Former municipal judge candidate pleads not guilty to embezzlement

A former candidate for Roswell municipal judge accused of diverting tens of thousands of dollars from New Mexico Mounted Patrol Troop 13 into his own personal bank accounts has pleaded not guilty to an embezzlement charge.
Timothy Davidson, 52, of Roswell, according to court documents, waived a reading of formal charges and entered a plea of not guilty to one count of embezzlement over $20,000 Monday during his arraignment in New Mexico’s Fifth Judicial District Court in Chaves County.
Davidson, who in 2020 lost a three-way race for municipal judge, is suspected of using the internet to transfer $43,788.52 from Troop 13’s account into three of his personal accounts. Of that total amount, $24,750 was deposited from Davidson’s accounts back into Troop 13’s account. ....

A local judge has ruled that a man arrested in connection with a recent shooting will remain in custody up through his eventual trial.

Judge Jared Kallunki of New Mexico’s Fifth Judicial District Court on Wednesday granted a motion by the District Attorney’s Office to hold Bryan Dillard, 25, of Roswell, without bond on charges related to a Jan. 5 shooting.
Dillard is charged with aggravated battery with a deadly weapon, conspiracy to commit aggravated battery with a deadly weapon, bribery of a witness, retaliation against a witness, and armed robbery.
Court documents state that on Jan. 5 Dillard and Lorena Beltran, 42, of Roswell, picked up a male acquaintance and took him to a 500 block of West Tilden Street residence where Dillard reportedly robbed the victim at gunpoint of $1,000 before Beltran shot him once in the chest. The victim then fled to a nearby convenience store where police ....

Judge rules that plaintiff can amend pleadings
A state district judge granted the city of Roswell’s request to have claims against it dismissed in a lawsuit about one of the city’s Superfund sites.
In his decision Monday, New Mexico 5th Judicial District Court Judge Thomas Lilley also gave the plaintiff, Lynda Anaya, the right to amend her complaint within a month.
A lawsuit filed November 2019 by Lynda Anaya, the widow of Raymond Anaya, against both the city and the New Mexico Environment Department alleges that the governmental entities and some of their employees acted negligently by failing to take adequate steps to inform people of the dangers at the site and by giving business licenses to dry cleaning operations, although those operations were considered primary sources of chemical pollutants. ....

A man who engaged in a lengthy armed standoff with Roswell police in June has pleaded not guilty to multiple criminal charges.

On Monday when he appeared via Google Meet at his arraignment in New Mexico’s 5th Judicial District Court in Chaves County, court documents state Jerry Steven Padilla, 46, of Roswell, waived a formal reading of charges and pleaded not guilty to five counts of aggravated assault on a peace officer, along with one count each of battery of a household member and evading, resisting or obstructing an officer. He also pleaded not guilty to two counts of aggravated assault with a deadly weapon in an unrelated case. ....
