case, that he does accepted and they also respect the judicial process, seeming to reiterate a promise that he made last week that he won t part in. hunter biden but as biden balances both being an english parent and president in-between the verdict and that we re union that you just saw there on the tarmac. he also gave a speech on gun safety in washington it s time once again, do what i did when i was a senator, ban assault weapons before that speech, that was preplanned. i should note before the verdict came down this morning, it was in the delaware courtroom where the jury s decision on hunter biden was unanimous, guilty but notably three jurors told cnn after that they question whether or not these charges should have been brought at all a fourth, that was known to only us as juror number ten, said no politics were at play when they were deliberating their decision pressure, inviting never really even came in to play for me. you kinda put that out of your mind. politics was not even spoken about the first family was not even spoken about. it was all it was all about hunter and of course, as we know it, as far from over for hunter biden, he is facing sentencing on the gun conviction that is going to come at the height of the general presidential election and another potentially even more serious trial on tax charges. this fall. few people know more about the personal toll that this is taken on president biden than my source tonight. evan owls knows is one of the country s foremost biden biographers and a cnn contributor. he is the author of joe biden, their life, the run and what matters now and having joins me now, i mean, there s basically no precedent for what we are seeing right now. a president s a sitting president s immediate family member has never been convicted on any kind of crime while they were in office. and i just wonder what you make of it, what stood out to you have how president biden reacted today? yeah, it is something extraordinary to see. i mean, he is balancing these two distinct roles as father and as president and on some level, this combination of private life and public life has been at the center of his relationship with hunter since hunter was a baby after all you remember, of course, his mother was killed in that car accident when he was a toddler, joe biden at that point was between being elected and being sworn into the senate his hunters entire life has been in some ways straddling the struggles, the privileges, the choices, the risks that come with that. and i think of this tonight is a moment in some ways, it s part of this long arc, this really sort of epic american political story. yeah. i mean, the family seemed surprised when this came down today. it did it happened relatively quickly. hunter biden himself is not even at the courthouse today and you saw them them rushing back in there and including the first lady, jill biden. but after we didn t see any of this anguish or they re real response in front of the cameras. at least we saw the embracing the tarmac what do you think it s like behind closed doors and wilmington tonight? yeah. they ve got abundant experience of tragedy on some level, and tragedy is not to be exculpatory here when nobody and least of all, joe biden is saying that hunter biden didn t make choices that lead to this result. but they have also learned over the years about how you get through this. they turn inward. they have this. it s not a coincidence that they re going to wilmington for this. that s sort of the ancestral homeland and they go there and they meet as a family. they have these traditions of these family meetings and the line that you often hear in politics from biden is that through pain you have to find purpose. it can sound like it s a line, except that for him, it is at the core of how he gets through this. and i can tell you that is no question what he is telling the other members of his family that if we re going to get through this part of our purpose is to demonstrate that nobody is above the law that a president does not interfere in the activity because of the court that a jury can still find its way to a result even in a time of intense partisanship, you ve spent a lot of time with biden. i and his family as you are writing your book, did you ever think that you d see a day like today? i ll be frank. no, i think when i first started interviewing joe biden back in 2014, a decade ago, beau biden was alive. it was actually kind of a hopeful moment in the course of his treatment. they thought that they might have had some good news. and in so many ways, this story, the one we are inhabiting today is the result of beau biden s death in 2015. it was like a bomb that went off in that family and i have to say one of the things we learned from this trial and it really was a revelation even to people who know the family well was the depth to which the impact of addiction rippled all the way through hallie biden, as we heard, of course, also ended up involved with crack cocaine. it was just a a period of his life and i think as as political observers, we study president s not only because it helps us understand the choices they in make the pressures that they re under. but it s also a reflection of ourselves, of our country and our time and what this family was going through between 2015 and 2021 and all toya all the way up to today is in itself a very american story as someone who studies biden. i mean, what is it? what did you take away from? they already had this pre-planned event on gun safety at the white house, which i think a lot of people were thinking to themselves. i mean, the timing here is unbelievable, but he came out, he didn t give the full speech. she actually was going to talk about a new gun restrictions that the doj has enacted what that has resulted in. he did not he spoke about it more broadly. his speech that had been previously planned, but he didn t seem to give anything away. i don t want i saw that speech. yeah, not a word. i think there s a way that he has drawn this bright line between what s happening with the family and what s happening in politics. and it can almost look, i think a little awkward because people are expecting him to talk about this thing in his life. but he is so concerned that it will be turned into a talking point by his opponent that i think he s almost going out of his way not to talk about well, i wonder how, how does a way on him when he hears three jurors who told cnn obviously they voted. this was unanimous. they voted to convict, but they were asking themselves if this would have been brought it all had he not been a hunter biden. that s been a fact for awhile. i mean, joe biden is said to have told people around him that he knows that had he not continued on in politics, that his son might not be facing the charges that must really weigh on it. i think to tap that i think it s a very heavy burden and look the joe biden s decision to be in public life as long as he has has added to the pressure on hunter biden, joe biden has always known for a long time that the gene of addiction, which is in this family is in hunter biden his life and by staying in politics, by being is exposed as they are in some ways, it has put pressures on hunter biden, and i do think that weighs on the president. and obviously officers coming in the middle of the election year, we will talk in a second about how republicans are handling this. but how does biden handle this at the debate? i don t think anyone thinks it s gonna have a huge impact on the election, but we ll see, but how does he handle it for the debate trump, who of course, at the last debate brought up a hunter biden. i think in the broader sense, there is a way in which this adds to the psychic load of what he is contending with. i mean, if you think about the middle please do you think about the us and now of course, within his own family, actually though as a pro, as a political matter and in the debate that s actually an area where joe biden knows how to handle this. you remember in 2020 there was a moment when he essentially telegraph very clearly back-off. i love my son and actually, and the data in the campaign was clear about this. that was a moment that americans responded to. i think there is some piece of the public that says we want to see not only that president, but also that dad. yeah. everyone else and it s great to have you on this. thank you for joining us. pleasure. of course, as i mentioned, the fallout from this verdict is already happening in a fast and furious way from capitol hill all the way to mar-a-lago. tonight, joining us here also, andrew mccabe, the former fbi deputy director and cnn senior law enforcement analyst, ashley allison, scene and political commentator and the former coalitions director for the 2020 biden campaign. and also david urban, cnn, senior political commentator and former trump campaign adviser. so we really got the entire gamut here. and andrew mccabe. but let me start with you because we did hear from the special counsel, david weiss today, someone we have not heard from very often in this case, he came out and spoke after the guilty verdict no one in this country is above the law everyone must be accountable for their actions. even this defendant however hunter biden, should be no more accountable than any other citizen convicted of this same conduct obviously, andrew mccabe, a hunter biden s legal team has made clear they re going to challenge this, but this is not the end of the legal exposure. legal troubles front or biden. he s got another case pending this november or this fall yeah katelyn, he s not out of the woods by a long shot. the case that he has coming up in september on the tax charges very serious case, and it s one that on its own brings the threat of much more extensive potential jail time. now, of course, they ll go into that case, having already been convicted of another felony, so he s no longer considered a first-time offender in the resolution of the tax case, which could make his penalties if he s convicted even more intense okay. so you do believe age or became that it would it could impact the outcome of the case potentially yeah, there s no question. he goes into that case now is having been recently convicted of another totally unrelated offense. so that s not a good thing for him. i think it was interesting that weiss made those comments about the fact that hunter biden should not be held more accountable than anybody else there s no question that this the trial was conducted in the way you would expect to see any criminal trial conducted. the prosecutors had an overwhelming amount of evidence. their case went in very smoothly. the defense had a very, very limited range of motion to work with here, trying to get the jury to basically thread the eye of a needle and focus on the fact that hunter allegedly wasn t taking drugs the day he bought the gun that was kind of a hail mary pass and obviously didn t work for them. all of that aside, despite the validity of this jury verdict, i think mr. weiss is going to have some really tough questions to answer in the long run about the broader decisions that he made along this path. why he offered such a favorable plea deal that he then walked away from and wouldn t give back to the defendant once when he asked her that initially. so there s a lot of questions about why hunter biden was held to this standard. maybe prosecuted in a way that most other defendants who might be who were allegedly involved in similar conduct would not have been held to the same standard. those questions are still i think hanging out there for me. yeah, weiss, it we don t often see a case like this broad as we ve noted and looked at the historical context david, can we talk about how the trump campaign responded to this day? because obviously republicans talk about hunter biden a lot, but this i noticed this today with the trump campaign where they first released a version of the state of a statement on what happened criticizing biden, criticizing his family, essentially saying that hunter biden should have been charged with with other things. but at the end, on the initial statement, they said, quote, as for hunter, we wish him well, in his recovery and legal affairs okay. but then they retracted that and put out another one striking that last line and no longer wishing him well and then resending the statement all together. what do you make of that? well well, kaitlan, i like i like the first version better, right? obviously, nobody wants to see anybody languish in an addiction and spiral downward any more than they already have been. and is well chronicled on the laptop and is andrew pointed out correctly, september 5, hunter biden stands trial. again on these tax charges, which is what are much more serious, they re seven charges, i think three felonies and for misdemeanor charges, he is facing for not paying over $1,000,000.5 in taxes over a five-year period on $7,000,000 earned and so he s he s in for, some rough sledding ahead and two, your earlier get to evan s point earlier, it s going to be right in the middle of that campaign, september 5th. and it was kinda right when people are getting ramped up in campaign season. and that s gonna be weighing heavily on joe biden mind, he is not campaigning and it s going to be in the news every day is american goods are contemplating what they re gonna do. i don t think it s going to have a positive impact on who votes for whom, but people republicans are going to point back to the laptop and the 50 plus national security individuals who said the laptop was rushing russian interference camp the pain and it wasn t real. and in this case, the laptop with the fbi said laptop was real. israel could be so it s going to provide a bunch of fodder for the campaigns. for the republican campaign moving forward. yeah. i just wanted to when we ve had any of those officials who ve signed that letter, james clapper, brennan, we ve talked to them about putting their name on that and what not but ashley, in the sense of this of what we re hearing from republicans and then struggling to kind respond to this. some of them are saying that they believe that conviction is kind of dumb in the words of one of them. in other situations they ve been arguing there was this two-tiered system of justice, but, but i mean the president s son was just convicted by his justice department yeah. i mean, it s interesting to see republicans contort themselves in certain moments to make the story work for them. downtown was prosecuted. will the state a state-level charge not joe biden, they blamed joe biden now, hunter hunter biden. joe biden s son is prosecuted by the department of justice, who joe biden are president nominated attorney general, and they still are not satisfied i love i think at the end of the day, i agree with david in terms of there will be another case that hunter biden and involved in. and i do not think that these outcomes of the case particularly related to joe biden, son joe biden, like donald trump, but joe biden s son will be determined them on how voters actually the decide to vote in the fall. but what i do get allows an opportunity to do is to draw a contrast. yet again, on how the two 21 former president, one current president, who both our fathers approach the situation, talk about the situation, handled it with compassion or lack of compassion, handle it with honesty. and i think that will be in there ll be opportunity hey, this fall to see the state contrast how one side handles it versus the other. well, and we heard from the house speaker mike johnson on this