[ cheers and applause ] reporter: inside, students from across the bay area and the state have planted themselves in the capitol rotunda, many pledging to stay there until their demands are met. it s a visible presence of people voicing their dissent, voicing that, you know, the way that politics has worked, as usual, has not worked for us. reporter: earlier today, thousands more students rallied outside the building. this group of students spent four days marching from oakland to sacramento. i feel like we ve done the letters, we ve done it the quote/unquote right way, and now i feel like we have to take it a step further so our voices can be heard. reporter: lieutenant governor gavin newsom is throwing his weight behind the students and even joining them inside. i m incredibly proud of every single one of them. they ve got other things to do, and they stepped up and stepped in. why can t i go in?! reporter: but inside, things are getting tense, and the chp refuses to let more students inside the rotunda. they say they will not allow students to stay inside for long. let him in! let him in! let him in! they have been given an order to leave, you don t leave, we re left with no option but to physically arrest you. this is in the tradition of martin luther king, this is in the tradition of the civil rights movement and the anti-war movement of people using free speech and using can democratic discourse to push the issue, as to what we need, what we the community need. reporter: and we re back here live. you re looking at the north steps of the capitol. but, again, it is inside where things are really heating up at this moment. i was just in contact with a student who is inside, who says that the students are refusing to leave. and right now, they are practicing civil disobedience. they are doing some training, gearing up for the dispersal order. police are out here and they will give that order at some point, and then we can imagine there just may be a standoff and perhaps some arrests. reporting live in sacramento, i m jodi hernandez, nbc bay area news. all right, thank. of course, we ll continue to monitor the situation at the capitol there closely and we ll update you. new at 6:00 tonight, hundreds, possibly thousands of dui cases in san francisco will be getting a second and a closer look after the police discovered it hasn t been checking its breathalyzers for accuracy. and in a rare move, the d.a. and the public defender teamed up today to announce they ll work together to figure out exactly what happened and how to fix it. nbc bay area s kimberly tere is live in san francisco with more on the details. what is the plan moving forward now? reporter: the plan is to go through all of the records and find out just how many cases could be impacted here, whether it s hundreds or thousands. it was actually a chp audit that detected the problem that could result in dui cases. dating as far back as 2001, to be thrown out. san francisco s public defender and district attorney are scrutinizing dui cases, in which the police department used preliminary alcohol screening, or pas devices, also known as breathalyzers. i am somewhat flabbergasted by the fact that these trained officers were not doing what they were supposed to do, in terms of testing these machines. it put a stop to the use of this particular equipment, and we re now conducting an investigation to try to determine how many cases would be impacted by the use of this particular equipment. reporter: according to manufacturer recommendations, and police guidelines, accuracy tests of the devices must be conducted every ten days or 150 uses. but district attorney george gascohn says this was not being done. he contends police were calibrating the device without checking for accuracy first. until proper procedures are in place, gascohn will not admit pas evidence in pending cases. there will be cases that we ve brought to court, the process would be that we would make a motion to withdraw the plea and, you know, the remedy would be determined by the court. obviously, we would be seeking a dismissal. reporter: attorney peter fitzpatrick says the lack of oversight by police is unacceptable. he represents a client who had a 5% difference between her pas test and chemical test results. it s a huge discrepancy, and it shows how inaccurate these machines were. reporter: the public defender s office is asking anyone who was arrested for dui by san francisco police and given a pas test to contact them. a spokesperson for the san francisco police department says they have taken all 20 devices out of use. he has confirmed that and the department is cooperating fully with both the offices of the public defender and the district attorney. live in san francisco, kimberly tere, nbc bay area news. well, what started as an nbc bay area investigation has now grown into a state audit. seven south bay legislators are asking for a state audit of san jose s pension controversy. today at city hall, these lawmakers say they want to know the source of the pension estimates used by mayor chuck reed for the last year. our investigation exposed the inflated amount of a projected $650 million deficit. the actual projected deficit