The United States District Court for the District of Maryland is now accepting applications to fill two full-time United States Magistrate Judge positions in the Northern Division and one in the Southern Division. Two of these appointments are to fill anticipated vacancies due to the retirements of Magistrate Judge Thomas M. DiGirolamo and Magistrate Judge Charles B. Day in early 2022, and one is contingent upon the confirmation of a current incumbent, the Honorable Deborah L. Boardman, as a United States District Judge.
The current salary of the position is $201,112.00. The term of office is eight (8) years, and incumbents may be reappointed. ....

Southern California Eatery Sues Postmates for Trademark Infringement and Unfair Competition

Plaintiff Lucky Boy Hamburgers, Inc. (Lucky Boy) sued Postmates Inc. on Wednesday over the third-party courier service’s ostensible refusal to cease its unauthorized use of Lucky Boy’s registered trademark on its online platform. The Central District of California complaint seeks injunctive relief and damages.
According to the filing, family-owned Lucky Boy was founded in 1960 and since then it has used two trademarks in connection with its restaurant services. It explains that Postmates, like its rivals DoorDash, Uber Eats, and GrubHub, enables its customers to order food online that a driver collects from a restaurant and delivers to their door. Postmates purportedly generates its revenue by charging delivery service fees to both the customer and the eating establishment. ....

On Wednesday, Magistrate Judge Thomas S. Hixson sided with Apple Inc. in a discovery dispute wherein Apple requested that third-party Valve Corporation (Valve) produce sales data to permit Apple to analyze competition between the platforms, Valve’s Steam desktop application where users purchase video games and Apple’s iOS App Store.
The order pertains to three related cases, one of which was brought by Epic Games, Inc. (Epic) last year. The
Fortnite game developer alleged that Apple impermissibly restrained trade with its app store policies, and in particular, its 30% levy on the sale of every app and digital in-app purchase. ....