listen to what he told manu raju today. david mr. speaker, you ve been saying two-tier system of justice for some time. here s the president sayyed being convicted on three counts as that undercut your it doesn t every case is different and clearly the evidence is overwhelming here i don t think that s the case and the trump trials and all the charges because it had been brought against that have been obviously brought for political purposes. a hunter biden is a separate instance okay. but david, is that really i mean, it does undercut the claims that it s a two tiered system what it does, it look, everyone s saying, look, two things can be true here, right? people are saying, oh, this wouldn t have been brought if hunter biden wasn t joe biden? in sun, but yet nobody is saying that same thing, right? except maybe for fareed zakaria, that nobody would have brought the case against donald trump if you weren t his name work donald trump so possibly both those things are true in this and these both cases, and i think that s what s getting republicans goats here. andrew mccabe, can i just get your thought on this? i mean, you were the deputy director vector of the fbi. how do you view this in the sense of, you the rule of law and justice system overall and how that is. but this new political weapon at the center of everything caitlin, i spent my entire professional life in it. the justice system in this country is not perfect. it s got a lot of flaws, but it is not two tiered. i have also seen that people who have outcomes, they don t like, generally don t like the system. and people who have favorable outcomes, they like it this politics aside, that s basically what shapes people s opinions i guess the speaker believes that his own judgments about the quality of evidence in each individual prosecution, which he admits they re all very different, his own judgment about those things should supersede the decisions of judges and juries. i disagree with that but i guess we ll just have to leave it there and i should note figure johnson was not actually in the courtroom. we were listening to all of that evidence, of course, andrey cave, ashley, i ll send david urban great to have you pushing through the primaries. people who cannot win general elections, but who pledged fealty to him. that s not a good way to build and grow a party without relationships still is ic as ever, we re also learning that another relationship may be on the verge of thawing out donald trump and senator mitch mcconnell will share the same air for the first time in nearly four years this week as after mcconnell confirmed to cnn today that he will be at that meeting, trump is having with senate republicans in washington on thursday. now this is so notable because donald trump and mitch mcconnell have not spoken since december of 2020 it was shortly before the january 6 attack on the capitol for which mcconnell, as we all remember, and that floor speech said trump was practically and morally responsible for what happened then of course four years later. and a remarkable turnaround, mcconnell announced in march that he will be voting for donald trump come november by source on all this tonight is former republican congressman adam kinzinger, who served on the january 6 congressional committee and gardens and just first off, what do you make of trump s upcoming meeting with senate republicans, but also the fact we don t know if they ll actually interact. it s not that big of a crown bit, but the donald trump in mitch mcconnell will be around each other for the first time in four years. well obviously the meeting itself isn t surprising. mitch mcconnell meeting with trump really isn t surprising. he s a political animal at his core. i mean, he s a he does some honorable things like the support for ukraine and stuff like that, but he s made it clear from the very beginning that he will support the republican nominee money i wish he wouldn t because, i mean, obviously, he could stay away. he could not say anything at all. and it s pretty obvious he s not going to be there in a number of years. so why not go out with the legacy? so it s too bad, but like i said, i m not surprised at all well, i mean, it s essentially the opposite of what we are hearing from paul ryan. he said is now voting for trump. he s going to write someone and he did that in 2020. so it s not a surprise. but this is what he said to neil cavuto about why he can t bring himself to vote for donald trump i think it really is just character at the another day and the fact that if you re willing to put yourself about the constitution and oath new or swear when you take office in federal office where there s president, remember? for congress, you swear an oath to the constitution. and if we re willing to suborn, it to yourself, i think that makes you unfit for office why do you think that other republicans more republicans who feel the same way, paul ryan does, don t say it i don t know when i wish they did. i mean, i look, there s reality that members of congress and former members of congress, particularly, or ones that are leaving don t want to make the party mad because they can go make a bunch of money lobbying after that. and so a lot of them stay quiet, which is why people asked me how can somebody that s leaving stays quiet? you don t want to tick off the party. i m very proud of paul ryan for saying that because he could have stayed silent. he could have not said anything, but he made a very clear, concise case for why he he s unqualified and on the point about the constitution law, caitlin when i swore in to congress, i did not take enough to my district. i didn t take an oath to the 700,000 people i represented. i took an oath to the constitution of the united states. that is the most important thing more than any issue. we re than any tax rate. the most important thing is, are we going to uphold these basic principles because democracy can t survive if you don t. so i think paul the speaker, made a very compelling case. he did it in front of an audience that didn t want to hear that. and i hope he says it more. it didn t talk about people though who are political animals that are interested in keeping their jobs on capitol hill. i mean, i think they look at this in a cynical way and say, okay, well, if i say what paul brian s out there saying, look at paul ryan, he s no longer in washington. he is no longer the house speaker. he left he s out why would i take that route if that s going to portend my fate? yeah. and let s look, it s true. you will be kicked out. the question is of conscience what is most important to you, a title, an identity. i mean, those are powerful things where you re conscience or your country, or the legacy that you leave. and so these people look at him, they ll look at, you know, liz cheney and i this is what a colt does by the way, it takes a few people that are out of line that don t swear fealty to the leader. they kick him out they politically execute them, and it sends a message to everybody else, don t get out of line. and that s why over the last eight years, we ve seen increasing, not just loyalty to trump but increasingly members of congress, for instance unwilling to go outside, criticized him for anything unwilling to go outside of what other whatever his daily orthodoxy is, which has nothing to do with conservatism and look, it s really just a question of conscience i m glad you said that about conservatism because this is what paul ryan s essential take was on what trump has done to the republican party. obviously, your lifelong republican, this is what he said also today i m a conservative republican. he is a populist. he s not a conservative. i want to see someone who s, who has fidelity to principles. i would prefer a party that is based on principles not personality or populism this populism is untethered to principles, but is that the future of the republican party mean that is the direction it seems to be moving in more and more look it depends how far in the future i think in a year, yet still that party i think if you fast forward ten years, i believe there s not going to be a person on this planet alive that will ever admit they support it and donald trump, because i think look, if he loses, obviously he s a loser once again. and that has a way of basically waking people up in a movement or in a political party, even if he wins, he s president for four years. very few presidents come out of that more popular than they went in america will be exhausted of him. and i i think the republican party will start to eat them up by the end of that. that s my optimistic view. but then somebody else could come along and run that same formula. and so who knows, but this is why people like paul ryan speaking out talking about being a conservative. but now being called a rhino, not because of what he believes but because he s not january 6, justice alito responded to that in a letter to congress saying that the response to that reporting, blaming his wife for putting those flags up tonight, their neighbor in the alitos house, emily baden, said that she believes that everything that has happened, everything new here on this audio proofs are right absolute horror if there s one thing that is the basic job description of a supreme court justice. it is to remain impartial and with the upside-down flag, with the appeal to heaven flag. samuel alito has shown that he is not impartial here tonight. the vernon jordan chair and civil rights at howard university law school. cheryl, an ipl and it s great to have you here. i should note, we ve heard the full recording. this is just what has been posted online that we can hear but from what we did here i wonder what stood out the most to you and all of this audio that is mostly about martha-ann alito, but also we re from justice alito himself as well yeah. katelyn, i am focused as well on the recording involving the justice himself. justice alito and the parts that i found most disturbing, probably the part that i find most concerning is when the reporter says that we need to return this country to godliness. and he says, yes, i agree with you. i find this to be a very shocking statement coming from a supreme court justice in a democracy like hours, which is not a democracy ruled by a particular religion you know, when john kennedy was asked whether as president his allegiance would be to the catholic church or to the constitution. he said, i swear an oath to the constitution. and that is what will guide my, thinking and my work. as president of the united states. i would ve expected justice alito or any justice on the supreme court to say the same and then similarly, i was very alarmed by his endorsement of the idea that it is impossible to compromise around a set of issues that people feel passionately about. the very nature of the judicial function on an appellate court like the supreme court, is to engage in compromise, to engage in conversation, to find a way towards an answer. justice alito is fond of citing brown versus board of education, which is indeed a magician important decision that changed american democracy. but it was born of compromise to get to a unanimous decision striking down separate but equal required months of work and wrangling. but but ultimately, the court created a unanimous decision because they understood the importance of coming before the country as one speaking to such a volatile issue and what justice alito essentially said was that he concedes he gives into the idea that there are simply things he cannot compromise on and that the two, what he calls the two sides cannot compromise on. and his framing of these decisions as well. winners and losers also suggests something that is, that i think is contrary to how we think about the judicial function. what does it say to you that we haven t heard from justice alito since these recordings were published? well, i d say a few things. kaitlan that i think we should be keeping our eye on. first of all, as, you know, senator durban is going to try to move forward. the senate ethics bill that he and senator whitehouse have put together that s obviously going to be a difficult thing to do, but he s determined to do to it. and when he was asked why he s doing this, pushes it because of the recordings. he said it is not because of the recordings and he said it was because of a financial disclosures and ethic statements. and i would remind everyone that justice thomas issued new disclosures, just a few weeks ago revealing trips from 2019. so quite late. and justice alito sought a 90 day extension, which he was granted so there may be other shoe to drop so we don t know. and i think that justice alito is not going to respond to every drip and drop of the revelations that are coming out. i think he responded last week around recusal from the case because that is imminent. yeah. but i don t think he intends to respond to each of these allegations. we saw him respond to that because they were asking him to recuse himself. he said he didn t fill he didn t think that it met the standard here. but cash you something else though because i m curious as we talk about this is i wonder what you would say to people who listen to this recording in their responses. well, i m uncomfortable or i m skeptical of this because it was someone posing as a conservative supporter or a sympathizer of what the alitos deal with. i wonder what you would say two people who raise questions about that when they listen to these audio recordings yeah. i mean if the questions are about the ethics of recording someone pretending that you are sympathetic to their cause. that is one set of questions that i think are actually not the focus of our concern. i think that the focus is that justice alito was speaking in an environment where he felt very comfortable. he was speaking unreservedly. he had a sounded as though he were speaking quite sincerely as did mrs. alito. and what was also interesting was that it confirmed much of the account that was given to us by the neighbor of the very disturbing account about what was happening winning between them in that community. and even that violates at least as i read it, the court s own code of conduct that they released in november last year in response to pressure that they were getting after the revelations of financial disclosures, many of us have criticized that code but that code does say that adjusted should require similar conduct by those subject to the justices control in terms of harassing behavior and conduct, simply saying it was my wife who hung the flag or it was my wife who was engaged in the altercation by their own standards is not enough so we learned a lot from that recording that i think is important, and we ll be watching closely for the and somehow get revenge against these candidates. these voters care about donald trump. he runs a reply publican party, not kevin mccarthy. yeah, there was some funding that kevin mccarthy helped with with mazes challenger, but but that was pretty much it. but we re also projecting that the republican michael ruling is going to win that that special election in ohio s six congressional district. this obviously matters because right now republicans having teeny tiny majority in the house and heal help with that margin just to teeny tiny bit. yeah. yeah. he ll help in that. but really what s interesting to me there is the margin which is he s not winning by a whole heck of a lot of the margin i last checked around was about ten percentage points. and why that s important, it s trump won that district by nearly 30 points. this is just another