is millions of dollars less, which has local unions and city employees crying foul. we need some adults in the room. some people that are independent, that have no stake in the fight, to say, this is here s the financial number. here s our review. and then, here are options that you may take. reporter: the joint legislative audit committee will review the request on wednesday and decide whether to move forward with a state audit. the mayor s office issued a response saying they would not object to an audit, but also believed the committee s decision should be delayed until after the pension reform ballot measure in june. to view the lawmaker s letter, go to our website and search pension on nbcbayarea.com. a horrible pattern of alleged sexual abuse coming to light in south san francisco. police say a teenager recently reported being sexually assaulted by kyle vogt for more than a decade. police say the abuse began when the girl was 5. after just two weeks of investigation, police now believe the auto mechanic sexually abused four teenage girls he knew through family and friends. police say vogt used money and threats to keep his victims quiet. it seems like his standard pattern would be, he would victimize the girls, and then he would threaten them with bodily harm or supply them with buy them things to keep them quiet. police arrested vogt at his home in south san francisco last week on a no-bail warrant. investigators say they collected lots of evidence, but they think there may be more victims. vogt is now facing 11 criminal counts, including a ve ining a sexual assault of a minor and the sexual assault of someone under 16. some significant new details in the high-profile case of sheriff ross. the judge says he will allow his former girlfriend to testify in this domestic abuse trial. also today, his attorney cited pre-trial publicity as reason to move this trial to another county. the judge so far has not ruled on that motion and the d.a. has until wednesday to weigh in. meanwhile, merckeeny s wife is appealing the judge s decision of her to admit a videotape of her displaying a bruise on her arm. this stems from an alleged confrontation between merckeeny and his wife on new year s eve. get those shovels ready. in a few months, the dream of a new 49ers stadium will become a reality. a judge threw out a bid to allow the city s residence to vote on the project s financing. the ruling means construction will begin on the 68,000-seat stacium this summer, most likely in july.is opponents of the stadium argue the $858 million debt financing was too risky for the city of santa clara and was never approved by its residents. the santa clara city council insists that residents are protected from having to re-pay this loan. police on the hunt for two gunman who opened fire on a group of people hanging outside a berkeley home. tonight, three of these people are recovering from gunshot wounds. the shooting happened early sunday morning, near the corner of seventh and addison. investigators say the shooters did manage to get away. they found the victims a couple of blocks away, though, treated at a hospital, and are expected to be okay. turns out it is the second triple shooting in berkeley in just recent days. officers are investigating if there s a possible connection between those two crimes. the bay area might not be a republican hotbed, but it is filled with money and support for mitt romney. the republican front-runner is coming to town. supporters will host the former massachusetts governor in redwood city on march 26th. now, among romney s prominent supporters, hp s meg whitman, sun microsystems but the chance of rain. we ll detail it all for you coming up in minutes. one thin line causing a lot of headaches in morgan hill. construction crews cut a fiber optic line, cutting phone and computer service to countless verizon customers. nbc bay area s kris sanchez has more from morgan hill. reporter: crews worked furiously at this construction site near monterrey and watsonville roads. about a half mile away, business was at a standstill. the whole building is out of internet and phone service. three cpa firms, two lawyers, two investment firms, bank of america mortgage. nobody s going to be able to function today. reporter: about 9:30 this morning, a contractor cut a verizon fiber optic line while working on the city s butterfield boulevard south extension project. a verizon spokesman says the company dispatched a repair crew immediately, but couldn t say how many customers were affected. however, we know that it was more than just the folks making phone calls. at this gas station, customers had to pay with cash or credit inside, because the readers on the pumps outside weren t working. my son s trying to get back on the road to go back to college down south, and it s slowing him down. reporter: and at this bank of the west branch, the phones were down and employees were only allowing in one customer at a time. deposits were about the only transactions possible. not what michelle harvick needed in the middle of buying a house. i was trying to set up to get money wired here to morgan hill title company, and everything s on hold now. reporter: and at the morgan