feeling bad about, it and shuffling in apologizing and explaining away. you let the government get the stuff back. it's not uncommon to take away classified documents inadvertently. it just doesn't seem like an innocent thing when confronted with the fact that you've done that, you don't let the government retrieve the information. or you lie to them about whether or not you have the information. and i think the thing that ever is gonna be looking for on tuesday, when the indictment presumably is unsealed, any indication of what trump's intent was. why he did it. it is a weird thing to do, given that we've seen other senior officials ostensibly at face value, in the same kind of situation. he behaved very differently when confronted with the fact that he had this material. why? >> rachel, he's also testified about the case, in effect, publicly. on social media. on television.

prosecutor jack smith to oversee the case on november 18th of last year. now, six and a half months after jack smith entered the case, donald trump is facing serious federal criminal charges for which other people have received long prison sentences. leading off our discussion at this hour tonight, is rachel maddow. rachel, on that monday, august 8th, we were both covering something we thought inconceivable, we talked about how shocked we were walking down the hallway, getting this information, that a search warrant was being served at the home of the former president of the united states. and here we are tonight. >> yeah, i mean, it's

now, it is important to have a judge who does a very careful jury selection process. for both sides, to make sure that you're not getting somebody who has a predetermine view, they're gonna listen to the facts and obey the law. but 99 times out of 100, that's what happens. i agree with bread, if you have a very strong case, the best that's going to happen for the defendant is a hung jury. not an acquittal. that's what it would've been john durham lost two of his trials, that was such a blowout, that meant that 24 jurors actually disagreed. there was not a hung jury in either case. so, i think people should calm down about florida, they're citizens in florida, their citizens all over this country. every day, show up on honduras and do their duty. >> milk of teal, bradley moss, andrew weissmann, i could not have a stronger group to join me on this historic night. we are going to reconvene this

deputy attorney general, who's a presidential appointee. this is left to jack smith, it wasn't overruled. a sign of that is when we saw the defense council went in the prone of justice for an appeal. the reports were neither the attorney general, nor the deputy attorney general, where there. instead, the most senior, non political person, the most senior career prosecutor was there. again, what that does is say, this is outside of politics. we are playing this completely straight. this is what would happen to anyone, regardless of their name is trump, or if they are the lieutenant colonel who just got sentenced to three years in jail for doing less than what donald trump is going to be accused of when these are unsealed charges. >> neal katyal, you wrote the special counsel rule in the justice department, they're operating under in this case. what is your interpretation on

indicted long ago if his name or not trump. the reason that important, when you are indicting a political figure, it's not enough that you have a strong case. it's also important that the public understand that this is not selected prosecution. this is not somebody who's singled out. he's being treated just like anyone else, and there are legions of cases of people who did far less who are in jail because of this kind of conduct. that is what it means to have a rule of law. that is what it means to not have a king, but to have somebody who, if they violate the law, will be treated regardless of their station, or in this, case their former station. in the government. so, to that extent, this is really a great day for america, in terms of upholding that principle. i know it's not when we've been through before, but i do think, if you step back and think about what this country is supposed to stand for, that is