example of democrats turning out and high numbers in these special elections democrats are highly engaged and that s the thing they re hoping for come november, right? that this highly engaged electorate that they re seeing in these special elections will translate come november and their voters were turnout and trump s voters perhaps won t. okay, so that s interesting. so he wanted the district by how much in 2020 trump won it by a little less than 30 percentage twice and now you re seeing how close that is in that race is exactly right, and that s something we ve seen throughout the special elections since roe v. wade was overturned as democrats been outperforming their 2020 basin and democrats are hoping that translates to 2024. but of course there ll be a much wider turnout in 2024. the question is, how much larger? well, that turned out, actually, yeah, and highly engaged voters important can i ask you? we re going to have now just been arrested here in the united states. we are told they re rounded up in los angeles, new york, and philadelphia on immigration charges and law enforcement sources tell cnn that they came in through the southern border, the us southern border, and they were screened by us officials, but apparently no red flags at the time investigators later discovered possible links to isis members overseas, which is what triggered this initial federal investigation. here tonight, danielle harvey and the former head of intelligence for the decent dc homeland security department, i mean, how concerning is it that homeland security officials and how worried are they after seeing this about potential terrorists, people with ties to isis exploiting the us southern border to enter the united states well, the good news is that the system worked, right? so let s just everyone take a deep breath. federal officials caught these individuals. they investigated them, they track them down. they have them in custody. so this is exactly how it s supposed to unfold. why didn t catch them when they entered is a whole different conversation. they will have to hear soon as the investigation guilty verdict on three felony gun charges, becoming the first child hello, to the sitting us president to face conviction. we re getting new reaction from the defense team, the special counsel, the first family, and the trump campaign plus new tails, new details are emerging from donald trump s probation interview that could weigh on judge juan merchan, sentencing decision. what trump told me officials about a firearm. he didn t turn over to police after his indictment. and what that means potentially now that he s a convicted felon also tonight secret audio recordings to taken by liberal activist are raising new questions about the neutrality of the us supreme court. justice samuel alito s comment it s about religion, are raising eyebrows. welcome to our viewers here in the united states and around the world. i m willing or a year in the situation room the skis, cnn breaking news the breaking news tonight, that president biden in delaware right now after a jury convicted his son, hunter biden on federal gun charges, are chief legal affairs correspondent paula reid has the latest developments of the conclusion of this historic trip president joe biden, son hunter, left federal court in wilmington, delaware today, a convicted felon, a jury of six men and six women, took less than three hours to find him guilty on three counts related to a 2018 gun purchase a few jurors spoke to cnn after court adjourned. one question, whether the case should have been brought in the first place, saying it seemed like a waste of taxpayer dollars, but another juror told cnn that this was a legitimate pursuit. i mean, do you think that this was a legitimate use of taxpayer resources to bring this case? yes. i do believe it, despite feeling badly for hunter and his battles with addiction, the 12 jurors agreed that they had no choice but to convict all 12 jurors. did agree that yes, he know and laying bought a gun when he was an attic or he was addicted to drugs and the jurors interviewed by cnn said politics played no role in their decision. those are inviting never really even came in to play for me. his name was only brought up one store in the trial and that s when i that s when it kind of sunk and a little bit, but you kind of put that out of your mind. president biden released a statement after his son s verdict saying, in part i am the president, but i am also a dad jill, and i love our son and we are so proud of the man he is today and i will accept the outcome of this case and will continue to respect the judicial process as hunter considers an appeal hunter also issued a statement after court thanking his wife and supporters saying i am more grateful today for the love and support i experienced this last week from melissa, my family, my friends, and my community, than i am disappointed by the outcome. special counsel, david weiss made a rare statement defending the case ultimately, this case was not just about addiction, a disease that haunts families across the united states, including hunter biden s this case was about the illegal choices defendant made while in the throes of addiction this conviction comes to the possibility of a decades in prison, hundreds of thousands of dollars in fines. but that is the upper range of sentencing possibilities. it s widely expected here that hunter biden would face something far less. one of the jurors that we spoke with today said he doesn t believe that hunter biden should go to jail at all but the decision ultimately rests with the judge and we ll find out what she decides. we want to go to the white house right now. that s where cnn s kayla tausche is standing by. taylor what more can you tell us about how president biden is handling this conviction? well, well, if we can say that president biden is handling this emotionally and with his family i m late in-person, although the biden family has in the past sought privacy during events related to hunter s legal battles. but today, choosing a very republic show of support at the delaware air national guard, where you saw president biden hugging hunter, hugging his wife, melissa biden, and giving a kiss on the head to bone let s his toddler son to hunter and waleses toddler son, beau before hunter greeted the secret service members and many white house staff members before getting into his his own car. and leaving that scene. but this of course comes as president biden is seeking to wear two hats, one of both dad and president. and in that role president earlier in the day, he delivered remarks at a gun safety event everytown for gun safety is gun sense university where he was talking about all of the new the protections put in place by a bipartisan gun law that he and members of congress and promoted back in 2022 following the uvalde school shooting. and he was expected to announce a high volume of doj prosecution s on new gun crimes under that law, totaling more than 500. that statistic appeared in a doj press release but it did not appear in the president s remarks, the white house, when asked about why not they chose instead to point to the overarching message that president biden delivered. there. now as for what happens next, president biden has already been asked about the powers of clemency that he possesses as president and whether he would seek a pardon for his son he has said had no here s how that response came in will you accept the jury s outcome, their verdict no matter what it is? yes. and have you ruled pulled out a pardon for your son? yes. you have he was not asked about a potential commutation of a potential sentence, but the sentencing is currently expected to take place in the weeks before the election. wealth. kayla tausche at the white house for us, kayla, thank you. i want to dig deeper right now with our legal and political experts of course, khardori or former federal prosecutor, i ll start with you. what do you make of this fascinate the fascinating information we ve learned at least so far from jurors about how they reached this guilty verdict. well, it may think it s a testament to their honesty that the president s status as our commander-in-chief apparently did not weigh into there deliberations in any serious way. i do share the view of one of the jurors who described this as a potential waste of taxpayer money but nevertheless, that juror voted to convict hunter biden, understanding evidently that it s not that person s decision to decide whether or not the case should have been brought, but it was brought the judge the evidence and reach the conclusion that i think was largely unavoidable. jamal, let me get your thoughts and your mouth. simmons is with us. hunter biden, of course, is not a candidate. he s just the president s son. so what do you think the actual political impact of this conviction could be? i don t think there s going to be that great, but political impact, most people are not going to be swayed by this because most people have had some experience with their lives as the tragedy of addiction and gone down the road of what happens if people in their families who are addicted. so on one hand, you ve got the president signs and who is an addict? two substances on the other hand, you ve got a former president who has been convicted of 34 counts of hiding hush money payments to as pornstar mistress to keep her from going public during the midst of a presidential campaign. they re not the same thing. i think most voters know that alyssa farah griffin is also with us. alyssa, i want you in our viewers to listen to the house speaker mike johnson s reaction earlier today to this verdict. listen to this mr. speaker, you ve been saying two-tiered system of justice for some time. here s the president sayyed being convicted on three counts as that undercut your client it doesn t every case is different and clearly the evidence is overwhelming here. i don t think that s the case and the trump trials and all the charges that have and brought against couldn t have been obviously brought for political purposes. a hunter biden is a separate instance does this verdict elicit take the steam out of the republicans baseless claims about the weaponization of the us justice department of course, while it absolutely undercut said just taking a step back, we re in uncharted territory here were the same department of justice that indicted donald trump in the mar-a-lago documents case. and in the january 6 case, also just convicted the sitting president, son of a crime through a jury this is anything underscores that our justice system works without fear or favor despite the imperfections of it, it is something that works to be objective and i think it dramatically undermines this claim that it s a weaponized system. if you re an undecided voter, who d wasn t really sure what to make of the trump conviction. you her on the one side, on the right, that this was a weapon and on the left that no. a jury of his peers found him guilty. you re seeing this and i think you re saying, oh, wait, the system does seem to work regardless of who s who the name of the person that is on trial on kirsha, you were in the courtroom. my for much of this trial, hunters, sentencing, as we know, will likely take place in the fall before the election how much time, if any, is he realistically, realistically looking at? and does he have a chance on appeal? look, i would think he would be looking realistically at potentially months in prison if the prosecutors decide to seek a prison term and the judge is seriously considering it that would be consistent with sort of a first-time offender in this space. i m sure he will be arguing for a probation and he would have a good claim to probation given his history in and the uniqueness of this prosecution. but i think at the sort of the extreme he would looking at months, not not multiple years in terms of its appeal prospects. look, i do think he has a colorable appeal here based on his argument that the second amendment basically renders this prosecution unconstitutional and a prohibition it s not generally speaking, then as applied to him, unconstitutional. i have no idea how that issue will be resolved, but the supreme court has issued some very pro-gun rulings in this area. and if you were to follow the logic of the bruin decision to a t, there is a pretty good argument here that the laws under which biden was convicted are also unconstitutional as applied to him under the second amendment two, very interesting jamal or the timing of the verdict and eight, created a rather bizarre optics situation with the president biden delivering a previously scheduled speech, speech about gun safety. what just hours after his son was convicted on felony gun charges? the white house also later canceled the daily press briefing. is this a bad look for the administration? what do you think it s a bad day for the administration, but more importantly, it s a bad day for the president and for his son, but it s a bad day in a personal way, not really one about the administration and its policies. the president s policies aren t guns had been clear for a long time. he passed the assault weapons ban. but i just wanna go back to something we were at a minute ago with alyssa can you imagine a world where obama prosecutor, when after don junior, ivanka trump, while barak, while while donald trump was president he allowed that prosecutor to go after them, indict them, see them commit, can see them onto this gun impact potentially his sentencing. it s coming up. what july 11, how soon does he have to turn this gun? well, that s a good question. well, if i think technically he should have already turned this gun in as was just reported donald trump was convicted of a felony. and so at this time, he would be considered a felon in possession of the firearm. now, new york has a very clear road map to how defendant needs to surrender their firearms post-conviction, it s a little bit different when we re talking about federally or other jurisdictions, when the conviction happened elsewhere however the by the letter of the law, once he is convicted, he can no longer be in possession. so it is odd to me at todd blanche would have sat there as he made this admission and not thought of this before the interview, we need more information when he says it s in florida, is it it is house. did he surrender it? where is it but assuming argue window, it s in mar-a-lago. that s a potential problem now, directly to your question as to whether or not it will impact sentencing. again, it s the facts and circumstances is the former president holding onto the firearm and just refusing to relinquish it. i think that would be a data point. the judge were merchan will take into consideration. but is this really just a case of figuring out how to surrender it or is he in the process of transferring ownership? all of those details will matter. come sentencing de chief ramsey, as you know, in new york officials said this information will be passed along to florida police to quote, and i m quoting now, take whatever steps are necessary if trump doesn t voluntarily return his gun what authorities do you believe have to step in well, you know, i think not at this has come to light that they ll work toward getting that gun. he s not supposed to be in possession of the gun. he is a convicted felon. but this is a situation where, you know, he s really living in two different places. i mean, he spends a lot of time in new york also in florida. the one gun is in florida now he had two others that he surrendered last year shortly