hill police department, we got a busy signal when we called the main line, but the sergeant says emergency services were never compromised. we were still able to answer all 911 calls and residents are able to call 911 as well. that is not affected whatsoever. that was kris sanchez reporting. well, there were some tense moments at a school in south san jose today. someone heard gunshots nearby, forcing the campus into a lockdown mode. oak grove high school received a code blue from police around lunchtime. students were asked to stay inside. now, police believe the gunshots might have come from a group of students near the campus, not on campus, but near it. officers d find shell casings, but have not made an arrest in this case. the lockdown was lifted after about 20 minutes. no one was hurt. a murder suspect s father and two girlfriends are behind bars tonight, accused of helping that murder suspect collect more than $30,000 in unemployment checks. anthony garcia is convicted was convicted last april of being involved in a southern california gang murder. the evidence, prosecutors say, garcia had a tattoo of the murder scene on his chest. now his father and two of his girlfriends are accused of helping him cash checks worth $1,600 a week over a two-year period. jail inmates are barred from receiving unemployment benefits. investigators say the suspect deposited some of the money into jail accounts belonging to garcia and some fellow gang members as well. more rumors surrounding yahoo! and these rumors include significant layoffs. several online news agencies reporting that yahoo! s new ceo, scott thompson, is on the verge of announcing a large-scale layoff. the sunnyvale-based company has struggled for years, trying to find a viable direction and business model. yahoo! is not commenting on these possible layoffs, but it is saying that there will be some strategic change. well, not as rich as the other guys. facebook co-founder mark zuckerberg is worth more than $20 billion, but he still doesn t qualify as one of the world s top 20. analysts say zuckerberg s 25% stake in the menlo-based company will soon be worth less than $21 billion. that s $7 billion less than previous estimates. zuckerberg s stock will be diluted when facebook issues its class b stock at its upcoming ipo. number one on bloomberg s billionaire s index is mexico s telecom tycoon, carlos slim, microsoft chairman bill gates, and warren buffett ranks second and third. and you see three of sam walton s children, of the walton empire the walmart empire, excuse me, are included in the daily top 20 rankings from bloomberg. talking on a cell phone while driving is never safe. and new information just released suggests the the law cracking down on talking while driving is actually working. a new study says death due to handheld cell phone use by drivers has dropped since the state implemented that ban in july of 2008. but research done at cal berkeley looked into state crash records two years before the law was enacted and two years after. overall traffic deaths declined 22% while handheld cell phone driver deaths declined by 47%. a small setback for injured giants fan bryan stow. he s telling his family he s scared. stow s family says he s having trouble sleeping at his new rehabilitation home and he barely has an appetite. the family isn t saying where that new facility is, only that it s, a quote, long drive from stow s hometown of santa cruz and that the adjustment has been tough. stow was left with severe brain damage from a beating in the parking lot of dodgers stadium after a dodgers/giants game last year. before climate change sends rising ocean waters over the lawns of california s coastal residents, a new study indicates birds will be affected first. that study by the state fish and game department looked at birds in marin county and found wetland species are more vulnerable than other kinds of birds, because their habitats are near the shore or on islands. the report says that brown pelican are among the species that will be most threatened. okay. let s bring in our chief meteorologist, jeff ranieri. it s been hot and cold for the last several days. and you ve been on top of it, jeff. yes, of course, always tracking that forecast, most accurate one in the bay area, if i do say so myself. today we had 68 in santa rosa, 72 in santa cruz, and also plenty of 70s down in the south bay. where numbers right now are dropping anywhere from 20 to 30 degrees in the extreme south bay, from what we had in those daytime highs. this cold blast already starting to settle in, with 55 in san jose, 58 in livermore, and 55 in santa cruz. namely right now, we re starting to see these winds shift to more of an onshore flow, right across san francisco. that s where we take you inside right now to the golden gate bridge. we do have a little shred of that marine layer moving across, but it s definitely a lot stronger from downtown san francisco, just about ten miles away. all the way south, across the peninsula, with a lot of clouds streaming across. as we look at the overall picture from up above, what we re also noticing is some rainfall here, this weak system producing some returns up near eureka. we