A COURT challenge to Nicola Sturgeon’s independence referendum bill would not be left to a private individual, senior UK government figures have indicated.
Boris Johnson’s cabinet is gearing up for a legal fight over the Holyrood legislation but has ruled out the possibility of a citizen campaigner emerging to stop a referendum.
There has been some confusion over whether the Conservative government would take the Scottish Government to court over a referendum bill, with Cabinet Office minister Michael Gove appearing to rule out the possibility.

Boris Johnson's devolution tsar questions how seriously Whitehall takes the Union

Boris Johnson’s devolution tsar has said there needs to be a “fundamental change of culture” at the heart of government if the Union is to be strengthened.
Former Tory minister Andrew Dunlop told MPs there had been a “devolve and forget approach” in Whitehall for too long and said we now needed “a government for the Union”.
The peer called for the appointment of a “Secretary of State for the Union” to oversee four-nation relations and urged the prime minister to schedule regular meetings with his devolved counterparts to strengthen cross-government working.
The comments come two months after the publication of the Dunlop Review, which made more than 40 recommendations on devolution.

THE UK Government will “not be legislating to prevent all future referenda”, Michael Gove has said.
The Tory MP's words suggest that Westminster will not legislate to prevent a second Scottish independence referendum in the coming years, as the former head of the Union Unit has recommended.
However, it would be impossible for Westminster to legislate “to prevent all future referenda”, as the principle of parliamentary sovereignty means that no sitting parliament can create a law which a future parliament cannot undo.
Gove was giving evidence in front of Westminster’s Northern Ireland Affairs Committee, Public Administration and Constitutional Affairs Committee, Scottish Affairs Committee, and Welsh Affairs Committee when he made the comment.

Boris Johnson’s top civil servant has said the preservation of the Union is now “at the forefront of policymaking in Whitehall”.
Cabinet Secretary Simon Case told a House of Lords committee the Covid-19 pandemic had changed how the civil service operates and had resulted in much greater cooperation between Westminster and the devolved governments.
Mr Case said “the world of devolve and forget” had ended, adding that there is now a much greater understanding of devolution among mandarins.
He said: “If you’d asked me only a few years ago did I think that devolution or the Union was at the forefront of policymaking in Whitehall I would have said probably not.