after he was indicted so he s already given up two of the guns. this is the one that s outstanding i really find it hard to believe that they would not make every effort to try to turn that in as soon as possible, or leases trump potentially at risk of being criminally charged for illegally possessing a firearm yeah. so i don t think he is now, again technically, could they charged him perhaps if the circumstances are correct, if it is in mar-a-lago, if it is within his constructive possession, then yes. it s a very serious charge. they could charge him federally i just looked into it prior prior to speaking with you, it carries a term of a potential ten years in prison of slightly old statistic, but from 2021, the united states sentencing commission said 96.9% of defendants charged with that crime. were, were sentenced to prison. so very, very serious, risky, which is why i don t know why todd blanche would have not made sure that the gun was surrendered to authorities prior to the psi, but very unlikely because he s still in between the conviction and sentencing. and there isn t a clear legal requirement of when and how he surrenders the gun in florida. chief ramsey, your the former police chief here in washington, dc. former police commissioner in philadelphia, is trump getting more leeway, right now or is it standard for convicted felons to take time? to return their guns well, is that standard for convicted felons to take time to turn in a gun i m not aware of that occurring with any degree of frequency, but i do think that they will make some allowances to give him an opportunity to turn to gun in i d be surprised if that doesn t happen now, he is guarded as john miller said, by secret service 24 hours a day, seven days a week, he has a nice guy. he s got, but earth of his life, he ll have that kind of protection. and so there s a lot going on. this is unprecedented. we ve never had a homer president convicted of anything and so now this is just one of those things. it s very serious. i m analyst, steve vladeck. he s a professor at the university texas school of law. steve, do you see these comments from justice alito specifically as inappropriate? and is it reasonable to question his impartiality wolfe, i think what i m struck by in those recordings is the contrast between justice alito who, you know, for better, for worse, took the bait and who had no problem expressing views on subjects that you probably shouldn t have versus what we heard from chief justice roberts, which is basically what they teach in judge school, ought to be the answer when judges are asked to weigh in on contemporary political debates so i think justice alito is remarks are probably right up, if not over the line, wolf, the problem is putting them in context where this is not a one-off, where we re seeing so many examples of justice alito saying things like this in public suggested that he has very strong political views now he s having a hard time checking those at the door. well, if i think it s the aggregation of all of these public statements by justice alito. that s really the source of the cause for concern. because you know steve, this is the second controversy involving a martha-ann alito ginni thomas, also has faced questions about her political activities. so how does that impact perceptions of the us supreme court? yeah. i mean, i think there s no question that it has some bearing on public perception of the court. i mean, we really ought not to be judged by the actions of our spouses that certainly my wife s position about me but i do think it s worth stressing that the real question here is not can justice x participate in case why? the real question is, are the justices behaving in a way that is enhanced in public faith in the integrity of the court as an institution or not. and so for as much as justice alito has tried to suggest that the entire flag controversy are basically his wife s fault. i think his responses have not suggested that he is especially concerned about the message that the flag sent. his responses at the supreme court historical society suggest that he s not particularly concerned about being publicly associated with deeply, intensely divisive political comments and so wolfe, i think again, the question is whether if you look at this as a whole, there s reason to worry, not about individual justices in individual cases, but about whether there are justices on the supreme court who really do cede part of their job as picking a side and who are caring about when winning versus what we heard from chief justice this is robert, which is their job is to basically toe the line politically and decide the cases before them. we don t expect the justices to be saints, but we do expect them to at least appear publicly as if they are completely uninvestigated. and i think that s the concern that all of this behavior by justice alito by justice thomas, by their spouses is really brings us back to steve i think you would have had a quite different storm from them. so i mean, maybe it s political break as hard as it is maybe tough just because i think it is so hard on the president, his family, but i absolutely agree this is not going to be a huge political winner for the republicans for couple of reasons. first of all, we ve actually seen them try to make a hunter biden line of attack that sticks to joe biden for five years now. i m trying to to make it central to the 2020 campaign. it didn t work and i ll tell you, we saw on the biden campaign in 2020, not only did it not work, it actually wound up highlighting some of the things that people most love and connect to about joe biden, his love for his family as humanity. so this just hasn t been a winning line of attack for them. and then also if you look at the reaction republicans had yesterday, it was all over the board to say the least. i mean, i think they recognize that the center of this conversation is really one about addiction. and that s a hard thing to seem like you re on the attack over. there s also the gun politics here. i mean, this is sort of a weird, unnatural place. it s for republicans to be arguing for less strict gun laws essentially. so no, i do not think there s gonna be a political winner for the republican by any stretch. i mean, i think matt, i m reading from the wall street journal. they write about the guilty verdict and they say the guilty verdict is likely to minimize any political impact and acquittal bio biden, hometown jury would have fed donald trump s narrative of unequal justice, especially since the justice department tried to let hunter off with a slap on the wrist plea deal. yeah. i mean, i don t think there s going to move votes. one way or the other. i mean, look at the end of the de is 50-year-old man are so he s responsible for his actions and you re lying on a federal form like that is something that is apparently great easily prosecutor able like it s it s fairly, fairly open and shut and so look, i don t think this is gonna move votes one way or another. i mean you remember, i remember 2020 debate. i think when that became an issue, i wonder if it s become an issue this time. i think it s unlikely. i think if they try the convicted felon line and that could be easier. or torque but yeah i don t really think at the end of the day this is going to move votes one way or another. and he s responsible for his actions. and we had another case coming down the pike it with tax charges in a few months. well, and also not the candidate. right. i mean, that s the other key difference here response to donald trump being a convicted felon is like, well, your son is a convicted. okay. well that s been kind of the whole, the whole game all the way along, right? so on and when you look at the impeachment proceedings against president biden, that really fizzled what they were trying to do was muddy the waters and make it and this is why they use the phrase biden crime, family, right? they re trying to tag the president with something that may be associated with the sum, but we haven t seen them actually come up with anything. right. without evidence. right? right. right at this point, i think i think what you saw yesterday in terms of the reactions from some republicans was some reaching, right? as well as an inconsistent overall message on how to react to this. you add some once again going to unfounded sort of conspiracy theories almost not mentioning the trial yesterday, not mentioning this result, but trying to indicate that there are other charges again, without without evidence, you had other republicans that seem to be saying that once again, trying to frame the justice system still as launching a witch hunt against, against trump, which again, just this would seem to muddy to undermine that argument when you have a justice department that did just deliver a guilty verdict to the president s son here. so at this point, you re not seeing really a consistent response from the gop on how to react to something that is really complicated. i mean, just a couple of days he s ago, you also saw the former president talk about the issue that was clouding this trial, which is that of addiction, one that i think many republicans and democrats know, many americans throughout the country are dealing with or know somebody who is, who is struggling with that issue. so it s not an easy one to tackle here. brandy i mean, one thing that we ve gotten in this case is that we ve actually started to hear from some of the jurors. yes. i m talking about this and this, of course something that when we have talked, obviously the former president s trial has become so political, but the jury itself, right? when you ask republicans like, hey, like, this was a jury if normal people, yes, they ll say, well, they re from manhattan, but you don t get the same kinds of attacks on the jury. and now we have jurors here in this case arguing that, hey, like our decision was not political, let s watch a little bit of that. if anybody was in that courtroom or the jury around, they would know it was not motivated by politics politics played no part whatsoever in my mind i can t speak for the other jurors but nothing was nothing was ever said about this election year that was never brought up pretty interesting texture there. yes, there is no better perspective than that from a juror. and so to hear from a juror that there was nothing in their minds that had to do with the political nature of the fact that it was president biden son, i think says a lot. i think jury systems work and i think to have our jury is talk about like, look, everybody knows is joe biden son, but at the end of the day, we re just looking at whether or not he lied on a form and whether or not he s guilty. and i think that says a lot about how intact our jury system is, because obviously there s a lot of noise surrounding the fact that it s the president s son so we re also learning about what he s going to potentially use on appeal. and the lawyers have indicated that they might try to use a supreme court ruling that actually came down in favor of conservative gun rights advocates. the president has criticized it to try to appeal this conviction is that something that you to see being potentially effective for him? line in his refusal to vote for donald trump that some republicans like mitch mcconnell is not doing that what is going on here with him? and what does it tell you about the state of the party today? i think it s easier for ryan to do. he s not an office and he s he s kind of has a nice kinda private-sector job. god bless him. it s easier to have that when mcconnell s still in office, who knows me going to run again? probably not. we ll see, but i think that is the kinda be different there. and look, i think the parties changing last ten years. i mean, we were just came upon the ten-year anniversary of eric cantor losing a primary back in 2014, and from that data, this day, who would have kinda thought i will say i respect what paul ryan is saying. he has obviously first-hand experience working with him as speaker of the house. i also don t think it s going to change very many mines and this is kind of what the other thing i talk a lot about and the kinds of democrats, but i ll just say in the context of the setting, people price in the fact that trump s has all this bad stuff. trump does this, trump says that that s fine. now we re going to talk a lot about abortion later in the show. and i think that might be the more salient issue if you re a democrat to push rather than look at what trump said now, but i respect what he s saying and i think you re right. this is the former vice presidential nominee from what, 12 years ago, but paul ryan s increasingly the minority of the party. i fight. i mean, anytime we mentioned this as an island, write a small island isolated on anytime we mentioned sort of these signs of descent, i think it s also worth mentioning the reason why it s news in a way is because it s, it s becoming increasingly rare to hear a republican kinda come out and criticized trump, love that magnitude. i mean, right, i mean, he s not let s point. i mean, he s not an office right to me, it s like such an indictment of the republican party rigueur as it stands right now, you have people for whom speaking up and saying donald trump is not fit to be present, united states might impact their electoral chances. that is, a position they should still take if that s what they believe, but they don t. and that tells you a lot hi about where the republican party, let s look at how one elected office holder, congressman troy nehls, talked about paul ryan with my colleague or my cnn colleague up on the hill yesterday. watch paul ryan, you re a piece of garbage. you re a piece of garbage. and we should kick you out of the party for paul ryan and say he s not vote for donald trump. that s the problem with some of our republicans. its guys like that. don t go spout in your mouth. often saying you re a conservative your spit in the face of the leader of our party, donald trump. i m grow up a little bit a piece of garbage. it s also like this message. i m just like fealty to the great leader rather than like making an argument that welcomes a lot of different voices and into your party, it s such a bizarre electoral strategy. i understand. you know, trump won in 2016 and since then, essentially republicans have said only donald trump is the way we can win despite the fact as paul ryan pointed out, despite the fact that they ve actually not won an election sense. and yet the message you get from republicans is like how, first of all, piece of garbage just course it s language but also it s like how dare he criticized the great leader. it s just a bizarre, i don t know. it s just a bizarre mindset. i will say this. i think troy s have bit of an outlier in a few respects because he was same guy, didn t you also came to the courthouse and like sedimentary, he knows when he has to say to get on tv. and so he knew the say something saying like this, we actually get them time on tv. so i think he might be an outlier in this. i think if you asked almost anybody in the conference, they would not agree with that. but he knows what he has to do to get on tv. but i think you re right. in some respects, look, it s easier when when paul ryan it s out of offices in office, i know trump is coming down to dc today to have kind of a meeting and looking is the leader of the party. i will say this we a primary, right? like we had and he had a one-on-one race with nikki haley. he did. and he one and i think that is it makes it a lot easier for republicans. it s not like 