ll get a little bit of this as we head into our overnight hours. we re not expecting heavy rainfall, but definitely some areas of scattered showers that we think will start to move across and accumulate about a tenth of an inch of rainfall here to the north bay by 3:00 a.m., and then we ll keep that chance of showers until about 6:00 a.m. then from there on out, it will be a clearing and a drying picture as we start to see some pretty substantial winds back in the forecast for tomorrow. wind advisory in place here for most of the bay area, with some of the strongest wind at this point expected right up across the east bay hills, where winds could top 40 miles per hour. here s the thing about the wind tomorrow, guys. we could see some power outages and also some tree limbs down. you want to be real careful on tuesday, even if the sun s out, we definitely may have some damage. more on is now celebrating its night life for the color green. nbc bay area s joe rosato jr. show us a new city study is shining a spotlight on how much san francisco makes. reporter: there s no question san francisco s nightlife is brassy and bold. from its palette to its punk. once the sun goes down, a whole nocturnal life begins. but for sean manchester, the owner of the dance club mighty, the positives of the city s might write nightlife are sometimes overlooked. i think the greatest challenge is the perception that nightlife is a bunch of people out raising, you know, raising hell, creating havoc. reporter: but san francisco s nightlife isn t just colorful, it s lucrative. today the city released a new report on just how much money it makes. and something like this, an economic impact study gives us some clout, some teeth to say, you know, we re with a contributor. reporter: in fact, 4.2 billion teeth, to be exact. that s how many dollars the report says were generated by nightlife establishments in 2010. $4.2 billion in consumer spending, 48,000 jobs in the city, $55 million in tax revenue. reporter: san francisco supervisor scott weiner called for the citywide study. he said for over a decade, clubs and venues have battled to survive amid police crack dons and neighborhood complaints. it s useful, as we make policy decisions in the future, about regulations for these nighttime businesses or land use, zoning decisions. reporter: the report included everything from restaurants to clubs to the symphony. it found that visitors from outside the bay area spent $2 of every $3 generated. we know that these, that these nightlife interests are important to san francisco s cultural fabric, but now we know, we have the numbers to prove, that it s really important to san francisco s economy. reporter: a coalition of nightlife groups says it s working to weed out bad club owners and cut down on violence. all from an industry that s happy for a chance to blow its business and tech reporter, scott budman, is there, as the president of israel began his tour today. yeah, jessica, shimon peres in town to talk tech, the social network a little, and compare notes. because although tiny in comparison, israel has a lot in common with the u.s. when it comes to the business of technology. israeli president shimon peres tour of silicon valley began at ibm. specifically, in an ibm research lab where scientists demonstrated a molecular model that helps with brain research. peres, who says he came here to see the future, talked about why science and education are so important to both israel and the u.s. if you want to look at what will happen in the coming ten years, go here and not to the stock exchanges and not banks. it is not money that produces money. it is science that produces money. when it comes to tech, israel is big business. it s success to the u.s. in companies listed on the nasdaq. president peres, who will also travel to obama and israeli prime minister benjamin netanyahu met today at the white house. the president is pressing for time to let sanctions and diplomacy force iran to disarm itself. but netanyahu isn t ruling out an israeli military strike. israel has the right, the sovereign right, to make its own decisions. i believe that s why you appreciate, mr. president, that israel must reserve the right to defend itself. their meeting is underscored by a u.n. report that iran has tripled its monthly production of enriched uranium, which it denies is used for a weapon. senator joe lieberman has also promised a powerful pro-israeli group that the united states will disarm iran, using force if necessary. tomorrow is super tuesday, the biggest day so far in the republican presidential race, with 11 primaries and caucuses. ron paul is looking for his first win in alaska, idaho, or north dakota. in his home state of georgia, newt gingrich looks like a lock for his second primary win. but the focus will be on ohio and santorum versus romney. in the latest nbc news/ wall street journal poll, the gap has narrowed to just two points, which really is a statistical tie. i m going to vote for mitt romney, because i think he s more of a middle of the road candidate. i absolutely follow christ, like he is who i want to be a reflection of his perfection. does that mean a vote for rick santorum tomorrow? i would lean more towards that way. the drawn-out race appears to be hurting the gop and helping president obama. today s nbc poll finds that 40% of americans say they re getting a less favorable impression of republicans. while senator john mccain calls for air strikes in syria, syria s leaders are now showing some signs of appeasing international opposition to the killing of the demonstrators. both u.s. and european leaders are calling for syria s president, bashar al assad, to step down amidst the ongoing bloodshed. facing international pressure, syria s government says it will now allow two envoys and the red cross to enter its borders. but, still, opposition forces say the government offensive continues. meanwhile, senator mccain says u.s.