2016 where there s this clown car at the end where people were siphoning off votes. so i think it s easier for trump to take the mantle if he goes down there today and say, look, you had a primary i won fair and square, like we come together. well, this is the other key. i mean, paul ryan also says that he s he s not saying he s going to vote for joe biden he s criticizing trump, but he s not saying he s going to vote for joe biden. and when i hear his comments, basically expressing disappointment with both candidates, i also wonder you were talking about the primary. what that means for other voters that may share similar views as paul ryan s, such as maybe some of the haley voters, other members of the republican party are voters that are disappointed with both of these candidates. what will they do in november? and it makes you think about that when you hear those comments. okay. i think think of paul ryan, it s a nikki haley voter, didn t vote for trump, 20, didn t vote for, i can vote for trump in 24, didn t 16? z is central all right. welcome back. later this week, the senate will be voting on legislation to try to ensure nationwide access to ivf treatments it s a democratic efforts not only in trying federal protections for reproductive care, but also highlight republican resistance ahead of the november election. the vote comes as the country is approaching the two-year anniversary of the downfall of roe versus wade and made way for controversial alabama ruling that through the question, the legality of increasingly used fertility treatments. majority leader chuck schumer calling on his republican colleagues to pass this ivf bill protecting ivf should be one of the easiest votes the senate has taken all year the vast majority of senators should agree that strengthened and treatments that help people start a family is a good thing. but no way shape or form is protecting ivf a show vote. it s a show us who you are vote all right, joining me now, are new york times reporters. elizabeth is and lisa layer. they are the authors of the new book, the fall of roe and the rise of a new america. good morning to both of you. thank you so much for being here and we ll let kate and matt ask some questions as well, because this obviously is a conversation that the country he is now having with itself what how is the nation going to look in the wake of the fall of roe? and we are learning every day, the new implications that come out of it talk a little bit about how you came to write this because you really, i think set out to answer the question how was it that row fell at what did you learn in the course of reporting this that helps us understand what s going on now. sure we thought it was really important to create a narrative of just what even happened especially over the last ten years because there hadn t really been one, right? this is an issue that s pretty polemical well, and instead of just looking at that side of it, we needed to know what are the facts because he can t understand where we re going. and i were talking about ivf all kinds of issues that we had not talked about really publicly. it campaigns before mean when was the last time anyone talked about icf as a presidential issue or never? when, we were talking about your embryos on the conversation. but as long time, you can t understand the stakes about where we re going until you understand the pieces of where we ve come from. so our book, the fall of roe really takes a look at all the things that maybe people missed about how we ended up, where we are yeah, it really is the first narrative of how rho fell. it s we we did a lot of deep reporting on both sides of this fight, talk to people who really just opened up about sort of the legal and political strategy in the anti-abortion movement. and also how the abortion rights movement fail to see and some cases stop what was going on as much as they could and so it s really encompassing of the legal strategy and the political strategy of documenting this, this really like historic period and time. and i do think it s scrambled our politics massively. i can t think of an issue that scrambled or politics so quickly and so dramatically as the end of roe. and so to understand these new politics and really in some ways to understand this election cycle where abortion has emerged as this determinative issue in a way that it really hadn t been at the presidential level. you have to understand how we got to this point yeah, fascinating. and of course, we got to this point in no small part because of samuel alito is a justice who has come under increasing criticism at here. and we actually heard him on tape. this was a liberal activist who recorded him. i, at a dinner where he talked about. and again, this was someone at a party who s approaching him with her view and he says he agrees. but the word godliness comes up and i think it really ties into this conversation. let s just watch a little reminder here. i suppose that and then we ll talk people in. this country, we re leaving that keep fighting to return our country a place the bottling names. i agree with so elizabeth, i mean, you really focus in on the connection between religion and our politics when you hear that, i mean, how does it tie in with what lisa does every day? which number well, it s not a phrase you d normally hear in legal disgust, like legal decisions, godliness, returning the idea returns turn america to a place of godliness but we re seeing more and more in american public life, like basically you name, name the area where this merging of conservative christianity and, and the future, like what the certain segment of mostly right-wing of a gel calls and catholics want for the future of the country. it s a movement that prioritizes this opposing abortion often same-sex marriage, all kinds of these big hot-button cultural issues. and you hear echoes of this. all the way in the highest court, right. with samuel alito, it s why we re hearing references to the flags being flown at his home or appeal to heaven, which is another conservative christian. sort of, well, actually banner based really about what kind of country they want yeah. i mean, i think part of what our book shows that there the fall of roe was accomplished by this web of conservative activists and lawyers and, churches and other and politicians, of course, republic we can politicians who are all pulling together. there s no one mastermind. but they were pulling together in a way that took generations and part of that effort was working conservative justices up through the courts and particularly to the supreme court and then they made their sort of guidance. they made their ideal political deal with donald trump helped get them election, elected. donald trump got three justices on the court, which was pretty unprecedented and they got these justices who had come up in their movement and we re willing to strike. it s such a landmark legal precedent i m curious. did you did you find especially in the wake of the immediate political backlash that i think it s fair to say republicans are feeling after the fall of roe, as you re talking to republicans, do you do hear them charting a course forward that is about leaning further into this. do you feel that you did you hear them? recalibrating? i m just curious, sort of. well, what what what the, the political folks you were talking to, what they feel like the prognosis it s so interesting because it wasn t just that democrats didn t believe row could actually fall and abortion, even some abortion rights activists and believe row could actually fall, report many republicans didn t believe row could actually fall. so the policy that was made as we show in the book in what we call the row era was built with this understanding that a lot of these things were political positioning, or even if they republicans believe they wanted to enter abortion, they didn t actually think these policies would necessarily be put in place, then real fell and the country was plunged into the series of unprecedented debates. and all of a sudden, these politicians on both sides had to talk about things like ivf had. i think i ve heard the word missing it s kerogen uterus. use more in political discourse over the past few years. i don t think i ever heard that in all my years. all our years covering campaigns, casey ray, now everyone is plunged into this world where abortion rights are not, this abstract concept on the national level, like we re living in this real reality of like how sick does a woman have to be to get a medical exemption? what s sick enough, like what what are these things actually mean? and that s forced as you re sort of saying, a scrambling of these politics. i would ask, i m telling him i would agree with you. first of all i found in a lot of respects our sayyed it was oh, here, we have this kind of thing. it s coming like it really wasn t like for a lot of folks at very tangible thing and very, very close. and i get to that point what is one? kind of either event or decision that kinda led that we might have missed to it than that 510 years span prior that you think like this was kind of where it was set a little bit on the glide path, was the justices wasn t something more minute? yeah. and i m not saying republicans were not sincere in their desire to end abortion. i think they were. i just think nobody really thought through what it actually would mean in real life, tangible impact. it s interesting because our book starts in 2012 and right after the reelection of barack obama, and we started that point because it s really the lowest point for the anti-abortion movement. and if you remember what the country was, it s the moment when conservative christians stopping a majority in american public life. it s the moment when obama is reelected, when democrats feel ascendant, when they have this abortion rights majority on the supreme court. and i think that moment that republican autopsy, which i m sure we all remember republic, i covered that can t be he i said x each other on the plane for very many, many days, we weeks where republicans, the republican party really said we think abortions a loser. it s a loser of an issue for us. and that moment i think is overlooked because that s the moment when the anti-abortion movement let s start to claw back and they really sort of these activists, i think dug deep and figured out a new strategy. and their strategy was, we re not shying away from this word, leaning into it more. and we think are voters and our politicians will support us. and they were right in some ways, it would be really easy to just find one moment, right? if there was just one thing we all understood, then i can unlock this mystery. but this part of the major success of the anti-abortion movement was their ability not to create one plan, but dozens, hundreds of plans, right? it was this idea but they will leave no stone unturned. they would felt every crack and eventually they would build a collective, a collective body of work that would inevitably lead to the overturning of roe yeah. i think your book also kind of outlines how while these groups were able to do that and had the passion, the dedication to do this for years and years. that was missing from people, from the movement that supported abortion rights. oh, a dead. yeah, absolutely. okay. lisa lara elizabeth is thank you both so much for being here. again, the book is the fall of roe and the rise of a new america highly recommend it s fascinating raid. all right, coming up next here, the emotional toll. hunter biden s federal conviction is having on the president and his family plus joey chestnut. remember him removed from the nathan s hot dog eating contest. why organizers? and his wife, jill biden was not they re valid. biden was not there. she hurried and basically right after the guilty verdict had been red basically the first lady came up and went straight to the goodness holding room and then went to hunter and then obviously exited with him holding his hand. hunter biden when he heard the verdict he basically didn t move. he was like just this still portrait and then right afterward, he just nodded his head three times. it s okay. let s move forward. he hugged his lawyers. yes. it s wife. and then just said, let s get on with it. the next thing and there s plenty of next things to go beyond. appeals are definitely going to come potentially on second amendment grounds. you also have another trial that honestly as messy as this one was, this one. the next one might be messier because when you re dealing with a tax case, you re dealing with everything with spending money on yeah. there s a lot there. it keep any field. i mean, you when you were working in the white house, had to grapple with a lot of this as it was unfolding in real time. and one of the things i think i hadn t quite realized was the level of guilt that the president seems to feel around what hunter was going through then it obviously coincide with a time when he was deciding that he was going to run for president of the united states. can you take us inside that a little bit? yeah so yes, there is an amount of guilt that president biden feels you obviously know who s that if he were not president, if you were not front and center in our political conversation, hunter probably would not be dealing with these legal challenges but it s also important to understand about that period of time when president biden was deciding whether or not to run in 2019, that hunter really encouraged him to run and hunter didn t want to be a reason that he didn t run for president. so there was a lot of alex called it a love story. there s there was a lot of mutual love there between the two of them. both of them looking out for each other personally and wanting the other wanting to do what was right for the other so there s a lot of complicated feelings there, but at its core, a lot of love and a lot of respect it is also incredibly difficult and challenging for the president as it is for. i mean, i think any american who has a family member who struggled with addiction, it is a constant cloud that can hang over you. and obviously the president is enormously proud of how far hunter has come and how his thought to get to where he is today and protecting and preserving that progress that hunter s made is really important to the biden family and we know today in his story as well that the president does still fully believed that hunter can continue on this on his word to refer recovery. but at the same time, given all the events going on, he is concerned about what the future holds for his son as well i think that it s interesting that also you re seeing and that s evidenced also and just the movement of the president yesterday, you saw him change his scheduled to go to wilmington. you saw those images as well of him stepping off the plane, immediately embracing his son. i was in delaware last weekend and thought it was interesting that i mean, every public appearance you saw him basically attached to a hunter biden, whether they were going to church together or cycling together as well. you ve seen him really continue can you to embrace the sun? and i think that will continue as well as the language we saw from present biden statement when describing this case, when reacting to a you re going to see him continue to affirm his love for his son and continued to express empathy similar to that moment that we saw on the debate in 20 hey, 20, when trump was attacking, was going after hunter biden and the present had one of his more memorable moments where he really stood there and said, look, i stand by my son and i do love them. yeah. oh, sorry. no, no no. heading down that, the president s greatest fears, hunter relapsing and anyone knows it s been through banners and addiction. the biggest trigger for relapse is shame, which is why you have hunter always or sorry, joe biden always saying, i m proud of my son. i m proud of my son and trying to show that i m not embarrassed by you yeah. what i was going to say was they mean when you re the president there are cameras for your ever every movement, but if they didn t want a picture of joe biden embracing hunter biden yesterday. they could have avoided it, right? like they did that on purpose yeah. one sometimes when i think sometimes like joe biden doesn t even really care about the optics. i mean, i don t think having a hunter biden at some of these state dinners alongside merrick garland is like the best political optics, but joe biden doesn t care. yes, he is talking he has always going to put hunter s for hunter first. he s always going to put his family first and yes, there are times when it s optics me down. i love my son and the most important thing to me as being a father, i guess it s why kinda considering everything who said here, i am candidly skeptical of win or lose there s another, there s not a pardon in the future, forgetting every you re not alone. there are people, there, people close to the president that you didn t know. he has said this. he said this, you know, obviously very publicly there s some people around them that think he could change his mind. yeah. i mean, i think what do we have that the interview with david mirror where president biden said that he s not going to, pardon his son all right. we don t have that, but i mean there is the looming question of this, alex and in this other trial as well. i mean, if he gets off on prison time in this, which many of our legal experts have said, look like he s a first-time offender it s unlikely that this gun thing could lead even though there s a potential for 25 years, it s likely not to hit that. however, we re talking to a lawyer earlier on this program who said one of the things they could consider if there s a guilty verdict in the next case is that there will also then have been this prior conviction which makes it much more likely. i find it very hard to believe that that joe biden, the man if he has the power to get his son out of prison, doesn t do it will end as kate was just saying, you know, joe biden feels responsible for some of this because you have to remember when joe biden declared for president hunter biden is still not in recovery yet, like joe biden announces april of 2019, has his first rally on may in may of 20, 1,900 byte does not get sober until june of 19, 2019, and the thing is if you re running for president and this vicious political environment with his son that has a crack code cocaine crack cocaine addiction, you know that this is going to probably hurt his life potentially and it really has. so that s why i think that s why i think people, as you as you noted and simulated people close to the president, thank he might ultimately change his mind because he feels good. also, you referred to the abc news interview. he did say that he would not pardon his son. there is still the follow-up question of commey of commutation as well. there s multiple forms of clemency. could there be a sentence? since shortened or, or any sort of relief that way that i would imagine that that question at some points the president will face a look. i will say he he loves his son unquestioningly. he also loves his country and he also thinks that it is dangerous that we are in a moment where the rule of law is under attack, where a judicial system is under attack. so i would say don t, don t underestimate how significant it is to him that a president needs to send a message that the justice system works, that he will not inappropriately put his thumb on the scale. so i think let s see how things play out, but i would say as somebody who knows joe biden very well, i would take him at his word that he believes that but not sending a signal that he is going to interfere in the way the justice system plays out here is important and genuine, and it puts the hypocrisy of these republicans on display. absolutely accept to say absolute ipod pros, the way that they re handling this hunter thing, they re basically saying, well, it s totally not the same. i m sorry. i you mean republican politicians are looking at, you know, when, when we ve asked them and they ve responded to this, they re the speaker of the house for example, said, every case is different. the evidence was overwhelming in the hunter case, but that s it s not the case in the trump trial. yeah. i mean, look, i think at the end of the day, waiting and if you re republican politician into a hunter stuff is not going to win you any votes. let the flood the process play out. but i am very keen can you see i do think if there s a pardon, i think that could change things. all right thank you guys for that conversation. i will leave you with this get them bts army is celebrating the region turn of one of their own this morning, bts member jin has completed his mandatory military service in south korea. but k-pop star was seen leaving base today after 18 months in uniform he is far i will say, from the big first big pop star to spend time serving his country jaylen. jailhouse rock or elvis presley reported to the army after he was drafted in 19 58, the king was a soldier until the spring and 1961, earned his discharge from the army reserve in 1964 and then there was this i came

alito, the activists behind the reporting s will share it with us in just minutes from now, plus, hunter biden convicted the new reporting about the reaction from inside the trump campaign and say it busy tuesday night for months, donald trump and republicans have tried to make the case that there is a two tiered justice system one system of justice for trump and one for everybody else. there are tax goes something like this that the justice department is being weaponized against donald trump. and donald trump only at direction of president biden. never mind that trump and his allies are also claiming that biden is slipping mentally while at the same time orchestrating that conspiracy set that aside. just consider the trump-world allegation that biden is behind this plot. two persecute the former president just so you understand this is all done by biden and his people maybe as people more importantly, democrats across the slide they ve crossed the line in which now the court system is a political weapon. this department of justice, the biden department of justice he is the most partisan department of justice in our nation s history today that same biden department of justice secured a conviction against the president s son, hunter, guilty on all three counts for lying about his drug use when he purchased a gun here is david weiss, the special counsel leading the case no one in this country is above the law. everyone must be accountable for their actions. i want to thank attorney general garland for providing the support necessary to fulfill our mission. that s why it s thanking the attorney general for ensuring that he has independence. the same attorney general that the former president and his allies have relentlessly accused without evidence of conspiring to get trump s today. some of those trump allies accused the biden administration of pursuing a conviction of hunter basically accusing the president of sacrificing his own son to continue that conspiracy. former trump white house adviser stephen miller posted this. take a look at this. the gun charges he says are a misdirection, don t be gasland. this is all about protecting joe biden don t be gaslight. indeed, new tonight, the new york times reports hunter biden s conviction not only undercuts trump s narrative, but also hurts his campaigns fundraising efforts, citing a person familiar, the time says, quote, there had been discussions about how much an acquittal of hunter biden would help mr. trump? potentially raising tens of millions of additional dollars as they plan to cite it as more evidence. the justice system was rigged oops it s an ai, democrats on the hill noted their response to the biden conviction was different. we re not here contesting the results. were not here trying to defund the fbi or the department of justice because we don t like the outcome of a of a given trial we respect the judicial process, which we respect the outcome of it for his part, president biden two, it says he accepts the outcome of the case, and we ll respect it. he issued that statement before he changed the schedule to be with his son, fleming fine. to wilmington, delaware, where he remains the night photographer. you can see right? they re capturing their embrace hey, shortly after the president landed on the tarmac. now i want to get to brandy harden, a criminal defense attorney, liam donovan, former national republican senatorial campaign committee aid and karen funny a cnn legal commentator. brandy, i so let s let s jump right into this. republicans still saying that doj is a big weapon but against them, does that hold up anymore? let s listen to a speaker johnson. he was talking to our manu raju and other reporters about this verdict will talk about the other side every case is different. and clearly the evidence is overwhelming here. i don t think that s the case and the trump trials and all the charges that have been brought again, obviously brought for political purposes. hunter biden is a separate instance separate instance. the speaker say separate incidents, and so i think, look, this convictions certainly undercuts the theory that there are two there s a two tier justice system in reality, there s not one system for donald trump in one system for other folks in reality, we see that this conviction stands that when the government sets their sights on you, when they think that you ve committed a crime, they re gonna go after you and just like what happened here, a jury of your peers is going to listen, is going to figure out what happens. and here there was a guilty verdict yeah. and leon, the new york times, reporting that the trump campaign plan to raise millions of dollars off of 100 biden acquittal, i guess that s oh, well, i guess that s not gonna work out now what do you make of that? well, i mean, it s certainly makes sense if you re trying to play into the cynical idea that the system is rigged, that would certainly be prove it. i think well, with the punches though, if you start with that premise, then you can use that to any anything can come back and affirm that. so there s there s nothing that can prove the negative the system s not rigged, not a conviction of hunter biden. i mean, look, this would never should have gone to trial was supposed to be a plea deal. the plea deal fell apart. this also doesn t resolve because there s going to be a tax trial that comes up in september. it s just a mess. nobody s actually satisfied the president. but what do you sent through a tax trial to get help right? exactly what where does the conspiracy end? all the way up and then sanity begin? but here s this so cynical and discussing about that anybody who is dealt with addiction or it has people that they know deal with addiction it is a journey to stay clean, right? and the idea that the president would want to risk his child sobriety for the presidency. i get why in donald trump s mind that might make sense because that s how he thinks about things, right? is how do i work the angles to get the result i want, but the thought of joe biden doing that after again, i think what s important about today, i think about the contrast here you have a man who has this is a guy who has taken punches throughout his life. joe biden and he gets back up and he s resilient and he has figured out how to say, look, i love my son, but the law is the law versus trump, who acts like a spoiled brat, who just doesn t get his way yeah. i mean liam, the trump campaign saying in a statement, we put this up on screen. this trial has been nothing more than a distraction from the real crimes of the biden crime family and limb. people buy this stuff. i think there is a separate issue. i mean, truly if you look at this, this is kind of the it s the bragg case of the hunter charges. it really is small potatoes. i mean, i don t think republicans truly do believe there are other things that foot here they. haven t produced the goods though. they haven t been able to put together a case in the house of representatives that would that would be able to pursue this. i know that the oversight committee is tried, but there are big things that you re going to call the biden crime family. should you have are tied to the president, wears we re doing we re doing hot dogs later ron, those out. we ll look at for the nothing now, you know, that s why i think we are where we are. they talk a good game. they talk like there s going to be something else. but in reality, this is it. this is what they have. this is the case that they have and ultimately it s resulted in a conviction. yeah. and brandie, a juror ten, spoke to cnn about the decision all 12 jurors did agree that yes, he know and laying bought a gun when he was an attic or he was addicted to drugs yeah. i know everything gets thrown into the political meat grinder in dc. but again, this is further validation of the jury system that we have in this country. it s, it s not perfect. it s flawed. our justice system is why there s no doubt about that but in the trump case, you had a jury of men and women doing their job, doing their civic duty. they came to a verdict. they issued that verdict. same in this case, saving this point in new york one and delaware, you know, it s really important that we rely on the jury system. i mean, we call it a jury of your peers, whether it s actually your peers or not, it s 12 people who listen to the evidence and make get decision. one of the things that i think is so problematic here though, is that why is this? i mean, you shouldn t be able to lie on an application, but with respect to whether or not he was addicted, i mean, that just takes it another step and i think it s sad that he was struggling with addiction is sad ultimately that he said what he said on the application, but i do think that the jury system i m has 12 people decide what the evidence is and i listened to what the juror said the jury seem to say the fact that he s in the biden family had nothing to do with the case although in reality, everyone knew it was joe biden son and so even if it was in the back of their minds, they may have been at the front of their mind, but certainly it was something that everyone was aware of apparently it didn t, impact the verdict. this ties back to this larger theme about democracy that we ve been talking about, right? because there is a part of democracy that is a leap of faith. you have to have a leap of faith that you go into the system 12 people are going to listen to the evidence and make a decision and you abide by that decision, you have a right to appeal, you have a right, you write, you have plenty of rights, under house that hunter has that right there s rather, you know, exactly. and so but that s democracy that and when some of the commentary that we re seeing from republican let s the whole fact that the trump campaign initially put out a statement that had sympathy for hunter and then pull that back. i mean, all that does is undermine people s belief in our democracy and in our