-led air power is the only way to stop the government s slaughter of demonstrators and save lives. they have earned our respect, and now they need our support to finish what they started. the syrian people deserve to succeed. shame on us if we fail to help them. thousands of syrians continue to make their way through brutal winter weather to flee into lebanon. well, rush limbaugh says he s sorry, but advertisers aren t buying it. neither is the georgetown law student that he offended. sandra fluke says his apology changes nothing. last week, during his radio show, limbaugh called fluke several derogatory terms. today, he apologized again, saying he chose the wrong words and did not mean a personal attack. the controversy stems from fluke s support of the obama administration s new rule requiring health insurance coverage for birth control. eight companies have now pulled ads from limbaugh s show, the the latest company is america online. it took a while for the u.s. geological survey to sort out the earthquakes that rocked the east bay this morning. that s because the first two struck so close together. the first quake happened at 5:33 in the morning, with a magnitude of 3.5. eight seconds later, a 4.0 struck in the same place along the hayward fault a mile north of el cerrito. a half hour later, the third quake hit, measuring 2.0. the quakes were felt widely, from a napa to redwood city. a chopper flew over the area, but no major damage or injuries. b.a.r.t. did stop to inspect the tracks, as it usually does. it found no issues, but folks were a little rattled still me and my sister came together, and i said, oh, did you feel that?! i was scared to go out the door, because i m scared of them. it was like, whoo! you know? and it shook, you know, side to side. i felt maybe five seconds of fear. reporter: are you still nervous? i am. well, while people were a little nervous, luckily, there were no reports of any damage or injuries, so all was well so far. a warning tonight from pg&e. someone has been trying to impersonate a pg&e employee in alameda to get inside homes. a customer reported the imposter, saying they asked to check the homeowner s electricity. alameda does not use pg&e for its electric service, only its gas service. customers should always ask to see identification from pg&e employees. police in palo alto are in search of the vandals who slashed dozens of tires. over the weekend, they targeted parked cars along five blocks near el camino real and elmo street. in all, 55 cars had their tires slashed. the owners say they re out hundreds of dollars and they can t understand why someone would do it in the first place. if people knew jesus, they would love their neighbor. this kind of stuff wouldn t be happening, you know? find the lord, and then after that, they ll find peace. and they won t be committing vandalism. investigators believe it happened between 2:00 and 7:00 sunday morning. so far, no arrests have been made and, fortunately, police say they have no idea who s doing it. an oakland man now 44 years old pled not guilty today to killing a classmate when he was a teenager. steven carlson is accused of stabbing to death 14-year-old tina faelz in pleasanton nearly 28 years ago. they were both students at foothill high. the crime remained unsolved for 27 years until pleasanton police announced just last august that dna [ continues ] [ gasping ] finding a place and a means to express yourself in high school can often be difficult. but a fremont high school has found a unique place to do just that. nbc bay area s stephanie trang has more on the student project that s helping others find their voice. reporter: they say a picture is worth a thousand words. but these words are worth more. stories straight from the students at fremont s irvington high school describe rampant depression, grown out of academic pressures, to much worse. there was ones about, like, sexual, like abuse, like within their family, and, like, how they, like, people have attempted suicide over it. reporter: their darkest moments are written all over the walls of the girls bathroom. a junior started the project in the hope that it would the help to free some of her peers from their pain. i wanted this story wall to be a lifesaver to pull people back in and to bring them to a positive space. reporter: this one reads, if you really knew me, you d know that i suffer from depression and have attempted suicide four times. i was abused