systems at a time when we actually should be reaffirming into your point, it s not perfect. there s so much work we need to do. but this is our system and we ve got to work with it. and by undermining it actually makes us less safe as a country tree. and the jury system works. i mean, at the end of the day and we re gonna for a long time, it worked and so regardless of how perfect it is, one way or the other, 12 people look at the evidence, they listen, sometimes say they get it wrong, sometimes they get it right, but the jury system works and leave just very quickly. there s a bob menendez trial going on henry cuellar trial going i mean, there are other trials of prominent democrats going on right now. i think the tricky part is and you re exactly right, but i think the tricky part is if you look at these piecemeal, you can say, well, this just proves the democrats are corrupt in this case of menendez or whomever. i think the tricky part is, as you say, i think there is trust in these institutions. but when we start to, when we start to talk about the supreme court, we start to talk about judge cannon and we pick apart things that maybe it looks like it s not on the level in other areas. i think it s hard to make these cases that we need to trust in the system if we re not bringing that across the board fair point, our guys, thank you very much. great discussion. i appreciate just heart wrenching and it s impossible to overstate date just how close joe and hunter biden arnon it goes all the way back to that horrific car crash in 1972, which hunter and beau barely survived. it s the reason why we ve been seeing him holding him close through throughout the trial and jill biden has been there and why you see these continuing statements of support? i mean, i think that for joe biden, this is a personal tragedy at a political windfall because i think that politically, i just don t see any downside soup so many people, so many americans can relate to a father, loving and supporting his son why? and chris, we were talking about this new york times piece that s out this evening where the trump campaign has sort of analyze this various different ways of how a biden acquittal or conviction might play out. one of the things that says in that story is that the former president has been talking about hunter biden a whole lot less out on the campaign trail in part because the former president thinks that there s some sympathy out there for the current president because of what his son has been going through. and it is worth reminding our viewers just how much tragedy, personal tragedy, the president, the united states has endured over his life. and it has shaped him. it s made him the man he is. now. it s absolutely true and i think that look, i think a lot of the joe biden s advisers are keeping a close eye on him, not because they re worried about the political fallout as i say, i think that s nothing but upside, but i think they re just worried about him personally. they re worried about having to shoulder this on top of the burdens of the presidency. this is a guy who s got a lot of stuff on his plate but again, politically, i think there s no downside. i thought so even before the verdict and after the verdict, even more so because the guilty verdict gives the lie to the notion that joe biden is some kind of puppeteer who weaponized as the department of justice punishing his enemies it s and freeing his friends, obviously hundred biden never would have seen the inside of a courtroom if that were the case. and i think luck we ve got a debate coming up and i don t think joe biden, would ever go there. i don t think he ll bring it up but let me tell you if donald trump is makes the mistake of going there and spewing nonsense about the biden crime family. i think joe will be prepared. mean can you imagine if that happened? joe biden saying, look, last time i checked you were guilty of 34 felonies i m guilty of loving my son yeah. and chris, the president, has said that he will not pardon his son. what did you think of that? i thought it was extraordinary. i mean, it was it was a moment of just moral clarity on the part of joe biden and couldn t have been in starker contrast to the way donald trump has handled his own conviction so i think it was extraordinary when he was asked will you will you accept the verdict, why did you want to get these justices on tape? and was it tough when you walked up to them where they more reserved at first digit to warm them up. how did it work? well, so it went to two different dinners. there s one and 20231 and 2024, at the first one? i spoke with justice alito only there were several justices there, but we had a good conversation. i had gone initially because of propublica reporting on clarence thomas so i thought at the time, will he be there? will he not who knows, but the reporting is it s like one of his favorite dinners so i thought there was a good chance he was not there. harlan crow is not there to my knowledge but justice alito was and so i had a conversation with him about how do we repair this partisan rift in our country that s right. they didn t say partisan rather, sorry. how do we repair the polarization in this country at the time he responded really and newsworthy way it was. i don t know. i don t know. that s not really a role. so he didn t publish that audio. but then this was before he actually went under the glare of propublica is fantastic reporting, right and so i imagined that because of that he might be more aggrieved and i might have a second shot at that this year. and sure enough, when i asked him similar questions, he had a much different response. and let s talk about what he had to say. they re about pro public. i mean, it is odd to say the leaves to see a supreme court justice or hear a supreme court justice go after a news organization which by the way, for propublica did a perfectly legitimate series of new stories on what was going on at the supreme court. and it s raised all sorts of questions about the ethics there there have been calls for ethics, codes and so on, because of that, they ve wonderful is a private one that they did they did honestly, i have no idea what propublica is budget is, but let s just say that what is it 4 million that i think that clarence thomas is accepted in gifts from donors. i would, imagine that given that it s an independent newsroom, that the annual budget probably rivals the amount that clarence thomas is taken in donations that he hasn t reported. do i know for sure? i don t know. i just you know, if you re talking about millions of dollars there that you didn t report and justice alito is saying, oh, they ve spent a fortune on going after clarence thomas. let s look at that relative. were you surprised that he was as candid with you as he comes across and as mrs. alito comes across, i mean, what what surprised you the most? it was very surprised in my so just to give some more context to this, i spoke with justice alito at the cocktail reception before. that s nris spoke with mrs. alito after the dinner? and i was surprised with him because when i went, i honestly thought these justices, they have to exercise discretion all the time. and so it wasn t surprised the first year when it wasn t newsworthy. the second year i go back. okay. we ll try again and see if we get something newsworthy so as i m standing there and having this conversation with him, it s blowing my mind when he says there are fundamental things that can t be compromised. and so to me that s okay. well, wow what are those fundamental things that can t be compromised because it s clearly is going to affect how you rule on really critical decisions that are impacting the lives of americans every day yeah and i know you and i talked about this earlier this morning, but just in case the viewers have missed that, are watching now let s talk about tactics and the way you went about doing this when i was talking to you earlier this morning, you said spare me the pearl-clutching but what about the folks at home who might be saying, oh, you know what, she shouldn t have misrepresented who she was, she should just go in there and say, hey, i m i m doing this investigation, talk to me well, you know, if i were to walk up to someone and say, hi, i m a journalists, would you please tell me that you have a lack of impartiality. that s not something you re really going to be candid about. and it really goes to the genesis. i ve done undercover reporting for a long time back to a huge scoop that i had in 2014 with the koch brothers it s reserved for events or situations where you re not going to get information. really any other way. and in this particular circumstance, they re not forthcoming. there already evading any accountability measures whatsoever. and so is it worse for me too? tend to be a fan girl or is it worse for them to not disclose millions of dollars worth of gifts from gop donors let s talk about relative ethics violations here. i think that what i m doing is in service of knowledge for the public good, the greater good for all of us congress needs to take action this i shouldn t have to do this it should be congress and this should be the media holding these justice. justice is two accounts is say your public service as part of the problem, the supreme court is unaccountable course. it isn t accountable. they can get ethics reform passed you know, why are we having congressional hearings into this? i think any reasonable person would say that clarence thomas let s getting his mother s house paid for or his nephews tuition paid for or an rv loan, much of which was forgiven. all of these things, any from about 13% to 9%. so look out of a cohort of 34 million or so, 17 to 24 year-olds we can only seem to generate 500,000 or so that are qualified and interested in serving. so this is, this is a matter i m deeply concerned about. it s not going to bite us today or tomorrow. but if these trends continue in their cultural there lifestyle trends, if they continue, we re going to find ourselves in a bad situation when it comes to the all voluntary force, 5810 years from now let me ask you about the political dimensions of this, because trump says he doesn t. this is not his idea, but he famously calls some american veterans who died in we re losers and suckers does trump s past comments about the military make recruiting more difficult i mean, can you imagine something like this happening in a second trump term after what he has said about fallen american heroes there are a number of things that have made recruiting difficult coming from both sides of the aisle, frankly, but i think it s the bigger issues in our country. i mean, the bottom line is that america s youth just are not familiar with americans military, with the one-half of 1% that serves and defense them. and that s the challenges we had to grow that with a close that knowledge gap among america s youth. so i think there are a number of ways to address that. measures that are far less radical than then reinstating a draft. things such as expanding j rotc and making sure that recruiters are guaranteed full access to high schools too. to simple things like bringing back physical fitness to high school students every day. and when they go to school and high school, things like that, they could really improve the pool of applicants. because right now, they just simply don t know that these are credible career fields and we don t want to go the way of mandatory service because what s really made the american military great since the draft was ended in 1973, was affected, they re all volunteers. they re professionals who want to serve. they want to be there. they want to do right by their country. and that s makes our military so capable and so great you and i were talking before the segment about various things and i asked about d-day. and, you know, my thoughts. i mean, there s still with those amazing veterans that we saw on june 6, last week. you know, these these men who and women who we are in their late 90s and 100s, just a stunning and just stirring example of bravery to americans all over the country have you been able to put your finger on what has been lost in and why? maybe americans just don t have the same reverence for military service that we have for the greatest generation for the people who fought on d-day know what i mean yeah, there are tremendous generation toughened by the depression of course. and then brought together by the spread of naziism. and of course imperial japan in world war ii they re just remarkable and they thought that war for four years and then came back home and went straight to work and raised families and built america into what she is today. but look i think that ember is still there in the hearts of america s youth. i see when i visit the academies, when i used to go to visit basic training or units out in the field, i think it s still there but again, they re a distance is grown between the american population and the military that serves them. and we have to bring them back together and we need our national leaders to go out there and talk about the virtues of military service, about what it means to help one another to serve one another. and i do think there is also a virtue and bring them, bringing the americans together from all democrats graphics from all ethnic groups, from all religious and racism, bringing them together that would go a long distance to helping bring our country together, make us more cohesive. as cohesive as the greatest generation was nearly 80 years ago now. yeah, and i should note, you and i both though after 911, we saw the same kind of patriotic response. inside this country. and so does somebody extent what chris miller is saying is that maybe we need to bring back mandatory service because that doesn t exist anymore. but if there were to be a national crisis, international crisis, i agree with you. i think americans, young americans would respond in the probably doesn t like trump, but she is liberal or is that just an act he asks, she she s legitimately liberal. it s not an act, it surprises me that a country star can be, can be successful, being liberal trump said before the author noted that s with crossover to pop music years ago, the crossover, she, she can, she can do whatever she wants. i would say is it good for politics to take on taylor swift i mean, this is this just goes into that bucket of weird and strange that we are seeing pop up almost every single day in this campaign. kate. but again, i think the more than donald trump focuses and n is obsessed with somebody like taylor swift, the better it is for democrats because i think we do know that she s liberal. we do know that she probably will not vote for donald trump and she may even come out in and endorsed joe biden and kamala harris and the democrats before the november election, which i think would be the republicans and donald trump s biggest nightmare. and that s probably why he s injecting this question mark into this election for whatever reason, he might think helps him. but again, this just goes into the weirdness of what this campaign is. and could come this morning very shortly. the jury and the hunter biden s gun trial resumes deliberations. the murder rate in the us could be headed to its largest annual decline ever big drops in crime deliberations after meeting for just over an hour? yes. but i and any minute we could see the president s son for the first time. today walking into the courthouse that is where he s expected to have to wait or nearby as the jurors decide whether to convict get him on three felony