for ten years. i was bullied for three years. another equally chilling says, if you knew me, you d know that when i look in the mirror, i hate what i see. tammy mcfarron isn t surprised. in fact, she admits that she s also had thoughts about killing herself. contemplation on suicide, seriously. and a lot of girls have thought the same thing too. i don t blame them. it s very common. there would be people telling me, like, you know, can you even see with your eyes like that? you know, they look like sharpy slits. reporter: that s why both girls helped start a new club this year. sister-to-sister provides a space where younger classman can confide in older classmen and confide. just come to us, be yourself, you re enough. very nice. sister to sister at that high school. all right. let s turn things over to jeff ranieri. you ve got your apps, our human app. you know, i have the people come up to me on the street and just ask me, and sometimes it just comes out. you know, i feel like an app sometimes. all right. 68 in santa rosa. 69 in san jose. also some record heat down here into the almaden valley, we re with 78 in gilroy. 71 in fairfield. and also 74 in concord. numbers at this hour are crashing, from those daytime highs, already some 40s on the board, up into novato. 50 in san francisco. 52 in san mateo. and also 48 in oakland. it s a combination right now of some fairly clear skies coming in here with this onshore flow, helping these numbers to drop at this hour. and then we have another storm system we re going to be tracking for tomorrow. that s going to drop those numbers even more. but most significantly, provide us this wind event for tuesday, where winds could top 40 miles per hour, and then in the seven-day forecast, we re going to go back up and then back down again. kind of all over the place when it comes to our temperatures. but here is the latest problem. we have another storm system that we re tracking, but the center of the storm is still well far away from us, like every other storm we ve had this season. so we re not going to see a whole lot of rainfall from this. the primary things will be these numbers dropping anywhere from 10 to 15 degrees throughout tuesday. a slight chance of a shower and also this widespread wind from the north bay, all the way down to the south bay. and then as we transition into wednesday, we ll start to see these winds calming down. as for tonight, we ll see a few showers, likely here across the coastline and also the peninsula, with the best chance of some accumulating rainfall when a lot of you are asleep, around 1:00, 2:00, and also 3:00 in the morning. and then as we head into 5:00 and 6:00, just the slight chance of a shower still lingering here for that early morning commute, but not expecting heavy rain. then as we head throughout the late morning, that rain, well, it s going to be moving on out. and what we re going to find is this wind starting to build in. and that s also going to give us a sunny finish to the afternoon. so let s get a look here at wyo can expect when it comes to this wind. as we head throughout the afternoon, that s when those winds will be peaking, possibly as high as 60 miles per hour at some of our highest hilltops, like near mt. diablo and also at mt. hamilton. and this may even produce some damage into the east bay with some trees down and also a few power outages. and here s the thing, without any rain or clouds by the afternoon, when that wind starts to ramp up, you re not going to have anything that s going to signal these winds gusting. so that s when it could get dangerous, and we have tree limbs coming down and also some power lines, when it s just completely sunny out here. we re going to find a little bit of moisture up across the sierra, but only about 2 to 3 inches of snowfall, with a lot of this storm centered well off towards the east. as for the morning hours, starting off at 44 in santa cruz, 45 in los gatos, 41 in napa, and also 45 in san rafael. after our record-setting heat today, numbers will be going down anywhere from 20 to 25 degrees in some locations. 60s in los gatos. 59 in sunnyvale. back for the east bay, a widespread mix of 50s here. danville, 55. dublin, 55. and also castro valley with 57. and 60 in santa rosa. in your three-day forecast, we keep this cooler weather for the next two days, tuesday and wednesday. and then as we head throughout thursday, you guessed it. as weapon mentioned, numbers up and back down again. we re looking at 70 by thursday s forecast. 73 on friday. a pretty sweet stride, and as we head into saturday and sunday, we don t have any rainfall, but we do have temperatures starting to cool off. our next best chance of rain coming our way is highlighted right there on monday. and it does not even lack like a big storm system, so as for tomorrow, just watch out with those winds gusting in the afternoon again. we ll have some sunny skies, the wind could gust up, and it s full sunshine and we still could have tree limbs coming down. okay. thank you, jeff. sure. let s get to sports. well, will you look who it is! just took the words right out of my mouth. were you on a european vacation or something, because we haven t seen you?