charges related to a 2018 gun purchase. hunter biden faces up to 25 years in prison if he is convicted on all three counts, it is however unlikely. we re told that he would serve that kind of jail time still standing by to standby to here exactly what this jury decides. cnn s marshall cohen outside the court four just once again, how is jury deliberations going to look this morning okay. good morning. it s 8:00 now. and the jury is expected back in one hour, 9:00 a.m. they got one hour of deliberations in the books yesterday before breaking through the night. and they will resume this morning. now, the judge who has been overseeing this case she doesn t feel the need to bring the jurors into the actual courtroom at nine and wish them a good morning. they can go straight to the jury box and once they are all here here today, they can resume those deliberations on the three felony charges that hunter biden is facing for allegedly purchasing and possessing a gun while addicted to it is illegal drugs. now, i should note that, yes, there are three top line charges here, but underneath each one of those counts are a series of elements of each crime that the jurors need to deliberate and degree on unanimously for each element of each crime that s in this indictment. look, you mentioned it he is convicted on all three charges he could face prison time up to 25 years. that seems highly unlikely though, given the fact that he is a first-time offender. but as we sit here, for and wait for the verdict, the fate of the president s son is in the hands of those 12 jurors from delaware six men and six women. there ll be back in about one hour to finish up marshall, we ve seen the first lady going into court. we know that a hunter biden s other members of hunter biden s family have also been in the courtroom as any family does. and can to show their support for him. but that became part of the prosecutor s closing argument. why? yeah. it is, of course, common for defendants to have the support of their family it s pretty rare for those family members to have their own secret service agents following their every move. but they really beefed up the presence yesterday for the closing arguments. obviously, there was the first lady, jill biden president biden s sister, valerie, was their president biden s brother, james hunters, younger sister, ashley, they were all there in the pews. and the prosecutors noticed one of the very first things okay that the special counsel, prosecutor leo wise, said in his closing arguments to the jury, was that they may recognize some faces in the gallery from the news. they america may recognize some of those vips from the community here in wilmington. but respectfully, none of that matters. that s what he s said. none of that matters. he wants them to focus on the evidence, which in the view of the prosecution is overwhelming. what people think about this trial? well, in terms of how hunter biden has been treated. yeah. you know, there s this real thing. what hunter biden even be on trial if he wasn t the president s son, there are a lot of folks who are on hunter biden signed are and joe biden cited say they wouldn t even be brought. that s not necessarily the case. all right. according to the public legal systems treatment of hunter bye. now, this was after the criminal indictments of them, but before this most recent trial, look at is 66% set of americans say that the legal system, treatment of hunter biden has been fair. in fact according to the polling, if anything, they think it s been not harsh enough on him. just 27% of americans think that the legal system has been unfair. so the fact is, most americans have no problem with hunter biden being on trial. his favorite bility ratings are quite low and it s something thank when you look at the polling, why the white house i think is genuinely worried because he s definitely in their minds potentially a liability for me, at least outside of joe biden and think that, well, the important thing to remember is that it s hunter biden? correct. who is on trial here, not president joe biden, but there is some data in terms of what the public thinks about the president in how he views are is i guess connected to his son. yeah. you know, sort of my leading question here. all right. hunter biden s legal troubles and joe biden, hunter hunters troubles are related to joe 46% related to juror, correct? i m related to job. thank you. 46% say that is believable that they were unrelated to joe. that is the plurality believe it is unrelated to joe biden, just 37% of americans believe that is not believe well, that s a good number for joe biden. how about this joe biden is a good dad by supporting his son, the clear majority, 54% say that that is believable, and this is, i think the polling that joe biden sort of two, is listening to saying, you know, what first off, i don t necessarily care about the public, but secondly, i think the public thinks i d be a pretty good dad by supporting his son. yeah, he may not be looking at the polling all at all when it comes to his public statements about this trial or his son, he may just being a dead dead. what is the potential impact on the left? yeah. a very probably not much at all because the clear majority of folks believed that hunter biden s illegal troubles. they have no impact on their vote. yes, there s this 23% who say they re less likely to vote for joe biden. but you know who that is, 23% are there republicans who weren t going to vote for joe biden anyway? or 4%. therefore, who say it s more likely to vote for joe biden, but you can get for free percent of americans to basically say hard to see the logic there. all right, harriet and great to see you much some police in china have now arrested a man. they say stabbed for americans in broad daylight video appears to show the victims on the ground clearly bloodied and chinese tourist was also interviewed that video though not seen on social media in china as it was swiftly censored after being published. the four americans injured are instructors from cornell college in cornell college in iowa, who were in northeast china as part of an exchange program, officials say they are all in stable stand okay. this appears to be more positive position than we ve seen in quite some time now, when it comes to the efforts to reach a ceasefire and a hostage release between israel and hamas. secretary if they d anthony blinken making a whirlwind trip through the region, first, he was in egypt at the start of the week than a series of meetings with israeli leaders, the prime minister, the defense minister, the opposition leader the member of the war cabinet, who just resigned. and now he s in jordan and then we ll be going to cut her. so a lot of the key players needed to get not only the israelis on board and the biden administration is clearly confident that they have the israelis agreeing to the ceasefire proposal. but now to try to push hamas to agree to the ceasefire proposal that s on the table. there have been some positive noises coming from hamas, both in reaction to the un security council resolution calling for a permanent ceasefire, end to the proposal on the table. the question of course, is in the details and that remains to be seen because the process has fallen apart repeatedly on the details in the past, sill, blinken knows who he has to convince here and that s the head of hamas s military in gaza, the most powerful person in the organization, right now, yahya sinwar, he was a blinken said a short time ago there are those who have influenced, but influences one thing actually getting a decision made is the another thing i don t think anyone other than the hamas leadership in gaza actually are the ones who can make make decisions that s what we re waiting now, the wall street journal was able to view messages written by yahya sinwar over the course of the negotiations and from the start of the war, and they give an interesting insight into his mindset and his person spective in one of these messages, the wall street journal viewed which cnn cannot verify sinwar says, we have the israelis, right where we want them. sinwar sit in a recent message two hamas officials i think the broker an agreement with qatari and egyptian officials on the big picture perspective on how many pills to palestinians have been killed here it is clear from these alleged messages that sinwar views this as something almost necessary to push forward the palestinian national cause. here s another quote from the wall street journal. in one message to hamas shows violent crime in the us is falling. the murder rate has dropped dramatically and could be headed for its largest annual decline ever seen as josh campbell is with us now and you know, josh crime in the first three three months of this year, murders are down 26% reported rapes decreased by nearly 26% aggravated assault is down. robberies or down, you look at property crimes, the same trend their burgers have dropped nearly 17%. motor vehicle thefts have decreased about 17%. so across the board and regions across the united how did it states they re seeing these drops based on this initial data i particularly want it focused in on murders. now, there s a caveat, obviously, this prelim preliminary, the year isn t up yet, but murder right now is down by 80% in places like boston, over 40% in cities like new orleans seattle, baltimore, and fill it dell fea, murder spiked about 30% during the pandemic, but then started to fall. i ve been talking with crime data analysts who say that if these numbers now hold, we could see a potential historic drop here throughout the rest of this year. so as we look at this trend some, obviously some promising data when you look at prime across the country, john, look this is the type of data that i imagine everyone, all of the evidence that we have so far is showing a basically a double decline relative to what it was last year at this point, last year, it was down about ten or 11%. now we re talking 19 or 20%. it s plausible that this will be by far the largest one-year decline in american history. so obviously one of the analysts, we were speaking with, and as you were saying they re john, i mean, we often focused on a lot of different facts and figures in life. nothing more personal than when we re talking about crime, whether it s crime that s impacting us, whether it s crime that is impacting members of our community. of course, we are hearing from people like the attorney general who are now speaking out touting these numbers the attorney general saying yesterday in a statement that this continued historic decline in homicides does not represent abstract statistics. it represents people whose lives were saved, people who are still here to see their children grow up to work toward fulfilling their dreams and to contribute to their communities unities. we also heard the president come out with similar statements. of course, this is a topic that can always be improved when we talk about crime. and so this is not certainly not something to celebrate when there was work to be done, but when you look at that trend, particularly after the pandemic, when we saw so much violence is certainly moving in the right direction. and this is the type of trend that we ve all been waiting for, you so new this morning a panel of independent advisers to the fda gave their approval to eli lilly s experimental alzheimer s drug is still has to get full approval from the agency, but it has a lot of people excited. our chief medical correspondent, dr. sanjay gupta is year. what are we talking about here? sanjay? good morning, john yeah, potentially a big deal here there are no drugs to cure or to prevent alzheimer. so what we re talking about here are medications that can slow the progression of symptoms once they start. and if this gets approved this would now be the second drug that could do that sort of thing. as you know, john, the fda advisory committee that s an independent committee. they make their recommendations. they recommended this be approved. the fda usually follows her guidance, not always, but this is certainly a good sign and that approval could come by the end of the year so for this particular study, they looked at 1,700 people, just over 1,700 people between the ages of 6085 and these were people who had mild cognitive impairment. so this was early part of their diagnosis, early part of their disease and they gave them this drug and what they found was that over time, over 76 weeks that about a 29% reduction in cognitive decline. so they got worse, more slowly. it s not that they reverse the disease. it s not that they stalled the disease. they got worse more slowly, about 29%. so that is the big number in terms of benefit. the committee was paying attention to. on the flip side of that, let me tell you quickly, john, is the risks there are risks of these drugs specifically something known as aria, which stands for amyloid related imaging abnormality. you don t need to remember that, but basically it s these bleeds that can occur in the brain in response to the drug and what they found was about 37% of the people who are getting the medication compared to placebo, 14% did have evidence of these, these changes in the brain related to the amyloid. three people did die as well in that trial. so that was something that committee looked at very, very closely and still determined that the benefits outweigh the risks. john sanjay two very important questions. number one, how do you say the drugs named? because i can t make it out. i can t make sense of that in number two, how exactly does this one work yeah so the nonna mab and mab, which you hear at the end of a lot of these drugs, stands for monoclonal antibody. the other drug that i was talking about, lecanemab also a monoclonal antibody and a lot of people know monoclonal antibodies. they learned about them during the pandemic. but you re essentially giving the antibodies as part of the drug let me show you this quick animation of how it works. you know, amyloid is this protein plaque that builds up in the brain. when you give these medications, it can basically disrupt some of the building blocks of those plaques not allowing them to form as well or clearing them after they ve already formed so that s that s basically how these monoclonal antibody drugs work. and again, this might be the second one. what i tell you one interesting thing about this, this trial the ilo liliya suggesting that they follow the amount of amyloid that people have in their brain. and if the amyloid clears they suggest that maybe just stopping the drug it s a monthly infusion. but they say if the amyloid has gone no need to continue taking the drug when you typically think of the drugs, you think of them as lifelong for the rest of your life. maybe not the case here we ll see how the fda weighs in on that the nonna map sounds like sesame street phenomena to me, which is how i ll remember from now on how many people are we talking about that this could benefit hard to remember yeah. so you got about in the country, got about 6 million people who have alzheimer disease carry the diagnosis, but about 1 million who fall into that early stage category. again, keep in mind someone goes in there now developing early symptoms, sometimes hard to diagnose but potentially 1 million people taking the medication, right now. that is the population. will see in the future if some of these medications get approved for people who are further along in their diagnosis while got moderate or severe now so many people take any any promising news when it comes to
